<section id="d140665e106" identifier="/us/pl/115/387/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Countering Weapons of Mass Destruction Act of 2018</shortTitle>”.</content></section>
<section id="d140665e116" identifier="/us/pl/115/387/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>COUNTERING WEAPONS OF MASS DESTRUCTION OFFICE.</heading><subsection class="firstIndent0 fontsize10" id="y71876c80-e830-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/387/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Title XIX of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s591/etseq">6 U.S.C. 591 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y71876c81-e830-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/387/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the title heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><b>DOMESTIC NUCLEAR DETECTION OFFICE</b></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><b>COUNTERING WEAPONS OF MASS DESTRUCTION OFFICE</b></quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y71876c82-e830-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/387/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x71876c83-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s591">6 USC 591</ref>.</p></sidenote><content>by <amendingAction type="delete">striking</amendingAction> section 1901 and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="indentUp1 firstIndent-2" id="y7187baa4-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="1900">“SEC. 1900. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7187baa5-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s590">6 USC 590</ref>.</p></sidenote><heading class="bold">DEFINITIONS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “In this title:</chapeau><paragraph class="indentDown1 fontsize10" id="y7187baa6-e830-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Assistant secretary</inline>.—</heading><content>The term ‘<term>Assistant Secretary</term>’ means the Assistant Secretary for the Countering Weapons of Mass Destruction Office.</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7187baa7-e830-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Intelligence community</inline>.—</heading><content>The term ‘<term>intelligence community</term>’ has the meaning given such term in section 3(4) of the National Security Act of 1947 (<ref href="/us/usc/t50/s3003/4">50 U.S.C. 3003(4)</ref>).</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7187baa8-e830-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Office</inline>.—</heading><content>The term ‘<term>Office</term>’ means the Countering Weapons of Mass Destruction Office established under section 1901(a).</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="y7187baa9-e830-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Weapon of mass destruction</inline>.—</heading><content>The term ‘<term>weapon of mass destruction</term>’ has the meaning given the term in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<ref href="/us/usc/t50/s1801">50 U.S.C. 1801</ref>).</content></paragraph>

<subtitle id="y7187baaa-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658178"><num class="fontsize14 bold" value="A">“Subtitle A—</num><heading class="fontsize14 bold">Countering Weapons of Mass Destruction Office</heading><section class="indentUp1 firstIndent-2" id="y7187baab-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="1901">“SEC. 1901. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7187baac-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s591">6 USC 591</ref>.</p></sidenote><heading class="bold">COUNTERING WEAPONS OF MASS DESTRUCTION OFFICE.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y7187baad-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established in the Department a Countering Weapons of Mass Destruction Office.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7187baae-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7187baaf-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Appointment.</p><p class="leftAlign firstIndent0 fontsize8" id="x7187bab0-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Assistant Secretary</inline>.—</heading><content>The Office shall be headed by an Assistant Secretary for the Countering Weapons of Mass Destruction Office, who shall be appointed by the President.<page identifier="/us/stat/132/5163">132 STAT. 5163</page></content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7187bab1-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Responsibilities</inline>.—</heading><chapeau>The Assistant Secretary shall serve as the Secretary’s principal advisor on—</chapeau><paragraph class="fontsize10" id="y7187bab2-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>weapons of mass destruction matters and strategies; and</content></paragraph>
<paragraph class="fontsize10" id="y7187bab3-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7187bab4-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>coordinating the efforts of the Department to counter weapons of mass destruction.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7187bab5-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Details</inline>.—</heading><content>The Secretary may request that the Secretary of Defense, the Secretary of Energy, the Secretary of State, the Attorney General, the Nuclear Regulatory Commission, and the heads of other Federal agencies, including elements of the intelligence community, provide for the reimbursable detail of personnel with relevant expertise to the Office.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7187bab6-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>The Office shall terminate on the date that is 5 years after the date of the enactment of the Countering Weapons of Mass Destruction Act of 2018.”</content></subsection>

<paragraph class="fontsize10" id="y7187bab7-e830-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/387/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subtitle id="y7187e1c8-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658178"><num class="fontsize14 bold" value="B">“Subtitle B—</num><heading class="fontsize14 bold">Mission of the Office</heading><section class="indentUp1 firstIndent-2" id="y7187e1c9-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="1921">“SEC. 1921. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7187e1ca-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p><p class="leftAlign firstIndent0 fontsize8" id="x7187e1cb-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s591g">6 USC 591g</ref>.</p></sidenote><heading class="bold">MISSION OF THE OFFICE.</heading><content class="indentDown1 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “The Office shall be responsible for coordinating with other Federal efforts and developing a strategy and policy for the Department to plan for, detect, and protect against the importation, possession, storage, transportation, development, or use of unauthorized chemical, biological, radiological, or nuclear materials, devices, or agents in the United States and to protect against an attack using such materials, devices, or agents against the people, territory, or interests of the United States.</content></section>
<section class="indentUp1 firstIndent-2" id="y7187e1cc-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="1922">“SEC. 1922. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7187e1cd-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s591h">6 USC 591h</ref>.</p></sidenote><heading class="bold">RELATIONSHIP TO OTHER DEPARTMENT COMPONENTS AND FEDERAL AGENCIES.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y7187e1ce-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The authority of the Assistant Secretary under this title shall not affect or diminish the authority or the responsibility of any officer of the Department or any officer of any other Federal agency with respect to the command, control, or direction of the functions, personnel, funds, assets, or liabilities of any component of the Department or any other Federal agency.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7187e1cf-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7187e1d0-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x7187e1d1-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Office for Strategy, Policy, and Plans</inline>.—</heading><content>Not later than one year after the date of the enactment of the Countering Weapons of Mass Destruction Act of 2018, the Assistant Secretary shall, in coordination with the Under Secretary for Strategy, Policy, and Plans, submit to the appropriate congressional committees a strategy and implementation plan to direct programs within the Office and to integrate those programs with other programs and activities of the Department.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7187e1d2-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Federal Emergency Management Agency</inline>.—</heading><content>Nothing in this title or any other provision of law may be construed to affect or reduce the responsibilities of the Federal Emergency Management Agency or the Administrator of the Agency, including the diversion of any asset, function, or mission of the Agency or the Administrator of the Agency.”</content></subsection>

<subsection class="indentDown2 firstIndent0 fontsize10" id="y7188a53b-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>Through the STC program the Secretary shall—</chapeau><paragraph class="fontsize10" id="y7188a53c-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>assist State, local, Tribal, and territorial governments in designing and implementing, or enhancing existing, architectures for coordinated and integrated detection and interdiction of nuclear or other radiological materials that are out of regulatory control;</content></paragraph>
<paragraph class="fontsize10" id="y7188a53d-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>support the development of an operating capability to detect and report on nuclear and other radiological materials out of regulatory control;</content></paragraph>
<paragraph class="fontsize10" id="y7188a53e-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>provide resources to enhance detection, analysis, communication, and coordination to better integrate State, local, Tribal, and territorial assets into Federal operations;</content></paragraph>
<paragraph class="fontsize10" id="y7188a53f-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>facilitate alarm adjudication and provide subject matter expertise and technical assistance on concepts of operations, training, exercises, and alarm response protocols;</content></paragraph>
<paragraph class="fontsize10" id="y7188a540-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>communicate with, and promote sharing of information about the presence or detection of nuclear or other radiological materials among appropriate Federal, State, local, Tribal, and territorial government agencies, in a manner that ensures transparency with the jurisdictions designated under subsection (c);<page identifier="/us/stat/132/5165">132 STAT. 5165</page></content></paragraph>
<paragraph class="fontsize10" id="y7188a541-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>provide augmenting resources, as appropriate, to enable State, local, Tribal, and territorial governments to sustain and refresh their capabilities developed under the STC program;</content></paragraph>
<paragraph class="fontsize10" id="y7188a542-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>monitor expenditures under the STC program and track performance in meeting the goals of the STC program; and</content></paragraph>
<paragraph class="fontsize10" id="y7188a543-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>provide any other assistance the Secretary determines appropriate.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7188a544-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Designation of Jurisdictions</inline>.—</heading><paragraph class="fontsize10" id="y7188a545-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In carrying out the STC program under subsection (a), the Secretary shall designate jurisdictions from among high-risk urban areas under section 2003.</content></paragraph>
<paragraph class="fontsize10" id="y7188a546-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a547-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Congressional notification</inline>.—</heading><content>The Secretary shall notify the Committee on Homeland Security and the Committee on Appropriations of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate not later than 3 days before the designation of a new jurisdiction under paragraph (1) or any change to a jurisdiction previously designated under that paragraph.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7188a548-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Accountability</inline>.—</heading><paragraph class="fontsize10" id="y7188a549-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Implementation plan</inline>.—</heading><subparagraph class="fontsize10" id="y7188a54a-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a54b-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall develop, in consultation with relevant stakeholders, an implementation plan for carrying out the STC program that includes—</chapeau><clause class="fontsize10" id="y7188a54c-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a discussion of the goals of the STC program and a strategy to achieve those goals;</content></clause>
<clause class="fontsize10" id="y7188a54d-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>performance metrics and milestones for the STC program;</content></clause>
<clause class="fontsize10" id="y7188a54e-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>measures for achieving and sustaining capabilities under the STC program; and</content></clause>
<clause class="fontsize10" id="y7188a54f-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a550-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Costs.</p></sidenote><content>costs associated with achieving the goals of the STC program.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y7188a551-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a552-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Submission to congress</inline>.—</heading><content>Not later than one year after the date of the enactment of the Countering Weapons of Mass Destruction Act of 2018, the Secretary shall submit to the appropriate congressional committees and the Comptroller General of the United States the implementation plan required by subparagraph (A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7188a553-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Report required</inline>.—</heading><chapeau>Not later than one year after the submission of the implementation plan under paragraph (1)(B), the Secretary shall submit to the appropriate congressional committees and the Comptroller General a report that includes—</chapeau><subparagraph class="fontsize10" id="y7188a554-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a555-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>an assessment of the effectiveness of the STC program, based on the performance metrics and milestones required by paragraph (1)(A)(ii); and</content></subparagraph>
<subparagraph class="fontsize10" id="y7188a556-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a557-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Proposals.</p></sidenote><content>proposals for any changes to the STC program, including an explanation of how those changes align with the strategy and goals of the STC program and, as appropriate, address any challenges faced by the STC program.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7188a558-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a559-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x7188a55a-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Comptroller general review</inline>.—</heading><content>Not later than 18 months after the submission of the report required by paragraph (2), the Comptroller General of the United States shall submit to the appropriate congressional committees a report evaluating the implementation plan required by paragraph (1) <page identifier="/us/stat/132/5166">132 STAT. 5166</page>
and the report required by paragraph (2), including an assessment of progress made with respect to the performance metrics and milestones required by paragraph (1)(A)(ii) and the sustainment of the capabilities of the STC program.</content></paragraph>
<paragraph class="fontsize10" id="y7188a55b-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Briefing and submission requirements</inline>.—</heading><chapeau>Before making any changes to the structure or requirements of the STC program, the Assistant Secretary shall—</chapeau><subparagraph class="fontsize10" id="y7188a55c-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188a55d-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>consult with the appropriate congressional committees; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7188a55e-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>provide to those committees—</chapeau><clause class="fontsize10" id="y7188a55f-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a briefing on the proposed changes, including a justification for the changes;</content></clause>

<subsection class="indentDown2 firstIndent0 fontsize10" id="y7188f294-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Qualifications</inline>.—</heading><content>The individual appointed as Chief Medical Officer shall be a licensed physician possessing a demonstrated ability in and knowledge of medicine and public health.<page identifier="/us/stat/132/5167">132 STAT. 5167</page></content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7188f295-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Responsibilities</inline>.—</heading><chapeau>The Chief Medical Officer shall have the responsibility within the Department for medical issues related to natural disasters, acts of terrorism, and other man-made disasters, including—</chapeau><paragraph class="fontsize10" id="y7188f296-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>serving as the principal advisor on medical and public health issues to the Secretary, the Administrator of the Federal Emergency Management Agency, the Assistant Secretary, and other Department officials;</content></paragraph>
<paragraph class="fontsize10" id="y7188f297-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>providing operational medical support to all components of the Department;</content></paragraph>
<paragraph class="fontsize10" id="y7188f298-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>as appropriate, providing medical liaisons to the components of the Department, on a reimbursable basis, to provide subject matter expertise on operational medical issues;</content></paragraph>
<paragraph class="fontsize10" id="y7188f299-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7188f29a-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>coordinating with Federal, State, local, and Tribal governments, the medical community, and others within and outside the Department, including the Centers for Disease Control and Prevention and the Office of the Assistant Secretary for Preparedness and Response of the Department of Health and Human Services, with respect to medical and public health matters; and</content></paragraph>
<paragraph class="fontsize10" id="y7188f29b-e830-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>performing such other duties relating to such responsibilities as the Secretary may require.”</content></paragraph>
