<section id="d256518e275" identifier="/us/pl/115/393/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS; SENSE OF CONGRESS.</heading><subsection class="firstIndent0 fontsize10" id="y269d6a03-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds the following:</chapeau><paragraph class="fontsize10" id="y269d6a04-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The crime of human trafficking involves the exploitation of adults through force, fraud, or coercion, and children for such purposes as forced labor or commercial sex.</content></paragraph>
<paragraph class="fontsize10" id="y269d6a05-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Reliable data on the prevalence of human trafficking in the United States is not available, but cases have been reported in all 50 States, the territories of the United States, and the District of Columbia.</content></paragraph>
<paragraph class="fontsize10" id="y269d6a06-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Each year, thousands of individuals may be trafficked within the United States, according to recent estimates from victim advocates.</content></paragraph>
<paragraph class="fontsize10" id="y269d6a07-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>More accurate and comprehensive data on the prevalence of human trafficking is needed to properly combat this form of modern slavery in the United States.</content></paragraph>
<paragraph class="fontsize10" id="y269d6a08-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Victims of human trafficking can include men, women, and children who are diverse with respect to race, ethnicity, and nationality, among other factors.</content></paragraph>
<paragraph class="fontsize10" id="y269d6a09-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Since the enactment of the Trafficking Victims Protection Act of 2000 (<ref href="/us/pl/106/386">Public Law 106–386</ref>; <ref href="/us/stat/114/1464">114 Stat. 1464</ref>), human traffickers have launched increasingly sophisticated schemes to increase the scope of their activities and the number of their victims.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y269d6a0a-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><content>It is the sense of Congress that Congress supports additional efforts to raise awareness of and oppose human trafficking.</content></subsection>

<title id="d256518e336" identifier="/us/pl/115/393/tI" style="-uslm-lc:I658178"><num value="I">TITLE I—</num><heading>FREDERICK DOUGLASS TRAFFICKING PREVENTION ACT OF 2017</heading>
<section id="d256518e341" identifier="/us/pl/115/393/tI/s101" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><heading>TRAINING OF SCHOOL RESOURCE OFFICERS TO RECOGNIZE AND RESPOND TO SIGNS OF HUMAN TRAFFICKING.</heading><content style="-uslm-lc:I658120">  Section 1701(b)(12) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3796dd/b/12">42 U.S.C. 3796dd(b)(12)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, including the training of school resource officers in the prevention of human trafficking offenses</quotedText>” before the semicolon at the end.</content></section>
<section id="d256518e357" identifier="/us/pl/115/393/tI/s102" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>TRAINING FOR SCHOOL PERSONNEL.</heading><content style="-uslm-lc:I658120">  Section 41201(f) of the Violence Against Women Act of 1994 (<ref href="/us/usc/t42/s14043c/f">42 U.S.C. 14043c(f)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>2014 through 2018</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2019 through 2022</quotedText>”.</content></section>

<section id="d256518e383" identifier="/us/pl/115/393/tII/s201" style="-uslm-lc:I658143"><num class="fontsize12" value="201">SEC. 201. </num><heading>INJUNCTIVE RELIEF.</heading><subsection class="firstIndent0 fontsize10" id="y269db82b-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tII/s201/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t18/ch77">Chapter 77 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 1595 the following:<quotedContent><section class="centered fontsize12" id="y269ddf3c-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658165"><num class="fontsize12" value="1595A">“§ 1595A.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x269ddf3d-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1595A">18 USC 1595A</ref>.</p></sidenote> Civil injunctions</heading><subsection class="firstIndent0 fontsize10" id="y269ddf3e-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Whenever it shall appear that any person is engaged or is about to engage in any act that constitutes or will constitute a violation of this chapter, chapter 110, or chapter <page identifier="/us/stat/132/5267">132 STAT. 5267</page>
117, or a conspiracy under section 371 to commit a violation of this chapter, chapter 110, or chapter 117, the Attorney General may bring a civil action in a district court of the United States seeking an order to enjoin such act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y269ddf3f-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Action by Court</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x269ddf40-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Hearings.</p><p class="leftAlign firstIndent0 fontsize8" id="x269ddf41-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determinations.</p></sidenote>The court shall proceed as soon as practicable to the hearing and determination of a civil action brought under subsection (a), and may, at any time before final determination, enter such a restraining order or prohibition, or take such other action, as is warranted to prevent a continuing and substantial injury to the United States or to any person or class of persons for whose protection the civil action is brought.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y269ddf42-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Procedure</inline>.—</heading><paragraph class="fontsize10" id="y269ddf43-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A proceeding under this section shall be governed by the Federal Rules of Civil Procedure, except that, if an indictment has been returned against the respondent, discovery shall be governed by the Federal Rules of Criminal Procedure.</content></paragraph>
<paragraph class="fontsize10" id="y269ddf44-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Sealed proceedings</inline>.—</heading><chapeau>If a civil action is brought under subsection (a) before an indictment is returned against the respondent or while an indictment against the respondent is under seal—</chapeau><subparagraph class="fontsize10" id="y269ddf45-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the court shall place the civil action under seal; and</content></subparagraph>
<subparagraph class="fontsize10" id="y269ddf46-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>when the indictment is unsealed, the court shall unseal the civil action unless good cause exists to keep the civil action under seal.</content></subparagraph>

<subparagraph class="indentUp0 fontsize10" id="y26a0296b-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="K">“(K) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a0296c-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>provide forensic and direct on-site technical assistance and consultation to families, law enforcement agencies, child-serving professionals, and nongovernmental organizations in child abduction and exploitation cases, including facial reconstruction of skeletal remains and similar techniques to assist in the identification of unidentified deceased children;”</content></subparagraph>

<item class="fontsize10" id="y26a0779c-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="hh">“(hh) </num><content>misleading words or digital images on the Internet; and</content></item>

<subclause class="fontsize10" id="y26a1af5b-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>will be used to strengthen efforts to investigate and prosecute those who knowingly benefit financially from participation in a venture that has engaged in any act of human trafficking;<page identifier="/us/stat/132/5273">132 STAT. 5273</page></content></subclause>
<subclause class="fontsize10" id="y26a1af5c-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>will be used to take affirmative measures to avoid arresting, charging, or prosecuting victims of human trafficking for any offense that is the direct result of their victimization; and</content></subclause>
<subclause class="fontsize10" id="y26a1d66d-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>will not be used to require a victim of human trafficking to collaborate with law enforcement officers as a condition of access to any shelter or restorative services; and</content></subclause>

<clause class="fontsize10" id="y26a1d66e-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the applicant will provide dedicated resources for anti-human trafficking law enforcement officers for a period that is longer than the duration of the grant received under this paragraph.”</content></clause>

and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives a report on the status of the Innocence Lost National Initiative, which shall include, for each of the last 5 fiscal years, information on—</chapeau><paragraph class="fontsize10" id="y26a272bc-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s401/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the number of human traffickers who were arrested, disaggregated by—</chapeau><subparagraph class="fontsize10" id="y26a272bd-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s401/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of individuals arrested for patronizing or soliciting an adult;</content></subparagraph>
<subparagraph class="fontsize10" id="y26a272be-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s401/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the number of individuals arrested for recruitment, harboring, maintaining, or obtaining an adult;</content></subparagraph>

<paragraph class="fontsize10" id="y26a272c2-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s401/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the number of minor victims who were identified;</content></paragraph>
<paragraph class="fontsize10" id="y26a272c3-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s401/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the number of minor victims who were arrested and formally petitioned by a juvenile court or criminally charged; and</content></paragraph>
<paragraph class="fontsize10" id="y26a272c4-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s401/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the placement of and social services provided to each such minor victim as part of each State operation.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y26a272c5-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s401/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Availability of Reports</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a272c6-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote>The reports required under subsections (a) and (b) shall be posted on the website of the Department of Justice.</content></subsection>

paragraph (2).<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a2c0f0-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">List.</p></sidenote> The report shall contain a list of all departments and agencies within the Federal Government subject to paragraph (2) and whether each department or agency is in compliance with paragraph (2).”</content></paragraph>

<section id="d256518e1979" identifier="/us/pl/115/393/tIV/s403" style="-uslm-lc:I658143"><num class="fontsize12" value="403">SEC. 403. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a2c0f1-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p><p class="leftAlign firstIndent0 fontsize8" id="x26a2c0f2-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s645a">6 USC 645a</ref>.</p></sidenote><heading>HUMAN TRAFFICKING ASSESSMENT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x26a30f13-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Executive Associate Director of Homeland Security Investigations shall submit to the Committee on Homeland Security and Governmental Affairs and the Committee on the Judiciary of the Senate, and the Committee on Homeland Security and the Committee on the Judiciary of the House of Representatives a report on human trafficking investigations undertaken by Homeland Security Investigations that includes—</chapeau><paragraph class="fontsize10" id="y26a30f14-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s403/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the number of confirmed human trafficking investigations by category, including labor trafficking, sex trafficking, and transnational and domestic human trafficking;</content></paragraph>
<paragraph class="fontsize10" id="y26a30f15-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s403/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>the number of victims by category, including—</chapeau><subparagraph class="fontsize10" id="y26a30f16-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tIV/s403/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>whether the victim is a victim of sex trafficking or a victim of labor trafficking; and</content></subparagraph>

<title id="d256518e2022" identifier="/us/pl/115/393/tV" style="-uslm-lc:I658178"><num value="V">TITLE V—</num><heading>TRAINING AND TECHNICAL ASSISTANCE</heading>
<section id="d256518e2027" identifier="/us/pl/115/393/tV/s501" style="-uslm-lc:I658143"><num class="fontsize12" value="501">SEC. 501. </num><heading>ENCOURAGING A VICTIM-CENTERED APPROACH TO TRAINING OF FEDERAL LAW ENFORCEMENT PERSONNEL.</heading><subsection class="firstIndent0 fontsize10" id="y26a3844a-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Training Curriculum Improvements</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a3ab5b-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x26a3ab5c-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x26a3ab5d-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s20709b">34 USC 20709b</ref>.</p></sidenote>The Attorney General, Secretary of Homeland Security, and Secretary of Labor shall periodically, but not less frequently than once every 2 years, implement improvements to the training programs on human trafficking for employees of the Department of Justice, Department of Homeland Security, and Department of Labor, respectively, after consultation with survivors of human trafficking, or trafficking victims service providers, and Federal law enforcement agencies responsible for the prevention, deterrence, and prosecution of offenses involving human trafficking (such as individuals serving as, or who have served as, investigators in a Federal agency and who have expertise in identifying human trafficking victims and investigating human trafficking cases).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y26a3ab5e-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a3ab5f-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s20709b">34 USC 20709b</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Advanced Training Curriculum</inline>.—</heading><paragraph class="fontsize10" id="y26a3ab60-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a3ab61-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 1 year after the date of enactment of this Act, the Attorney General and the Secretary of Homeland Security shall develop an advanced training curriculum, to supplement the basic curriculum for investigative personnel of the Department of Justice and the Department of Homeland Security, respectively, that—</chapeau><subparagraph class="fontsize10" id="y26a3ab62-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>emphasizes a multidisciplinary, collaborative effort by law enforcement officers who provide a broad range of investigation and prosecution options in response to perpetrators, and victim service providers, who offer services and resources for victims;<page identifier="/us/stat/132/5276">132 STAT. 5276</page></content></subparagraph>
<subparagraph class="fontsize10" id="y26a3ab63-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>provides guidance about the recruitment techniques employed by human traffickers to clarify that an individual who knowingly solicits or patronizes a commercial sex act from a person who was a minor (consistent with <ref href="/us/usc/t18/s1591/c">section 1591(c) of title 18, United States Code</ref>) or was subject to force, fraud, or coercion is guilty of an offense under <ref href="/us/usc/t18/ch77">chapter 77 of title 18, United States Code</ref>, and is a party to a human trafficking offense; and</content></subparagraph>
<subparagraph class="fontsize10" id="y26a3ab64-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>explains that—</chapeau><clause class="fontsize10" id="y26a3ab65-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>victims of sex or labor trafficking often engage in criminal acts as a direct result of severe trafficking in persons and such individuals are victims of a crime and affirmative measures should be taken to avoid arresting, charging, or prosecuting such individuals for any offense that is the direct result of their victimization; and</content></clause>
<clause class="fontsize10" id="y26a3ab66-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>a comprehensive approach to eliminating human trafficking should include demand reduction as a component.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y26a3ab67-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Use of curriculum</inline>.—</heading><chapeau>The Attorney General and the Secretary of Homeland Security shall provide training using the curriculum developed under paragraph (1) to—</chapeau><subparagraph class="fontsize10" id="y26a3ab68-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>all law enforcement officers employed by the Department of Justice and the Department of Homeland Security, respectively, who may be involved in the investigation of human trafficking offenses; and</content></subparagraph>
<subparagraph class="fontsize10" id="y26a3ab69-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>members of task forces that participate in the investigation of human trafficking offenses.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y26a3ab6a-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Training Components</inline>.—</heading><chapeau>Section 107(c)(4)(B) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7105/c/4/B">22 U.S.C. 7105(c)(4)(B)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y26a3ab6b-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s501/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in clause (ii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>

<section id="d256518e2191" identifier="/us/pl/115/393/tV/s502" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="502">SEC. 502. </num><heading>VICTIM SCREENING TRAINING.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x26a3f98f-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 114 of the Justice for Victims of Trafficking Act of 2015 (<ref href="/us/usc/t34/s20709">34 U.S.C. 20709</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y26a3f990-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s502/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (c)(1)(A)—</chapeau><subparagraph class="fontsize10" id="y26a3f991-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s502/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in clause (i), by <amendingAction type="delete">striking</amendingAction> the “<quotedText>and</quotedText>” at the end;</content></subparagraph>

<paragraph class="fontsize10" id="y26a420a8-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tV/s502/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y26a447b9-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Department of Justice Victim Screening Protocol</inline>.—</heading><paragraph class="fontsize10" id="y26a447ba-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a447bb-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 180 days after the date of enactment of this subsection, the Attorney General shall issue a screening protocol for use during all anti-trafficking law enforcement operations in which the Department of Justice is involved.</content></paragraph>
<paragraph class="fontsize10" id="y26a447bc-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>The protocol required to be issued under paragraph (1) shall—</chapeau><subparagraph class="fontsize10" id="y26a447bd-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>require the individual screening of all adults and children who are suspected of engaging in commercial sex acts or who are subject to labor exploitation that may be in violation of child labor laws to determine whether each individual screened is a victim of human trafficking;</content></subparagraph>
<subparagraph class="fontsize10" id="y26a447be-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>require affirmative measures to avoid arresting, charging, or prosecuting human trafficking victims for any offense that is the direct result of their victimization;</content></subparagraph>
<subparagraph class="fontsize10" id="y26a447bf-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>require all Federal law enforcement officers and relevant department personnel who participate in human trafficking investigations to receive training on enforcement of the protocol;</content></subparagraph>
<subparagraph class="fontsize10" id="y26a447c0-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a447c1-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>be developed in consultation with State and local law enforcement agencies, the Department of Health and Human Services, survivors of human trafficking, and nongovernmental organizations that specialize in the identification, prevention, and restoration of victims of human trafficking; and</content></subparagraph>
<subparagraph class="fontsize10" id="y26a447c2-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><chapeau>include—</chapeau><clause class="fontsize10" id="y26a447c3-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>procedures and practices to ensure that the screening process minimizes trauma or revictimization of the person being screened; and</content></clause>
<clause class="fontsize10" id="y26a46ed4-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a46ed5-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Guidelines.</p></sidenote><content>guidelines on assisting victims of human trafficking in identifying and receiving victim services.”</content></clause>

<paragraph class="fontsize10" id="y26a53237-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s702/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Group</inline>.—</heading><content>The term “<term>Group</term>” means the Senior Policy Operating Group established under section 105(g) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7103/g">22 U.S.C. 7103(g)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y26a53238-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s702/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Task force</inline>.—</heading><content>The term “<term>Task Force</term>” means the President’s Interagency Task Force to Monitor and Combat Trafficking established under section 105(a) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7103/a">22 U.S.C. 7103(a)</ref>).</content></paragraph>

<section id="d256518e2557" identifier="/us/pl/115/393/tVII/s703" style="-uslm-lc:I658143"><num class="fontsize12" value="703">SEC. 703. </num><heading>PUBLIC-PRIVATE PARTNERSHIP ADVISORY COUNCIL TO END HUMAN TRAFFICKING.</heading><subsection class="firstIndent0 fontsize10" id="y26a5f589-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a5f58a-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-tions.</p></sidenote>There is established the Public-Private Partnership Advisory Council to End Human Trafficking, which shall provide advice and recommendations to the Group and the Task Force.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y26a5f58b-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><page identifier="/us/stat/132/5279">132 STAT. 5279</page>
<paragraph class="fontsize10" id="y26a5f58c-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Composition</inline>.—</heading><content>The Council shall be composed of not fewer than 8 and not more than 14 representatives of nongovernmental organizations, academia, and nonprofit groups who have significant knowledge and experience in human trafficking prevention and eradication, identification of human trafficking, and services for human trafficking victims.</content></paragraph>
<paragraph class="fontsize10" id="y26a5f58d-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Representation of nonprofit and nongovernmental organizations</inline>.—</heading><content>To the extent practicable, members of the Council shall be representatives of nonprofit groups, academia, and nongovernmental organizations who accurately reflect the diverse backgrounds related to work in the prevention, eradication, and identification of human trafficking and services for human trafficking victims in the United States and internationally.</content></paragraph>
<paragraph class="fontsize10" id="y26a5f58e-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Appointment</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a5f58f-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x26a5f590-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="x26a5f591-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultations.</p></sidenote>Not later than 180 days after the date of the enactment of this Act, the President shall appoint—</chapeau><subparagraph class="fontsize10" id="y26a5f592-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>1 member of the Council, after consultation with the President Pro Tempore of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="y26a5f593-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>1 member of the Council, after consultation with the Minority Leader of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="y26a5f594-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>1 member of the Council, after consultation with the Speaker of the House of Representatives;</content></subparagraph>
<subparagraph class="fontsize10" id="y26a5f595-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>1 member of the Council, after consultation with the Minority Leader of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="y26a5f596-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the remaining members of the Council.</content></subparagraph>

<paragraph class="fontsize10" id="y26a5f597-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Term; reappointment</inline>.—</heading><chapeau>Each member of the Council—</chapeau><subparagraph class="fontsize10" id="y26a5f598-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>shall serve for a term of 2 years; and</content></subparagraph>
<subparagraph class="fontsize10" id="y26a5f599-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a5f59a-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><content>may be reappointed by the President to serve 1 additional 2-year term.</content></subparagraph>

<paragraph class="fontsize10" id="y26a5f59b-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Employee status</inline>.—</heading><chapeau>Members of the Council—</chapeau><subparagraph class="fontsize10" id="y26a5f59c-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>shall not be considered employees of the Federal Government for any purpose; and</content></subparagraph>
<subparagraph class="fontsize10" id="y26a5f59d-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/b/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>shall not receive compensation.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y26a5f59e-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Functions</inline>.—</heading><chapeau>The Council shall—</chapeau><paragraph class="fontsize10" id="y26a5f59f-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>be a nongovernmental advisory body to the Group;</content></paragraph>
<paragraph class="fontsize10" id="y26a5f5a0-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>meet, at its own discretion or at the request of the Group, not less frequently than annually, to review Federal Government policy and programs intended to combat human trafficking, including programs relating to the provision of services for victims;</content></paragraph>
<paragraph class="fontsize10" id="y26a5f5a1-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>serve as a point of contact, with the United States Advisory Council on Human Trafficking, for Federal agencies reaching out to human trafficking nonprofit groups and nongovernmental organizations for input on programming and policies relating to human trafficking in the United States;</content></paragraph>
<paragraph class="fontsize10" id="y26a5f5a2-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a5f5a3-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p><p class="leftAlign firstIndent0 fontsize8" id="x26a5f5a4-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-tions.</p></sidenote><content>formulate assessments and recommendations to ensure that the policy and programming efforts of the Federal Government conform, to the extent practicable, to the best practices in the field of human trafficking prevention and rehabilitation and aftercare of human trafficking victims; and</content></paragraph>
<paragraph class="fontsize10" id="y26a5f5a5-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a5f5a6-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x26a5f5a7-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>meet with the Group not less frequently than annually, and not later than 45 days before a meeting with the Task Force, to formally present the findings and recommendations of the Council.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y26a5f5a8-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s703/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplicability of FACA</inline>.—</heading><content>The Council shall not be subject to the requirements under the Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>).<page identifier="/us/stat/132/5280">132 STAT. 5280</page></content></subsection>

<section id="d256518e2749" identifier="/us/pl/115/393/tVII/s704" style="-uslm-lc:I658143"><num class="fontsize12" value="704">SEC. 704. </num><heading>REPORTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x26a643c9-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x26a643ca-e830-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Coordination.</p></sidenote>Not later than 1 year after the date of the enactment of this Act and annually thereafter until the date described in section 705, the Council, in coordination with the United States Advisory Council on Human Trafficking, shall submit a report containing the findings derived from the reviews conducted pursuant to section 703(c)(2) to—</chapeau><paragraph class="fontsize10" id="y26a643cb-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s704/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Appropriations of the Senate;</content></paragraph>
<paragraph class="fontsize10" id="y26a643cc-e830-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/393/tVII/s704/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Foreign Relations of the Senate;</content></paragraph>
