<section id="d127581e103" identifier="/us/pl/115/90/dA/s101" role="instruction" style="-uslm-lc:I658172"><num class="bold" value="101">SEC. 101. </num><heading>FURTHER CONTINUING APPROPRIATIONS.</heading><content class="firstIndent0 fontsize10" id="xfe1baed9-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Continuing Appropriations Act, 2018 (<ref href="/us/pl/115/56/dD">division D of Public Law 115–56</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> the date specified in section 106(3) and<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfe1baeda-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><i>Ante</i>, p. 1141.</p></sidenote> <amendingAction type="insert">inserting</amendingAction> “<quotedText>December 22, 2017</quotedText>”.</content></section><level><p class="firstIndent0 fontsize10" id="xfe1baedb-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  This division may be cited as the “<shortTitle role="division">Further Continuing Appropriations Act, 2018</shortTitle>”.</p></level>

<division id="d127581e135" identifier="/us/pl/115/90/dB" style="-uslm-lc:I658178"><num value="B">DIVISION B—</num><heading>CHILDREN’S HEALTH INSURANCE PROGRAM (CHIP) ALLOCATION REDISTRIBUTION SPECIAL RULE</heading>
<section id="d127581e140" identifier="/us/pl/115/90/dB/s201" role="instruction" style="-uslm-lc:I658172"><num class="bold" value="201">SEC. 201. </num><heading>CHIP ALLOCATION REDISTRIBUTION SPECIAL RULE FOR CERTAIN SHORTFALL STATES DURING FIRST QUARTER OF FISCAL YEAR 2018.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xfe1bfcfc-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 2104(f)(2) of the Social Security Act (<ref href="/us/usc/t42/s1397dd/f/2">42 U.S.C. 1397dd(f)(2)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yfe1bfcfd-e82b-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/90/dB/s201/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="amend">amending</amendingAction> subparagraph (B) to read as follows:<quotedContent><subparagraph class="fontsize10" id="yfe1c240e-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Determination of redistributed amounts if insufficient amounts available</inline>.—</heading><clause class="fontsize10" id="yfe1c240f-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Proration rule</inline>.—</heading><content>Subject to clause (ii), if the amounts available for redistribution under paragraph (1) for a fiscal year are less than the total amounts of the estimated shortfalls determined for the year under subparagraph (A), the amount to be redistributed under such paragraph for each shortfall State shall be reduced proportionally.</content></clause>
<clause class="fontsize10" id="yfe1c2410-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfe1c2411-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Special rule for first quarter of fiscal year </inline>2018.—</heading><subclause class="fontsize10" id="yfe1c2412-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>For the period beginning on October 1, 2017, and ending December 31, 2017, <page identifier="/us/stat/131/1281">131 STAT. 1281</page>
with respect to any amounts available for redistribution under paragraph (1) for fiscal year 2018, the Secretary shall redistribute under such paragraph such amounts to each emergency shortfall State (as defined in subclause (II)) in such amount as is equal to the amount of the shortfall described in subclause (II) for such State and period (as may be adjusted under subparagraph (C)) before the Secretary may redistribute such amounts to any shortfall State that is not an emergency shortfall State. In the case of any amounts redistributed under this subclause to a State that is not an emergency shortfall State, such amounts shall be determined in accordance with clause (i).</content></subclause>
<subclause class="fontsize10" id="yfe1c2413-e82b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Emergency shortfall state defined</inline>.—</heading><content>For purposes of this clause, the term ‘<term>emergency shortfall State</term>’ means, with respect to the period beginning October 1, 2017, and ending December 31, 2017, a shortfall State for which the Secretary estimates, in accordance with subparagraph (A) (unless otherwise specified in this subclause), that the projected expenditures under the State child health plan and under section 2105(g) (calculated as if the reference under section 2105(g)(4)(A) to ‘2017’ were a reference to ‘2018’ and insofar as the allotments are available to the State under this subsection or subsection (e) or (m)) for such period will exceed the sum of the amounts described in clauses (i) through (iii) of subparagraph (A) for such period, including after application of any amount redistributed under paragraph (1) before such date of enactment to such State. A shortfall State may be an emergency shortfall State under the previous sentence without regard to whether any amounts were redistributed before such date of enactment to such State under paragraph (1) for fiscal year 2018.</content></subclause>
<subclause class="fontsize10" id="yfe1c2414-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><heading class="fontsize10"><inline class="smallCaps">Application of qualifying state option</inline>.—</heading><chapeau>During the period described in subclause (I), section 2105(g)(4) shall apply to a qualifying State (as defined in section 2105(g)(2)) as if under section 2105(g)(4)—</chapeau><item class="fontsize10" id="yfe1c2415-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the reference to ‘2017’ were a reference to ‘2018’; and</content></item>
<item class="fontsize10" id="yfe1c2416-e82b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the reference to ‘under subsections (e) and (m) of such section’ were a reference to ‘under subsections (e), (f), and (m) of such section’.”</content></item>
