<section id="d255220e94" identifier="/us/pl/115/399/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Stigler Act Amendments of 2018</shortTitle>”.</content></section>
<section id="d255220e104" identifier="/us/pl/115/399/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd9baa541-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s355">25 USC 355 note</ref>.</p></sidenote><heading>IN GENERAL.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd9baf362-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The first section of the Act of August 4, 1947 (<ref href="/us/stat/61/731/ch458">61 Stat. 731, chapter 458</ref>), <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd9baf363-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the matter before subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>That all restrictions</quotedText>” and all that follows through subsection (a) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="indentDown1 firstIndent0 fontsize10" id="yd9bb4184-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“<inline class="smallCaps">Sec. 1.</inline></num><subsection class="inline" id="yd9bb4185-e82f-11f0-bc57-ad3ac4b1618c"><num value="a"> (a) </num><content>All restrictions against alienation, conveyance, lease, mortgage, creation of liens, or other encumbrances upon all lands, including oil and gas or other mineral interests, in Oklahoma belonging to a lineal descendant by blood of an original enrollee whose name appears on the Final Indian Rolls of the Five Civilized Tribes in Indian Territory, whether acquired by allotment, inheritance, devise, gift, purchase, exchange, partition, partition sale, or by purchase with restricted funds, of whatever degree of Indian blood, and whether enrolled or unenrolled, shall be and are hereby, extended until an Act of Congress determines otherwise.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd9bb4186-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><chapeau>The extension of restrictions described in subsection (a) shall include without limitation, those interests in the estate of a decedent Indian who died before the date of enactment of the Stigler Act Amendments of 2018—</chapeau><paragraph class="fontsize10" id="yd9bb4187-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>if such interests were acquired by an heir or devisee of one-half or more degree of Indian blood, as computed from the nearest enrolled lineal ancestors of Indian blood enrolled on the Final Rolls described in subsection (a), by final order issued by an Oklahoma district court or a United States district court determining the decedent’s heirs or devisees or otherwise determining the ownership of said interests before said date; or</content></paragraph>
<paragraph class="fontsize10" id="yd9bb4188-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>if such interests were, immediately prior to the decedent’s death, subject to restrictions and had not, as of the date of enactment of the Stigler Act Amendments of 2018, been—</chapeau><subparagraph class="fontsize10" id="yd9bb4189-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the subject of a final order issued by an Oklahoma district court or a United States district court determining <page identifier="/us/stat/132/5332">132 STAT. 5332</page>
the decedent’s heirs or devisees or otherwise determining the ownership of said interests;</content></subparagraph>
<subparagraph class="fontsize10" id="yd9bb418a-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>conveyed by the decedent’s undetermined heirs or devisees by deed approved by an Oklahoma district court; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd9bb418b-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>conveyed by the decedent’s undetermined heirs or devisees of less than one-half degree of Indian blood with or without Oklahoma district court approval.</content></subparagraph>
</paragraph>
</subsection>
</section>
<section class="indentDown1 firstIndent0 fontsize10" id="yd9bb418c-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“<inline class="smallCaps">Sec. 2.</inline></num><subsection class="inline" id="yd9bb418d-e82f-11f0-bc57-ad3ac4b1618c"><num value="a"> (a) </num><content>Except as provided in subsection (f), subsection (g), subsection (h), and subsection (i), no conveyance, including an oil and gas or mineral lease, of any interest in the restricted lands described in this section shall be valid unless approved in open court by the district court of the county in Oklahoma in which the land is situated;”</content></subsection>

<paragraph class="fontsize10" id="yd9bb418e-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="yd9bb418f-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>county judge</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>district judge</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd9bb4190-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>Proceedings for approval of conveyances by restricted heirs or devisees</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Proceedings for approval of conveyances</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd9bb4191-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (c), by <amendingAction type="delete">striking</amendingAction> “<quotedText>best interest of the Indian</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>best interest of the grantor</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yd9bb4192-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="add">adding</amendingAction> before the period at the end the following: “<quotedText>; (h) nothing contained in this section shall limit or affect the right of an Indian owner of restricted lands described in this Act to seek and obtain Secretarial removal of restrictions on all or any portion of said restricted lands in accordance with any applicable Federal law; (i) nothing contained in this section shall invalidate the alienation, conveyance, lease, including oil and gas or other mineral leases, mortgage, creation of liens, or other encumbrance of any lands, if such action was effective before the date of enactment of the Stigler Act Amendments of 2018 and valid under the law then in effect; and (j) in determining the quantum of Indian blood of any Indian heir or devisee, the Final Indian Rolls of the Five Civilized Tribes in Indian Territory as to such heir or devisee, if enrolled, shall be conclusive of his or her quantum of Indian blood. If unenrolled, his or her degree of Indian blood shall be computed from the nearest enrolled lineal ancestors of Indian blood enrolled on the Final Indian Rolls of the Five Civilized Tribes in Indian Territory</quotedText>”.</content></paragraph>

<section id="d255220e242" identifier="/us/pl/115/399/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd9bb4193-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s355">25 USC 355 note</ref>.</p></sidenote><heading>TECHNICAL AMENDMENTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd9bb68a4-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The Act of August 4, 1947 (<ref href="/us/stat/61/731/ch458">61 Stat. 731, chapter 458</ref>), <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd9bb68a5-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in section 5, by <amendingAction type="delete">striking</amendingAction> “<quotedText>of one-half or more Indian blood,</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yd9bb68a6-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in section 6(c)—</chapeau><subparagraph class="fontsize10" id="yd9bb68a7-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>purchase, partition sale,</quotedText>” after “<quotedText>gift,</quotedText>” each place it appears; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd9bb68a8-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>of one-half or more Indian blood</quotedText>”; and</content></subparagraph>

<paragraph class="fontsize10" id="yd9bb68a9-e82f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/399/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in section 8, by <amendingAction type="delete">striking</amendingAction> “<quotedText>of one-half or more Indian blood,</quotedText>”.</content></paragraph>

<section id="d255220e337" identifier="/us/pl/115/399/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd9bb8fbe-e82f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s355">25 USC 355 note</ref>.</p></sidenote><heading>RULE OF CONSTRUCTION PROVIDING FOR NO RETROACTIVITY.</heading><content style="-uslm-lc:I658120">  Nothing in this Act, or the amendments made by this Act, shall be construed to revise or extend the restricted status of any lands under the Act of August 4, 1947 (<ref href="/us/stat/61/731/ch458">61 Stat. 731, chapter 458</ref>) that lost restricted status under such Act before the date of enactment of this Act.</content></section>
