<section id="d130265e92" identifier="/us/pl/115/64/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Hurricanes Harvey, Irma, and Maria Education Relief Act of 2017</shortTitle>”.</content></section>
<section id="d130265e102" identifier="/us/pl/115/64/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ALLOCATION AND USE OF CAMPUS-BASED HIGHER EDUCATION ASSISTANCE.</heading><subsection class="firstIndent0 fontsize10" id="yf3bcb176-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yf3bcb177-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Affected area</inline>.—</heading><content>The term “<term>affected area</term>” means an area for which the President declared a major disaster or an emergency under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5170">42 U.S.C. 5170</ref> and 5191) as a result of Hurricane Harvey, Hurricane Irma, Hurricane Maria, Tropical Storm Harvey, Tropical Storm Irma, or Tropical Storm Maria.</content></paragraph>
<paragraph class="fontsize10" id="yf3bcb178-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Affected student</inline>.—</heading><chapeau>The term “<term>affected student</term>” means an individual who has applied for or received student financial assistance under title IV of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070/etseq">20 U.S.C. 1070 et seq.</ref>), and who—</chapeau><subparagraph class="fontsize10" id="yf3bcb179-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>was enrolled or accepted for enrollment on August 25, 2017, at an institution of higher education that is located in an affected area;</content></subparagraph>
<subparagraph class="fontsize10" id="yf3bcb17a-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is a dependent student who was enrolled or accepted for enrollment on August 25, 2017, at an institution of higher education that is not located in an affected area, but whose parent or parents resided or was employed on August 25, 2017, in an affected area; or</content></subparagraph>
<subparagraph class="fontsize10" id="yf3bcb17b-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>suffered direct economic hardship as a direct result of Hurricane Harvey, Hurricane Irma, Hurricane Maria, Tropical Storm Harvey, Tropical Storm Irma, or Tropical Storm Maria, as determined by the Secretary.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf3bcb17c-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Institution of higher education</inline>.—</heading><content>The term “<term>institution of higher education</term>” has the meaning given the term in section 102 of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1002">20 U.S.C. 1002</ref>).<page identifier="/us/stat/131/1188">131 STAT. 1188</page></content></paragraph>
<paragraph class="fontsize10" id="yf3bcb17d-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Education.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf3bcb17e-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3bcb17f-e82c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Waivers</inline>.—</heading><paragraph class="fontsize10" id="yf3bcb180-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Waiver of non-federal share requirement</inline>.—</heading><chapeau>Notwithstanding sections 413C(a)(2) and 443(b)(5) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070b–2/a/2">20 U.S.C. 1070b–2(a)(2)</ref> and 1087–53(b)(5)), with respect to funds made available for award years 2016–2017 and 2017–2018—</chapeau><subparagraph class="fontsize10" id="yf3bcb181-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the case of an institution of higher education that is located in an affected area, the Secretary shall waive the requirement that a participating institution of higher education provide a non-Federal share to match Federal funds provided to the institution for the programs authorized pursuant to subpart 3 of part A and part C of title IV of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070b/etseq">20 U.S.C. 1070b et seq.</ref> and 1087–51 et seq.); and</content></subparagraph>
<subparagraph class="fontsize10" id="yf3bcb182-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in the case of an institution of higher education that is not located in an affected area but has enrolled or accepted for enrollment any affected students, the Secretary may waive the non-Federal share requirement described in subparagraph (A) after considering the institution’s student population and existing resources.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf3bcb183-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Waiver of reallocation rules</inline>.—</heading><subparagraph class="fontsize10" id="yf3bcb184-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Authority to reallocate</inline>.—</heading><chapeau>Notwithstanding sections 413D(d) and 442(d) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070b–3/d">20 U.S.C. 1070b–3(d)</ref> and 1087–52(d)), the Secretary shall—</chapeau><clause class="fontsize10" id="yf3bcb185-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>reallocate any funds returned under such section 413D or 442 of the Higher Education Act of 1965 that were allocated to institutions of higher education for award year 2016–2017 to an institution of higher education that is eligible under subparagraph (B); and</content></clause>
<clause class="fontsize10" id="yf3bcb186-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>waive the allocation reduction for award year 2018–2019 for an institution of higher education that is eligible under subparagraph (B) returning more than 10 percent of its allocation under such section 413D or 442 of the Higher Education Act of 1965 for award year 2017–2018.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf3bcd897-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Institutions eligible for reallocation</inline>.—</heading><chapeau>An institution of higher education is eligible under this subparagraph if the institution—</chapeau><clause class="fontsize10" id="yf3bcd898-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>participates in the program for which excess allocations are being reallocated; and</content></clause>
<clause class="fontsize10" id="yf3bcd899-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii)</num><subclause class="inline" id="yf3bcd89a-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/B/ii/I"><num value="I">(I) </num><content>is located in an affected area; or</content></subclause>
<subclause class="indentUp0 fontsize10" id="yf3bcd89b-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/B/ii/II" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>has enrolled or accepted for enrollment any affected students in award year 2017–2018.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf3bcd89c-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Basis of reallocation</inline>.—</heading><chapeau>The Secretary shall—</chapeau><clause class="fontsize10" id="yf3bcd89d-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf3bcd89e-e82c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determine the manner in which excess allocations will be reallocated pursuant to this paragraph; and</content></clause>
<clause class="fontsize10" id="yf3bcd89f-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>give preference in making reallocations to the needs of institutions of higher education located in an affected area.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf3bcd8a0-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Additional waiver authority</inline>.—</heading><content>Notwithstanding any other provision of law, in order to carry out this paragraph, the Secretary may waive or modify any statutory or regulatory provision relating to the reallocation of excess <page identifier="/us/stat/131/1189">131 STAT. 1189</page>
allocations under subpart 3 of part A or part C of title IV of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070b/etseq">20 U.S.C. 1070b et seq.</ref> and 1087–51 et seq.) in order to ensure that assistance is received by institutions of higher education that are eligible under subparagraph (B).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf3bcd8a1-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Availability of funds date extension</inline>.—</heading><chapeau>Notwithstanding any other provision of law—</chapeau><subparagraph class="fontsize10" id="yf3bcd8a2-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any funds available to the Secretary under sections 413A and 441 of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070b">20 U.S.C. 1070b</ref> and 1087–51) for which the period of availability would otherwise expire on September 30, 2017, shall be available for obligation by the Secretary until September 30, 2018, for the purposes of the programs authorized pursuant to subpart 3 of part A and part C of title IV of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070b/etseq">20 U.S.C. 1070b et seq.</ref> and 1087–51 et seq.); and</content></subparagraph>
<subparagraph class="fontsize10" id="yf3bcd8a3-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Secretary may recall any funds allocated to an institution of higher education for award year 2016–2017 under section 413D or 442 of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1070b–3">20 U.S.C. 1070b–3</ref> and 1087–52), that, if not returned to the Secretary as excess allocations pursuant to either of those sections, would otherwise lapse on September 30, 2017, and reallocate those funds in accordance with paragraph (2)(A).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf3bcd8a4-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Emergency Requirement</inline>.—</heading><content>This section is designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<ref href="/us/pl/111/139/tI">title I of Public Law 111–139</ref>; <ref href="/us/usc/t2/s933/g">2 U.S.C. 933(g)</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf3bcd8a5-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than October 1, 2018, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and the Workforce of the House of Representatives information on—</chapeau><paragraph class="fontsize10" id="yf3bcd8a6-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the total volume of assistance received by each eligible institution of higher education under subsection (b)(2); and</content></paragraph>
<paragraph class="fontsize10" id="yf3bcd8a7-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the total volume of the non-Federal share waived for each institution of higher education under subsection (b)(1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf3bcd8a8-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>The provisions of subsection (b) shall cease to be effective on September 30, 2018.</content></subsection>
</section>
<section id="d130265e390" identifier="/us/pl/115/64/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PROJECT SERV AND EQUITABLE SERVICES FOR CHILDREN AND TEACHERS IN PRIVATE SCHOOLS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xf3bd26c9-e82c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 8501(b)(1) of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s7881/b/1">20 U.S.C. 7881(b)(1)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yf3bd26ca-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (D), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yf3bd26cb-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (E), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yf3bd26cc-e82c-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/64/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<page identifier="/us/stat/131/1190">131 STAT. 1190</page>
