<section id="d136588e101" identifier="/us/pl/115/424/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Victims of Child Abuse Act Reauthorization Act of 2018</shortTitle>”.</content></section>
<section id="d136588e111" identifier="/us/pl/115/424/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REAUTHORIZATION.</heading><subsection class="firstIndent0 fontsize10" id="y75e8400e-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Section 211 of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20301">34 U.S.C. 20301</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y75e8400f-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2,000,000</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>3,300,000</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y75e84010-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in paragraph (6)—</chapeau><subparagraph class="fontsize10" id="y75e84011-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>improve positive outcomes for the child,</quotedText>” before “<quotedText>and increase</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y75e84012-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y75e84013-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in paragraph (7), by <amendingAction type="delete">striking</amendingAction> “<quotedText>could be duplicated in many jurisdictions throughout the country.</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>have expanded dramatically throughout the United States; and</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y75e84014-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y75e84015-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><chapeau>State chapters of children’s advocacy center networks are needed to—</chapeau><subparagraph class="fontsize10" id="y75e84016-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>assist local communities in coordinating their multidisciplinary child abuse investigation, prosecution, and intervention services; and</content></subparagraph>
<subparagraph class="fontsize10" id="y75e86727-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provide oversight of, and training and technical assistance in, the effective delivery of evidence-informed programming.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y75e86728-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>Section 212 of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20302">34 U.S.C. 20302</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y75e86729-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraphs (3) and (6);</content></paragraph>
<paragraph class="fontsize10" id="y75e8672a-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (4), (5), (7), (8), and (9) as paragraphs (3), (4), (5), (6), and (7), respectively;</content></paragraph>

working to implement a multidisciplinary response to child abuse in the provision of evidence-informed initiatives, including mental health counseling, forensic interviewing, multidisciplinary team coordination, and victim advocacy.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y75e8672f-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Regional Children’s Advocacy Centers</inline>.—</heading><chapeau>Section 213 of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20303">34 U.S.C. 20303</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y75e86730-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y75e86731-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>with the Director and</quotedText>”</content></subparagraph>

<subparagraph class="fontsize10" id="y75e8673c-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>communities that want to develop local children’s advocacy centers.”</content></subparagraph>

<subclause class="fontsize10" id="y75e88e5b-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>programmatic evaluation; and</content></subclause>
<subclause class="fontsize10" id="y75e88e5c-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>financial oversight of Federal funding;”</content></subclause>

<paragraph class="indentUp0 fontsize10" id="y75e8dcb1-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>child abuse professionals instrumental to the protection of children, intervention in child abuse cases, and treatment of victims of child abuse, for the purpose of—</chapeau><subparagraph class="fontsize10" id="y75e8dcb2-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>improving the quality of such protection, intervention, and treatment; and</content></subparagraph>
<subparagraph class="fontsize10" id="y75e8dcb3-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>promoting the effective delivery of the evidence-informed Children’s Advocacy Model and the multidisciplinary response to child abuse, including best practices in programmatic evaluation and financial oversight of Federal funding.”</content></subparagraph>

<paragraph class="fontsize10" id="y75e8dcb4-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (b) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y75e903c5-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Grantee Organizations</inline>.—</heading><paragraph class="fontsize10" id="y75e903c6-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Prosecutors</inline>.—</heading><chapeau>An organization to which a grant is made for specific training and technical assistance for prosecutors under subsection (a)(1) shall be one that has—</chapeau><subparagraph class="fontsize10" id="y75e903c7-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a broad representation of attorneys who prosecute criminal cases in State courts; and</content></subparagraph>
<subparagraph class="fontsize10" id="y75e903c8-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>demonstrated experience in providing training and technical assistance for prosecutors.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y75e903c9-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Child abuse professionals</inline>.—</heading><chapeau>An organization to which a grant is made for specific training and technical assistance for child abuse professionals under subsection (a)(2) shall be one that has—</chapeau><subparagraph class="fontsize10" id="y75e903ca-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a diverse portfolio of training and technical resources for the diverse professionals responding to child abuse, including a digital library to promote evidence-informed practice; and</content></subparagraph>
<subparagraph class="fontsize10" id="y75e903cb-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>demonstrated experience in providing training and technical assistance for child abuse professionals, especially law enforcement officers, child protective service workers, prosecutors, forensic interviewers, medical professionals, victim advocates, and mental health professionals.”</content></subparagraph>
</paragraph>
</subsection>

<paragraph class="fontsize10" id="y75e903cc-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (c)(2), by <amendingAction type="insert">inserting</amendingAction> after “<quotedText>shall require</quotedText>” the following: “<quotedText>, in the case of a grant made under subsection (a)(1),</quotedText>”.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y75e903cd-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/f" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><chapeau>Section 214B of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20306">34 U.S.C. 20306</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y75e903ce-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s2/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>sections 213 and 214</quotedText>” and all that follows and <amendingAction type="insert">inserting</amendingAction> the following: “<quotedText>sections 213 and 214, $16,000,000 for each of fiscal years 2019 through 2023.</quotedText>”; and</content></paragraph>

<paragraph class="fontsize10" id="y75e951f6-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>describes—</chapeau><subparagraph class="fontsize10" id="y75e951f7-e82e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the method by which amounts are allocated to grantees and subgrantees under this subtitle, including to local children’s advocacy centers, State chapters, and regional children’s advocacy program centers; and</content></subparagraph>

pursuant to a good faith report of child abuse or neglect shall not be subject to civil liability or criminal prosecution, under any Federal law, rising from making such report or providing such information or assistance.</content></paragraph>
<paragraph class="fontsize10" id="y75e9a025-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Presumption of good faith</inline>.—</heading><content>In a Federal civil action or criminal prosecution brought against a person based on the person’s reporting a suspected or known instance of child abuse or neglect, or providing information or assistance with respect to such a report, as described in paragraph (1), there shall be a presumption that the person acted in good faith.</content></paragraph>
<paragraph class="fontsize10" id="y75e9a026-e82e-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/424/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Costs</inline>.—</heading><content>If the defendant prevails in a Federal civil action described in paragraph (2), the court may award costs and reasonable attorney’s fees incurred by the defendant.</content></paragraph>
