<section id="d248388e236" identifier="/us/pl/115/70/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab19b93f-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21701">34 USC 21701</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xab19e050-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act—</chapeau><paragraph class="fontsize10" id="yab19e051-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the terms “abuse”, “adult protective services”, “elder”, “elder justice”, “exploitation”, “law enforcement”, and “neglect” have the meanings given those terms in section 2011 of the Social Security Act (<ref href="/us/usc/t42/s1397j">42 U.S.C. 1397j</ref>);</content></paragraph>
<paragraph class="fontsize10" id="yab19e052-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the term “<term>elder abuse</term>” includes abuse, neglect, and exploitation of an elder; and<page identifier="/us/stat/131/1209">131 STAT. 1209</page></content></paragraph>
<paragraph class="fontsize10" id="yab19e053-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the term “<term>State</term>” means each of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and any other territory or possession of the United States.</content></paragraph>

<section id="d248388e275" identifier="/us/pl/115/70/tI/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab19e054-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Designations.</p><p class="leftAlign firstIndent0 fontsize8" id="xab19e055-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="xab19e056-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21711">34 USC 21711</ref>.</p></sidenote><heading>SUPPORTING FEDERAL CASES INVOLVING ELDER JUSTICE.</heading><subsection class="firstIndent0 fontsize10" id="yab1af1c7-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Support and Assistance</inline>.—</heading><paragraph class="fontsize10" id="yab1af1c8-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Elder justice coordinators</inline>.—</heading><chapeau>The Attorney General shall designate in each Federal judicial district not less than one Assistant United States Attorney to serve as the Elder Justice Coordinator for the district, who, in addition to any other responsibilities, shall be responsible for—</chapeau><subparagraph class="fontsize10" id="yab1af1c9-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>serving as the legal counsel for the Federal judicial district on matters relating to elder abuse;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1af1ca-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>prosecuting, or assisting in the prosecution of, elder abuse cases;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1af1cb-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>conducting public outreach and awareness activities relating to elder abuse; and</content></subparagraph>
<subparagraph class="fontsize10" id="yab1af1cc-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>ensuring the collection of data required to be collected under section 202.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yab1af1cd-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1af1ce-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Investigative support</inline>.—</heading><chapeau>The Attorney General, in consultation with the Director of the Federal Bureau of Investigation, shall, with respect to crimes relating to elder abuse, ensure the implementation of a regular and comprehensive training program to train agents of the Federal Bureau of Investigation in the investigation and prosecution of such crimes and the enforcement of laws related to elder abuse, which shall include—</chapeau><subparagraph class="fontsize10" id="yab1af1cf-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>specialized strategies for communicating with and assisting elder abuse victims; and</content></subparagraph>
<subparagraph class="fontsize10" id="yab1af1d0-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>relevant forensic training relating to elder abuse.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yab1af1d1-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Resource group</inline>.—</heading><content>The Attorney General, through the Executive Office for United States Attorneys, shall ensure the operation of a resource group to facilitate the sharing of knowledge, experience, sample pleadings and other case documents, training materials, and any other resources to assist prosecutors throughout the United States in pursuing cases relating to elder abuse.</content></paragraph>
<paragraph class="fontsize10" id="yab1af1d2-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Designated elder justice working group or subcommittee to the attorney general’s advisory committee of united states attorneys</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1af1d3-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote>.—</heading><content>Not later than 60 days after the date of enactment of this Act, the Attorney General, in consultation with the Director of the Executive Office for United States Attorneys, shall establish a subcommittee or working group to the Attorney General’s Advisory Committee of United States Attorneys, as established under <ref href="/us/cfr/t28/s0.10">section 0.10 of title 28, Code of Federal Regulations</ref>, or any successor thereto, for the purposes of advising the Attorney General on policies of the Department of Justice relating to elder abuse.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yab1af1d4-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Department of Justice Elder Justice Coordinator</inline>.—</heading><chapeau>Not later than 60 days after the date of enactment of this Act, the Attorney General shall designate an Elder Justice Coordinator <page identifier="/us/stat/131/1210">131 STAT. 1210</page>
within the Department of Justice who, in addition to any other responsibilities, shall be responsible for—</chapeau><paragraph class="fontsize10" id="yab1af1d5-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>coordinating and supporting the law enforcement efforts and policy activities for the Department of Justice on elder justice issues;</content></paragraph>
<paragraph class="fontsize10" id="yab1af1d6-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1af1d7-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p><p class="leftAlign firstIndent0 fontsize8" id="xab1af1d8-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><chapeau>evaluating training models to determine best practices and creating or compiling and making publicly available replication guides and training materials for law enforcement officers, prosecutors, judges, emergency responders, individuals working in victim services, adult protective services, social services, and public safety, medical personnel, mental health personnel, financial services personnel, and any other individuals whose work may bring them in contact with elder abuse regarding how to—</chapeau><subparagraph class="fontsize10" id="yab1af1d9-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1af1da-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Investigations.</p></sidenote><content>conduct investigations in elder abuse cases;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1af1db-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>address evidentiary issues and other legal issues; and</content></subparagraph>
<subparagraph class="fontsize10" id="yab1af1dc-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1af1dd-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>appropriately assess, respond to, and interact with victims and witnesses in elder abuse cases, including in administrative, civil, and criminal judicial proceedings; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yab1af1de-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>carrying out such other duties as the Attorney General determines necessary in connection with enhancing the understanding, prevention, and detection of, and response to, elder abuse.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yab1af1df-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Federal Trade Commission</inline>.—</heading><paragraph class="fontsize10" id="yab1af1e0-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Federal trade commission elder justice coordinator</inline>.—</heading><chapeau>Not later than 60 days after the date of enactment of this Act, the Chairman of the Federal Trade Commission shall designate within the Bureau of Consumer Protection of the Federal Trade Commission an Elder Justice Coordinator who, in addition to any other responsibilities, shall be responsible for—</chapeau><subparagraph class="fontsize10" id="yab1af1e1-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>coordinating and supporting the enforcement and consumer education efforts and policy activities of the Federal Trade Commission on elder justice issues; and</content></subparagraph>
<subparagraph class="fontsize10" id="yab1af1e2-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tI/s101/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>serving as, or ensuring the availability of, a central point of contact for individuals, units of local government, States, and other Federal agencies on matters relating to the enforcement and consumer education efforts and policy activities of the Federal Trade Commission on elder justice issues.</content></subparagraph>

<section id="d248388e699" identifier="/us/pl/115/70/tIII/s301" style="-uslm-lc:I658143"><num class="fontsize12" value="301">SEC. 301. </num><heading>SENSE OF THE SENATE.</heading><subsection class="firstIndent0 fontsize10" id="yab1c298c-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>The Senate finds the following:</chapeau><paragraph class="fontsize10" id="yab1c298d-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The vast majority of cases of abuse, neglect, and exploitation of older adults in the United States go unidentified and unreported.</content></paragraph>
<paragraph class="fontsize10" id="yab1c298e-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Not less than $2,900,000,000 is taken from older adults each year due to financial abuse and exploitation.</content></paragraph>
<paragraph class="fontsize10" id="yab1c298f-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Elder abuse, neglect, and exploitation have no boundaries and cross all racial, social, class, gender, and geographic lines.</content></paragraph>

<paragraph class="fontsize10" id="yab1c2991-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Up to half of all older adults with dementia will experience abuse.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yab1c2992-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Sense of the Senate</inline>.—</heading><chapeau>It is the sense of the Senate that—</chapeau><paragraph class="fontsize10" id="yab1c2993-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>elder abuse involves the exploitation of potentially vulnerable individuals with devastating physical, mental, emotional, and financial consequences to the victims and their loved ones;</content></paragraph>
<paragraph class="fontsize10" id="yab1c2994-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to combat this affront to America’s older adults, we must do everything possible to both support victims of elder abuse and prevent the abuse from occurring in the first place; and</content></paragraph>
<paragraph class="fontsize10" id="yab1c2995-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIII/s301/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the Senate supports a multipronged approach to prevent elder abuse and exploitation, protect the victims of elder abuse and exploitation from further harm, and bring the perpetrators of such crimes to justice.</content></paragraph>

<section id="d248388e839" identifier="/us/pl/115/70/tIV/s402" style="-uslm-lc:I658143"><num class="fontsize12" value="402">SEC. 402. </num><heading>ENHANCED PENALTY FOR TELEMARKETING AND EMAIL MARKETING FRAUD DIRECTED AT ELDERS.</heading><subsection class="firstIndent0 fontsize10" id="yab1cecf0-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIV/s402/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1cecf1-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18">18 USC </ref></p><p class="leftAlign firstIndent0 fontsize8" id="xab1cecf2-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">prec. 2325.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Chapter 113A of <ref href="/us/usc/t18">title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yab1cecf3-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIV/s402/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the chapter heading, by <amendingAction type="insert">inserting</amendingAction> “<quotedText><b>AND EMAIL MARKETING</b></quotedText>” after “<quotedText><b>TELEMARKETING</b></quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yab1cecf4-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tIV/s402/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> section 2325 and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="centered fontsize12" id="yab1d3b15-e82c-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658164"><num class="fontsize12" value="2325">“§ 2325.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1d3b16-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s2325">18 USC 2325</ref>.</p></sidenote> Definition</heading><chapeau class="indentDown1 firstIndent0 fontsize10" id="xab1d3b17-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  “In this chapter, the term ‘<term>telemarketing or email marketing</term>’—</chapeau><paragraph class="indentUp0 fontsize10" id="yab1d3b18-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>means a plan, program, promotion, or campaign that is conducted to induce—</chapeau><subparagraph class="fontsize10" id="yab1d3b19-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>purchases of goods or services;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b1a-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>participation in a contest or sweepstakes;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b1b-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a charitable contribution, donation, or gift of money or any other thing of value;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b1c-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>investment for financial profit;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b1d-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>participation in a business opportunity;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b1e-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>commitment to a loan; or</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b1f-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>participation in a fraudulent medical study, research study, or pilot study,</content></subparagraph>
<continuation class="firstIndent1 fontsize10" id="xab1d3b20-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122">by use of one or more interstate telephone calls, emails, text messages, or electronic instant messages initiated either by a person who is conducting the plan, program, promotion, or campaign or by a prospective purchaser or contest or sweepstakes participant or charitable contributor, donor, or investor; and</continuation></paragraph>
<paragraph class="indentUp0 fontsize10" id="yab1d3b21-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>does not include the solicitation through the posting, publication, or mailing of a catalog or brochure that—</chapeau><subparagraph class="fontsize10" id="yab1d3b22-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>contains a written description or illustration of the goods, services, or other opportunities being offered;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b23-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>includes the business address of the solicitor;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b24-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>includes multiple pages of written material or illustration; and</content></subparagraph>
<subparagraph class="fontsize10" id="yab1d3b25-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>has been issued not less frequently than once a year,</content></subparagraph>

in response to the written materials, whether in hard copy or digital format, and in response to those interstate telephone calls, emails, text messages, or electronic instant messages does not conduct further solicitation.”</continuation></paragraph>

<paragraph class="fontsize10" id="yab1d6241-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>any equipment, software, or other technology used or intended to be used to commit or to facilitate the commission of such offense.</content></paragraph>

<section id="d248388e1257" identifier="/us/pl/115/70/tV/s501" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="501">SEC. 501. </num><heading>COURT-APPOINTED GUARDIANSHIP OVERSIGHT ACTIVITIES UNDER THE ELDER JUSTICE ACT OF 2009.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xab1e25ac-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 2042(c) of the Social Security Act (<ref href="/us/usc/t42/s1397m–1/c">42 U.S.C. 1397m–1(c)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yab1e25ad-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s501/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(and, in the case of demonstration programs described in paragraph (2)(E), to the highest courts of States)</quotedText>” after “<quotedText>States</quotedText>”;</content></paragraph>

</paragraph>
<paragraph class="fontsize10" id="yab1e4cc4-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s501/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (3), (4), and (5) as paragraphs (4), (5), and (6), respectively;<page identifier="/us/stat/131/1216">131 STAT. 1216</page></content></paragraph>
<paragraph class="fontsize10" id="yab1e4cc5-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s501/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (2), the following new paragraph:<quotedContent><paragraph class="indentUp0 fontsize10" id="yab1e4cc6-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Requirements for court-appointed guardianship oversight demonstration programs</inline>.—</heading><subparagraph class="fontsize10" id="yab1e4cc7-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Award of grants</inline>.—</heading><content>In awarding grants to the highest courts of States for demonstration programs described in paragraph (2)(E), the Secretary shall consider the recommendations of the Attorney General and the State Justice Institute, as established by section 203 of the State Justice Institute Act of 1984 (<ref href="/us/usc/t42/s10702">42 U.S.C. 10702</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="yab1e4cc8-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Collaboration</inline>.—</heading><content>The highest court of a State awarded a grant to conduct a demonstration program described in paragraph (2)(E) shall collaborate with the State Unit on Aging for the State and the Adult Protective Services agency for the State in conducting the demonstration program.”</content></subparagraph>

<section id="d248388e1398" identifier="/us/pl/115/70/tV/s502" style="-uslm-lc:I658143"><num class="fontsize12" value="502">SEC. 502. </num><heading>GAO REPORTS.</heading><subsection class="firstIndent0 fontsize10" id="yab1e9aeb-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1e9aec-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Review.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Elder Justice Recommendations</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall review existing Federal programs and initiatives in the Federal criminal justice system relevant to elder justice and shall submit to Congress—</chapeau><paragraph class="fontsize10" id="yab1ec1fd-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a report on such programs and initiatives; and</content></paragraph>
<paragraph class="fontsize10" id="yab1ec1fe-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any recommendations the Comptroller General determines are appropriate to improve elder justice in the United States.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yab1ec1ff-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report on Elder Abuse and International Criminal Enterprises</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on—</chapeau><paragraph class="fontsize10" id="yab1ec200-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>Federal Government efforts to monitor—</chapeau><subparagraph class="fontsize10" id="yab1ec201-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the exploitation of older adults of the United States in global drug trafficking schemes and other international criminal enterprises;</content></subparagraph>
<subparagraph class="fontsize10" id="yab1ec202-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the extent to which exploitation of older adults of the United States by international criminal enterprises has resulted in the incarceration of these citizens of the United States in foreign countries; and</content></subparagraph>
<subparagraph class="fontsize10" id="yab1ec203-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the total annual number of elder abuse cases pending in the United States; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yab1ec204-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/70/tV/s502/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the results of intervention by the United States with foreign officials on behalf of citizens of the United States who are elder abuse victims in international criminal enterprises.</content></paragraph>

<section id="d248388e1459" identifier="/us/pl/115/70/tV/s503" style="-uslm-lc:I658143"><num class="fontsize12" value="503">SEC. 503. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xab1ec205-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><heading>OUTREACH TO STATE AND LOCAL LAW ENFORCEMENT AGENCIES.</heading><content style="-uslm-lc:I658120">  The Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report on efforts by the Department <page identifier="/us/stat/131/1217">131 STAT. 1217</page>
of Justice to conduct outreach to State and local law enforcement agencies on the process for collaborating with the Federal Government for the purpose of investigating and prosecuting interstate and international elder financial exploitation cases.</content></section>
