<section id="d255062e102" identifier="/us/pl/115/401/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Ashanti Alert Act of 2018</shortTitle>”.</content></section>
<section id="d255062e112" identifier="/us/pl/115/401/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ESTABLISHMENT OF ASHANTI ALERT COMMUNICATIONS NETWORK.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa840a0c0-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Kristen’s Act (<ref href="/us/pl/106/468">Public Law 106–468</ref>; <ref href="/us/stat/114/2027">114 Stat. 2027</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya840a0c1-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/401/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="insert">inserting</amendingAction> before section 2 (<ref href="/us/usc/t34/s40504">34 U.S.C. 40504</ref>) the following:<quotedContent><title id="ya840c7d2-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658178"><num class="fontsize14 bold" value="I">“TITLE I—</num><heading class="fontsize14 bold">GRANTS”</heading></title>
</quotedContent><b>;</b></content></paragraph>
<paragraph class="fontsize10" id="ya840c7d3-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/401/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> sections 2 (<ref href="/us/usc/t34/s40504">34 U.S.C. 40504</ref>) and 3 (<ref href="/us/usc/t34/s40504">34 U.S.C. 40504 note</ref>) as sections 101 and 102, respectively;</content></paragraph>
<paragraph class="fontsize10" id="ya840c7d4-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/401/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in section 101(b), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>this Act</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>this title</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="ya840c7d5-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/401/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in section 102, as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>this Act</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>this title</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ya840c7d6-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/401/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><title id="ya8427587-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658178"><num class="fontsize14 bold" value="II">“TITLE II—</num><heading class="fontsize14 bold">ASHANTI ALERT COMMUNICATIONS NETWORK</heading><section class="centered fontsize12" id="ya8427588-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="201">“SEC. 201. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8427589-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21901">34 USC 21901</ref>.</p></sidenote><heading class="fontsize12">DEFINITIONS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “In this title:</chapeau><paragraph class="indentUp0 fontsize10" id="ya842758a-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">AMBER alert communications network</inline>.—</heading><content>The term ‘<term>AMBER Alert communications network</term>’ means the AMBER Alert communications network established under subtitle A of title III of the PROTECT Act (<ref href="/us/usc/t34/s20501/etseq">34 U.S.C. 20501 et seq.</ref>).</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="ya842758b-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Ashanti alert</inline>.—</heading><content>The term ‘<term>Ashanti Alert</term>’ means an alert issued through the Ashanti Alert communications network, related to a missing adult.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="ya842758c-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Ashanti alert communications network</inline>.—</heading><content>The term ‘<term>Ashanti Alert communications network</term>’ means the national communications network established by the Attorney General under section 202(a).<page identifier="/us/stat/132/5337">132 STAT. 5337</page></content></paragraph>
<paragraph class="indentUp0 fontsize10" id="ya842758d-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Ashanti alert coordinator of the department of justice; coordinator</inline>.—</heading><content>The term ‘<term>Ashanti Alert Coordinator of the Department of Justice</term>’ or ‘Coordinator’ means the employee designated by the Attorney General to act as the national coordinator of the Ashanti Alert communications network under section 203(a).</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="ya842758e-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Ashanti alert plan</inline>.—</heading><content>The term ‘<term>Ashanti Alert plan</term>’ means a local element of the Ashanti Alert communications network.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="ya842758f-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe</inline>.—</heading><content>The term ‘<term>Indian Tribe</term>’ means a federally recognized Indian Tribe or a Native village, Regional Corporation, or Village Corporation (as those terms are defined in section 3 of the Alaska Native Claims Settlement Act (<ref href="/us/usc/t43/s1602">43 U.S.C. 1602</ref>)).</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="ya8427590-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Missing adult</inline>.—</heading><chapeau>The term ‘<term>missing adult</term>’ means an individual who—</chapeau><subparagraph class="fontsize10" id="ya8427591-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is older than the age for which an alert may be issued through the AMBER Alert communications network in the State or territory of an Indian Tribe in which the individual is identified as a missing individual;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8427592-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is identified by a law enforcement agency as a missing individual; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8427593-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>meets the requirements to be designated as a missing adult, as determined by the State in which, or the Indian Tribe in the territory of which, the individual is identified as a missing individual.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="ya8427594-e82f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term ‘<term>State</term>’ means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</content></paragraph>

<section class="centered fontsize12" id="ya8427595-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="202">“SEC. 202. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8427596-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Coordination.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8427597-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21902">34 USC 21902</ref>.</p></sidenote><heading class="fontsize12">ASHANTI ALERT COMMUNICATIONS NETWORK.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="ya8427598-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Attorney General shall, subject to the availability of appropriations, establish a national communications network within the Office of Justice Programs of the Department of Justice to provide assistance to regional and local search efforts for missing adults through the initiation, facilitation, and promotion of local elements of the network, in coordination with States, Indian Tribes, units of local government, law enforcement agencies, and other concerned entities with expertise in providing services to adults.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ya8427599-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Integration With Existing Communications Network</inline>.—</heading><content>In establishing the Ashanti Alert communications network under subsection (a), the Attorney General shall coordinate, when advisable, with missing person alert systems in existence as of the date of enactment of this title, such as the AMBER Alert communications network and Silver Alert communications networks.</content></subsection>
</section>
<section class="centered fontsize12" id="ya842759a-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="203">“SEC. 203. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa842759b-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21903">34 USC 21903</ref>.</p></sidenote><heading class="fontsize12">ASHANTI ALERT COORDINATOR.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="ya842759c-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">National Coordinator Within Department of Justice</inline>.—</heading><content>The Attorney General<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa842759d-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Designation.</p></sidenote> shall designate an employee of the Office of Justice Programs of the Department of Justice to act as the national coordinator of the Ashanti Alert communications network.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ya842759e-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Duties of the Coordinator</inline>.—</heading><chapeau>In acting as the national coordinator of the Ashanti Alert communications network, the Coordinator shall—<page identifier="/us/stat/132/5338">132 STAT. 5338</page></chapeau><paragraph class="fontsize10" id="ya842759f-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>work with States and Indian Tribes to encourage the development of additional Ashanti Alert plans in the network;</content></paragraph>
<paragraph class="fontsize10" id="ya84275a0-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa84275a1-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Guidelines.</p></sidenote><chapeau>establish voluntary guidelines for States and Indian Tribes to use in developing Ashanti Alert plans that will promote compatible and integrated Ashanti Alert plans throughout the United States, including—</chapeau><subparagraph class="fontsize10" id="ya84275a2-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa84275a3-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>a list of the resources necessary to establish an Ashanti Alert plan;</content></subparagraph>
<subparagraph class="fontsize10" id="ya84275a4-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa84275a5-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Criteria.</p></sidenote><chapeau>criteria for evaluating whether a situation warrants issuing an Ashanti Alert, taking into consideration the need for the use of Ashanti Alerts to be limited in scope because the effectiveness of the Ashanti Alert communications network may be affected by overuse, including criteria to determine—</chapeau><clause class="fontsize10" id="ya8429cb6-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>whether the mental capacity of an adult who is missing, and the circumstances of his or her disappearance, including any history of domestic violence, sexual assault, child abuse, or human trafficking, warrant the issuance of an Ashanti Alert; and</content></clause>
<clause class="fontsize10" id="ya8429cb7-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>whether the individual who reports that an adult is missing is an appropriate and credible source on which to base the issuance of an Ashanti Alert;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya8429cb8-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a description of the appropriate uses of the Ashanti Alert name to readily identify the nature of search efforts for missing adults; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cb9-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cba-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa8429cbb-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>recommendations on how to protect the privacy, dignity, independence, autonomy, and safety of any missing adult who may be the subject of an Ashanti Alert;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8429cbc-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cbd-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Protocols.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8429cbe-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote><chapeau>develop proposed protocols for efforts to recover missing adults and to reduce the number of adults who are reported missing, including protocols for procedures that are needed from the time of initial notification of a law enforcement agency that the adult is missing through the time of the return of the adult to family, guardian, or domicile, as appropriate, including—</chapeau><subparagraph class="fontsize10" id="ya8429cbf-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>public safety communications protocol;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cc0-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>case management protocol;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cc1-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>command center operations;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cc2-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>reunification protocol;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cc3-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>incident review, evaluation, debriefing, and public information procedures; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cc4-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>protocols for declining to issue an Ashanti Alert;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8429cc5-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cc6-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>work with States and Indian Tribes to ensure appropriate regional coordination of various elements of the network;</content></paragraph>
<paragraph class="fontsize10" id="ya8429cc7-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><chapeau>establish an advisory group to assist States, Indian Tribes, units of local government, law enforcement agencies, and other entities involved in the Ashanti Alert communications network with initiating, facilitating, and promoting Ashanti Alert plans, which shall include—</chapeau><subparagraph class="fontsize10" id="ya8429cc8-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to the maximum extent practicable, representation from the various geographic regions of the United States; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cc9-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>members who are—</chapeau><clause class="fontsize10" id="ya8429cca-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>representatives of adult citizen advocacy groups, law enforcement agencies, victim service providers (as defined in section 40002(a) of the Violence <page identifier="/us/stat/132/5339">132 STAT. 5339</page>
Against Women Act of 1994 (<ref href="/us/usc/t34/s12291/a">34 U.S.C. 12291(a)</ref>), and public safety communications;</content></clause>
<clause class="fontsize10" id="ya8429ccb-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>broadcasters, first responders, dispatchers, and radio station personnel; and</content></clause>
<clause class="fontsize10" id="ya8429ccc-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>representatives of any other individuals or organizations that the Coordinator determines are necessary to the success of the Ashanti Alert communications network; and</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8429ccd-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><chapeau>act as the nationwide point of contact for—</chapeau><subparagraph class="fontsize10" id="ya8429cce-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the development of the network; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429ccf-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>regional coordination of alerts for missing adults through the network.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ya8429cd0-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cd1-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><paragraph class="fontsize10" id="ya8429cd2-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Coordination with other agencies</inline>.—</heading><content>The Coordinator shall coordinate and consult with the Secretary of Transportation, the Federal Communications Commission, the Assistant Secretary for Aging of the Department of Health and Human Services, and other appropriate offices of the Department of Justice, including the Office on Violence Against Women, in carrying out activities under this title.</content></paragraph>
<paragraph class="fontsize10" id="ya8429cd3-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">State, tribal, and local coordination</inline>.—</heading><content>The Coordinator shall consult with local broadcasters and State, Tribal, and local law enforcement agencies in establishing minimum standards under section 204 and in carrying out other activities under this title, as appropriate.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ya8429cd4-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Annual Reports</inline>.—</heading><paragraph class="fontsize10" id="ya8429cd5-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this title, and annually thereafter, the Coordinator shall submit to Congress a report on—</chapeau><subparagraph class="fontsize10" id="ya8429cd6-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the activities of the Coordinator; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cd7-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the effectiveness and status of the Ashanti Alert plan of each State or Indian Tribe that has established or is in the process of establishing such a plan.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8429cd8-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Each report under paragraph (1) shall include—</chapeau><subparagraph class="fontsize10" id="ya8429cd9-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cda-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>a list of each State or Indian Tribe that has established an Ashanti Alert plan;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cdb-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cdc-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>a list of each State or Indian Tribe that is in the process of establishing an Ashanti Alert plan;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cdd-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>for each State or Indian Tribe that has established an Ashanti Alert plan, to the extent the data is available—</chapeau><clause class="fontsize10" id="ya8429cde-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the number of Ashanti Alerts issued;</content></clause>
<clause class="fontsize10" id="ya8429cdf-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the number of missing adults located successfully;</content></clause>
<clause class="fontsize10" id="ya8429ce0-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the average period of time between the issuance of an Ashanti Alert and the location of the missing adult for whom the Alert was issued;</content></clause>
<clause class="fontsize10" id="ya8429ce1-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>the State or Tribal agency or authority issuing Ashanti Alerts, and the process by which Ashanti Alerts are disseminated;</content></clause>
<clause class="fontsize10" id="ya8429ce2-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>the cost of establishing and operating the Ashanti Alert plan;</content></clause>
<clause class="fontsize10" id="ya8429ce3-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>the criteria used by the State or Indian Tribe to determine whether to issue an Ashanti Alert; and</content></clause>
<clause class="fontsize10" id="ya8429ce4-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>the extent to which missing adults for whom Ashanti Alerts were issued crossed State lines or territorial borders of an Indian Tribe;<page identifier="/us/stat/132/5340">132 STAT. 5340</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya8429ce5-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>actions States and Indian Tribes have taken to protect the privacy and dignity of the missing adults for whom Ashanti Alerts are issued;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429ce6-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>ways that States and Indian Tribes have facilitated and improved communication about missing adults between families, caregivers, law enforcement officials, and other authorities; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429ce7-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>any other information the Coordinator determines to be appropriate.</content></subparagraph>

</section>
<section class="centered fontsize12" id="ya8429ce8-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="204">“SEC. 204. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429ce9-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21904">34 USC 21904</ref>.</p></sidenote><heading class="fontsize12">MINIMUM STANDARDS FOR ISSUANCE AND DISSEMINATION OF ALERTS THROUGH ASHANTI ALERT COMMUNICATIONS NETWORK.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="ya8429cea-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment of Minimum Standards</inline>.—</heading><chapeau>Subject to subsection (b), the Coordinator shall establish minimum standards for—</chapeau><paragraph class="fontsize10" id="ya8429ceb-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the issuance of alerts through the Ashanti Alert communications network; and</content></paragraph>
<paragraph class="fontsize10" id="ya8429cec-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the extent of the dissemination of alerts issued through the Ashanti Alert communications network.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ya8429ced-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><paragraph class="fontsize10" id="ya8429cee-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cef-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8429cf0-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Dissemination of information</inline>.—</heading><content>The minimum standards established under subsection (a) shall, to the maximum extent practicable (as determined by the Coordinator in consultation with State, Tribal, and local law enforcement agencies), provide for the dissemination of appropriate information relating to the special needs of a missing adult (including health care needs) to the appropriate law enforcement, public health, and other public officials.</content></paragraph>
<paragraph class="fontsize10" id="ya8429cf1-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429cf2-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8429cf3-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Geographic areas</inline>.—</heading><chapeau>The minimum standards established under subsection (a) shall, to the maximum extent practicable (as determined by the Coordinator in consultation with State, Tribal, and local law enforcement agencies), provide that the dissemination of an alert through the Ashanti Alert communications network shall be limited to the geographic areas that the missing adult could reasonably reach, considering—</chapeau><subparagraph class="fontsize10" id="ya8429cf4-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the circumstances and physical and mental condition of the missing adult;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cf5-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the modes of transportation available to the missing adult; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cf6-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the circumstances of the disappearance.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8429cf7-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Other requirements</inline>.—</heading><chapeau>The minimum standards established under subsection (a) shall require that, in order for an Ashanti Alert to be issued for a missing adult, the missing adult—</chapeau><subparagraph class="fontsize10" id="ya8429cf8-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>suffers from a proven mental or physical disability, as documented by a source determined credible by an appropriate law enforcement agency; or</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cf9-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>be missing under circumstances that indicate, as determined by an appropriate law enforcement agency—</chapeau><clause class="fontsize10" id="ya8429cfa-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>that the physical safety of the missing adult may be endangered; or</content></clause>
<clause class="fontsize10" id="ya8429cfb-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>that the disappearance of the missing adult may not have been voluntary, including an abduction or kidnapping.<page identifier="/us/stat/132/5341">132 STAT. 5341</page></content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8429cfc-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Safety, privacy, and civil liberties protections</inline>.—</heading><chapeau>The minimum standards established under subsection (a) shall—</chapeau><subparagraph class="fontsize10" id="ya8429cfd-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>ensure that alerts issued through the Ashanti Alert communications network comply with all applicable Federal, State, Tribal, and local privacy laws and regulations;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cfe-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>include standards that specifically provide for the protection of the civil liberties and sensitive medical information of missing adults; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8429cff-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>include standards requiring, as appropriate, a review of relevant court records, prior contacts with law enforcement, and other information relevant to the missing adult or the individual reporting, in order to provide protections against domestic violence.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8429d00-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">State, tribal, and local voluntary coordination</inline>.—</heading><content>In establishing minimum standards under subsection (a), the Coordinator may not interfere with the system of voluntary coordination between local broadcasters and State, Tribal, and local law enforcement agencies for purposes of regional and local search efforts for missing adults that was in effect on the day before the date of enactment of this title.</content></paragraph>
</subsection>
</section>
<section class="centered fontsize12" id="ya8429d01-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="205">“SEC. 205. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429d02-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21905">34 USC 21905</ref>.</p></sidenote><heading class="fontsize12">VOLUNTARY PARTICIPATION.</heading><content class="indentUp0 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “The minimum standards established under section 204(a), and any other guidelines and programs established under section 203, shall be adoptable on a voluntary basis only.</content></section>
<section class="centered fontsize12" id="ya8429d03-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="206">“SEC. 206. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8429d04-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s21906">34 USC 21906</ref>.</p></sidenote><heading class="fontsize12">TRAINING AND EDUCATIONAL PROGRAMS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “The Coordinator shall make available to States, Indian Tribes, units of local government, law enforcement agencies, and other concerned entities that are involved in initiating, facilitating, or promoting Ashanti Alert plans, including broadcasters, first responders, dispatchers, public safety communications personnel, and radio station personnel—</chapeau><paragraph class="indentUp0 fontsize10" id="ya8429d05-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>training and educational programs related to the Ashanti Alert communications network and the capabilities, limitations, and anticipated behaviors of missing adults, which the Coordinator shall update regularly to encourage the use of new tools, technologies, and resources in Ashanti Alert plans; and</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="ya8429d06-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>informational materials, including brochures, videos, posters, and websites to support and supplement the training and educational programs described in paragraph (1).</content></paragraph>
