<section id="d252409e92" identifier="/us/pl/115/427/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Trafficking Victims Protection Reauthorization Act of 2017</shortTitle>”.</content></section>
<section id="d252409e102" identifier="/us/pl/115/427/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x618b15e1-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 103 of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7102">22 U.S.C. 7102</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y618b15e2-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (5) through (15) as paragraphs (7) through (17), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="y618b15e3-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (4) the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y618b8b14-e82e-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Concrete actions</inline>.—</heading><chapeau>The term ‘<term>concrete actions</term>’ means actions that demonstrate increased efforts by the government of a country to meet the minimum standards for the elimination of trafficking, including any of the following:</chapeau><subparagraph class="fontsize10" id="y618b8b15-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Enforcement actions taken.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b16-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Investigations actively underway.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b17-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Prosecutions conducted.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b18-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>Convictions attained.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b19-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>Training provided.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b1a-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>Programs and partnerships actively underway.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b1b-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>Efforts to prevent severe forms of trafficking, including programs to reduce the vulnerability of particularly vulnerable populations, involving survivors of trafficking in community engagement and policy making, engagement with foreign migrants, ending recruitment fees, and other such measures.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b1c-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>Victim services offered, including immigration services and restitution.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b1d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>The amount of money the government has committed to the actions described in subparagraphs (A) through (H).</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="y618b8b1e-e82e-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Credible information</inline>.—</heading><chapeau>The term ‘<term>credible information</term>’ includes all of the following:</chapeau><subparagraph class="fontsize10" id="y618b8b1f-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Reports by the Department of State.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b20-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Reports of other Federal agencies, including the Department of Labor’s List of Goods Produced by Child Labor or Forced Labor and List of Products Produced by Forced Labor or Indentured Child Labor.<page identifier="/us/stat/132/5504">132 STAT. 5504</page></content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b21-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>Documentation provided by a foreign country, including—</chapeau><clause class="fontsize10" id="y618b8b22-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>copies of relevant laws, regulations, and policies adopted or modified; and</content></clause>
<clause class="fontsize10" id="y618b8b23-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an official record of enforcement actions taken, judicial proceedings, training conducted, consultations conducted, programs and partnerships launched, and services provided.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y618b8b24-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>Materials developed by civil society organizations.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b25-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>Information from survivors of human trafficking, vulnerable persons, and whistleblowers.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b26-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>All relevant media and academic reports that, in light of reason and common sense, are worthy of belief.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b27-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>Information developed by multilateral institutions.</content></subparagraph>
<subparagraph class="fontsize10" id="y618b8b28-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>An assessment of the impact of the actions described in subparagraphs (A) through (I) of paragraph (5) on the prevalence of human trafficking in the country.”</content></subparagraph>

<section id="d252409e253" identifier="/us/pl/115/427/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>SENSE OF CONGRESS.</heading><subsection class="firstIndent0 fontsize10" id="y618bb239-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Private Sector Support to Strengthen Law Enforcement Agencies and the Role of Private Businesses in Preventing and Combating Child Sex Trafficking</inline>.—</heading><chapeau>It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y618bb23a-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the President should work with the private sector to explore, develop, and use technology that strengthens Federal law enforcement capabilities to combat traffickers and criminal networks; and</content></paragraph>
<paragraph class="fontsize10" id="y618bb23b-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>private businesses, both domestic and international, should take every reasonable step to prevent and combat child sex trafficking.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y618bb23c-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Efforts to End Modern Slavery</inline>.—</heading><content>It is the sense of Congress that any future authorization of appropriations to carry out the grant program authorized under section 1298 of the Defense Authorization Act for Fiscal Year 2017 (<ref href="/us/usc/t22/s7114">22 U.S.C. 7114</ref>) should simultaneously extend the accountability provisions under subsections (c), (d), and (e) of such section.</content></subsection>

<section id="d252409e291" identifier="/us/pl/115/427/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>PROHIBITION ON PLACEMENT OR RECRUITMENT FEES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x618bd94d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 106(g) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7104/g">22 U.S.C. 7104(g)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y618bd94e-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> clauses (i) through (iv) as paragraphs (1) through (4), respectively, and moving such paragraphs 4 ems to the left; and</content></paragraph>
<paragraph class="fontsize10" id="y618c005f-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in paragraph (4), as redesignated—</chapeau><subparagraph class="fontsize10" id="y618c0060-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s4/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subclauses (I) through (V) as subparagraphs (A) through (E), respectively, and moving such subparagraphs 4 ems to the left;</content></subparagraph>
<subparagraph class="fontsize10" id="y618c0061-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s4/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (B), as redesignated, by <amendingAction type="redesignate">redesignating</amendingAction> items (aa) and (bb) as clauses (i) and (ii), respectively, and moving such clauses 4 ems to the left; and</content></subparagraph>
<subparagraph class="fontsize10" id="y618c0062-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s4/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in subparagraph (D), as redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>unreasonable placement or recruitment fees</quotedText>” and all that follows through the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>placement or recruitment fees.</quotedText>”.<page identifier="/us/stat/132/5505">132 STAT. 5505</page></content></subparagraph>

<section id="d252409e350" identifier="/us/pl/115/427/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>MINIMUM STANDARDS FOR THE ELIMINATION OF TRAFFICKING.</heading><content style="-uslm-lc:I658120">  Section 108(b)(7) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7106/b/7">22 U.S.C. 7106(b)(7)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or enable</quotedText>” after “<quotedText>condone</quotedText>”.</content></section>
<section id="d252409e366" identifier="/us/pl/115/427/s6" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>ACTIONS AGAINST GOVERNMENTS FAILING TO MEET MINIMUM STANDARDS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x618ceac3-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 110(b) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7107">22 U.S.C. 7107</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y618ceac4-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s6/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y618ceac5-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s6/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618ceac6-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>The report should</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>The report shall, to the extent concurrent reporting data is available, cover efforts and activities taking place during the period between April 1 of the year preceding the report and March 31 of the year in which the report is made, and should</quotedText>”;</content></subparagraph>

<subparagraph class="fontsize10" id="y618ceac8-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s6/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in subparagraph (B) by <amendingAction type="insert">inserting</amendingAction> “<quotedText>based only on concrete actions taken by the country (excluding any commitments by the country to take additional future steps during the next year) that are recorded during the reporting period</quotedText>” after “<quotedText>compliance</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y618ceac9-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s6/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>in subparagraph (F), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></subparagraph>
<subparagraph class="fontsize10" id="y618ceaca-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s6/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>in subparagraph (G), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y618ceacb-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s6/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y618ceacc-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>for each country included in a different list than the country had been placed in the previous annual report, a detailed explanation of how the concrete actions (or lack of such actions) undertaken (or not undertaken) by the country during the previous reporting period contributed to such change, including a clear linkage between such actions and the minimum standards enumerated in section 108.”</content></subparagraph>

<clause class="fontsize10" id="y618d3904-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to prevent severe forms of trafficking in persons; and</content></clause>

<subparagraph class="indentUp0 fontsize10" id="y618d3905-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>the extent to which the government of the country has consulted with domestic and international civil society organizations that resulted in concrete actions to improve the provision of services to victims of trafficking in persons.”</content></subparagraph>

<paragraph class="fontsize10" id="y618d3906-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s6/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y618d8727-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Action plans for countries upgraded to tier 2 watchlist</inline>.—</heading><subparagraph class="fontsize10" id="y618d8728-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618d8729-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x618d872a-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote>.—</heading><chapeau>Not later than 180 days after the release of the annual Trafficking in Persons Report, the Secretary of State, acting through the Ambassador-at-Large of the Office to Monitor and Combat Trafficking and the Assistant Secretary of the appropriate regional bureau, in consultation with appropriate officials from the government of each country described in paragraph (2)(A)(ii), and with the assistance of the United States Ambassador or Charge d’Affaires in each country, shall—</chapeau><clause class="fontsize10" id="y618d872b-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>prepare an action plan for each country upgraded from Tier 3 to Tier 2 Watchlist to further improve such country’s tier ranking under this subsection; and</content></clause>
<clause class="fontsize10" id="y618d872c-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>present the relevant action plan to the government of each such country.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y618d872d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Each action plan prepared under this paragraph—</chapeau><clause class="fontsize10" id="y618d872e-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>shall include specific concrete actions to be taken by the country to substantively address deficiencies preventing the country from meeting Tier 2 standards, based on credible information; and</content></clause>
<clause class="fontsize10" id="y618d872f-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>should be focused on short-term and multi-year goals.<page identifier="/us/stat/132/5507">132 STAT. 5507</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y618d8730-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Briefings</inline>.—</heading><content>The Ambassador-at-Large of the Office to Monitor and Combat Trafficking and all appropriate regional Assistant Secretaries shall make themselves available to brief the Committee on Foreign Relations of the Senate, the Committee on Appropriations of the Senate, the Committee on Foreign Affairs of the House of Representatives, and the Committee on Appropriations of the House of Representatives on the implementation of each action plan prepared under this paragraph.</content></subparagraph>
<subparagraph class="fontsize10" id="y618d8731-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Savings provision</inline>.—</heading><chapeau>Nothing in this paragraph may be construed as modifying—</chapeau><clause class="fontsize10" id="y618d8732-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>minimum standards for the elimination of trafficking under section 108; or</content></clause>
<clause class="fontsize10" id="y618d8733-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the actions against governments failing to meet minimum standards under this section or the criteria for placement on the Special Watch List under paragraph (2).”</content></clause>

<section id="d252409e743" identifier="/us/pl/115/427/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>COMMUNICATION WITH GOVERNMENTS OF COUNTRIES DESIGNATED AS TIER 2 WATCH LIST COUNTRIES ON THE TRAFFICKING IN PERSONS REPORT.</heading><subsection class="firstIndent0 fontsize10" id="y618dd554-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618dd555-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s7107">22 USC 7107 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not less than annually, the Secretary of State shall provide, to the foreign minister of each country that has been downgraded to a “Tier 2 Watch List” country pursuant to the Trafficking in Persons report submitted under section 110(b) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7107/b">22 U.S.C. 7107(b)</ref>)—</chapeau><paragraph class="fontsize10" id="y618dd556-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a copy of the annual Trafficking in Persons report; and</content></paragraph>
<paragraph class="fontsize10" id="y618dd557-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>information pertinent to that country’s downgrade, including—</chapeau><subparagraph class="fontsize10" id="y618dd558-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>confirmation of the country’s designation to the Tier 2 Watch List;</content></subparagraph>
<subparagraph class="fontsize10" id="y618dd559-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the implications associated with such designation and the consequences for the country of a downgrade to Tier 3;</content></subparagraph>
<subparagraph class="fontsize10" id="y618dd55a-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the factors that contributed to the downgrade; and</content></subparagraph>
<subparagraph class="fontsize10" id="y618dd55b-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the steps that the country must take to be considered for an upgrade in status of designation.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y618dd55c-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress Regarding Communications</inline>.—</heading><content>It is the sense of Congress that, given the gravity of a Tier 2 Watch List designation, the Secretary of State should communicate the information described in subsection (a) to the foreign minister of any country downgraded to the Tier 2 Watch List.</content></subsection>

<section id="d252409e805" identifier="/us/pl/115/427/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618dd55d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s262d">22 USC 262d note</ref>.</p></sidenote><heading>UNITED STATES SUPPORT FOR INTEGRATION OF ANTI-TRAFFICKING INTERVENTIONS IN MULTILATERAL DEVELOPMENT BANKS.</heading><subsection class="firstIndent0 fontsize10" id="y618e4a8e-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s8/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618e4a8f-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote>.—</heading><chapeau>The Secretary of the Treasury, in consultation with the Secretary of State, acting through the Ambassador at Large for Monitoring and Combating Trafficking in Persons, shall instruct the United States Executive Director of each multilateral development bank to initiate discussions with the other executive directors and management of the respective multilateral development bank to—</chapeau><paragraph class="fontsize10" id="y618e4a90-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s8/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>further develop anti-human trafficking provisions in relevant project development, safeguards, procurement, and evaluation policies;<page identifier="/us/stat/132/5508">132 STAT. 5508</page></content></paragraph>
<paragraph class="fontsize10" id="y618e4a91-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s8/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618e4a92-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p><p class="leftAlign firstIndent0 fontsize8" id="x618e4a93-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Plans.</p></sidenote><content>employing a risk-based approach, require human trafficking risk assessments and integration plans as a routine part of developing projects through existing, forthcoming or new mechanisms and processes;</content></paragraph>
<paragraph class="fontsize10" id="y618e4a94-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s8/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618e4a95-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analyses.</p></sidenote><content>support analyses of the impact of severe forms of trafficking in persons on key indicators of economic and social development and of the benefits of reducing human trafficking on economic and social development;</content></paragraph>
<paragraph class="fontsize10" id="y618e4a96-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s8/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>support the proactive integration of effective anti-trafficking interventions into projects with the objectives of enhancing development outcomes and reducing the incidence of severe forms of trafficking in project areas;</content></paragraph>
<paragraph class="fontsize10" id="y618e4a97-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/427/s8/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x618e4a98-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p></sidenote><content>increase the capacity of multilateral development banks and of recipient governments to conduct human trafficking risk assessments and integrate anti-trafficking interventions into projects;</content></paragraph>
