<section id="d138281e113" identifier="/us/pl/115/408/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">State Offices of Rural Health Reauthorization Act of 2018</shortTitle>”.</content></section>
<section id="d138281e123" identifier="/us/pl/115/408/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>STATE OFFICES OF RURAL HEALTH.</heading><content class="firstIndent0 fontsize10" id="x532361e2-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 338J of the Public Health Service Act (<ref href="/us/usc/t42/s254r">42 U.S.C. 254r</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="indentUp2 firstIndent-2" id="y53242533-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="338J">“SEC. 338J. </num><heading class="bold">GRANTS TO STATE OFFICES OF RURAL HEALTH.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y53242534-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary, acting through the Director of the Federal Office of Rural Health Policy (established under section 711 of the Social Security Act), shall make grants to each State Office of Rural Health for the purpose of improving health care in rural areas.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y53242535-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Requirement of Matching Funds</inline>.—</heading><paragraph class="fontsize10" id="y53242536-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to paragraph (2), the Secretary may not make a grant under subsection (a) unless the State office of rural health involved agrees, with respect to the costs to be incurred in carrying out the purpose described in such subsection, to provide non-Federal contributions toward such costs in an amount equal to $3 for each $1 of Federal funds provided in the grant.</content></paragraph>
<paragraph class="fontsize10" id="y53242537-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x53242538-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Waiver or reduction</inline>.—</heading><content>The Secretary may waive or reduce the non-Federal contribution if the Secretary determines that requiring matching funds would limit the State office of rural health’s ability to carry out the purpose described in subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y53242539-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Determination of amount of non-federal contribution</inline>.—</heading><content>Non-Federal contributions required in paragraph (1) may be in cash or in kind, fairly evaluated, including plant, equipment, or services. Amounts provided by the Federal Government, or services assisted or subsidized to any significant extent by the Federal Government, may not be included in determining the amount of such non-Federal contributions.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y5324253a-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Certain Required Activities</inline>.—</heading><chapeau>Recipients of a grant under subsection (a) shall use the grant funds for purposes of—</chapeau><paragraph class="fontsize10" id="y5324253b-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>maintaining within the State office of rural health a clearinghouse for collecting and disseminating information on—<page identifier="/us/stat/132/5385">132 STAT. 5385</page></chapeau><subparagraph class="fontsize10" id="y5324253c-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>rural health care issues;</content></subparagraph>
<subparagraph class="fontsize10" id="y5324253d-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>research findings relating to rural health care; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5324253e-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>innovative approaches to the delivery of health care in rural areas;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5324253f-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>coordinating the activities carried out in the State that relate to rural health care, including providing coordination for the purpose of avoiding redundancy in such activities; and</content></paragraph>
<paragraph class="fontsize10" id="y53242540-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>identifying Federal and State programs regarding rural health, and providing technical assistance to public and nonprofit private entities regarding participation in such programs.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y53242541-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Requirement Regarding Annual Budget for Office</inline>.—</heading><content>The Secretary may not make a grant under subsection (a) unless the State involved agrees that, for any fiscal year for which the State office of rural health receives such a grant, the office operated pursuant to subsection (a) of this section will be provided with an annual budget of not less than $150,000.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y53242542-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Certain Uses of Funds</inline>.—</heading><paragraph class="fontsize10" id="y53242543-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Restrictions</inline>.—</heading><chapeau>The Secretary may not make a grant under subsection (a) unless the State office of rural health involved agrees that the grant will not be expended—</chapeau><subparagraph class="fontsize10" id="y53242544-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to provide health care (including providing cash payments regarding such care);</content></subparagraph>
<subparagraph class="fontsize10" id="y53242545-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>to conduct activities for which Federal funds are expended—</chapeau><clause class="fontsize10" id="y53242546-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>within the State to provide technical and other nonfinancial assistance under section 330A(f);</content></clause>
<clause class="fontsize10" id="y53242547-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>under a memorandum of agreement entered into with the State office of rural health under section 330A(h); or</content></clause>
<clause class="fontsize10" id="y53242548-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>under a grant under section 338I;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y53242549-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>to purchase medical equipment, to purchase ambulances, aircraft, or other vehicles, or to purchase major communications equipment;</content></subparagraph>
<subparagraph class="fontsize10" id="y53244c5a-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>to purchase or improve real property; or</content></subparagraph>
<subparagraph class="fontsize10" id="y53244c5b-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>to carry out any activity regarding a certificate of need.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y53244c5c-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Authorities</inline>.—</heading><chapeau>Activities for which a State office of rural health may expend a grant under subsection (a) include—</chapeau><subparagraph class="fontsize10" id="y53244c5d-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>paying the costs of maintaining an office of rural health for purposes of subsection (a);</content></subparagraph>
<subparagraph class="fontsize10" id="y53244c5e-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>subject to paragraph (1)(B)(iii), paying the costs of any activity carried out with respect to recruiting and retaining health professionals to serve in rural areas of the State; and</content></subparagraph>
<subparagraph class="fontsize10" id="y53244c5f-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>providing grants and contracts to public and nonprofit private entities to carry out activities authorized in this section.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y53244c60-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Limit on indirect costs</inline>.—</heading><content>The Secretary may impose a limit of no more than 15 percent on indirect costs claimed by the recipient of the grant.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y53244c61-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><chapeau>The Secretary may not make a grant under subsection (a) unless the State office of rural health involved agrees—</chapeau><paragraph class="fontsize10" id="y53244c62-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>to submit to the Secretary reports or performance data containing such information as the Secretary may require regarding activities carried out under this section; and<page identifier="/us/stat/132/5386">132 STAT. 5386</page></content></paragraph>
<paragraph class="fontsize10" id="y53244c63-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>to submit such a report or performance data not later than September 30 of each fiscal year immediately following any fiscal year for which the State office of rural health has received such a grant.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y53244c64-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Requirement of Application</inline>.—</heading><content>The Secretary may not make a grant under subsection (a) unless an application for the grant is submitted to the Secretary and the application is in such form, is made in such manner, and contains such agreements, assurances, and information as the Secretary determines to be necessary to carry out such subsection.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y53244c65-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x53244c66-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Noncompliance</inline>.—</heading><content>The Secretary may not make payments under subsection (a) to a State office of rural health for any fiscal year subsequent to the first fiscal year of such payments unless the Secretary determines that, for the immediately preceding fiscal year, the State office of rural health has complied with each of the agreements made by the State office of rural health under this section.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y53244c67-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><paragraph class="fontsize10" id="y53244c68-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>For the purpose of making grants under subsection (a), there are authorized to be appropriated $12,500,000 for each of fiscal years 2018 through 2022.</content></paragraph>
<paragraph class="fontsize10" id="y53244c69-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Availability</inline>.—</heading><content>Amounts appropriated under paragraph (1) shall remain available until expended.”</content></paragraph>
