<section id="d249269e94" identifier="/us/pl/115/59/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Social Security Number Fraud Prevention Act of 2017</shortTitle>”.</content></section>
<section id="d249269e104" identifier="/us/pl/115/59/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>RESTRICTION OF SOCIAL SECURITY NUMBERS ON DOCUMENTS SENT BY MAIL.</heading><subsection class="firstIndent0 fontsize10" id="y274808f3-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x274808f4-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Restriction</inline>.—</heading><content>An agency may not include the social security account number of an individual on any document sent by mail unless the head of the agency determines that the inclusion of the social security account number on the document is necessary.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y274808f5-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x274808f6-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><chapeau>Not later than 5 years after the date of the enactment of this Act, the head of each CFO Act agency shall issue regulations specifying the circumstances under which inclusion of a social security account number on a document sent by mail is necessary. Such regulations shall include—</chapeau><paragraph class="fontsize10" id="y274808f7-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>instructions for the partial redaction of social security account numbers where feasible; and</content></paragraph>
<paragraph class="fontsize10" id="y274808f8-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a requirement that social security account numbers not be visible on the outside of any package sent by mail.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y274808f9-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 30 days after the date of the enactment of this Act, and not later than the first, second, third, fourth, and fifth-year anniversary of such date of enactment, the head of each CFO Act agency shall submit to the Committee on Ways and Means and the Committee on Oversight and Government Reform of the House of Representatives, the Committee on Finance and the Committee on Homeland Security and Governmental Affairs of the Senate, and any other appropriate authorizing committees of the House of Representatives and the Senate, a report on the implementation of subsection (a) that includes the following:</chapeau><paragraph class="fontsize10" id="y274808fa-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The title and identification number of any document used by the CFO Act agency during the previous year that includes the complete social security account number of an individual.</content></paragraph>
<paragraph class="fontsize10" id="y274808fb-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x274808fc-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Plan.</p></sidenote><content>For the first report submitted, a plan that describes how the CFO Act agency will comply with the requirements of subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y274808fd-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>For the final report submitted, the title and identification number of each document used by the CFO Act agency <page identifier="/us/stat/131/1153">131 STAT. 1153</page>
for which the head of the agency has determined, in accordance with regulations issued pursuant to subsection (b), that the inclusion of a social security account number on such document is necessary, and the rationale for such determination.</content></paragraph>
<paragraph class="fontsize10" id="y274808fe-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x274808ff-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Update.</p></sidenote><content>For any other report that is not the first or final report submitted, an update on the implementation of the plan described under paragraph (2).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y27480900-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y27480901-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/d/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term “<term>agency</term>” has the meaning given that term in <ref href="/us/usc/t5/s551">section 551 of title 5, United States Code</ref>, but includes an establishment in the legislative or judicial branch of the Government (except the Senate, the House of Representatives, and the Architect of the Capitol, and any activities under the direction of the Architect of the Capitol).</content></paragraph>
<paragraph class="fontsize10" id="y27480902-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/d/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">CFO act agency</inline>.—</heading><content>The term “<term>CFO Act agency</term>” means the agencies listed in paragraphs (1) and (2) of <ref href="/us/usc/t31/s901/b">section 901(b) of title 31, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y27480903-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/59/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>Subsection (a) shall apply with respect to any document sent by mail on or after the date that is 5 years after the date of the enactment of this Act.</content></subsection>
