<section id="d139352e104" identifier="/us/pl/115/398/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Stop, Observe, Ask, and Respond to Health and Wellness Act of 2018</shortTitle>” or the “<shortTitle role="act">SOAR to Health and Wellness Act of 2018</shortTitle>”.</content></section>
<section id="d139352e117" identifier="/us/pl/115/398/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROGRAM ESTABLISHMENT.</heading><content class="firstIndent0 fontsize10" id="xe76ea398-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Part E of title XII of the Public Health Service Act (<ref href="/us/usc/t42/s300d–51/etseq">42 U.S.C. 300d–51 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="indentUp2 firstIndent-2" id="ye76f3fd9-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="1254">“SEC. 1254. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe76f3fda-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s300d–54">42 USC 300d–54</ref>.</p></sidenote><heading class="bold">STOP, OBSERVE, ASK, AND RESPOND TO HEALTH AND WELLNESS TRAINING PROGRAM.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3fdb-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary shall establish a program to be known as the Stop, Observe, Ask, and Respond to Health and Wellness Training Program or the SOAR to Health and Wellness Training Program (in this section referred to as the ‘Program’) to provide training to health care and social service providers on human trafficking in accordance with this section.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3fdc-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Activities</inline>.—</heading><paragraph class="fontsize10" id="ye76f3fdd-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Program shall include the Stop, Observe, Ask, and Respond to Health and Wellness Training Program’s activities existing on the day before the date of enactment of this section and the authorized initiatives described in paragraph (2).</content></paragraph>
<paragraph class="fontsize10" id="ye76f3fde-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Authorized initiatives</inline>.—</heading><chapeau>The authorized initiatives of the Program shall include—</chapeau><subparagraph class="fontsize10" id="ye76f3fdf-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>engaging stakeholders, including victims of human trafficking and Federal, State, local, and tribal partners, to develop a flexible training module—</chapeau><clause class="fontsize10" id="ye76f3fe0-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>for supporting activities under subsection (c); and</content></clause>
<clause class="fontsize10" id="ye76f3fe1-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>that adapts to changing needs, settings, health care providers, and social service providers;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ye76f3fe2-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>providing technical assistance to grantees related to implementing activities described in subsection (c) and reporting on any best practices identified by the grantees;</content></subparagraph>
<subparagraph class="fontsize10" id="ye76f3fe3-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe76f3fe4-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Data.</p></sidenote><content>developing a reliable methodology for collecting data, and reporting such data, on the number of human trafficking victims identified and served by grantees in a manner that, at a minimum, prevents disclosure of <page identifier="/us/stat/132/5329">132 STAT. 5329</page>
individually identifiable information consistent with all applicable privacy laws and regulations; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye76f3fe5-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>integrating, as appropriate, the training described in paragraphs (1) through (4) of subsection (c) with training programs, in effect on the date of enactment of this section, for health care and social service providers for victims of intimate partner violence, sexual assault, stalking, child abuse, child neglect, child maltreatment, and child sexual exploitation.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3fe6-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Grants</inline>.—</heading><chapeau>The Secretary may award grants to appropriate entities to train health care and social service providers to—</chapeau><paragraph class="fontsize10" id="ye76f3fe7-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>identify potential human trafficking victims;</content></paragraph>
<paragraph class="fontsize10" id="ye76f3fe8-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>implement best practices for working with law enforcement to report and facilitate communication with human trafficking victims, in accordance with all applicable Federal, State, local, and tribal laws, including legal confidentiality requirements for patients and health care and social service providers;</content></paragraph>
<paragraph class="fontsize10" id="ye76f3fe9-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>implement best practices for referring such victims to appropriate health care, social, or victims service agencies or organizations; and</content></paragraph>
<paragraph class="fontsize10" id="ye76f3fea-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>provide such victims with coordinated, age-appropriate, culturally relevant, trauma-informed, patient-centered, and evidence-based care.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3feb-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Consideration in Awarding Grants</inline>.—</heading><chapeau>The Secretary, in making awards under this section, shall give consideration to—</chapeau><paragraph class="fontsize10" id="ye76f3fec-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>geography;</content></paragraph>
<paragraph class="fontsize10" id="ye76f3fed-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the demographics of the population to be served;</content></paragraph>
<paragraph class="fontsize10" id="ye76f3fee-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the predominant types of human trafficking cases involved; and</content></paragraph>
<paragraph class="fontsize10" id="ye76f3fef-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>health care and social service provider profiles.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3ff0-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Data Collection and Reporting</inline>.—</heading><paragraph class="fontsize10" id="ye76f3ff1-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall collect data and report on the following:</chapeau><subparagraph class="fontsize10" id="ye76f3ff2-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The total number of entities that received a grant under this section.</content></subparagraph>
<subparagraph class="fontsize10" id="ye76f3ff3-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The total number and geographic distribution of health care and social service providers trained through the Program.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye76f3ff4-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Initial report</inline>.—</heading><content>In addition to the data required to be collected under paragraph (1), for purposes of the initial report to be submitted under paragraph (3), the Secretary shall collect data on the total number of facilities and health care professional organizations that were operating under, and the total number of health care and social service providers trained through, the Stop, Observe, Ask, and Respond to Health and Wellness Training Program existing prior to the establishment of the Program under this section.</content></paragraph>
<paragraph class="fontsize10" id="ye76f3ff5-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Annual report</inline>.—</heading><content>Not later than 1 year after the date of enactment of this section, and annually thereafter, the Secretary shall submit an annual report to Congress on the data collected under this subsection in a manner that, at a minimum, prevents the disclosure of individually identifiable information consistent with all applicable privacy laws and regulations.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3ff6-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe76f3ff7-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Sharing Best Practices</inline>.—</heading><content>The Secretary shall make available, on the Internet website of the Department of Health and Human Services, a description of the best practices and procedures <page identifier="/us/stat/132/5330">132 STAT. 5330</page>
used by entities that receive a grant for carrying out activities under this section.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3ff8-e82f-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>In this section, the term ‘<term>human trafficking</term>’ has the meaning given the term ‘<term>severe forms of trafficking in persons</term>’ as defined in section 103 of the Trafficking Victims Protection Act of 2000.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ye76f3ff9-e82f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>There is authorized to be appropriated to carry out this Act, $4,000,000 for each of fiscal years 2020 through 2024.”</content></subsection>
