<section id="d248745e94" identifier="/us/pl/115/65/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as “<shortTitle role="act">The American Legion 100th Anniversary Commemorative Coin Act</shortTitle>”.</content></section>
<section id="d248745e104" identifier="/us/pl/115/65/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe4f742be-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The Congress finds that—</chapeau><paragraph class="fontsize10" id="ye4f742bf-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>on March 15, 1919, The American Legion was founded in Paris, France, by members of the American Expeditionary Force occupying Europe after World War I and concerned about the welfare of their comrades and communities upon their return to the United States;</content></paragraph>
<paragraph class="fontsize10" id="ye4f742c0-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>on September 16, 1919, Congress chartered The American Legion, which quickly grew to become the largest veterans service organization in the United States;</content></paragraph>
<paragraph class="fontsize10" id="ye4f742c1-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The American Legion conferences in Washington, DC, in 1923 and 1924 crafted the first United States Flag Code, which was adopted in schools, States, cities and counties prior to being enacted in 1942, establishing the proper use, display, and respect for the colors of the United States;</content></paragraph>
<paragraph class="fontsize10" id="ye4f742c2-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>during World War II, The American Legion developed and presented to Congress its case for vastly improved support for medically discharged, disabled veterans, which ultimately became the Servicemen’s Readjustment Act of 1944 (<ref href="/us/stat/58/284">58 Stat. 284</ref>; chapter 268), better known as the G.I. Bill of Rights, and was drafted by former American Legion National Commander Harry W. Colmery in Washington’s Mayflower Hotel;</content></paragraph>
<paragraph class="fontsize10" id="ye4f742c3-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>through the leadership and advocacy of The American Legion, the G.I. Bill was enacted in June 1944, which led to monumental changes in United States society, including the democratization of higher education, home ownership for average people in the United States, better VA hospitals, business and farm loans for veterans, and the ability to appeal conditions of military discharge;</content></paragraph>
<paragraph class="fontsize10" id="ye4f742c4-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>defying those who argued the G.I. Bill would break the Treasury, according to various researchers, the G.I. Bill provided a tremendous return on investment of $7 to the United States economy for every $1 spent on the program, triggering a half-century of prosperity in the United States;<page identifier="/us/stat/131/1192">131 STAT. 1192</page></content></paragraph>
<paragraph class="fontsize10" id="ye4f742c5-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>after Hurricane Hugo in 1989, The American Legion established the National Emergency Fund to provide immediate cash relief for veterans who have been affected by natural disasters;</content></paragraph>
<paragraph class="fontsize10" id="ye4f742c6-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>American Legion National Emergency Fund grants after Hurricanes Katrina and Rita in 2005, for instance, exceeded $1,700,000;</content></paragraph>
<paragraph class="fontsize10" id="ye4f742c7-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>The American Legion fought to see the Veterans Administration elevated to Cabinet-level status as the Department of Veterans Affairs, ensuring support for veterans would be set at the highest level of the Federal Government, as a priority issue for the President;</content></paragraph>
<paragraph class="fontsize10" id="ye4f769d8-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>after a decades-long struggle to improve the adjudication process for veterans disputing claims decisions, The American Legion helped shape and introduce the Veterans Reassurance Act to create a venue for judicial review of veterans’ appeals;</content></paragraph>
<paragraph class="fontsize10" id="ye4f769d9-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>building on these efforts, legislation was passed in 1988 to create the United States Court of Veterans Appeals, today known as the United States Court of Appeals for Veterans Claims;</content></paragraph>
<paragraph class="fontsize10" id="ye4f769da-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>The American Legion created the American Legacy Scholarship Fund for children of military members killed on active duty on or after September 11, 2001;</content></paragraph>
<paragraph class="fontsize10" id="ye4f769db-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/13" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><content>in 2016, The American Legion’s National Executive Committee amended the original scholarship criteria to include children of veterans with 50 percent or greater VA disability ratings;</content></paragraph>
<paragraph class="fontsize10" id="ye4f769dc-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/14" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><content>President George W. Bush signed into law the Post-9/11 Veterans Educational Assistance Act (title V of the Supplemental Appropriations Act, 2008; <ref href="/us/stat/122/2357">122 Stat. 2357</ref>), a next-generation G.I. Bill strongly supported by The American Legion and the most comprehensive educational benefits package since the original G.I. Bill of Rights was enacted in 1944;</content></paragraph>
<paragraph class="fontsize10" id="ye4f769dd-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/15" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">(15) </num><content>in August 2018, The American Legion will begin its centennial recognition at the 100th National Convention in Minneapolis, Minnesota, the site of the first American Legion National Convention; and</content></paragraph>
<paragraph class="fontsize10" id="ye4f769de-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s2/16" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">(16) </num><content>in March 2019, the organization will celebrate its 100th birthday in Paris, France, and September 16, 2019, will mark the 100th anniversary of The American Legion’s Federal charter.</content></paragraph>

<section id="d248745e204" identifier="/us/pl/115/65/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>COIN SPECIFICATIONS.</heading><subsection class="firstIndent0 fontsize10" id="ye4f7df0f-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Denominations</inline>.—</heading><chapeau>In recognition and celebration of the 100th anniversary of The American Legion, the Secretary of the Treasury (hereafter in this Act referred to as the “Secretary”) shall mint and issue the following coins:</chapeau><paragraph class="fontsize10" id="ye4f7df10-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10 smallCaps">$5 gold coins<inline class="noSmallCaps">.—</inline></heading><chapeau>Not more than 50,000 $5 coins, which shall—</chapeau><subparagraph class="fontsize10" id="ye4f7df11-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>weigh 8.359 grams;</content></subparagraph>
<subparagraph class="fontsize10" id="ye4f7df12-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>have a diameter of 0.850 inches; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye4f7df13-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>contain not less than 90 percent gold.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye4f7df14-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10 smallCaps">$1 silver coins<inline class="noSmallCaps">.—</inline></heading><chapeau>Not more than 400,000 $1 coins, which shall—</chapeau><subparagraph class="fontsize10" id="ye4f7df15-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>weigh 26.73 grams;</content></subparagraph>
<subparagraph class="fontsize10" id="ye4f7df16-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>have a diameter of 1.500 inches; and<page identifier="/us/stat/131/1193">131 STAT. 1193</page></content></subparagraph>
<subparagraph class="fontsize10" id="ye4f7df17-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>contain not less than 90 percent silver.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye4f7df18-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Half-dollar clad coins</inline>.—</heading><chapeau>Not more than 750,000 half-dollar coins which shall—</chapeau><subparagraph class="fontsize10" id="ye4f7df19-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>weigh 11.34 grams;</content></subparagraph>
<subparagraph class="fontsize10" id="ye4f7df1a-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>have a diameter of 1.205 inches; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye4f7df1b-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>be minted to the specifications for half-dollar coins contained in <ref href="/us/usc/t31/s5112/b">section 5112(b) of title 31, United States Code</ref>.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f7df1c-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Legal Tender</inline>.—</heading><content>The coins minted under this Act shall be legal tender, as provided in <ref href="/us/usc/t31/s5103">section 5103 of title 31, United States Code</ref>.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f7df1d-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Numismatic Items</inline>.—</heading><content>For purposes of sections 5134 and 5136 of <ref href="/us/usc/t31">title 31, United States Code</ref>, all coins minted under this Act shall be considered to be numismatic items.</content></subsection>

<section id="d248745e324" identifier="/us/pl/115/65/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DESIGN OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="ye4f82d3e-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The design for the coins minted under this Act shall be emblematic of The American Legion.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f82d3f-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Designations and Inscriptions</inline>.—</heading><chapeau>On each coin minted under this Act there shall be—</chapeau><paragraph class="fontsize10" id="ye4f82d40-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a designation of the denomination of the coin;</content></paragraph>
<paragraph class="fontsize10" id="ye4f82d41-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>an inscription of the year “2019”; and</content></paragraph>
<paragraph class="fontsize10" id="ye4f82d42-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>inscriptions of the words “Liberty”, “In God We Trust”, “United States of America”, and “E Pluribus Unum”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f82d43-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Selection</inline>.—</heading><chapeau>The design for the coins minted under this Act shall be—</chapeau><paragraph class="fontsize10" id="ye4f82d44-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>selected by the Secretary after consultation with—<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe4f82d45-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote></chapeau><subparagraph class="fontsize10" id="ye4f82d46-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Commission of Fine Arts; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye4f82d47-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Adjutant of The American Legion, as defined in the constitution and bylaws of The American Legion; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye4f82d48-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>reviewed<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe4f82d49-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Review.</p></sidenote> by the Citizens Commemorative Coin Advisory Committee.</content></paragraph>
</subsection>
</section>
<section id="d248745e400" identifier="/us/pl/115/65/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>ISSUANCE OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="ye4f8545a-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Quality of Coins</inline>.—</heading><content>Coins minted under this Act shall be issued in uncirculated and proof qualities.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f8545b-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Period for Issuance</inline>.—</heading><content>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2019.</content></subsection>
</section>
<section id="d248745e423" identifier="/us/pl/115/65/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>SALE OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="ye4f87b6c-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sale Price</inline>.—</heading><chapeau>The coins issued under this Act shall be sold by the Secretary at a price based upon the sum of—</chapeau><paragraph class="fontsize10" id="ye4f87b6d-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the face value of the coins;</content></paragraph>
<paragraph class="fontsize10" id="ye4f87b6e-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the surcharge provided in section 7(a) with respect to such coins; and</content></paragraph>
<paragraph class="fontsize10" id="ye4f87b6f-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f87b70-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Bulk Sales</inline>.—</heading><content>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f87b71-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Prepaid Orders</inline>.—</heading><paragraph class="fontsize10" id="ye4f87b72-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</content></paragraph>
<paragraph class="fontsize10" id="ye4f8a283-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s6/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Discount</inline>.—</heading><content>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.<page identifier="/us/stat/131/1194">131 STAT. 1194</page></content></paragraph>

<section id="d248745e490" identifier="/us/pl/115/65/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>SURCHARGES.</heading><subsection class="firstIndent0 fontsize10" id="ye4f8f0a4-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>All sales of coins minted under this Act shall include a surcharge as follows:</chapeau><paragraph class="fontsize10" id="ye4f8f0a5-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>A surcharge of $35 per coin for the $5 coin.</content></paragraph>
<paragraph class="fontsize10" id="ye4f8f0a6-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>A surcharge of $10 per coin for the $1 coin described under section 3(a)(2).</content></paragraph>
<paragraph class="fontsize10" id="ye4f8f0a7-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>A surcharge of $5 per coin for the half-dollar coin.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f8f0a8-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Distribution</inline>.—</heading><chapeau>Subject to <ref href="/us/usc/t31/s5134/f">section 5134(f) of title 31, United States Code</ref>, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to The American Legion for costs related to—</chapeau><paragraph class="fontsize10" id="ye4f8f0a9-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>promoting the importance of and caring for those who have served in uniform, ensuring they receive proper health care and disability benefits earned through military service;</content></paragraph>
<paragraph class="fontsize10" id="ye4f8f0aa-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>promoting the importance of, and caring for, those who are still serving in the Armed Forces;</content></paragraph>
<paragraph class="fontsize10" id="ye4f8f0ab-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>promoting the importance of maintaining the patriotic values, morals, culture, and citizenship of the United States; and</content></paragraph>
<paragraph class="fontsize10" id="ye4f8f0ac-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>promoting the importance of maintaining strong families, assistance for at-risk children, and activities that promote their healthy and wholesome development.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f8f0ad-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual commemorative coin program issuance limitation under <ref href="/us/usc/t31/s5112/m/1">section 5112(m)(1) of title 31, United States Code</ref> (as in effect on the date of the enactment of this Act). The Secretary of the Treasury may issue guidance to carry out this subsection.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye4f8f0ae-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s7/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Audit</inline>.—</heading><content>The recipient described under subsection (b) shall be subject to the audit requirements of <ref href="/us/usc/t31/s5134/f/2">section 5134(f)(2) of title 31, United States Code</ref>, with regard to the amounts received under subsection (b).</content></subsection>

<section id="d248745e578" identifier="/us/pl/115/65/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>FINANCIAL ASSURANCES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe4f917bf-e82c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The Secretary shall take such actions as may be necessary to ensure that—</chapeau><paragraph class="fontsize10" id="ye4f917c0-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s8/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</content></paragraph>
<paragraph class="fontsize10" id="ye4f917c1-e82c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/65/s8/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>no funds, including applicable surcharges, are disbursed to the recipient designated in section 7 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United <page identifier="/us/stat/131/1195">131 STAT. 1195</page>
States Treasury, consistent with sections 5112(m) and 5134(f) of <ref href="/us/usc/t31">title 31, United States Code</ref>.</content></paragraph>
