<section id="d135458e105" identifier="/us/pl/115/436/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Water Infrastructure Improvement Act</shortTitle>”.</content></section>
<section id="d135458e115" identifier="/us/pl/115/436/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x152633f6-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s4370j">42 USC 4370j note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x15265b07-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y15265b08-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrator</inline>.—</heading><content>The term “<term>Administrator</term>” means the Administrator of the Environmental Protection Agency.</content></paragraph>
<paragraph class="fontsize10" id="y15265b09-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Municipality</inline>.—</heading><content>The term “<term>municipality</term>” has the meaning given that term in section 502 of the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1362">33 U.S.C. 1362</ref>).</content></paragraph>
</section>
<section id="d135458e149" identifier="/us/pl/115/436/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>INTEGRATED PLANS.</heading><subsection class="firstIndent0 fontsize10" id="y1526d03a-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Integrated Plans</inline>.—</heading><content>Section 402 of the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1342">33 U.S.C. 1342</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y1527456b-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="s">“(s) </num><heading class="fontsize10"><inline class="smallCaps">Integrated Plans</inline>.—</heading><paragraph class="fontsize10" id="y1527456c-e82e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definition of integrated plan</inline>.—</heading><content>In this subsection, the term ‘<term>integrated plan</term>’ means a plan developed in accordance with the Integrated Municipal Stormwater and Wastewater Planning Approach Framework, issued by the Environmental Protection Agency and dated June 5, 2012.</content></paragraph>
<paragraph class="fontsize10" id="y1527456d-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Administrator (or a State, in the case of a permit program approved by the Administrator) shall inform municipalities of the opportunity to develop an integrated plan that may be incorporated into a permit under this section.</content></paragraph>
<paragraph class="fontsize10" id="y1527456e-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Scope</inline>.—</heading><subparagraph class="fontsize10" id="y1527456f-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Scope of permit incorporating integrated plan</inline>.—</heading><chapeau>A permit issued under this section that incorporates an integrated plan may integrate all requirements under this Act addressed in the integrated plan, including requirements relating to—</chapeau><clause class="fontsize10" id="y15276c80-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a combined sewer overflow;</content></clause>
<clause class="fontsize10" id="y15276c81-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a capacity, management, operation, and maintenance program for sanitary sewer collection systems;</content></clause>
<clause class="fontsize10" id="y15276c82-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a municipal stormwater discharge;</content></clause>
<clause class="fontsize10" id="y15276c83-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>a municipal wastewater discharge; and<page identifier="/us/stat/132/5559">132 STAT. 5559</page></content></clause>
<clause class="fontsize10" id="y15276c84-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>a water quality-based effluent limitation to implement an applicable wasteload allocation in a total maximum daily load.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y15276c85-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Inclusions in integrated plan</inline>.—</heading><chapeau>An integrated plan incorporated into a permit issued under this section may include the implementation of—</chapeau><clause class="fontsize10" id="y15276c86-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>projects, including innovative projects, to reclaim, recycle, or reuse water; and</content></clause>
<clause class="fontsize10" id="y15276c87-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>green infrastructure.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y15276c88-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Compliance schedules</inline>.—</heading><subparagraph class="fontsize10" id="y15276c89-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>A permit issued under this section that incorporates an integrated plan may include a schedule of compliance, under which actions taken to meet any applicable water quality-based effluent limitation may be implemented over more than 1 permit term if the schedule of compliance—</chapeau><clause class="fontsize10" id="y15276c8a-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is authorized by State water quality standards; and</content></clause>
<clause class="fontsize10" id="y15276c8b-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>meets the requirements of <ref href="/us/cfr/t40/s122.47">section 122.47 of title 40, Code of Federal Regulations</ref> (as in effect on the date of enactment of this subsection).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y15276c8c-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Time for compliance</inline>.—</heading><content>For purposes of subparagraph (A)(ii), the requirement of <ref href="/us/cfr/t40/s122.47">section 122.47 of title 40, Code of Federal Regulations</ref>, for compliance by an applicable statutory deadline under this Act does not prohibit implementation of an applicable water quality-based effluent limitation over more than 1 permit term.</content></subparagraph>
<subparagraph class="fontsize10" id="y15276c8d-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Review</inline>.—</heading><content>A schedule of compliance incorporated into a permit issued under this section may be reviewed at the time the permit is renewed to determine whether the schedule should be modified.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y15276c8e-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Existing authorities retained</inline>.—</heading><subparagraph class="fontsize10" id="y15276c8f-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Applicable standards</inline>.—</heading><content>Nothing in this subsection modifies any obligation to comply with applicable technology and water quality-based effluent limitations under this Act.</content></subparagraph>
<subparagraph class="fontsize10" id="y15276c90-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Flexibility</inline>.—</heading><content>Nothing in this subsection reduces or eliminates any flexibility available under this Act, including the authority of a State to revise a water quality standard after a use attainability analysis under <ref href="/us/cfr/t40/s131.10/g">section 131.10(g) of title 40, Code of Federal Regulations</ref> (or a successor regulation), subject to the approval of the Administrator under section 303(c).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y15276c91-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Clarification of state authority</inline>.—</heading><subparagraph class="fontsize10" id="y15276c92-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Nothing in section 301(b)(1)(C) precludes a State from authorizing in the water quality standards of the State the issuance of a schedule of compliance to meet water quality-based effluent limitations in permits that incorporate provisions of an integrated plan.</content></subparagraph>
<subparagraph class="fontsize10" id="y15276c93-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Transition rule</inline>.—</heading><content>In any case in which a discharge is subject to a judicial order or consent decree, as of the date of enactment of this subsection, resolving an enforcement action under this Act, any schedule of compliance issued pursuant to an authorization in a State water quality standard may not revise a schedule of compliance in that order or decree to be less stringent, unless <page identifier="/us/stat/132/5560">132 STAT. 5560</page>
the order or decree is modified by agreement of the parties and the court.”</content></subparagraph>
</paragraph>
</subsection>

<subsection class="firstIndent0 fontsize10" id="y15276c94-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Implementation of Integrated Plans Through Enforcement Tools</inline>.—</heading><content>Section 309 of the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1319">33 U.S.C. 1319</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y15276c95-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Implementation of Integrated Plans</inline>.—</heading><paragraph class="fontsize10" id="y15276c96-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In conjunction with an enforcement action under subsection (a) or (b) relating to municipal discharges, the Administrator shall inform a municipality of the opportunity to develop an integrated plan, as defined in section 402(s).</content></paragraph>
<paragraph class="fontsize10" id="y15276c97-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Modification</inline>.—</heading><content>Any municipality under an administrative order under subsection (a) or settlement agreement (including a judicial consent decree) under subsection (b) that has developed an integrated plan consistent with section 402(s) may request a modification of the administrative order or settlement agreement based on that integrated plan.”</content></paragraph>
</subsection>

<subsection class="firstIndent0 fontsize10" id="y152792a8-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x152792a9-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives, and make publicly available, a report on each integrated plan developed and implemented through a permit, order, or judicial consent decree pursuant to the Federal Water Pollution Control Act since the date of publication of the “Integrated Municipal Stormwater and Wastewater Planning Approach Framework” issued by the Environmental Protection Agency and dated June 5, 2012, including a description of the control measures, levels of control, estimated costs, and compliance schedules for the requirements implemented through such an integrated plan.</content></subsection>
</section>
<section id="d135458e440" identifier="/us/pl/115/436/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x152792aa-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s4370j">42 USC  4370j</ref>.</p></sidenote><heading>MUNICIPAL OMBUDSMAN.</heading><subsection class="firstIndent0 fontsize10" id="y152807db-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established within the Office of the Administrator an Office of the Municipal Ombudsman, to be headed by a Municipal Ombudsman.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y152807dc-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">General Duties</inline>.—</heading><chapeau>The duties of the Municipal Ombudsman shall include the provision of—</chapeau><paragraph class="fontsize10" id="y152807dd-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>technical assistance to municipalities seeking to comply with the Federal Water Pollution Control Act; and</content></paragraph>
<paragraph class="fontsize10" id="y152807de-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>information to the Administrator to help the Administrator ensure that agency policies are implemented by all offices of the Environmental Protection Agency, including regional offices.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y152807df-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Actions Required</inline>.—</heading><chapeau>The Municipal Ombudsman shall work with appropriate offices at the headquarters and regional offices of the Environmental Protection Agency to ensure that a municipality seeking assistance is provided information regarding—</chapeau><paragraph class="fontsize10" id="y152807e0-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>available Federal financial assistance for which the municipality is eligible;</content></paragraph>
<paragraph class="fontsize10" id="y152807e1-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>flexibility available under the Federal Water Pollution Control Act; and</content></paragraph>
<paragraph class="fontsize10" id="y152807e2-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the opportunity to develop an integrated plan under section 402(s) of the Federal Water Pollution Control Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y152807e3-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Information Sharing</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x152807e4-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote>.—</heading><chapeau>The Municipal Ombudsman shall publish on the website of the Environmental Protection Agency—</chapeau><paragraph class="fontsize10" id="y152807e5-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>general information relating to—<page identifier="/us/stat/132/5561">132 STAT. 5561</page></chapeau><subparagraph class="fontsize10" id="y152807e6-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the technical assistance referred to in subsection (b)(1);</content></subparagraph>
<subparagraph class="fontsize10" id="y152807e7-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the financial assistance referred to in subsection (c)(1);</content></subparagraph>
<subparagraph class="fontsize10" id="y152807e8-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the flexibility referred to in subsection (c)(2); and</content></subparagraph>
<subparagraph class="fontsize10" id="y152807e9-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/d/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>any resources developed by the Administrator related to integrated plans under section 402(s) of the Federal Water Pollution Control Act; and</content></subparagraph>

<paragraph class="fontsize10" id="y152807ea-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a copy of each permit, order, or judicial consent decree that implements or incorporates such an integrated plan.</content></paragraph>

<section id="d135458e547" identifier="/us/pl/115/436/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>GREEN INFRASTRUCTURE.</heading><subsection class="firstIndent0 fontsize10" id="y1528560b-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s5/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>Section 502 of the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1362">33 U.S.C. 1362</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="y1528560c-e82e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="27">“(27) </num><heading class="fontsize10"><inline class="smallCaps">Green infrastructure</inline>.—</heading><content>The term ‘<term>green infrastructure</term>’ means the range of measures that use plant or soil systems, permeable pavement or other permeable surfaces or substrates, stormwater harvest and reuse, or landscaping to store, infiltrate, or evapotranspirate stormwater and reduce flows to sewer systems or to surface waters.”</content></paragraph>

<paragraph class="fontsize10" id="y15285610-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/436/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after section 518 the following:<quotedContent><section class="centered fontsize12" id="y1528a431-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="519">“SEC. 519. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1528a432-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p><p class="leftAlign firstIndent0 fontsize8" id="x1528a433-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t33/s1377a">33 USC 1377a</ref>.</p></sidenote><heading class="fontsize12">GREEN INFRASTRUCTURE PROMOTION.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y1528a434-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Administrator shall promote the use of green infrastructure in, and coordinate the integration of green infrastructure into, permitting and enforcement under this Act, planning efforts, research, technical assistance, and funding guidance of the Environmental Protection Agency.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y1528a435-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Coordination of Efforts</inline>.—</heading><chapeau>The Administrator shall ensure that the Office of Water coordinates efforts to increase the use of green infrastructure with—</chapeau><paragraph class="fontsize10" id="y1528a436-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>other Federal departments and agencies;</content></paragraph>
<paragraph class="fontsize10" id="y1528a437-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>State, tribal, and local governments; and</content></paragraph>
<paragraph class="fontsize10" id="y1528a438-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the private sector.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y1528a439-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Regional Green Infrastructure Promotion</inline>.—</heading><chapeau>The Administrator shall direct each regional office of the Environmental Protection Agency, as appropriate based on local factors, and consistent with the requirements of this Act, to promote and integrate the use of green infrastructure within the region, including through—</chapeau><paragraph class="fontsize10" id="y1528a43a-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>outreach and training regarding green infrastructure implementation for State, tribal, and local governments, tribal communities, and the private sector; and</content></paragraph>
<paragraph class="fontsize10" id="y1528a43b-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the incorporation of green infrastructure into permitting and other regulatory programs, codes, and ordinance development, including the requirements under consent decrees and settlement agreements in enforcement actions.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y1528a43c-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Green Infrastructure Information-Sharing</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1528a43d-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Website.</p></sidenote>.—</heading><chapeau>The Administrator shall promote green infrastructure information-sharing, including through an internet website, to share information with, and provide technical assistance to, State, tribal, and local governments, tribal communities, the private sector, and the public, regarding green infrastructure approaches for—</chapeau><paragraph class="fontsize10" id="y1528a43e-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>reducing water pollution;<page identifier="/us/stat/132/5562">132 STAT. 5562</page></content></paragraph>
<paragraph class="fontsize10" id="y1528a43f-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>protecting water resources;</content></paragraph>
<paragraph class="fontsize10" id="y1528a440-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>complying with regulatory requirements; and</content></paragraph>
<paragraph class="fontsize10" id="y1528a441-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>achieving other environmental, public health, and community goals.”</content></paragraph>
