<section id="d138394e98" identifier="/us/pl/115/406/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62c80d5f-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s201">42 USC 201 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Building Our Largest Dementia Infrastructure for Alzheimer’s Act</shortTitle>” or the “<shortTitle role="act">BOLD Infrastructure for Alzheimer’s Act</shortTitle>”.</content></section>
<section id="d138394e116" identifier="/us/pl/115/406/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROMOTION OF PUBLIC HEALTH KNOWLEDGE AND AWARENESS OF ALZHEIMER’S DISEASE, COGNITIVE DECLINE, AND BRAIN HEALTH UNDER THE ALZHEIMER’S DISEASE AND HEALTHY AGING PROGRAM.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x62c8a9a0-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Part K of title III of the Public Health Service Act (<ref href="/us/usc/t42/s280c/etseq">42 U.S.C. 280c et seq.</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y62c8a9a1-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the part heading, by <amendingAction type="add">adding</amendingAction> “<quotedText>and public health programs for dementia</quotedText>” at the end; and</content></paragraph>
<paragraph class="fontsize10" id="y62c8a9a2-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subpart II—</chapeau><subparagraph class="fontsize10" id="y62c8a9a3-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> the subpart heading and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subpart id="y62c8a9a4-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658173"><num class="fontsize12 bold" value="II">“Subpart II—</num><heading class="fontsize12 bold">Programs With Respect to Alzheimer’s Disease and Related Dementias”</heading></subpart>

<subparagraph class="fontsize10" id="y62c8a9a5-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> section 398A (<ref href="/us/usc/t42/s280c–4">42 U.S.C. 280c–4</ref>) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="indentUp0 firstIndent-2" id="y62c99406-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="398A">“SEC. 398A. </num><heading class="bold">PROMOTION OF PUBLIC HEALTH KNOWLEDGE AND AWARENESS OF ALZHEIMER’S DISEASE AND RELATED DEMENTIAS.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y62c99407-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Alzheimer’s Disease and Related Dementias Public Health Centers of Excellence</inline>.—</heading><paragraph class="fontsize10" id="y62c99408-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62c99409-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p><p class="leftAlign firstIndent0 fontsize8" id="x62c9940a-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Grants.</p><p class="leftAlign firstIndent0 fontsize8" id="x62c9940b-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote>.—</heading><chapeau>The Secretary, in coordination with the Director of the Centers for Disease Control and Prevention and the heads of other agencies as appropriate, shall award grants, contracts, or cooperative agreements to eligible entities, such as institutions of higher education, State, tribal, and local health departments, Indian tribes, tribal organizations, associations, or other appropriate entities for the establishment or support of regional centers to address Alzheimer’s disease and related dementias by—</chapeau><page identifier="/us/stat/132/5363">132 STAT. 5363</page>
<subparagraph class="fontsize10" id="y62c9940c-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>advancing the awareness of public health officials, health care professionals, and the public, on the most current information and research related to Alzheimer’s disease and related dementias, including cognitive decline, brain health, and associated health disparities;</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb1d-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>identifying and translating promising research findings, such as findings from research and activities conducted or supported by the National Institutes of Health, including Alzheimer’s Disease Research Centers authorized by section 445, into evidence-based programmatic interventions for populations with Alzheimer’s disease and related dementias and caregivers for such populations; and</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb1e-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>expanding activities, including through public-private partnerships related to Alzheimer’s disease and related dementias and associated health disparities.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y62c9bb1f-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62c9bb20-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Application.</p></sidenote>.—</heading><chapeau>To be eligible to receive a grant, contract, or cooperative agreement under this subsection, an entity shall submit to the Secretary an application containing such agreements and information as the Secretary may require, including a description of how the entity will—</chapeau><subparagraph class="fontsize10" id="y62c9bb21-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>coordinate, as applicable, with existing Federal, State, and tribal programs related to Alzheimer’s disease and related dementias;</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb22-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>examine, evaluate, and promote evidence-based interventions for individuals with Alzheimer’s disease and related dementias, including underserved populations with such conditions, and those who provide care for such individuals; and</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb23-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>prioritize activities relating to—</chapeau><clause class="fontsize10" id="y62c9bb24-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>expanding efforts, as appropriate, to implement evidence-based practices to address Alzheimer’s disease and related dementias, including through the training of State, local, and tribal public health officials and other health professionals on such practices;</content></clause>
<clause class="fontsize10" id="y62c9bb25-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>supporting early detection and diagnosis of Alzheimer’s disease and related dementias;</content></clause>
<clause class="fontsize10" id="y62c9bb26-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>reducing the risk of potentially avoidable hospitalizations of individuals with Alzheimer’s disease and related dementias;</content></clause>
<clause class="fontsize10" id="y62c9bb27-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>reducing the risk of cognitive decline and cognitive impairment associated with Alzheimer’s disease and related dementias;</content></clause>
<clause class="fontsize10" id="y62c9bb28-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>enhancing support to meet the needs of caregivers of individuals with Alzheimer’s disease and related dementias;</content></clause>
<clause class="fontsize10" id="y62c9bb29-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>reducing health disparities related to the care and support of individuals with Alzheimer’s disease and related dementias;</content></clause>
<clause class="fontsize10" id="y62c9bb2a-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>supporting care planning and management for individuals with Alzheimer’s disease and related dementias; and</content></clause>
<clause class="fontsize10" id="y62c9bb2b-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">“(viii) </num><content>supporting other relevant activities identified by the Secretary or the Director of the Centers for Disease Control and Prevention, as appropriate.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y62c9bb2c-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><chapeau>In awarding grants, contracts, and cooperative agreements under this subsection, the Secretary shall consider, among other factors, whether the entity—<page identifier="/us/stat/132/5364">132 STAT. 5364</page></chapeau><subparagraph class="fontsize10" id="y62c9bb2d-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>provides services to rural areas or other underserved populations;</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb2e-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is able to build on an existing infrastructure of services and public health research; and</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb2f-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>has experience with providing care or caregiver support, or has experience conducting research related to Alzheimer’s disease and related dementias.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y62c9bb30-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Distribution of awards</inline>.—</heading><content>In awarding grants, contracts, or cooperative agreements under this subsection, the Secretary, to the extent practicable, shall ensure equitable distribution of awards based on geographic area, including consideration of rural areas, and the burden of the disease within sub-populations.</content></paragraph>
<paragraph class="fontsize10" id="y62c9bb31-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Data reporting and program oversight</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62c9bb32-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>.—</heading><chapeau>With respect to a grant, contract, or cooperative agreement awarded under this subsection, not later than 90 days after the end of the first year of the period of assistance, and annually thereafter for the duration of the grant, contract, or agreement (including the duration of any renewal period as provided for under paragraph (5)), the entity shall submit data, as appropriate, to the Secretary regarding—</chapeau><subparagraph class="fontsize10" id="y62c9bb33-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the programs and activities funded under the grant, contract, or agreement; and</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb34-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>outcomes related to such programs and activities.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y62c9bb35-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Improving Data on State and National Prevalence of Alzheimer’s Disease and Related Dementias</inline>.—</heading><paragraph class="fontsize10" id="y62c9bb36-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62c9bb37-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote>.—</heading><content>The Secretary shall, as appropriate, improve the analysis and timely reporting of data on the incidence and prevalence of Alzheimer’s disease and related dementias. Such data may include, as appropriate, information on cognitive decline, caregiving, and health disparities experienced by individuals with cognitive decline and their caregivers. The Secretary may award grants, contracts, or cooperative agreements to eligible entities for activities under this paragraph.</content></paragraph>
<paragraph class="fontsize10" id="y62c9bb38-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62c9bb39-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Application.</p></sidenote>.—</heading><content>To be eligible to receive a grant, contract, or cooperative agreement under this subsection, an entity shall be a public or nonprofit private entity, including institutions of higher education, State, local, and tribal health departments, and Indian tribes and tribal organizations, and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</content></paragraph>
<paragraph class="fontsize10" id="y62c9bb3a-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Data sources</inline>.—</heading><chapeau>The analysis, timely public reporting, and dissemination of data under this subsection may be carried out using data sources such as the following:</chapeau><subparagraph class="fontsize10" id="y62c9bb3b-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The Behavioral Risk Factor Surveillance System.</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb3c-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The National Health and Nutrition Examination Survey.</content></subparagraph>
<subparagraph class="fontsize10" id="y62c9bb3d-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>The National Health Interview Survey.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y62c9bb3e-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Improved Coordination</inline>.—</heading><content>The Secretary shall ensure that activities and programs related to dementia under this section do not unnecessarily duplicate activities and programs of other agencies and offices within the Department of Health and Human Services.”</content></subsection>

<section id="d138394e421" identifier="/us/pl/115/406/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>SUPPORTING STATE PUBLIC HEALTH PROGRAMS RELATED TO ALZHEIMER’S DISEASE AND RELATED DEMENTIAS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x62ca577f-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 398 of the Public Health Service Act (<ref href="/us/usc/t42/s280c–3">42 U.S.C. 280c–3</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y62ca5780-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the section heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText>establishment of program</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>cooperative agreements to states and public health departments for alzheimer’s disease and related dementias</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y62ca5781-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (a) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y62ca7e92-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62ca7e93-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote>.—</heading><chapeau>The Secretary, in coordination with the Director of the Centers for Disease Control and Prevention and the heads of other agencies, as appropriate, shall award cooperative agreements to health departments of States, political subdivisions of States, and Indian tribes and tribal organizations, to address Alzheimer’s disease and related dementias, including by reducing cognitive decline, helping meet the needs of caregivers, and addressing unique aspects of Alzheimer’s disease and related dementias to support the development and implementation of evidence-based interventions with respect to—</chapeau><paragraph class="fontsize10" id="y62ca7e94-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>educating and informing the public, based on evidence-based public health research and data, about Alzheimer’s disease and related dementias;</content></paragraph>
<paragraph class="fontsize10" id="y62ca7e95-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>supporting early detection and diagnosis;</content></paragraph>
<paragraph class="fontsize10" id="y62ca7e96-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>reducing the risk of potentially avoidable hospitalizations for individuals with Alzheimer’s disease and related dementias;</content></paragraph>
<paragraph class="fontsize10" id="y62ca7e97-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>reducing the risk of cognitive decline and cognitive impairment associated with Alzheimer’s disease and related dementias;</content></paragraph>
<paragraph class="fontsize10" id="y62ca7e98-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>improving support to meet the needs of caregivers of individuals with Alzheimer’s disease and related dementias;</content></paragraph>
<paragraph class="fontsize10" id="y62ca7e99-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>supporting care planning and management for individuals with Alzheimer’s disease and related dementias.</content></paragraph>
<paragraph class="fontsize10" id="y62ca7e9a-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>supporting other relevant activities identified by the Secretary or the Director of the Centers for Disease Control and Prevention, as appropriate”</content></paragraph>
</subsection>

<paragraph class="fontsize10" id="y62ca7e9c-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s3/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (c) as subsection (g);</content></paragraph>
<paragraph class="fontsize10" id="y62ca7e9d-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s3/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (a), the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y62caccbe-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Preference</inline>.—</heading><content>In awarding cooperative agreements under this section, the Secretary shall give preference to applications that focus on addressing health disparities, including populations and geographic areas that have the highest prevalence of Alzheimer’s disease and related dementias.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y62caccbf-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62caccc0-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Application.</p><p class="leftAlign firstIndent0 fontsize8" id="x62caccc1-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Plan.</p></sidenote>.—</heading><chapeau>To be eligible to receive a cooperative agreement under this section, an eligible entity (pursuant to subsection (a)) shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a plan that describes—</chapeau><paragraph class="fontsize10" id="y62caccc2-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>how the applicant proposes to develop or expand, programs to educate individuals through partnership engagement, workforce development, guidance and support for programmatic efforts, and evaluation with respect to Alzheimer’s disease and related dementias, and in the case of a cooperative agreement under this section, how the applicant proposes to support other relevant activities identified by the Secretary or Director of the Centers for Disease Control and Prevention, as appropriate.<page identifier="/us/stat/132/5366">132 STAT. 5366</page></content></paragraph>
<paragraph class="fontsize10" id="y62caccc3-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the manner in which the applicant will coordinate with Federal, tribal, and State programs related to Alzheimer’s disease and related dementias, and appropriate State, tribal, and local agencies, as well as other relevant public and private organizations or agencies; and</content></paragraph>
<paragraph class="fontsize10" id="y62caccc4-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the manner in which the applicant will evaluate the effectiveness of any program carried out under the cooperative agreement.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y62caccc5-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Matching Requirement</inline>.—</heading><content>Each health department that is awarded a cooperative agreement under subsection (a) shall provide, from non-Federal sources, an amount equal to 30 percent of the amount provided under such agreement (which may be provided in cash or in-kind) to carry out the activities supported by the cooperative agreement.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y62caccc6-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Waiver Authority</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62caccc7-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>.—</heading><content>The Secretary may waive all or part of the matching requirement described in subsection (d) for any fiscal year for a health department of a State, political subdivision of a State, or Indian tribe and tribal organization (including those located in a rural area or frontier area), if the Secretary determines that applying such matching requirement would result in serious hardship or an inability to carry out the purposes of the cooperative agreement awarded to such health department of a State, political subdivision of a State, or Indian tribe and tribal organization.”</content></subsection>

<paragraph class="fontsize10" id="y62caccc8-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s3/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>in subsection (f) (as so redesignated), by <amendingAction type="delete">striking</amendingAction> “<quotedText>grant</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>cooperative agreement</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y62caccc9-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s3/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y62caccca-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Non-duplication of Effort</inline>.—</heading><chapeau>The Secretary shall ensure that activities under any cooperative agreement awarded under this subpart do not unnecessarily duplicate efforts of other agencies and offices within the Department of Health and Human Services related to—</chapeau><paragraph class="fontsize10" id="y62cacccb-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>activities of centers of excellence with respect to Alzheimer’s disease and related dementias described in section 398A; and</content></paragraph>
<paragraph class="fontsize10" id="y62caf3dc-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>activities of public health departments with respect to Alzheimer’s disease and related dementias described in this section.”</content></paragraph>

<section id="d138394e643" identifier="/us/pl/115/406/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>ADDITIONAL PROVISIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x62cb901d-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 398B of the Public Health Service Act (<ref href="/us/usc/t42/s280c–5">42 U.S.C. 280c–5</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y62cb901e-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y62cb901f-e82f-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/406/s4/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or cooperative agreement</quotedText>” after “<quotedText>grant</quotedText>” each place that such appears;</content></subparagraph>
