<section id="d133315e95" identifier="/us/pl/115/50/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Rapid DNA Act of 2017</shortTitle>”.</content></section>
<section id="d133315e105" identifier="/us/pl/115/50/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>RAPID DNA INSTRUMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y6e22768b-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/50/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Standards</inline>.—</heading><content>Section 210303(a) of the DNA Identification Act of 1994 (<ref href="/us/usc/t42/s14131/a">42 U.S.C. 14131(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="y6e22768c-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5)</num><subparagraph class="inline" id="y6e22768d-e82d-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6e22768e-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><content>In addition to issuing standards as provided in paragraphs (1) through (4), the Director of the Federal Bureau of Investigation shall issue standards and procedures for the use of Rapid DNA instruments and resulting DNA analyses.</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y6e22768f-e82d-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6e227690-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><content>In this Act, the term ‘<term>Rapid DNA instruments</term>’ means instrumentation that carries out a fully automated process to derive a DNA analysis from a DNA sample.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y6e227691-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/50/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Index</inline>.—</heading><content>Paragraph (2) of section 210304(b) of the DNA Identification Act of 1994 (<ref href="/us/usc/t42/s14132/b/2">42 U.S.C. 14132(b)(2)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><paragraph class="fontsize10" id="y6e229da2-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>prepared by—</chapeau><subparagraph class="fontsize10" id="y6e229da3-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>laboratories that—</chapeau><clause class="fontsize10" id="y6e229da4-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>have been accredited by a nonprofit professional association of persons actively involved in forensic science that is nationally recognized within the forensic science community; and</content></clause>
<clause class="fontsize10" id="y6e229da5-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6e229da6-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>undergo external audits, not less than once every 2 years, that demonstrate compliance with standards established by the Director of the Federal Bureau of Investigation; or</content></clause>

<subparagraph class="fontsize10" id="y6e229da7-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>criminal justice agencies using Rapid DNA instruments approved by the Director of the Federal Bureau of Investigation in compliance with the standards and procedures issued by the Director under section 210303(a)(5); and”</content></subparagraph>

<section id="d133315e197" identifier="/us/pl/115/50/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6e229da8-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Waiver authority.</p><p class="leftAlign firstIndent0 fontsize8" id="x6e229da9-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><heading>CONFORMING AMENDMENTS RELATING TO COLLECTION OF DNA IDENTIFICATION INFORMATION.</heading><subsection class="firstIndent0 fontsize10" id="y6e22ebca-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/50/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">From Certain Federal Offenders</inline>.—</heading><chapeau>Section 3 of the DNA Analysis Backlog Elimination Act of 2000 (<ref href="/us/usc/t42/s14135a">42 U.S.C. 14135a</ref>) <amendingAction type="amend">is amended</amendingAction>—<page identifier="/us/stat/131/1002">131 STAT. 1002</page></chapeau><paragraph class="fontsize10" id="y6e22ebcb-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/50/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (b), by <amendingAction type="add">adding</amendingAction> at the end the following: “<quotedText>The Director of the Federal Bureau of Investigation may waive the requirements under this subsection if DNA samples are analyzed by means of Rapid DNA instruments and the results are included in CODIS.</quotedText>”; and</content></paragraph>
