<section id="d237165e183" identifier="/us/pl/116/103/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2a65a0-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s6401">31 USC 6401 note</ref>.</p></sidenote><heading>PURPOSES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x3a2a8cb1-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The purposes of this Act are to—</chapeau><paragraph class="fontsize10" id="y3a2a8cb2-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>modernize reporting by recipients of Federal grants and cooperative agreements by creating and imposing data standards for the information that those recipients are required by law to report to the Federal Government;</content></paragraph>
<paragraph class="fontsize10" id="y3a2a8cb3-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>implement the recommendation by the Director of the Office of Management and Budget contained in the report submitted under section 5(b)(6) of the Federal Funding Accountability and Transparency Act of 2006 (<ref href="/us/usc/t31/s6101">31 U.S.C. 6101 note</ref>) relating to the development of a “comprehensive taxonomy of standard definitions for core data elements required for managing Federal financial assistance awards”;</content></paragraph>
<paragraph class="fontsize10" id="y3a2a8cb4-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>reduce burden and compliance costs of recipients of Federal grants and cooperative agreements by enabling technology solutions, existing or yet to be developed, for use in both the public and private sectors to better manage the data that recipients already provide to the Federal Government; and</content></paragraph>
<paragraph class="fontsize10" id="y3a2a8cb5-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>strengthen oversight and management of Federal grants and cooperative agreements by agencies by consolidating the collection and display of and access to open data that has been standardized and, where appropriate, increasing transparency to the public.<page identifier="/us/stat/133/3267">133 STAT. 3267</page></content></paragraph>

<section id="d237165e222" identifier="/us/pl/116/103/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2ab3c6-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s6401">31 USC 6401 note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><content style="-uslm-lc:I658120">  In this Act, the terms “agency”, “Director”, “Federal award”, and “Secretary” have the meanings given those terms in <ref href="/us/usc/t31/s6401">section 6401 of title 31, United States Code</ref>, as added by section 4(a) of this Act.</content></section>
<section id="d237165e238" identifier="/us/pl/116/103/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DATA STANDARDS FOR GRANT REPORTING.</heading><subsection class="firstIndent0 fontsize10" id="y3a2b7717-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s4/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendment</inline>.—</heading><content><ref href="/us/usc/t31/stV">Subtitle V of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2b7718-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s6401">31 USC 6401</ref> prec.</p></sidenote> after chapter 63 the following:<quotedContent><chapter id="y3a2c8889-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658174"><num class="fontsize10 bold" value="64">“CHAPTER 64—</num><heading class="fontsize10 bold">DATA STANDARDS FOR GRANT REPORTING</heading><toc>

<section class="centered fontsize12" id="y3a2c888a-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="6401">“§ 6401.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2c888b-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s6401">31 USC 6401</ref>.</p></sidenote> Definitions</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x3a2c888c-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  “In this chapter:</chapeau><paragraph class="fontsize10" id="y3a2c888d-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term ‘<term>agency</term>’ has the meaning given the term in section 552(f) of title 5.</content></paragraph>
<paragraph class="fontsize10" id="y3a2c888e-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Core data elements</inline>.—</heading><chapeau>The term ‘<term>core data elements</term>’ means data elements relating to financial management, administration, or management that—</chapeau><subparagraph class="fontsize10" id="y3a2c888f-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>are not program-specific in nature or program-specific outcome measures, as defined in section 1115(h) of this title; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3a2c8890-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>are required by agencies for all or the vast majority of recipients of Federal awards for purposes of reporting.</content></subparagraph>

<paragraph class="fontsize10" id="y3a2cafa1-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term ‘<term>Director</term>’ means the Director of the Office of Management and Budget.</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafa2-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Executive department</inline>.—</heading><content>The term ‘<term>Executive department</term>’ has the meaning given the term in section 101 of title 5.</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafa3-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Federal award</inline>.—</heading><chapeau>The term ‘<term>Federal award</term>’—</chapeau><subparagraph class="fontsize10" id="y3a2cafa4-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>means the transfer of anything of value for a public purpose of support or stimulation authorized by a law of the United States, including financial assistance and Government facilities, services, and property;</content></subparagraph>
<subparagraph class="fontsize10" id="y3a2cafa5-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>includes a grant, a subgrant, a cooperative agreement, or any other transaction; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3a2cafa6-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>does not include a transaction or agreement—</chapeau><clause class="fontsize10" id="y3a2cafa7-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>that provides for conventional public information services or procurement of property or services for the direct benefit or use of the Government; or</content></clause>
<clause class="fontsize10" id="y3a2cafa8-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>that provides only—</chapeau><subclause class="fontsize10" id="y3a2cafa9-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>direct Government cash assistance to an individual;</content></subclause>
<subclause class="fontsize10" id="y3a2cafaa-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>a subsidy;</content></subclause>
<subclause class="fontsize10" id="y3a2cafab-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>a loan;</content></subclause>
<subclause class="fontsize10" id="y3a2cafac-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>a loan guarantee; or</content></subclause>
<subclause class="fontsize10" id="y3a2cafad-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>insurance.</content></subclause>

<paragraph class="fontsize10" id="y3a2cafae-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term ‘<term>Secretary</term>’ means the head of the standard-setting agency.<page identifier="/us/stat/133/3268">133 STAT. 3268</page></content></paragraph>
<paragraph class="fontsize10" id="y3a2cafaf-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Standard-setting agency</inline>.—</heading><content>The term ‘<term>standard-setting agency</term>’ means the Executive department designated under section 6402(a)(1).</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafb0-e82b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term ‘<term>State</term>’ means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</content></paragraph>

<section class="centered fontsize12" id="y3a2cafb1-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="6402">“§ 6402.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafb2-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s6402">31 USC 6402</ref>.</p></sidenote> Data standards for grant reporting</heading><subsection class="firstIndent0 fontsize10" id="y3a2cafb3-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><paragraph class="fontsize10" id="y3a2cafb4-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Designation of standard-setting agency</inline>.—</heading><content>The Director shall designate the Executive department that administers the greatest number of programs under which Federal awards are issued in a calendar year as the standard-setting agency.</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafb5-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafb6-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment of standards</inline>.—</heading><content>Not later than 2 years after the date of enactment of this chapter, the Secretary and the Director shall establish Governmentwide data standards for information reported by recipients of Federal awards.</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafb7-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Data elements</inline>.—</heading><chapeau>The data standards established under paragraph (2) shall include, at a minimum—</chapeau><subparagraph class="fontsize10" id="y3a2cafb8-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>standard definitions for data elements required for managing Federal awards; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3a2cafb9-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>unique identifiers for Federal awards and recipients of Federal awards that can be consistently applied Governmentwide.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3a2cafba-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Scope</inline>.—</heading><chapeau>The data standards established under subsection (a)—</chapeau><paragraph class="fontsize10" id="y3a2cafbb-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>shall include core data elements;</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafbc-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>may cover information required by law to be reported to any agency by recipients of Federal awards, including audit-related information reported under chapter 75 of this title; and</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafbd-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>may not be used by the Director or any agency to require the collection of any data not otherwise required under Federal law.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3a2cafbe-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>The data standards established under subsection (a) shall, to the extent reasonable and practicable—</chapeau><paragraph class="fontsize10" id="y3a2cafbf-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>render information reported by recipients of Federal awards fully searchable and machine-readable;</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc0-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>be nonproprietary;</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc1-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>incorporate standards developed and maintained by voluntary consensus standards bodies;</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc2-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>be consistent with and implement applicable accounting and reporting principles; and</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc3-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>incorporate the data standards established under the Federal Funding Accountability and Transparency Act of 2006 (<ref href="/us/usc/t31/s6101">31 U.S.C. 6101 note</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3a2cafc4-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><chapeau>In establishing the data standards under subsection (a), the Secretary and the Director shall consult with—</chapeau><paragraph class="fontsize10" id="y3a2cafc5-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the Secretary of the Treasury to ensure that the data standards established under subsection (a) incorporate the data standards established under the Federal Funding Accountability and Transparency Act of 2006 (<ref href="/us/usc/t31/s6101">31 U.S.C. 6101 note</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc6-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the head of each agency that issues Federal awards;</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc7-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>recipients of Federal awards and organizations representing recipients of Federal awards;<page identifier="/us/stat/133/3269">133 STAT. 3269</page></content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc8-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>private sector experts;</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafc9-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>members of the public, including privacy experts, privacy advocates, auditors, and industry stakeholders; and</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafca-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>State and local governments.</content></paragraph>

<section class="centered fontsize12" id="y3a2cafcb-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="6403">“§ 6403.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafcc-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s6403">31 USC 6403</ref>.</p></sidenote> Guidance applying data standards for grant reporting</heading><subsection class="firstIndent0 fontsize10" id="y3a2cafcd-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafce-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 3 years after the date of enactment of this chapter—</chapeau><paragraph class="fontsize10" id="y3a2cafcf-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the Secretary and the Director shall jointly issue guidance to all agencies directing the agencies to apply the data standards established under section 6402(a) to all applicable reporting by recipients of Federal awards; and</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafd0-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the Director shall prescribe guidance applying the data standards established under section 6402(a) to audit-related information reported under chapter 75 of this title.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3a2cafd1-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.—</heading><chapeau>The guidance issued under subsection (a) shall—</chapeau><paragraph class="fontsize10" id="y3a2cafd2-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>to the extent reasonable and practicable—</chapeau><subparagraph class="fontsize10" id="y3a2cafd3-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>minimize the disruption of existing reporting practices of, and not increase the reporting burden on, agencies or recipients of Federal awards; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3a2cafd4-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>explore opportunities to implement modern technologies in reporting relating to Federal awards;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3a2cafd5-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafd6-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>allow the Director to permit exceptions for classes of Federal awards, including exceptions for Federal awards granted to Indian Tribes and Tribal organizations consistent with the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5301/etseq">25 U.S.C. 5301 et seq.</ref>), if the Director publishes a list of those exceptions and submits the list to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives; and</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafd7-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>take into consideration the consultation required under section 6402(d).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3a2cafd8-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Updating Guidance</inline>.—</heading><paragraph class="fontsize10" id="y3a2cafd9-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafda-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not less frequently than once every 10 years, the Director shall update the guidance issued under subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafdb-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Procedures</inline>.—</heading><content>In updating guidance under paragraph (1), the Director shall, to the maximum extent practicable, follow the procedures for the development of the data standards and guidance prescribed under this section and section 6402.</content></paragraph>

<section class="centered fontsize12" id="y3a2cafdc-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="6404">“§ 6404.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafdd-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s6404">31 USC 6404</ref>.</p></sidenote> Agency requirements</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x3a2cafde-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  “Not<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2cafdf-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote> later than 1 year after the date on which guidance is issued or updated under subsection (b) or (c), respectively, of section 6403, the head of each agency shall—</chapeau><paragraph class="fontsize10" id="y3a2cafe0-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>ensure that all of the Federal awards that the agency issues use data standards for all future information collection requests; and</content></paragraph>
<paragraph class="fontsize10" id="y3a2cafe1-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>amend existing information collection requests under chapter 35 of title 44 (commonly known as the ‘Paperwork Reduction Act’) to comply with the data standards established under section 6402 of this chapter, in accordance with the guidance issued by the Secretary and the Director under section 6403 of this chapter.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y3a2d241e-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3a2d241f-e82b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Website.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Publication of Information</inline>.—</heading><content>The Secretary and the Director shall require the publication of data reported by recipients of Federal awards that is collected from all agencies on a single public portal, which may be an existing Governmentwide website, as determined appropriate by the Director.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3a2d2420-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">FOIA</inline>.—</heading><content>Nothing in this section shall require the disclosure to the public of information that would be exempt from disclosure under <ref href="/us/usc/t5/s552">section 552 of title 5, United States Code</ref> (commonly known as the “Freedom of Information Act”).</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y3a2d4b33-e82b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/116/103/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Factors to Be Considered</inline>.—</heading><content>In making the determination under subsection (a), the Director and the Secretary shall consider factors such as accessibility and cost to recipients of Federal awards, agencies that issue Federal awards, private sector experts, and members of the public, including privacy experts, privacy advocates, transparency experts, and transparency advocates.<page identifier="/us/stat/133/3271">133 STAT. 3271</page></content></subsection>

<section id="d237165e981" identifier="/us/pl/116/103/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>NO ADDITIONAL FUNDS AUTHORIZED.</heading><content style="-uslm-lc:I658120">  No additional funds are authorized to carry out the requirements of this Act and the amendments made by this Act. Such requirements shall be carried out using amounts otherwise authorized.</content></section>
