<section id="d248104e102" identifier="/us/pl/115/76/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Strengthening State and Local Cyber Crime Fighting Act of 2017</shortTitle>”.</content></section>
<section id="d248104e112" identifier="/us/pl/115/76/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AUTHORIZATION OF THE NATIONAL COMPUTER FORENSICS INSTITUTE OF THE DEPARTMENT OF HOMELAND SECURITY.</heading><subsection class="firstIndent0 fontsize10" id="y7de267b6-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/76/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subtitle C of title VIII of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s381/etseq">6 U.S.C. 381 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="centered fontsize12" id="y7de2b5d7-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="822">“SEC. 822. </num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de2b5d8-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Establishment.</p><p class="leftAlign firstIndent0 fontsize8" id="x7de2b5d9-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s383">6 USC 383</ref>.</p></sidenote>NATIONAL COMPUTER FORENSICS INSTITUTE.</heading><subsection class="firstIndent0 fontsize10" id="y7de2b5da-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>There is authorized for fiscal years 2017 through 2022 within the United States Secret Service a National Computer Forensics Institute (in this section referred to as the ‘Institute’). The Institute shall disseminate information related to the investigation and prevention of cyber and electronic crime and related threats, and educate, train, and equip State, local, tribal, and territorial law enforcement officers, prosecutors, and judges.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7de2b5db-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Functions</inline>.—</heading><chapeau>The functions of the Institute shall include the following:</chapeau><paragraph class="fontsize10" id="y7de2b5dc-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>Educating State, local, tribal, and territorial law enforcement officers, prosecutors, and judges on current—</chapeau><subparagraph class="fontsize10" id="y7de2b5dd-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>cyber and electronic crimes and related threats;</content></subparagraph>
<subparagraph class="fontsize10" id="y7de2b5de-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>methods for investigating cyber and electronic crime and related threats and conducting computer and mobile device forensic examinations; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7de2b5df-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>prosecutorial and judicial challenges related to cyber and electronic crime and related threats, and computer and mobile device forensic examinations.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7de2b5e0-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>Training State, local, tribal, and territorial law enforcement officers to—</chapeau><subparagraph class="fontsize10" id="y7de2b5e1-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>conduct cyber and electronic crime and related threat investigations;</content></subparagraph>
<subparagraph class="fontsize10" id="y7de2b5e2-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>conduct computer and mobile device forensic examinations; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7de2b5e3-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>respond to network intrusion incidents.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7de2b5e4-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Training State, local, tribal, and territorial law enforcement officers, prosecutors, and judges on methods to obtain, process, store, and admit digital evidence in court.<page identifier="/us/stat/131/1247">131 STAT. 1247</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7de2b5e5-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de2b5e6-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Information sharing.</p></sidenote><inline class="smallCaps">Principles</inline>.—</heading><content>In carrying out the functions specified in subsection (b), the Institute shall ensure, to the extent practicable, that timely, actionable, and relevant expertise and information related to cyber and electronic crime and related threats is shared with State, local, tribal, and territorial law enforcement officers and prosecutors.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7de2b5e7-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Equipment</inline>.—</heading><content>The Institute may provide State, local, tribal, and territorial law enforcement officers with computer equipment, hardware, software, manuals, and tools necessary to conduct cyber and electronic crime and related threat investigations and computer and mobile device forensic examinations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7de2b5e8-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Electronic Crime Task Forces</inline>.—</heading><content>The Institute shall facilitate the expansion of the network of Electronic Crime Task Forces of the United States Secret Service through the addition of State, local, tribal, and territorial law enforcement officers educated and trained at the Institute.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7de2b5e9-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Savings Provision</inline>.—</heading><content>All authorized activities and functions carried out by the Institute at any location as of the day before the date of the enactment of this section are authorized to continue to be carried out at any such location on and after such date.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y7de2b5ea-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/76/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><content>For each of fiscal years 2018 through 2022, amounts appropriated for United States Secret Service, Operations and Support, may be used to carry out this Act and the amendments made by this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7de2b5eb-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/76/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Clerical Amendment</inline>.—</heading><content>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s101/etseq">6 U.S.C. 101 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after the item relating to section 821 the following new item:<quotedContent><toc>

<section id="d248104e294" identifier="/us/pl/115/76/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PREVENTION, INVESTIGATION, AND PROSECUTION OF ECONOMIC, HIGH TECHNOLOGY, INTERNET, AND OTHER WHITE COLLAR CRIME.</heading><subsection class="firstIndent0 fontsize10" id="y7de32b1c-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/76/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10101/etseq">34 U.S.C. 10101 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><part id="y7de3a04d-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658173"><num class="fontsize12 bold" value="MM">“PART MM—</num><heading class="fontsize12 bold"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de3a04e-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">National White Collar Crime Control Act of 2017.</p><p class="leftAlign firstIndent0 fontsize8" id="x7de3a04f-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote>PREVENTION, INVESTIGATION, AND PROSECUTION OF WHITE COLLAR CRIME</heading><section class="indentUp2 firstIndent-2" id="y7de3a050-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="3030">“SEC. 3030. </num><heading class="bold">SHORT TITLE.</heading><content class="indentDown2 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “This part may be cited as the ‘<shortTitle role="part">National White Collar Crime Control Act of 2017</shortTitle>’.</content></section>
<section class="indentUp2 firstIndent-2" id="y7de3a051-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="3031">“SEC. 3031. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de3a052-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10721">34 USC 10721 note</ref>.</p></sidenote><heading class="bold">ESTABLISHMENT OF GRANT PROGRAM.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y7de3a053-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de3a054-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Contracts.</p></sidenote><inline class="smallCaps">Authorization</inline>.—</heading><content>The Director of the Bureau of Justice Assistance is authorized to enter into a cooperative agreement with or make a grant to an eligible entity for the purpose of improving the identification, investigation, and prosecution of white collar crime (including each category of such crimes set forth in paragraphs (1) through (3) of subsection (b)) by providing comprehensive, direct, and practical training and technical assistance to law enforcement officers, investigators, auditors and prosecutors in States and units of local government.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7de3a055-e82c-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">White Collar Crime Defined</inline>.—</heading><chapeau>For purposes of this part, the term ‘<term>white collar crime</term>’ includes—<page identifier="/us/stat/131/1248">131 STAT. 1248</page></chapeau><paragraph class="fontsize10" id="y7de3a056-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>high-tech crime, including cyber and electronic crime and related threats;</content></paragraph>
<paragraph class="fontsize10" id="y7de3a057-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>economic crime, including financial fraud and mortgage fraud; and</content></paragraph>
<paragraph class="fontsize10" id="y7de3a058-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Internet-based crime against children and child pornography.</content></paragraph>

<section class="indentUp2 firstIndent-2" id="y7de3a059-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="3032">“SEC. 3032. </num><heading class="bold"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de3a05a-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10722">34 USC 10722 note</ref>.</p></sidenote>PURPOSES.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “The purposes of this part include the following:</chapeau><paragraph class="indentDown1 fontsize10" id="y7de3a05b-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>To ensure that training is available for State, local, tribal and territorial law enforcement agencies and officers nationwide to support local efforts to identify, prevent, investigate, and prosecute cyber and financial crimes, including those crimes facilitated via computer networks and other electronic means, and crimes involving financial and economic impacts such as intellectual property crimes.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3a05c-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>To deliver training to State, local, tribal, and territorial law enforcement officers, and other criminal justice professionals concerning the use of proven methodologies to prevent, detect, and respond to such crimes, recognize emerging issues, manage electronic and financial crime evidence and to improve local criminal justice agency responses to such threats.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3a05d-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>To provide operational and technical assistance and training concerning tools, products, resources, guidelines, and procedures to aid and enhance criminal intelligence analysis, conduct cyber crime and financial crime investigations, and related justice information sharing at the local and State levels.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3a05e-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>To provide appropriate training on protections for privacy, civil rights, and civil liberties in the conduct of criminal intelligence analysis and cyber and electronic crime and financial crime investigations, including in the development of policies, guidelines, and procedures by State, local, tribal, and territorial law enforcement agencies to protect and enhance privacy, civil rights, and civil liberties protections and identify weaknesses and gaps in the protection of privacy, civil rights, and civil liberties.</content></paragraph>

<section class="indentUp2 firstIndent-2" id="y7de3a05f-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="3033">“SEC. 3033. </num><heading class="bold"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de3c770-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10723">34 USC 10723 note</ref>.</p></sidenote>AUTHORIZED PROGRAMS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “A grant or cooperative agreement awarded under this part may be made only for the following programs, with respect to the prevention, investigation, and prosecution of certain criminal activities:</chapeau><paragraph class="indentDown1 fontsize10" id="y7de3c771-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Programs to provide a nationwide support system for State and local criminal justice agencies.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3c772-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Programs to assist State and local criminal justice agencies to develop, establish, and maintain intelligence-focused policing strategies and related information sharing.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3c773-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Programs to provide training and investigative support services to State and local criminal justice agencies to provide such agencies with skills and resources needed to investigate and prosecute such criminal activities and related criminal activities.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3c774-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>Programs to provide research support, to establish partnerships, and to provide other resources to aid State and local criminal justice agencies to prevent, investigate, and prosecute such criminal activities and related problems.<page identifier="/us/stat/131/1249">131 STAT. 1249</page></content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3c775-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>Programs to provide information and research to the general public to facilitate the prevention of such criminal activities.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3c776-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>Programs to establish or support national training and research centers regionally to provide training and research services for State and local criminal justice agencies.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3c777-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>Programs to provide training and oversight to State and local criminal justice agencies to develop and comply with applicable privacy, civil rights, and civil liberties related policies, procedures, rules, laws, and guidelines.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7de3c778-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>Any other programs specified by the Attorney General as furthering the purposes of this part.</content></paragraph>

<section class="indentUp2 firstIndent-2" id="y7de3c779-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="3034">“SEC. 3034. </num><heading class="bold"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de3c77a-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10724">34 USC 10724 note</ref>.</p></sidenote>APPLICATION.</heading><content class="indentDown2 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “To be eligible for an award of a grant or cooperative agreement under this part, an entity shall submit to the Director of the Bureau of Justice Assistance an application in such form and manner, and containing such information, as required by the Director of the Bureau of Justice Assistance.</content></section>
<section class="indentUp2 firstIndent-2" id="y7de3c77b-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="3035">“SEC. 3035. </num><heading class="bold"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7de3c77c-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10725">34 USC 10725 note</ref>.</p></sidenote>ELIGIBILITY.</heading><content class="indentDown2 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “States, units of local government, not-for-profit entities, and institutions of higher-education with demonstrated capacity and experience in delivering training, technical assistance and other resources including direct, practical laboratory training to law enforcement officers, investigators, auditors and prosecutors in States and units of local government and over the Internet shall be eligible to receive an award under this part.</content></section>
