<section id="d250400e408" identifier="/us/pl/115/48/tI/s102" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>EDUCATIONAL ASSISTANCE UNDER POST-9/11 EDUCATIONAL ASSISTANCE PROGRAM FOR MEMBERS OF THE ARMED FORCES AWARDED THE PURPLE HEART.</heading><subsection class="firstIndent0 fontsize10" id="y8592ad6d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s102/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline>.—</heading><content>Section 3311(b) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="fontsize10" id="y8592d47e-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><content>An individual who is awarded the Purple Heart for service in the Armed Forces occurring on or after September 11, 2001, and continues to serve on active duty in the Armed Forces or is discharged or released from active duty as described in subsection (c).”</content></paragraph>

<section id="d250400e1283" identifier="/us/pl/115/48/tI/s109" style="-uslm-lc:I658143"><num class="fontsize12" value="109">SEC. 109. </num><heading>RESTORATION OF ENTITLEMENT TO EDUCATIONAL ASSISTANCE AND OTHER RELIEF FOR VETERANS AFFECTED BY SCHOOL CLOSURE OR DISAPPROVAL.</heading><subsection class="firstIndent0 fontsize10" id="y8596302d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s109/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">School Closure or Disapproval</inline>.—</heading><paragraph class="fontsize10" id="y8596302e-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s109/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Restoration of entitlement</inline>.—</heading><content>Chapter 36 <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="centered fontsize12" id="y8596a55f-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="3699">“§ 3699.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8596a560-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3699">38 USC 3699</ref>.</p></sidenote> Effects of closure or disapproval of educational institution</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y8596a561-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Closure or Disapproval</inline>.—</heading><chapeau>Any payment of educational assistance described in subsection (b) shall not—</chapeau><paragraph class="fontsize10" id="y8596a562-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>be charged against any entitlement to educational assistance of the individual concerned; or</content></paragraph>
<paragraph class="fontsize10" id="y8596a563-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>be counted against the aggregate period for which section 3695 of this title limits the receipt of educational assistance by such individual.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y8596a564-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8596a565-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Educational Assistance Described</inline>.—</heading><chapeau>Subject to subsection (c), the payment of educational assistance described in this paragraph is the payment of such assistance to an individual for pursuit of a course or program of education at an educational <page identifier="/us/stat/131/979">131 STAT. 979</page>
institution under chapter 30, 32, 33, or 35 of this title, or chapter 1606 or 1607 of title 10, if the Secretary determines that the individual—</chapeau><paragraph class="fontsize10" id="y8596a566-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>was unable to complete such course or program as a result of—</chapeau><subparagraph class="fontsize10" id="y8596a567-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the closure of the educational institution; or</content></subparagraph>
<subparagraph class="fontsize10" id="y8596a568-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the disapproval of the course or a course that is a necessary part of that program under this chapter by reason of—</chapeau><clause class="fontsize10" id="y8596a569-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a provision of law enacted after the date on which the individual enrolls at such institution affecting the approval or disapproval of courses under this chapter; or</content></clause>
<clause class="fontsize10" id="y8596a56a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>after the date on which the individual enrolls at such institution, the Secretary prescribing or modifying regulations or policies of the Department affecting such approval or disapproval; and</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8596a56b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>did not receive credit or lost training time, toward completion of the program of education being so pursued.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y8596a56c-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Period Not Charged</inline>.—</heading><chapeau>The period for which, by reason of this subsection, educational assistance is not charged against entitlement or counted toward the applicable aggregate period under section 3695 of this title shall not exceed the aggregate of—</chapeau><paragraph class="fontsize10" id="y8596a56d-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the portion of the period of enrollment in the course from which the individual did not receive credit or with respect to which the individual lost training time, as determined under subsection (b)(2); and</content></paragraph>
<paragraph class="fontsize10" id="y8596a56e-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the period by which a monthly stipend is extended under section 3680(a)(2)(B) of this title.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y8596a56f-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8596a570-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Continuing Pursuit of Disapproved Courses</inline>.—</heading><paragraph class="inline" id="y8596a571-e82d-11f0-bc57-ad3ac4b1618c"><num value="1">(1) </num><chapeau>The Secretary may treat a course of education that is disapproved under this chapter as being approved under this chapter with respect to an individual described in paragraph (2) if the Secretary determines, on a case-by-case basis, that—</chapeau><subparagraph class="fontsize10" id="y8596a572-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>such disapproval is the result of an action described in clause (i) or (ii) of subsection (b)(1)(B); and</content></subparagraph>
<subparagraph class="fontsize10" id="y8596a573-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>continuing pursuing such course is in the best interest of the individual.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y8596a574-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>An individual described in this paragraph is an individual who is pursuing a course of education at an educational institution under chapter 30, 32, 33, or 35 of this title, or chapter 1606 or 1607 of title 10, as of the date on which the course is disapproved under this chapter.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y8596a575-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8596a576-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Notice of Closures</inline>.—</heading><chapeau>Not later than 5 business days after the date on which the Secretary receives notice that an educational institution will close or is closed, the Secretary shall provide to each individual who is enrolled in a course or program or education at such educational institution using entitlement to educational assistance under chapter 30, 32, 33, or 35 of this title, or chapter 1606 or 1607 of title 10, notice of—</chapeau><paragraph class="fontsize10" id="y8596a577-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>such closure and the date of such closure; and</content></paragraph>
<paragraph class="fontsize10" id="y8596a578-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the effect of such closure on the individual’s entitlement to educational assistance pursuant to this section.”</content></paragraph>

<subparagraph class="fontsize10" id="y8596cc95-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8596cc96-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Extension dates.</p></sidenote><chapeau>solely for the purpose of awarding a monthly housing stipend described in section 3313 of this title, during periods following a permanent closure of an educational institution, or following the disapproval of a course of study described in section 3699(b)(1)(B) of this title, except that payment of such a stipend may only be continued until the earlier of—</chapeau><clause class="fontsize10" id="y8596cc97-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the date of the end of the term, quarter, or semester during which the closure or disapproval occurred; and</content></clause>
<clause class="fontsize10" id="y8596cc98-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the date that is 120 days after the date of the closure or disapproval.”</content></clause>

<subparagraph class="fontsize10" id="y8596cc9f-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s109/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8596cca0-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Special application</inline>.—</heading><content>With respect to courses and programs of education discontinued as described in <ref href="/us/usc/t38/s3699">section 3699 of title 38, United States Code</ref>, as added by subsection (a)(1), during the period beginning January 1, 2015, and ending on the date of the enactment of this Act, an individual who does not transfer credits from such program <page identifier="/us/stat/131/981">131 STAT. 981</page>
of education shall be deemed to be an individual who did not receive such credits, as described in subsection (b)(2) of such section, except that the period for which the individual’s entitlement is not charged shall be the entire period of the individual’s enrollment in the program of education.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8596cca1-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x8596cca2-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote> In carrying out this paragraph, the Secretary of Veterans Affairs, in consultation with the Secretary of Education, shall establish procedures to determine whether the individual transferred credits to a comparable course or program of education.</content></subparagraph>

<section id="d250400e1702" identifier="/us/pl/115/48/tI/s110" style="-uslm-lc:I658143"><num class="fontsize12" value="110">SEC. 110. </num><heading>ADDITIONAL AUTHORIZED TRANSFER OF UNUSED POST-9/11 EDUCATIONAL ASSISTANCE BENEFITS TO DEPENDENTS UPON DEATH OF ORIGINALLY DESIGNATED DEPENDENT.</heading><subsection class="firstIndent0 fontsize10" id="y85971ac6-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s110/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Transfer Upon Death of Dependent</inline>.—</heading><chapeau>Section 3319 <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y85971ac7-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s110/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (f)(1), by <amendingAction type="insert">inserting</amendingAction> after “<quotedText>section 3321</quotedText>” the following: “<quotedText>, and except as provided in subsection (k) or (l),</quotedText>”; and</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y85971acb-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s110/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Effective Dates</inline>.—</heading><paragraph class="fontsize10" id="y85971acc-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s110/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Eligible deaths</inline>.—</heading><content>The amendments made by this section shall apply with respect to deaths occurring on or after August 1, 2009.</content></paragraph>

<section id="d250400e1789" identifier="/us/pl/115/48/tI/s111" style="-uslm-lc:I658143"><num class="fontsize12" value="111">SEC. 111. </num><heading>EDITH NOURSE ROGERS STEM SCHOLARSHIP.</heading><subsection class="firstIndent0 fontsize10" id="y8598052e-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s111/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a"> (a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subchapter II of chapter 33 <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<page identifier="/us/stat/131/982">131 STAT. 982</page>
<quotedContent><section class="centered fontsize12" id="y8598c87f-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="3320">“§ 3320.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8598c880-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3320">38 USC 3320</ref>.</p></sidenote> Edith Nourse Rogers STEM Scholarship</heading><subsection class="firstIndent0 fontsize10" id="y8598c881-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subject to the limitation under subsection (f), the Secretary shall provide additional benefits to eligible individuals selected by the Secretary under this section. Such benefits shall be known as the ‘Edith Nourse Rogers STEM Scholarship’.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8598c882-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline>.—</heading><chapeau>For purposes of this section, an eligible individual is an individual—</chapeau><paragraph class="fontsize10" id="y8598c883-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>who is or was entitled to educational assistance under section 3311 of this title;</content></paragraph>
<paragraph class="fontsize10" id="y8598c884-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8598c885-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>who has used all of the educational assistance to which the individual is entitled under this chapter or will, based on the individual’s rate of usage, use all of such assistance within 180 days of applying for benefits under this section;</content></paragraph>
<paragraph class="fontsize10" id="y8598c886-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>who applies for assistance under this section; and</content></paragraph>
<paragraph class="fontsize10" id="y8598c887-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>who—</chapeau><subparagraph class="fontsize10" id="y8598c888-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>is an individual who—</chapeau><clause class="fontsize10" id="y8598c889-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>is enrolled in a program of education leading to a post-secondary degree that, in accordance with the guidelines of the applicable regional or national accrediting agency, requires more than the standard 128 semester (or 192 quarter) credit hours for completion in a standard, undergraduate college degree in—</chapeau><subclause class="fontsize10" id="y8598c88a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>biological or biomedical science;</content></subclause>
<subclause class="fontsize10" id="y8598c88b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>physical science;</content></subclause>
<subclause class="fontsize10" id="y8598c88c-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>science technologies or technicians;</content></subclause>
<subclause class="fontsize10" id="y8598c88d-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>computer and information science and support services;</content></subclause>
<subclause class="fontsize10" id="y8598c88e-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>mathematics or statistics;</content></subclause>
<subclause class="fontsize10" id="y8598c88f-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">“(VI) </num><content>engineering;</content></subclause>
<subclause class="fontsize10" id="y8598c890-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VII">“(VII) </num><content>engineering technologies or an engineering-related field;</content></subclause>
<subclause class="fontsize10" id="y8598c891-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VIII">“(VIII) </num><content>a health profession or related program;</content></subclause>
<subclause class="fontsize10" id="y8598c892-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IX">“(IX) </num><content>a medical residency program;</content></subclause>
<subclause class="fontsize10" id="y8598c893-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="X">“(X) </num><content>an agriculture science program or a natural resources science program; or</content></subclause>
<subclause class="fontsize10" id="y8598c894-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="XI">“(XI) </num><content>other subjects and fields identified by the Secretary as meeting national needs;</content></subclause>
</clause>
<clause class="fontsize10" id="y8598c895-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>has completed at least 60 standard semester (or 90 quarter) credit hours in a field referred to in clause (i); or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y8598c896-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is an individual who has earned a post-secondary degree in a field referred to in subparagraph (A)(i) and is enrolled in a program of education leading to a teaching certification.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8598c897-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Priority</inline>.—</heading><chapeau>In selecting eligible individuals to receive additional benefits under this section, the Secretary shall give priority to the following individuals:</chapeau><paragraph class="fontsize10" id="y8598c898-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Individuals who require the most credit hours described in subsection (b)(4).</content></paragraph>
<paragraph class="fontsize10" id="y8598c899-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Individuals who are entitled to educational assistance under this chapter by reason of paragraph (1), (2), (8), or (9) of section 3311(b) of this title.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8598c89a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8598c89b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Payments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Amount of Assistance</inline>.—</heading><paragraph class="inline" id="y8598c89c-e82d-11f0-bc57-ad3ac4b1618c"><num value="1">(1) </num><content>The Secretary shall pay to each eligible individual who receives additional benefits under this section the monthly amount payable under section 3313 of this title for not more than 9 months of the program of education in which the individual is enrolled (adjusted with respect to the <page identifier="/us/stat/131/983">131 STAT. 983</page>
individual pursuant to section 3313(c), as appropriate), except that the aggregate amount paid to an individual under this section may not exceed $30,000.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y8598c89d-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>The Secretary may not pay to such an individual an amount in addition to the amount payable under paragraph (1) by reason of section 3317 of this title.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y8598c89e-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>An individual who receives additional benefits under this section may also receive amounts payable by a college or university pursuant to section 3317 of this title.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8598c89f-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on Transfer</inline>.—</heading><content>An individual who receives additional benefits under this section may not transfer any amount of such additional benefits under section 3319 of this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8598c8a0-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Maximum Amount of Total Assistance</inline>.—</heading><chapeau>The total amount of benefits paid to all eligible individuals under this section may not exceed—</chapeau><paragraph class="fontsize10" id="y8598c8a1-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>$25,000,000 for fiscal year 2019;</content></paragraph>
<paragraph class="fontsize10" id="y8598c8a2-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>$75,000,000 for each of fiscal years 2020 through 2022; and</content></paragraph>
<paragraph class="fontsize10" id="y8598c8a3-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>$100,000,000 for fiscal year 2023 and each subsequent fiscal year.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8598c8a4-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8598c8a5-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Congressional Notice</inline>.—</heading><content>If the Secretary identifies a new subject or field pursuant to subsection (b)(4)(A)(i)(XI) as meeting a national need, the Secretary shall submit to Congress notice of such identification at least 90 days before conferring eligibility on any individual for purposes of this section on the basis of such identification, including any analysis of labor market supply and demand used in identifying the new subject or field, as applicable.”</content></subsection>

<subparagraph class="fontsize10" id="y8598c8b2-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s111/d/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The job placement rate for individuals who completed a program of education using educational assistance provided under the scholarship program in the field of study of the program of education.</content></subparagraph>
<subparagraph class="fontsize10" id="y8598c8b3-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s111/d/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>The median annual earnings of individuals who completed a program of education using educational assistance provided under the scholarship program.</content></subparagraph>
<subparagraph class="fontsize10" id="y8598c8b4-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s111/d/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>The average age of the individuals who received educational assistance under the scholarship program.</content></subparagraph>

<paragraph class="fontsize10" id="y8598c8b7-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s111/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8598c8b8-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p><p class="leftAlign firstIndent0 fontsize8" id="x8598c8b9-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Final report</inline>.—</heading><chapeau>Not later than August 1, 2024, the Comptroller General shall submit to Congress an assessment of such scholarship program that includes each of the following:</chapeau><subparagraph class="fontsize10" id="y8598c8ba-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s111/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Each item described in subparagraph (A) through (G) of paragraph (1).</content></subparagraph>

<section id="d250400e2190" identifier="/us/pl/115/48/tI/s112" style="-uslm-lc:I658143"><num class="fontsize12" value="112">SEC. 112. </num><heading>HONORING THE NATIONAL SERVICE OF MEMBERS OF THE ARMED FORCES BY ELIMINATION OF TIME LIMITATION FOR USE OF ENTITLEMENT.</heading><subsection class="firstIndent0 fontsize10" id="y85993ced-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s112/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Subsection (a) of section 3321 <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y85993cee-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s112/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>individual’s entitlement</quotedText>” and all that follows through the period and <amendingAction type="insert">inserting</amendingAction> “<quotedText>individual’s entitlement—</quotedText>”; and</content></paragraph>

<section id="d250400e2342" identifier="/us/pl/115/48/tI/s113" style="-uslm-lc:I658143"><num class="fontsize12" value="113">SEC. 113. </num><heading>MONTHLY STIPEND FOR CERTAIN MEMBERS OF THE RESERVE COMPONENTS OF THE ARMED FORCES RECEIVING POST-9/11 EDUCATIONAL ASSISTANCE.</heading><subsection class="firstIndent0 fontsize10" id="y85998b1f-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s113/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 3313 is further amended by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y85998b20-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="j">“(j) </num><heading class="fontsize10"><inline class="smallCaps">Determination of Monthly Stipends During Certain Active Duty Service</inline>.—</heading><paragraph class="fontsize10" id="y85998b21-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Pro rata basis</inline>.—</heading><content>In any month in which an individual described in paragraph (2) is performing active duty service described in section 3301(1)(B) of this title, the Secretary shall determine the amount of monthly stipends payable under this section for such month on a pro rata basis for the period of such month in which the covered individual is not performing such active duty service.</content></paragraph>
<paragraph class="fontsize10" id="y85998b22-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Individual described</inline>.—</heading><chapeau>An individual described in this paragraph is an individual who is—</chapeau><subparagraph class="fontsize10" id="y85998b23-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a member of the reserve components of the Armed Forces; and</content></subparagraph>

<section id="d250400e2461" identifier="/us/pl/115/48/tI/s115" style="-uslm-lc:I658143"><num class="fontsize12" value="115">SEC. 115. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8599d94c-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3301">38 USC 3301 note</ref>.</p></sidenote><heading>IMPROVEMENT OF INFORMATION TECHNOLOGY OF THE VETERANS BENEFITS ADMINISTRATION OF THE DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="y859a005d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s115/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Processing of Certain Educational Assistance Claims</inline>.—</heading><chapeau>The Secretary of Veterans Affairs shall, to the maximum extent possible, make such changes and improvements to the information technology system of the Veterans Benefits Administration of the Department of Veterans Affairs to ensure that—</chapeau><paragraph class="fontsize10" id="y859a005e-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s115/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to the maximum extent possible, all original and supplemental claims for educational assistance under <ref href="/us/usc/t38/ch33">chapter 33 of title 38, United States Code</ref>, are adjudicated electronically; and</content></paragraph>
<paragraph class="fontsize10" id="y859a005f-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s115/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>rules-based processing is used to make decisions with respect to such claims with little human intervention.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y859a0060-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s115/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859a0061-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation Plan</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to Congress a plan to implement the changes and improvements described in subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y859a0062-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s115/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to Congress a report on the implementation of the changes and improvements described in subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y859a0063-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s115/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>There is authorized to be appropriated to the Secretary of Veterans Affairs $30,000,000 to carry out this section during fiscal years 2018 and 2019.</content></subsection>

<section id="d250400e2524" identifier="/us/pl/115/48/tI/s116" style="-uslm-lc:I658143"><num class="fontsize12" value="116">SEC. 116. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859a0064-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3001">38 USC 3001 note</ref>.</p></sidenote><heading>DEPARTMENT OF VETERANS AFFAIRS HIGH TECHNOLOGY PILOT PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y859b8705-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Pilot Program</inline>.—</heading><content>The Secretary of Veterans Affairs shall carry out a pilot program under which the Secretary shall provide eligible veterans with the opportunity to enroll in high technology programs of education that the Secretary determines provide training or skills sought by employers in a relevant field or industry.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y859b8706-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline>.—</heading><content>For purposes of the pilot program under this section, an eligible veteran is a veteran who is entitled to educational assistance under chapter 30, 32, 33, 34, or 35 of <ref href="/us/usc/t38">title 38, United States Code</ref>, or chapter 1606 or 1607 of <ref href="/us/usc/t10">title 10, United States Code</ref>.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y859b8707-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Contracts</inline>.—</heading><paragraph class="fontsize10" id="y859b8708-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859b8709-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>For purposes of carrying out subsection (a), by not later than 180 days after August 1, 2018, the Secretary shall seek to enter into contracts with any number of qualified providers of high technology programs of education for the provision of such programs to eligible veterans under the pilot program.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859b870a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote> Each such contract shall provide for the conditions under which the Secretary may terminate the contract with the provider and the procedures for providing for the completion of the instruction of students who were enrolled in a program provided by such provider in the case of such a termination.</content></paragraph>
<paragraph class="fontsize10" id="y859b870b-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Payment of contractors</inline>.—</heading><chapeau>A contract under this subsection shall provide that the Secretary shall pay to a provider—</chapeau><subparagraph class="fontsize10" id="y859b870c-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>upon the enrollment of an eligible veteran in the program, 25 percent of the cost of the tuition and other fees for the program of education for the veteran;<page identifier="/us/stat/131/987">131 STAT. 987</page></content></subparagraph>
<subparagraph class="fontsize10" id="y859b870d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>upon the completion of the program by the veteran, 25 percent of such cost; and</content></subparagraph>
<subparagraph class="fontsize10" id="y859b870e-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>upon the employment of the veteran in the field of study of the program following completion of the program, 50 percent of such cost.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y859b870f-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Qualified providers</inline>.—</heading><chapeau>For purposes of the pilot program, a provider of a high technology program of education is qualified if—</chapeau><subparagraph class="fontsize10" id="y859b8710-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the provider has been operational for at least 2 years;</content></subparagraph>
<subparagraph class="fontsize10" id="y859b8711-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the provider has successfully provided the high technology program for at least 1 year; and</content></subparagraph>
<subparagraph class="fontsize10" id="y859b8712-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the provider meets the approval criteria developed by the Secretary under paragraph (4).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y859b8713-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Approval criteria</inline>.—</heading><content>The Secretary shall develop criteria for approving providers for purposes of the pilot program. In developing such criteria, the Secretary may consult with State approving agencies. Such criteria is not required to meet the requirements of <ref href="/us/usc/t38/s3672">section 3672 of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y859b8714-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Tuition reimbursement</inline>.—</heading><chapeau>In entering into contracts to carry out the pilot program, the Secretary shall give preference to a qualified provider that offers tuition reimbursement for any student who—</chapeau><subparagraph class="fontsize10" id="y859b8715-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>completes a program of education offered by the provider; and</content></subparagraph>
<subparagraph class="fontsize10" id="y859b8716-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/c/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859b8717-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x859b8718-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><content>does not find full-time meaningful employment in the field of study of the program within the 180-day period beginning on the date the student completes the program.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y859b8719-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859b871a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Payments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Housing Stipend</inline>.—</heading><chapeau>The Secretary shall pay to each eligible veteran who is enrolled in a high technology program of education under the pilot program on a full-time basis a monthly housing stipend equal to the product—</chapeau><paragraph class="fontsize10" id="y859b871b-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>of—</chapeau><subparagraph class="fontsize10" id="y859b871c-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the case of a veteran pursuing resident training, the monthly amount of the basic allowance for housing payable under <ref href="/us/usc/t37/s403">section 403 of title 37, United States Code</ref>, for a member with dependents in pay grade E–5 residing in the military housing area that encompasses all or the majority portion of the ZIP code area in which is located the institution at which the individual is enrolled; or</content></subparagraph>
<subparagraph class="fontsize10" id="y859b871d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in the case of a veteran pursuing a program of education through distance learning, a monthly amount equal to 50 percent of the amount payable under subparagraph (A), multiplied by</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y859b871e-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>the lesser of—</chapeau><subparagraph class="fontsize10" id="y859b871f-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>1.0; or</content></subparagraph>
<subparagraph class="fontsize10" id="y859b8720-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the number of course hours borne by the individual in pursuit of the program of education involved, divided by the minimum number of course hours required for full-time pursuit of such program of education, rounded to the nearest multiple of 10.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y859b8721-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/e" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">High Technology Program of Education Defined</inline>.—</heading><chapeau>In this section, the term “<term>high technology program of education</term>” means a program of education that—</chapeau><paragraph class="fontsize10" id="y859b8722-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>is offered by an entity other than an institution of higher learning;<page identifier="/us/stat/131/988">131 STAT. 988</page></content></paragraph>
<paragraph class="fontsize10" id="y859b8723-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>does not lead to a degree; and</content></paragraph>
<paragraph class="fontsize10" id="y859b8724-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>provides instruction in computer programming, computer software, media application, data processing, or information sciences.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y859b8725-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="y859b8726-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Secretary of veterans affairs</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report on the pilot program under this section.</content></paragraph>
<paragraph class="fontsize10" id="y859b8727-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Comptroller general</inline>.—</heading><subparagraph class="fontsize10" id="y859b8728-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859b8729-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Interim report</inline>.—</heading><chapeau>Not later than 3 years after the date on which the Secretary first enters into a contract under this section, the Comptroller General of the United States shall submit to Congress a report containing the results of the interim assessment of the Comptroller General. Such report<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859b872a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x859b872b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote> shall include the recommendations of the Comptroller General for improving the pilot program and an assessment of each of the following:</chapeau><clause class="fontsize10" id="y859b872c-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>The technology experience of the directors and instructors of the providers of high technology programs of education under the pilot program.</content></clause>
<clause class="fontsize10" id="y859b872d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>Whether the providers cooperated with the technology industry to create the curriculum for the program of education.</content></clause>
<clause class="fontsize10" id="y859b872e-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>Whether the providers use an open source curriculum for the program of education.</content></clause>
<clause class="fontsize10" id="y859b872f-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>The admittance rate into the pilot program.</content></clause>
<clause class="fontsize10" id="y859b8730-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>The job placement and retention rate for veterans who completed a program of education under the pilot program in the field of study of the program.</content></clause>
<clause class="fontsize10" id="y859b8731-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>The percentage of veterans who completed a program of education under the pilot program who were subsequently employed for a period of 6 months or longer in a field of study of the program.</content></clause>
<clause class="fontsize10" id="y859b8732-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>The percentage of veterans who completed a program of education under the pilot program who were subsequently employed for a period of less than 6 months in a field of study of the program.</content></clause>
<clause class="fontsize10" id="y859b8733-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>The median annual salary of veterans who completed a program of education under the pilot program and were subsequently employed.</content></clause>
<clause class="fontsize10" id="y859b8734-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/ix" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">(ix) </num><content>As applicable, the transfer rates to other academic or vocational programs and certifications and licensure exam passage rates.</content></clause>
<clause class="fontsize10" id="y859b8735-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/A/x" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="x">(x) </num><content>The average age of veterans who participated in the pilot program.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y859b8736-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/f/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Final report</inline>.—</heading><content>Not later than 5 years after the date on which the Secretary first enters into a contract under this section, the Comptroller General shall submit to Congress a final report on the pilot<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x859b8737-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x859b8738-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tion.</p></sidenote> program. Such report shall include the recommendation of the Comptroller General with respect to whether the program should be extended and an assessment of each item described in clauses (i) through (x) of subparagraph (A).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y859b8739-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>For each fiscal year during which the Secretary carries out a pilot program under this section, $15,000,000 shall be made available for such purpose from <page identifier="/us/stat/131/989">131 STAT. 989</page>
funds appropriated to, or otherwise made available to, the Department for the payment of readjustment benefits.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y859bae4a-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tI/s116/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>The authority to carry out a pilot program under this section shall terminate on the date that is 5 years after the date on which the Secretary first enters into a contract under this section.</content></subsection>
</section>
<num value="II">TITLE II—</num><heading>OTHER EDUCATIONAL ASSISTANCE PROGRAMS</heading>
<section id="d250400e2886" identifier="/us/pl/115/48/tII/s201" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="201">SEC. 201. </num><heading>WORK-STUDY ALLOWANCE.</heading><content style="-uslm-lc:I658120"> Section 3485(a)(4) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>the period beginning on June 30, 2017, and ending on June 30, 2022,</quotedText>” each place it appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>any time on or after June 30, 2017,</quotedText>”.</content></section>
<section id="d250400e2902" identifier="/us/pl/115/48/tII/s202" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="202">SEC. 202. </num><heading>DURATION OF EDUCATIONAL ASSISTANCE UNDER SURVIVORS’ AND DEPENDENTS’ EDUCATIONAL ASSISTANCE PROGRAM.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x859bd55b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"> Section 3511(a)(1) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y859bd55c-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tII/s202/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>chapter for</quotedText>” and all that follows through the period and <amendingAction type="insert">inserting</amendingAction> “<quotedText>chapter—</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y859bd55d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tII/s202/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraphs:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y859bd55e-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>in the case of a person who first enrolls in a program of education using such entitlement before August 1, 2018, for an aggregate period not in excess of 45 months (or to the equivalent thereof in part-time training); or</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y859bd55f-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>in the case of a person who first enrolls in a program of education using such entitlement on or after August 1, 2018, for an aggregate period not in excess of 36 months (or to the equivalent thereof in part-time training).”</content></subparagraph>

<subparagraph class="fontsize10" id="y859d3514-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>leads to—</chapeau><clause class="fontsize10" id="y859d3515-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a standard college degree;</content></clause>
<clause class="fontsize10" id="y859d3516-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a certificate that reflects educational attainment offered by an institution of higher learning; or</content></clause>
<clause class="fontsize10" id="y859d3517-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>a certificate that reflects completion of a course of study offered by—</chapeau><subclause class="fontsize10" id="y859d3518-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>an area career and technical education school (as defined in subparagraphs (C) and (D) of section 3(3) of the Carl D. Perkins Career and Technical Education Act of 2006 (<ref href="/us/usc/t20/s2302/3">20 U.S.C. 2302(3)</ref>)) that provides education at the postsecondary level; or</content></subclause>
<subclause class="fontsize10" id="y859d3519-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>a postsecondary vocational institution (as defined in section 102(c) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1002/c">20 U.S.C. 1002(c)</ref>)) that provides education at the postsecondary level; and</content></subclause>

</subparagraph>
<subparagraph class="fontsize10" id="y859d351a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>in the case of a program described in subparagraph (B)(iii)—</chapeau><clause class="fontsize10" id="y859d351b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>provides training aligned with the requirements of employers in the State or local area where the program is located, which may include in-demand industry sectors or occupations; and</content></clause>
<clause class="fontsize10" id="y859d351c-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>provides a student, upon completion of the program, with a recognized postsecondary credential that is recognized by employers in the relevant industry, which may include a credential recognized by industry or sector partnerships in the State or local area where the industry is located; and</content></clause>
<clause class="fontsize10" id="y859d351d-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>meets such content and instructional standards as may be required to comply with the criteria under section 3676(c)(14) and(15) of this title.”</content></clause>

<section id="d250400e3442" identifier="/us/pl/115/48/tIII/s304" style="-uslm-lc:I658143"><num class="fontsize12" value="304">SEC. 304. </num><heading>LIMITATION ON USE OF REPORTING FEES PAYABLE TO EDUCATIONAL INSTITUTIONS AND SPONSORS OF PROGRAMS OF APPRENTICESHIP.</heading><subsection class="firstIndent0 fontsize10" id="y859daa56-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tIII/s304/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subsection (c) of section 3684 <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subsection class="firstIndent0 fontsize10" id="y859dd167-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline" id="y859dd168-e82d-11f0-bc57-ad3ac4b1618c"><num value="1">(1) </num><content>The Secretary may pay to any educational institution, or to the sponsor of a program of apprenticeship, furnishing education or training under either this chapter or chapter 31, 34, or 35 of this title, a reporting fee which will be in lieu of any other compensation or reimbursement for reports or certifications which such educational institution or sponsor of a program of apprenticeship is required to submit to the Secretary by law or regulation.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y859dd169-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Such reporting fee shall be computed for each calendar year by multiplying $16 by the number of eligible veterans or eligible persons enrolled under this chapter or chapter 31, 34, or 35 of this title. The reporting fee shall be paid to such educational institution or sponsor of a program of apprenticeship as soon as feasible after the end of the calendar year for which it is applicable.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y859dd16a-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>No reporting fee payable to an educational institution under this subsection shall be subject to offset by the Secretary against any liability of such institution for any overpayment for which such institution may be administratively determined to be liable under section 3685 of this title unless such liability is not contested by such institution or has been upheld by a final decree of a court of appropriate jurisdiction.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y859dd16b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>Any reporting fee paid to an educational institution or sponsor of a program of apprenticeship after the date of the enactment of the Post-9/11 Veterans Educational Assistance Improvements Act of 2011 (<ref href="/us/pl/111/377">Public Law 111–377</ref>)—</chapeau><subparagraph class="fontsize10" id="y859dd16c-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>shall be utilized by such institution or sponsor solely for the making of certifications required under this chapter or chapter 31, 34, or 35 of this title or for otherwise supporting programs for veterans; and</content></subparagraph>
<subparagraph class="fontsize10" id="y859dd16d-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>with respect to an institution that has 100 or more enrollees described in paragraph (2) may not be used for or merged with amounts available for the general fund of the educational institution or sponsor of a program of apprenticeship.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y859dd16e-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>The reporting fee payable under this subsection shall be paid from amounts appropriated for readjustment benefits.”</content></paragraph>

If a covered educational institution does not ensure that a school certifying official employed by the educational institution meets such requirements, the Secretary may disapprove any course of education offered by such educational institution.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y859e1f94-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tIII/s305/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:<page identifier="/us/stat/131/993">131 STAT. 993</page></chapeau><paragraph class="fontsize10" id="y859e1f95-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tIII/s305/b/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The term “<term>covered educational institution</term>” means an educational institution that has enrolled 20 or more individuals using educational assistance under <ref href="/us/usc/t38">title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y859e1f96-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tIII/s305/b/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The term “<term>school certifying official</term>” means an employee of an educational institution with primary responsibility for certifying veteran enrollment at the educational institution.</content></paragraph>
<paragraph class="fontsize10" id="y859e1f97-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tIII/s305/b/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The term “<term>State approving agency</term>” means a department or agency of a State designated under <ref href="/us/usc/t38/s3671">section 3671 of title 38, United States Code</ref>.</content></paragraph>

Such counseling services shall be provided by employees of the Department who provide such services under section 3697A of this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y859e94cd-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Selection of Locations</inline>.—</heading><paragraph class="inline" id="y859e94ce-e82d-11f0-bc57-ad3ac4b1618c"><num value="1">(1) </num><content>To be selected by the Secretary under this section, an institution of higher learning shall provide an appropriate space on the campus of the institution where counseling services can be provided under this section.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y859e94cf-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>In selecting locations for the provision of counseling services under this section, the Secretary shall seek to select locations where the maximum number of veterans would have access to such services.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y859e94d0-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Annual Report</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this section, and each year thereafter, the Secretary shall submit to Congress a report on the counseling services provided under this section. Such report shall include, for the year covered by the report—</chapeau><paragraph class="fontsize10" id="y859e94d1-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the average ratio of counselors providing such services to individuals who received such services at each location where such services were provided;</content></paragraph>
<paragraph class="fontsize10" id="y859e94d2-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>a description of such services provided;</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y859f7e56-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tIII/s311/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit to the Secretary of Veterans Affairs, the Committee on Veterans’ Affairs of the Senate, and the Committee on Veterans’ Affairs of the House of Representatives, a report on the study required under subsection (a) and the findings and recommendations of the Comptroller General with respect to such study.</content></subsection>

<num value="IV">TITLE IV—</num><heading>RESERVE COMPONENT BENEFITS</heading>

<num value="V">TITLE V—</num><heading>OTHER MATTERS</heading>

<paragraph class="fontsize10" id="y85a21690-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Factors of consideration</inline>.—</heading><chapeau>In making a determination under paragraph (1), the Secretary—</chapeau><subparagraph class="fontsize10" id="y85a21691-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>shall consider—</chapeau><clause class="fontsize10" id="y85a21692-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>that contemporaneous records of testing of full-body exposure to a covered substance frequently may be unavailable because such tests were classified or such records were lost or destroyed;</content></clause>
<clause class="fontsize10" id="y85a21693-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>that many veterans were sworn to secrecy following testing described in clause (i);</content></clause>
<clause class="fontsize10" id="y85a21694-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>each statement based on personal knowledge of a veteran who served at a site listed in paragraph (3);</content></clause>
<clause class="fontsize10" id="y85a21695-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>information in the report from the Secretary of Defense under subsection (b)(2); and</content></clause>
<clause class="fontsize10" id="y85a21696-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>any evidence the Secretary considers relevant; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y85a21697-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>may not determine that testing of full-body exposure to a covered substance did not occur at a site based solely on—</chapeau><clause class="fontsize10" id="y85a21698-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>information contained in the Department of Defense and Department of Veterans Affairs Chemical Biological Warfare Database; or</content></clause>
<clause class="fontsize10" id="y85a21699-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/4/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any list of known sites of testing of full-body exposure to a covered substance maintained by the Department of Veterans Affairs or the Department of Defense.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y85a2169a-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x85a2169b-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Presumption of exposure</inline>.—</heading><chapeau>In carrying out paragraph (1), when the Secretary of Veterans Affairs makes a determination regarding whether a veteran experienced full-body exposure to a covered substance, the Secretary—</chapeau><subparagraph class="fontsize10" id="y85a2169c-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>shall presume, unless there is affirmative evidence to establish otherwise, that the veteran experienced such exposure by reason of the service of the veteran in World War II—</chapeau><clause class="fontsize10" id="y85a2169d-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/5/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>based on the locations listed in paragraph (3); and</content></clause>
<clause class="fontsize10" id="y85a23dae-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/5/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>consistent with the places, types, and circumstances of service of the veteran in accordance with section 1154 of title 38; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y85a23daf-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>shall resolve each reasonable doubt in favor of the veteran.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y85a23db0-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Effective date of award</inline>.—</heading><content>The effective date of any award of disability compensation resulting from reconsideration of a claim under paragraph (1) shall be fixed in accordance <page identifier="/us/stat/131/998">131 STAT. 998</page>
with the facts found, but shall not be earlier than the date of the receipt of the claim for compensation described in paragraph (2).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y85a23db1-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Investigation and Report by the Secretary of Defense</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall—</chapeau><paragraph class="fontsize10" id="y85a23db2-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>investigate and assess each site—</chapeau><subparagraph class="fontsize10" id="y85a23db3-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>where the Army Corps of Engineers has uncovered evidence of testing conducted by the Department of Defense during World War II to assess the effects of full-body exposure to a covered substance on humans; or</content></subparagraph>
<subparagraph class="fontsize10" id="y85a23db4-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>with regards to which more than two veterans have been denied claims for compensation under <ref href="/us/usc/t38/ch11">chapter 11 of title 38, United States Code</ref>, in connection with exposure to a covered substance at such site; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y85a23db5-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>submit to the appropriate congressional committees and the Secretary of Veterans Affairs a report on testing described in paragraph (1)(A), including—</chapeau><subparagraph class="fontsize10" id="y85a23db6-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x85a23db7-e82d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>a list of each location where such testing occurred, including locations investigated and assessed under paragraph (1);</content></subparagraph>
<subparagraph class="fontsize10" id="y85a23db8-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the dates of each such testing; and</content></subparagraph>
<subparagraph class="fontsize10" id="y85a23db9-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the number of members of the Armed Forces who experienced full-body exposure to a covered substance in each such testing.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y85a23dba-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Investigation and Report by Secretary of Veterans Affairs</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall—</chapeau><paragraph class="fontsize10" id="y85a23dbb-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>investigate and assess—</chapeau><subparagraph class="fontsize10" id="y85a23dbc-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the actions taken by the Secretary to contact individuals who experienced full-body exposure to a covered substance in the course of testing described in subsection (b)(1)(A);</content></subparagraph>
<subparagraph class="fontsize10" id="y85a23dbd-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the number of claims filed with the Secretary for disability compensation under <ref href="/us/usc/t38/ch11">chapter 11 of title 38, United States Code</ref>, arising from testing described in subsection (b)(1)(A); and</content></subparagraph>
<subparagraph class="fontsize10" id="y85a23dbe-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the percentage of claims described in subparagraph (B) that the Secretary denied.</content></subparagraph>

<paragraph class="fontsize10" id="y85a23dbf-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>submit to the appropriate congressional committees and the Secretary of Defense a report regarding the investigations and assessments carried out under paragraph (1).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y85a23dc0-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y85a23dc1-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The terms “active military, naval, or air service”, “veteran”, and “World War II” have the meanings given such terms in <ref href="/us/usc/t38/s101">section 101 of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y85a23dc2-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/d/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y85a23dc3-e82d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/48/tV/s502/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committees on Armed Services of the House of Representatives and the Senate; and</content></subparagraph>
