<section id="d134877e104" identifier="/us/pl/115/441/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Elie Wiesel Genocide and Atrocities Prevention Act of 2018</shortTitle>”.</content></section>
<section id="d134877e114" identifier="/us/pl/115/441/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe1061586-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is the sense of Congress that the United States Government’s efforts at atrocity prevention and response through interagency coordination, such as the Atrocities Prevention Board (referred to in this Act as the “Board”) or successor entity are critically important, and that appropriate officials of the United States Government should—</chapeau><paragraph class="fontsize10" id="ye1061587-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>meet regularly to monitor developments throughout the world that heighten the risk of atrocities;</content></paragraph>
<paragraph class="fontsize10" id="ye1061588-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>identify any gaps in United States foreign policy concerning regions or particular countries related to atrocity prevention and response;</content></paragraph>
<paragraph class="fontsize10" id="ye1063c99-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>facilitate the development and implementation of policies to enhance the capacity of the United States to prevent and respond to atrocities worldwide;</content></paragraph>
<paragraph class="fontsize10" id="ye1063c9a-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>provide the President and Congress with recommendations to improve policies, programs, resources, and tools related to atrocity prevention and response;</content></paragraph>
<paragraph class="fontsize10" id="ye1063c9b-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>conduct outreach, including consultations, not less frequently than biannually, with representatives of nongovernmental organizations and civil society dedicated to atrocity prevention and response;</content></paragraph>
<paragraph class="fontsize10" id="ye1063c9c-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>operate with regular consultation and participation of designated interagency representatives of relevant Federal agencies, executive departments, or offices; and</content></paragraph>
<paragraph class="fontsize10" id="ye1063c9d-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>ensure resources are made available for the policies, programs, and tools related to atrocity prevention and response.</content></paragraph>
</section>
<section id="d134877e157" identifier="/us/pl/115/441/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1063c9e-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2656">22 USC 2656 note</ref>.</p></sidenote><heading>STATEMENT OF POLICY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe1068abf-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It shall be the policy of the United States to—</chapeau><paragraph class="fontsize10" id="ye1068ac0-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>regard the prevention of atrocities as in its national interest;</content></paragraph>
<paragraph class="fontsize10" id="ye1068ac1-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>work with partners and allies, including to build their capacity, and enhance the capacity of the United States, to <page identifier="/us/stat/132/5587">132 STAT. 5587</page>
identify, prevent, and respond to the causes of atrocities, including insecurity, mass displacement, violent conflict, and other conditions that may lead to such atrocities; and</content></paragraph>
<paragraph class="fontsize10" id="ye1068ac2-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>pursue a United States Government-wide strategy to identify, prevent, and respond to the risk of atrocities by—</chapeau><subparagraph class="fontsize10" id="ye1068ac3-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>strengthening the diplomatic, risk analysis and monitoring, strategic planning, early warning, and response capacities of the Government;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1068ac4-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>improving the use of foreign assistance to respond early, effectively, and urgently in order to address the causes of atrocities;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1068ac5-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>strengthening diplomatic response and the effective use of foreign assistance to support appropriate transitional justice measures, including criminal accountability, for past atrocities;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1068ac6-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>supporting and strengthening local civil society, including human rights defenders and others working to help prevent and respond to atrocities;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1068ac7-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>promoting financial transparency and enhancing anti-corruption initiatives as part of addressing causes of conditions that may lead to atrocities; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye1068ac8-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><chapeau>employing a variety of unilateral, bilateral, and multilateral means to prevent and respond to atrocities by—</chapeau><clause class="fontsize10" id="ye1068ac9-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/F/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>placing a high priority on timely, preventive diplomatic efforts; and</content></clause>
<clause class="fontsize10" id="ye1068aca-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s3/3/F/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>exercising leadership in promoting international efforts to prevent atrocities.</content></clause>
</subparagraph>

<section id="d134877e230" identifier="/us/pl/115/441/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>TRAINING OF FOREIGN SERVICE OFFICERS IN CONFLICT AND ATROCITIES PREVENTION.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe106b1db-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 708 of the Foreign Service Act of 1980 (<ref href="/us/usc/t22/s4028">22 U.S.C. 4028</ref>) <amendingAction type="amend">is amended</amendingAction> in subsection (a)(1)—</chapeau><paragraph class="fontsize10" id="ye106b1dc-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (B), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="ye106b1dd-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ye106b1de-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s4/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="fontsize10" id="ye106d8ef-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe106d8f0-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xe106d8f1-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>for Foreign Service Officers who will be assigned to a country experiencing or at risk of mass atrocities, as determined by the Secretary of State, in consultation with the Director of National Intelligence and relevant civil society organizations, instruction on recognizing patterns of escalation and early warning signs of potential atrocities, and methods of preventing and responding to atrocities, including conflict assessment methods, peacebuilding, mediation for prevention, early action and response, and appropriate transitional justice measures to address atrocities.”</content></subparagraph>

<section id="d134877e285" identifier="/us/pl/115/441/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>REPORTS.</heading><subsection class="firstIndent0 fontsize10" id="ye1074e22-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1074e23-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act and annually thereafter for the following six years, the President shall transmit to the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives and the Committee on Foreign Relations and the Committee on Appropriations of the Senate a report, with a classified annex if necessary, that includes—</chapeau><page identifier="/us/stat/132/5588">132 STAT. 5588</page>
<paragraph class="fontsize10" id="ye1077534-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1077535-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p><p class="leftAlign firstIndent0 fontsize8" id="xe1077536-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><chapeau>a review, in consultation with appropriate interagency representatives, including the Board, consisting of a detailed description of—</chapeau><subparagraph class="fontsize10" id="ye1077537-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1077538-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>current efforts to prevent and respond to atrocities, based on United States and locally identified indicators, including an analysis of capacities and constraints for interagency detection, early warning and response, information-sharing, contingency planning, and coordination;</content></subparagraph>
<subparagraph class="fontsize10" id="ye1077539-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe107753a-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xe107753b-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>recommendations to further strengthen United States capabilities described in subparagraph (A);</content></subparagraph>
<subparagraph class="fontsize10" id="ye107753c-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>funding expended by relevant Federal departments and agencies on atrocities prevention activities, including appropriate transitional justice measures and the legal, procedural, and resource constraints faced by the Department of State and the United States Agency for International Development throughout respective budgeting, strategic planning, and management cycles regarding support for atrocity prevention activities;</content></subparagraph>
<subparagraph class="fontsize10" id="ye107753d-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe107753e-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>a global assessment of ongoing atrocities, including the findings of such assessment and, where relevant, the efficacy of any steps taken by the Board or relevant Federal agency to respond to such atrocities;</content></subparagraph>
<subparagraph class="fontsize10" id="ye107753f-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>countries and regions at risk of atrocities, including a description of specific risk factors, at-risk groups, and likely scenarios in which atrocities would occur; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye1077540-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>the atrocities prevention training for Foreign Service officers authorized under subparagraph (D) of section 708(a)(1) of the Foreign Service Act of 1980, as added by section 4;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1077541-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe1077542-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xe1077543-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><chapeau>recommendations to ensure shared responsibility by—</chapeau><subparagraph class="fontsize10" id="ye1077544-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>enhancing multilateral mechanisms for preventing atrocities, including strengthening the role of international organizations and international financial institutions in conflict prevention, mitigation, and response; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye1077545-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>strengthening relevant regional organizations;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye1077546-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the implementation status of the recommendations contained in the previous review required by this section; and</content></paragraph>
<paragraph class="fontsize10" id="ye1077547-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>identification of the Federal agencies and civil society, academic, and nongovernmental organizations and institutions consulted for preparation of such report.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye1077548-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Consideration of Recommendations</inline>.—</heading><content>The preparation of the report required by subsection (a) shall include a consideration of analysis, reporting, and policy recommendations to prevent and respond to atrocities produced by civil society, academic, and other nongovernmental organizations and institutions.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye1077549-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Availability to Congress</inline>.—</heading><content>The report required by subsection (a) shall be made available to all members of Congress.</content></subsection>

<section id="d134877e406" identifier="/us/pl/115/441/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe107754a-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2656">22 USC 2656 note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe1079c5b-e82d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act—</chapeau><paragraph class="fontsize10" id="ye1079c5c-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s6/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>genocide</term>” means an offense under subsection (a) of <ref href="/us/usc/t18/s1091">section 1091 of title 18, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="ye1079c5d-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s6/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the term “<term>atrocities</term>” means war crimes, crimes against humanity, and genocide;</content></paragraph>
<paragraph class="fontsize10" id="ye1079c5e-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s6/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the term “<term>transitional justice</term>” means the range of judicial, nonjudicial, formal, informal, retributive, and restorative measures employed by countries transitioning out of armed <page identifier="/us/stat/132/5589">132 STAT. 5589</page>
conflict or repressive regimes to redress legacies of atrocities and to promote long-term, sustainable peace; and</content></paragraph>
<paragraph class="fontsize10" id="ye1079c5f-e82d-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/441/s6/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the term “<term>war crime</term>” has the meaning given the term in <ref href="/us/usc/t18/s2441/c">section 2441(c) of title 18, United States Code</ref>.</content></paragraph>
