<section id="d253101e102" identifier="/us/pl/115/423/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">National Integrated Drought Information System Reauthorization Act of 2018</shortTitle>”.</content></section>
<section id="d253101e112" identifier="/us/pl/115/423/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>NATIONAL INTEGRATED DROUGHT INFORMATION SYSTEM PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y84bb924e-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 3 of the National Integrated Drought Information System Act of 2006 (<ref href="/us/usc/t15/s313d">15 U.S.C. 313d</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y84bb924f-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y84bb9250-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (1)(A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>in order to make usable, reliable, and timely forecasts of drought, including</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>, including precipitation, soil moisture, and evaporative demand, in order to make usable, reliable, and timely forecasts of drought and</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y84bb9251-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (3), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>watershed,</quotedText>” after “<quotedText>regional,</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y84bb9252-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>in paragraph (4)—</chapeau><clause class="fontsize10" id="y84bb9253-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, through interagency agreements</quotedText>” after “<quotedText>integrate</quotedText>”; and</content></clause>
<clause class="fontsize10" id="y84bb9254-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>information</quotedText>” after “<quotedText>warning</quotedText>”;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y84bb9255-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (5) to read as follows:<quotedContent><paragraph class="indentDown1 fontsize10" id="y84bb9256-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>utilize existing forecasting and assessment programs and partnerships, including forecast communication coordinators and cooperative institutes, and improvements in seasonal precipitation and temperature, subseasonal precipitation and temperature, and low flow water prediction; and”</content></paragraph>

<subparagraph class="fontsize10" id="y84bb9257-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>in paragraph (6), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>the prediction,</quotedText>” after “<quotedText>relating to</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y84bb9258-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (c) through (e) as subsections (d) through (f), respectively;</content></paragraph>
<paragraph class="fontsize10" id="y84bb9259-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (b) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y84bbb96a-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Partnerships</inline>.—</heading><chapeau>The National Integrated Drought Information System may—</chapeau><paragraph class="fontsize10" id="y84bbb96b-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>engage with the private sector to improve drought monitoring, forecast, and communication if the Under Secretary determines the partnership is appropriate, cost-effective, and beneficial to the public and decisionmakers described in subsection (b)(2)(A);<page identifier="/us/stat/132/5455">132 STAT. 5455</page></content></paragraph>
<paragraph class="fontsize10" id="y84bbb96c-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>facilitate the development of 1 or more academic cooperative partnerships to assist with National Integrated Drought Information System functions; and</content></paragraph>
<paragraph class="fontsize10" id="y84bbb96d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>utilize and support, as appropriate, monitoring by citizen scientists, including by developing best practices to facilitate maximum data integration.”</content></paragraph>

<paragraph class="fontsize10" id="y84bbb96e-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in subsection (d), as redesignated, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and sustainment</quotedText>” after “<quotedText>development</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y84bbb96f-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (f), as redesignated, and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y84bbb970-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84bbb971-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x84bbb972-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Strategy.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Soil Moisture</inline>.—</heading><content>Not later than 1 year after the date of enactment of the National Integrated Drought Information System Reauthorization Act of 2018, the Under Secretary, acting through the National Integrated Drought Information System, shall develop a strategy for a national coordinated soil moisture monitoring network.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y84bbb973-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>Section 4 of the National Integrated Drought Information System Act of 2006 (<ref href="/us/usc/t15/s313d">15 U.S.C. 313d note</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="y84bbe084-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658141"><num class="fontsize12" value="4">“SEC. 4. </num><heading class="fontsize12">AUTHORIZATION OF APPROPRIATIONS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “There are authorized to be appropriated to carry out this Act—</chapeau><paragraph class="fontsize10" id="y84bbe085-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>$13,500,000 for fiscal year 2019;</content></paragraph>
<paragraph class="fontsize10" id="y84bbe086-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>$13,750,000 for fiscal year 2020;</content></paragraph>
<paragraph class="fontsize10" id="y84bbe087-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>$14,000,000 for fiscal year 2021;</content></paragraph>
<paragraph class="fontsize10" id="y84bbe088-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>$14,250,000 for fiscal year 2022; and</content></paragraph>
<paragraph class="fontsize10" id="y84bbe089-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>$14,500,000 for fiscal year 2023.”</content></paragraph>

<section id="d253101e344" identifier="/us/pl/115/423/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REAUTHORIZATION OF TITLE II OF THE WEATHER RESEARCH AND FORECASTING INNOVATION ACT OF 2017.</heading><subsection class="firstIndent0 fontsize10" id="y84bc2eaa-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Reauthorization of Title II of the Weather Research and Forecasting Innovation Act of 2017</inline>.—</heading><chapeau>Section 1762 of the Food Security Act of 1985 (<ref href="/us/usc/t15/s8521">15 U.S.C. 8521</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y84bc2eab-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="amend">amending</amendingAction> subsection (j) to read as follows:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y84bc55bc-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="j">“(j) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><chapeau>There are authorized to be appropriated to carry out the activities under this section—</chapeau><paragraph class="fontsize10" id="y84bc55bd-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>$26,500,000 for fiscal year 2019;</content></paragraph>
<paragraph class="fontsize10" id="y84bc55be-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>$27,000,000 for fiscal year 2020;</content></paragraph>
<paragraph class="fontsize10" id="y84bc55bf-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>$27,500,000 for fiscal year 2021;</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y84bc55c4-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">United States Weather Research and Forecasting Improvement</inline>.—</heading><content>Section 110 of the Weather Research and Forecasting Innovation Act of 2017 (<ref href="/us/usc/t15/s8519">15 U.S.C. 8519</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="y84bcc9f5-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="110">“SEC. 110. </num><heading class="fontsize12">AUTHORIZATION OF APPROPRIATIONS.</heading><subsection class="firstIndent0 fontsize10" id="y84bcc9f6-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>There are authorized to be appropriated to the Office of Oceanic and Atmospheric Research to carry out this title—</chapeau><paragraph class="fontsize10" id="y84bcc9f7-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>$136,516,000 for fiscal year 2019, of which—</chapeau><subparagraph class="fontsize10" id="y84bcc9f8-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>$85,758,000 is authorized for weather laboratories and cooperative institutes;<page identifier="/us/stat/132/5456">132 STAT. 5456</page></content></subparagraph>
<subparagraph class="fontsize10" id="y84bcc9f9-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>$30,758,000 is authorized for weather and air chemistry research programs; and</content></subparagraph>
<subparagraph class="fontsize10" id="y84bcc9fa-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>$20,000,000 is authorized for the joint technology transfer initiative described in section 102(b)(4);</content></subparagraph>

<paragraph class="fontsize10" id="y84bcc9fb-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>$148,154,000 for fiscal year 2020, of which—</chapeau><subparagraph class="fontsize10" id="y84bcc9fc-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>$87,258,000 is authorized for weather laboratories and cooperative institutes;</content></subparagraph>
<subparagraph class="fontsize10" id="y84bcc9fd-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>$40,896,000 is authorized for weather and air chemistry research programs; and</content></subparagraph>

<paragraph class="fontsize10" id="y84be02a4-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Pilot programs</inline>.—</heading><subparagraph class="fontsize10" id="y84be02a5-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In order to more efficiently and effectively meet the mission requirements of the National Oceanic and Atmospheric Administration, the Under Secretary may create 1 or more pilot programs for assessing <page identifier="/us/stat/132/5458">132 STAT. 5458</page>
new or innovative information and technology capabilities and services.</content></subparagraph>
<subparagraph class="fontsize10" id="y84be02a6-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Program requirements</inline>.—</heading><chapeau>Any program created under paragraph (3) shall assess only those capabilities and services that—</chapeau><clause class="fontsize10" id="y84be02a7-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>meet or exceed the standards and requirements of the National Oceanic and Atmospheric Administration, including for processing speed, cybersecurity, and overall reliability; or</content></clause>

<paragraph class="fontsize10" id="y84be02ae-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>to ensure a balance between the research to operations requirements to develop the next generation of regional and global models as well as highly reliable operational models;</content></paragraph>
<paragraph class="fontsize10" id="y84be02af-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>to take advantage of advanced development concepts to, as appropriate, make next generation weather prediction models available in beta-test mode to operational forecasters, the United States weather industry, and partners in academic and Government research;</content></paragraph>

<section id="d253101e920" identifier="/us/pl/115/423/s6" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>SATELLITE ARCHITECTURE PLANNING.</heading><content class="firstIndent0 fontsize10" id="x84be77e5-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 301 of the Weather Research and Forecasting Innovation Act of 2017 (<ref href="/us/usc/t15/s8531">15 U.S.C. 8531</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y84bf3b36-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Next Generation Satellite Architecture</inline>.—</heading><paragraph class="fontsize10" id="y84bf3b37-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84bf3b38-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analysis.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Under Secretary shall analyze, test, and plan the procurement of future data sources and satellite architectures, including respective ground system elements, identified in the National Oceanic and Atmospheric Administration’s Satellite Observing System Architecture Study that—</chapeau><subparagraph class="fontsize10" id="y84bf3b39-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>lower the cost of observations used to meet the National Oceanic and Atmospheric Administration’s mission requirements;</content></subparagraph>
<subparagraph class="fontsize10" id="y84bf3b3a-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>disaggregate current satellite systems, where appropriate;</content></subparagraph>
<subparagraph class="fontsize10" id="y84bf3b3b-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>include new, value-adding technological advancements; and</content></subparagraph>
<subparagraph class="fontsize10" id="y84bf3b3c-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>improve weather forecasting and predictions.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y84bf3b3d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Quantitative assessments and partnership authority</inline>.—</heading><chapeau>In meeting the requirements described in paragraph (1), the Under Secretary—</chapeau><subparagraph class="fontsize10" id="y84bf3b3e-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>may partner with the commercial and academic sectors, non-governmental and not-for-profit organizations, and other Federal agencies; and</content></subparagraph>
<subparagraph class="fontsize10" id="y84bf3b3f-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84bf3b40-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analyses.</p></sidenote><content>shall, consistent with section 107 of this Act, undertake quantitative assessments for objective analyses, as the Under Secretary considers appropriate, to evaluate relative value and benefits of future data sources and satellite architectures described in paragraph (1).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y84bf3b41-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84bf3b42-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional Forms of Transaction Authorized</inline>.—</heading><paragraph class="fontsize10" id="y84bf3b43-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to paragraph (2), in order to enhance the effectiveness of data and satellite systems used by the National Oceanic and Atmospheric Administration to meet its missions, the Under Secretary may enter into and perform such transaction agreements on such terms as the Under Secretary considers appropriate to carry out basic, applied, and advanced research projects to meet the objectives described in subparagraphs (A) through (D) subsection (c)(1).</content></paragraph>
<paragraph class="fontsize10" id="y84bf3b44-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Method and scope</inline>.—</heading><subparagraph class="fontsize10" id="y84bf6255-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A transaction agreement under paragraph (1) shall be limited to research and development activities.</content></subparagraph>
<subparagraph class="fontsize10" id="y84bf6256-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Permissible uses</inline>.—</heading><chapeau>A transaction agreement under paragraph (1) may be used—</chapeau><clause class="fontsize10" id="y84bf6257-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>for the construction, use, operation, or procurement of new, improved, innovative, or value-adding satellites, instrumentation, ground stations, and data;</content></clause>
<clause class="fontsize10" id="y84bf6258-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to make determinations on how to best use existing or planned data, systems, and assets of the National Oceanic and Atmospheric Administration; and</content></clause>
<clause class="fontsize10" id="y84bf6259-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>only when the objectives of the National Oceanic and Atmospheric Administration cannot be met using a cooperative research and development agreement, grants procurement contract, or cooperative agreement.<page identifier="/us/stat/132/5460">132 STAT. 5460</page></content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y84bf625a-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Termination of effectiveness</inline>.—</heading><content>The authority provided in this subsection terminates effective September 30, 2023.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y84bf625b-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Transparency</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84bf625c-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x84bf625d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="x84bf625e-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p><p class="leftAlign firstIndent0 fontsize8" id="x84bf625f-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Estimate.</p></sidenote>.—</heading><content>Not later than 60 days after the date that a transaction agreement is made under subsection (d), the Under Secretary shall make publicly available, in a searchable format, on the website of the National Oceanic and Atmospheric Administration all uses of the authority under subsection (d), including an estimate of committed National Oceanic and Atmospheric Administration resources and the expected benefits to National Oceanic and Atmospheric Administration objectives for the transaction agreement, with appropriate redactions for proprietary, sensitive, or classified information.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y84bf6260-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="y84bf6261-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 90 days after September 30 of each fiscal year through September 30, 2023, the Under Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report on the use of additional transaction authority by the National Oceanic and Atmospheric Administration during the previous fiscal year.</content></paragraph>
<paragraph class="fontsize10" id="y84bf6262-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Each report shall include—</chapeau><subparagraph class="fontsize10" id="y84bf6263-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>for each transaction agreement in effect during the fiscal year covered by the report—</chapeau><clause class="fontsize10" id="y84bf6264-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>an indication of whether the transaction agreement is a reimbursable, non-reimbursable, or funded agreement;</content></clause>
<clause class="fontsize10" id="y84bf6265-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>a description of—</chapeau><subclause class="fontsize10" id="y84bf6266-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the subject and terms;</content></subclause>
<subclause class="fontsize10" id="y84bf6267-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the parties;</content></subclause>
<subclause class="fontsize10" id="y84bf6268-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>the responsible National Oceanic and Atmospheric Administration line office;</content></subclause>
<subclause class="fontsize10" id="y84bf6269-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>the value;</content></subclause>
<subclause class="fontsize10" id="y84bf626a-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>the extent of the cost sharing among Federal Government and non-Federal sources;</content></subclause>
<subclause class="fontsize10" id="y84bf626b-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">“(VI) </num><content>the duration or schedule; and</content></subclause>
<subclause class="fontsize10" id="y84bf626c-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VII">“(VII) </num><content>all milestones;</content></subclause>
</clause>
<clause class="fontsize10" id="y84bf626d-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>an indication of whether the transaction agreement was renewed during the previous fiscal year;</content></clause>
<clause class="fontsize10" id="y84bf626e-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>the technology areas in which research projects were conducted under that agreement;</content></clause>
<clause class="fontsize10" id="y84bf626f-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><chapeau>the extent to which the use of that agreement—</chapeau><subclause class="fontsize10" id="y84bf6270-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>has contributed to a broadening of the technology and industrial base available for meeting National Oceanic and Atmospheric Administration needs; and</content></subclause>
<subclause class="fontsize10" id="y84bf6271-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>has fostered within the technology and industrial base new relationships and practices that support the United States; and</content></subclause>
</clause>
<clause class="fontsize10" id="y84bf6272-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>the total value received by the Federal Government under that agreement for that fiscal year; and<page identifier="/us/stat/132/5461">132 STAT. 5461</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y84bf6273-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84bf6274-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">List.</p></sidenote><content>a list of all anticipated reimbursable, non-reimbursable, and funded transaction agreements for the upcoming fiscal year.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y84bf6275-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this section may be construed as limiting the authority of the National Oceanic and Atmospheric Administration to use cooperative research and development agreements, grants, procurement contracts, or cooperative agreements.”</content></subsection>

<subparagraph class="fontsize10" id="y84bffec2-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s8/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>States and regions where observations provided through the Program are scarce;</content></subparagraph>

<paragraph class="fontsize10" id="y84bffec3-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s8/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>working with State weather service headquarters to increase participation in the Program and to add stations in States and regions described in paragraph (1)(B);</content></paragraph>
<paragraph class="fontsize10" id="y84bffec4-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s8/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>where feasible, ensuring that data streams from stations that have been contributing data to the Program for more than 50 years are maintained and continually staffed by volunteers;</content></paragraph>
<paragraph class="fontsize10" id="y84bffec5-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s8/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>prioritizing the recruitment of new volunteers for the Program;</content></paragraph>
<paragraph class="fontsize10" id="y84bffec6-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s8/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>ensuring that opportunities exist for automated reporting to lessen the burden on volunteers to collect and report data by hand; and</content></paragraph>
<paragraph class="fontsize10" id="y84bffec7-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s8/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>ensuring that integrated reporting is available for qualitative observations that cannot be automated, such as drought conditions, snow observations, and hazardous weather events, to ensure that volunteers in the Program can report and upload observations quickly and easily.<page identifier="/us/stat/132/5462">132 STAT. 5462</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y84bffec8-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Coordination With States and Regions</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84bffec9-e82e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote>.—</heading><content>Not less frequently than every 180 days, the National Weather Service shall coordinate with State and regional offices with respect to the status of Cooperative Observer Program stations.</content></subsection>

<subparagraph class="fontsize10" id="y84c1aca5-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Donations</inline>.—</heading><content>Notwithstanding any other provision of law, an appropriate Federal official may accept donations of funds, services, facilities, materials, or equipment that the appropriate Federal official considers necessary for the purposes described in subparagraph (A). Any funds donated to an appropriate Federal official under this paragraph may be expended without further appropriation and without fiscal year limitation.</content></subparagraph>

<subparagraph class="fontsize10" id="y84c1aca8-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><content>In making a determination under subparagraph (A), the appropriate Federal official shall consider the toxicity of the harmful algal bloom, the severity of the hypoxia, its potential to spread, the economic impact, the relative size in relation to the past 5 occurrences of harmful algal blooms or hypoxia events that occur on a recurrent or annual basis, and the geographic scope, including the potential to affect several municipalities, to affect more than 1 State, or to cross an international boundary.</content></subparagraph>

<paragraph class="fontsize10" id="y84c1aca9-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="y84c1acaa-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/3/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate federal official</inline>.—</heading><chapeau>The term “<term>appropriate Federal official</term>” means—</chapeau><clause class="fontsize10" id="y84c1acab-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in the case of a marine or coastal hypoxia or harmful algal bloom event, the Under Secretary of Commerce for Oceans and Atmosphere; and</content></clause>
<clause class="fontsize10" id="y84c1acac-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in the case of a freshwater hypoxia or harmful algal bloom event, the Administrator of the Environmental Protection Agency.</content></clause>

<subparagraph class="fontsize10" id="y84c1acad-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/3/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Event of national significance</inline>.—</heading><content>The term “<term>event of national significance</term>” means a hypoxia or harmful algal bloom event that has had or will likely have a significant detrimental environmental, economic, subsistence use, or public health impact on an affected State.</content></subparagraph>
<subparagraph class="fontsize10" id="y84c1acae-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/g/3/C" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Hypoxia or harmful algal bloom event</inline>.—</heading><content>The term “<term>hypoxia or harmful algal bloom event</term>” means the occurrence of hypoxia or a harmful algal bloom as a result of a natural, anthropogenic, or undetermined cause.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y84c1acaf-e82e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/423/s9/h" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>Section 609(a) (<ref href="/us/usc/t33/s4009/a">33 U.S.C. 4009(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, and $20,500,000 for each of fiscal years 2019 through 2023</quotedText>” before the period at the end.</content></subsection>
