<section id="d128343e88" identifier="/us/pl/115/80/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">National Clinical Care Commission Act</shortTitle>”.</content></section>
<section id="d128343e98" identifier="/us/pl/115/80/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5dea3368-e82c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p><p class="leftAlign firstIndent0 fontsize8" id="x5dea3369-e82c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x5dea336a-e82c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading>NATIONAL CLINICAL CARE COMMISSION.</heading><subsection class="firstIndent0 fontsize10" id="y5deb92fb-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is hereby established, within the Department of Health and Human Services, a National Clinical Care Commission (in this section referred to as the “Commission”) to evaluate and make recommendations regarding improvements to the coordination and leveraging of programs within the Department and other Federal agencies related to awareness and clinical care for at least one, but not more than two, complex metabolic or autoimmune diseases resulting from issues related to insulin that represent a significant disease burden in the United States, which may include complications due to such diseases.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5debba0c-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><paragraph class="fontsize10" id="y5debba0d-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Commission shall be composed of the following voting members:</chapeau><subparagraph class="fontsize10" id="y5debba0e-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>The heads of the following Federal agencies and departments, or their designees:</chapeau><clause class="fontsize10" id="y5debba0f-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>The Centers for Medicare &amp; Medicaid Services.</content></clause>
<clause class="fontsize10" id="y5debba10-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>The Agency for Healthcare Research and Quality.</content></clause>
<clause class="fontsize10" id="y5debba11-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>The Centers for Disease Control and Prevention.</content></clause>
<clause class="fontsize10" id="y5debba12-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>The Indian Health Service.</content></clause>
<clause class="fontsize10" id="y5debba13-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>The Department of Veterans Affairs.</content></clause>
<clause class="fontsize10" id="y5debba14-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>The National Institutes of Health.</content></clause>
<clause class="fontsize10" id="y5debba15-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>The Food and Drug Administration.</content></clause>
<clause class="fontsize10" id="y5debba16-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>The Health Resources and Services Administration.</content></clause>
<clause class="fontsize10" id="y5debba17-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/ix" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">(ix) </num><content>The Department of Defense.</content></clause>
<clause class="fontsize10" id="y5debba18-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/x" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="x">(x) </num><content>The Department of Agriculture.</content></clause>
<clause class="fontsize10" id="y5debba19-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/A/xi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xi">(xi) </num><content>The Office of Minority Health.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5debba1a-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Twelve additional voting members appointed under paragraph (2).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5debba1b-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Additional members</inline>.—</heading><chapeau>The Commission shall include additional voting members, as may be appointed by the Secretary, with expertise in the prevention, care, and epidemiology of any of the diseases and complications described in subsection <page identifier="/us/stat/131/1262">131 STAT. 1262</page>
(a), including one or more such members from each of the following categories:</chapeau><subparagraph class="fontsize10" id="y5debba1c-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Physician specialties, including clinical endocrinologists, that play a role in the prevention or treatment of diseases and complications described in subsection (a).</content></subparagraph>
<subparagraph class="fontsize10" id="y5debba1d-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Primary care physicians.</content></subparagraph>
<subparagraph class="fontsize10" id="y5debba1e-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Non-physician health care professionals.</content></subparagraph>
<subparagraph class="fontsize10" id="y5debba1f-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Patient advocates.</content></subparagraph>
<subparagraph class="fontsize10" id="y5debba20-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>National experts, including public health experts, in the duties listed under subsection (c).</content></subparagraph>
<subparagraph class="fontsize10" id="y5debba21-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>Health care providers furnishing services to a patient population that consists of a high percentage (as specified by the Secretary) of individuals who are enrolled in a State plan under title XIX of the Social Security Act or who are not covered under a health plan or health insurance coverage.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5debba22-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Chairperson</inline>.—</heading><content>The members of the Commission shall select a chairperson from the members appointed under paragraph (2).</content></paragraph>
<paragraph class="fontsize10" id="y5debba23-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><content>The Commission shall meet at least twice, and not more than four times, a year.</content></paragraph>
<paragraph class="fontsize10" id="y5debba24-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Vacancies</inline>.—</heading><content>A vacancy on the Commission shall be filled in the same manner as the original appointments.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5debba25-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau>The Commission shall evaluate and make recommendations, as appropriate, to the Secretary of Health and Human Services and Congress regarding—</chapeau><paragraph class="fontsize10" id="y5debba26-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Federal programs of the Department of Health and Human Services that focus on preventing and reducing the incidence of the diseases and complications described in subsection (a);</content></paragraph>
<paragraph class="fontsize10" id="y5debba27-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>current activities and gaps in Federal efforts to support clinicians in providing integrated, high-quality care to individuals with the diseases and complications described in subsection (a);</content></paragraph>
<paragraph class="fontsize10" id="y5debba28-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the improvement in, and improved coordination of, Federal education and awareness activities related to the prevention and treatment of the diseases and complications described in subsection (a), which may include the utilization of new and existing technologies;</content></paragraph>
<paragraph class="fontsize10" id="y5debba29-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>methods for outreach and dissemination of education and awareness materials that—</chapeau><subparagraph class="fontsize10" id="y5debba2a-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>address the diseases and complications described in subsection (a);</content></subparagraph>
<subparagraph class="fontsize10" id="y5debba2b-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>are funded by the Federal Government; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5debba2c-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>are intended for health care professionals and the public; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5debba2d-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>whether there are opportunities for consolidation of inappropriately overlapping or duplicative Federal programs related to the diseases and complications described in subsection (a).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5debba2e-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5debba2f-e82c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Operating Plan</inline>.—</heading><chapeau>Not later than 90 days after its first meeting, the Commission shall submit to the Secretary of Health and Human Services and the Congress an operating plan for carrying out the activities of the Commission as described in subsection (c). Such operating plan may include—</chapeau><page identifier="/us/stat/131/1263">131 STAT. 1263</page>
<paragraph class="fontsize10" id="y5debba30-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a list of specific activities that the Commission plans to conduct for purposes of carrying out the duties described in each of the paragraphs in subsection (c);</content></paragraph>
<paragraph class="fontsize10" id="y5debba31-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a plan for completing the activities;</content></paragraph>
<paragraph class="fontsize10" id="y5debba32-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a list of members of the Commission and other individuals who are not members of the Commission who will need to be involved to conduct such activities;</content></paragraph>
<paragraph class="fontsize10" id="y5debba33-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>an explanation of Federal agency involvement and coordination needed to conduct such activities;</content></paragraph>
<paragraph class="fontsize10" id="y5debba34-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/d/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>a budget for conducting such activities; and</content></paragraph>
<paragraph class="fontsize10" id="y5debba35-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/d/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>other information that the Commission deems appropriate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5debba36-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Final Report</inline>.—</heading><content>By not later than 3 years after the date of the Commission’s first meeting, the Commission shall submit to the Secretary of Health and Human Services and the Congress a final report containing all of the findings and recommendations required by this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5debba37-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/80/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>The Commission shall terminate 60 days after submitting its final report, but not later than the end of fiscal year 2021.</content></subsection>
