<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x85364796-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Government Employee Fair Treatment Act</p><p class="leftAlign firstIndent0 fontsize8" id="x85364797-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">of 2019.</p></sidenote>
<section id="d124335e90" identifier="/us/pl/116/1/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x85364798-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s1301">31 USC 1301 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Government Employee Fair Treatment Act of 2019</shortTitle>”.</content></section>
<section id="d124335e105" identifier="/us/pl/116/1/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>COMPENSATION FOR FEDERAL AND OTHER GOVERNMENT EMPLOYEES AFFECTED BY A LAPSE IN APPROPRIATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x853695b9-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t31/s1341">Section 1341 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y853695ba-e82b-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/1/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a)(1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>An officer</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Except as specified in this subchapter or any other provision of law, an officer</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y853695bb-e82b-11f0-a1e4-69761a48a15a" identifier="/us/pl/116/1/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y8536bccc-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline" id="y8536bccd-e82b-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8536bcce-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definitions.</p></sidenote><chapeau>In this subsection—</chapeau><subparagraph class="fontsize10" id="y8536bccf-e82b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the term ‘<term>covered lapse in appropriations</term>’ means any lapse in appropriations that begins on or after December 22, 2018;</content></subparagraph>
<subparagraph class="fontsize10" id="y8536bcd0-e82b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the term ‘<term>District of Columbia public employer</term>’ means—</chapeau><clause class="fontsize10" id="y8536bcd1-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the District of Columbia Courts;</content></clause>
<clause class="fontsize10" id="y8536bcd2-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the Public Defender Service for the District of Columbia; or</content></clause>
<clause class="fontsize10" id="y8536bcd3-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the District of Columbia government;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y8536bcd4-e82b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the term ‘<term>employee</term>’ includes an officer; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8536bcd5-e82b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>the term ‘<term>excepted employee</term>’ means an excepted employee or an employee performing emergency work, as such terms are defined by the Office of Personnel Management or the appropriate District of Columbia public employer, as applicable.</content></subparagraph>

<paragraph class="indentUp0 firstIndent0 fontsize10" id="y8536bcd6-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Each employee of the United States Government or of a District of Columbia public employer furloughed as a result of a covered lapse in appropriations shall be paid for the period of the lapse in appropriations, and each excepted employee who is required to perform work during a covered lapse in appropriations shall be paid for such work, at the employee’s standard rate of pay, at the earliest date possible after the lapse in appropriations ends, regardless of scheduled pay dates.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y8536bcd7-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>During a covered lapse in appropriations, each excepted employee who is required to perform work shall be entitled to use leave under chapter 63 of title 5, or any other applicable law governing the use of leave by the excepted employee, for which <page identifier="/us/stat/133/4">133 STAT. 4</page>
compensation shall be paid at the earliest date possible after the lapse in appropriations ends, regardless of scheduled pay dates.”</content></paragraph>
