<section id="d258915e92" identifier="/us/pl/115/36/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Public Safety Officers’ Benefits Improvement Act of 2017</shortTitle>”.</content></section>
<section id="d258915e102" identifier="/us/pl/115/36/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REPORTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6c8321ea-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1205 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3796c">42 U.S.C. 3796c</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y6c8321eb-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>Rules, regulations, and procedures issued under this part may include regulations based on standards developed by another Federal agency for programs related to public safety officer death or disability claims.</quotedText>” before the last sentence;</content></paragraph>
<paragraph class="fontsize10" id="y6c8321ec-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y6c8321ed-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(1)</quotedText>” before “<quotedText>In making</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6c8321ee-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentDown2 firstIndent0 fontsize10" id="y6c8321ef-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c8321f0-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>In making a determination under section 1201, the Bureau shall give substantial weight to the evidence and all findings of fact presented by a State, local, or Federal administrative or investigative agency regarding eligibility for death or disability benefits.</content></paragraph>
<paragraph class="indentDown2 firstIndent0 fontsize10" id="y6c8321f1-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c8321f2-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x6c8321f3-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Certification.</p></sidenote><content>If the head of a State, local, or Federal administrative or investigative agency, in consultation with the principal legal officer of the agency, provides a certification of facts regarding eligibility for death or disability benefits, the Bureau shall adopt the factual findings, if the factual findings are supported by substantial evidence.”</content></paragraph>
</quotedContent>; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6c834904-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y6c84f6b5-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e)</num><paragraph class="inline" id="y6c84f6b6-e831-11f0-bc57-ad3ac4b1618c"><num value="1">(1)</num><subparagraph class="inline" id="y6c84f6b7-e831-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c84f6b8-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x6c84f6b9-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><content>Not later than 30 days after the date of enactment of this subsection, the Bureau shall make available on the public website of the Bureau information on all death, disability, and educational assistance claims submitted under this part that are pending as of the date on which the information is made available.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y6c84f6ba-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Not less frequently than once per week, the Bureau shall make available on the public website of the Bureau updated information with respect to all death, disability, and educational assistance claims submitted under this part that are pending as of the date on which the information is made available.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y6c84f6bb-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>The information made available under this paragraph shall include—</chapeau><clause class="fontsize10" id="y6c84f6bc-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>for each pending claim—<page identifier="/us/stat/131/850">131 STAT. 850</page></chapeau><subclause class="fontsize10" id="y6c84f6bd-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the date on which the claim was submitted to the Bureau;</content></subclause>
<subclause class="fontsize10" id="y6c84f6be-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the State of residence of the claimant;</content></subclause>
<subclause class="fontsize10" id="y6c84f6bf-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>an anonymized, identifying claim number; and</content></subclause>
<subclause class="fontsize10" id="y6c84f6c0-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>the nature of the claim; and</content></subclause>
</clause>
<clause class="fontsize10" id="y6c84f6c1-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the total number of pending claims that were submitted to the Bureau more than 1 year before the date on which the information is made available.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6c84f6c2-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c84f6c3-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x6c84f6c4-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p><p class="leftAlign firstIndent0 fontsize8" id="x6c84f6c5-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p><p class="leftAlign firstIndent0 fontsize8" id="x6c84f6c6-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determinations.</p><p class="leftAlign firstIndent0 fontsize8" id="x6c84f6c7-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Claims.</p></sidenote><chapeau>Not later than 180 days after the date of enactment of this subsection, the Bureau shall publish on the public website of the Bureau a report, and shall update such report on such website not less than once every 180 days thereafter, containing—</chapeau><subparagraph class="fontsize10" id="y6c84f6c8-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the total number of claims for which a final determination has been made during the 180-day period preceding the report;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6c9-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the amount of time required to process each claim for which a final determination has been made during the 180-day period preceding the report;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6ca-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before that date for which a final determination has not been made;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6cb-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before the date that is 1 year before that date for which a final determination has not been made;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6cc-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>for each claim described in subparagraph (D), a detailed description of the basis for delay;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6cd-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before that date relating to exposure due to the September 11th, 2001, terrorism attacks for which a final determination has not been made;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6ce-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>as of the last day of the 180-day period preceding the report, the total number of claims submitted to the Bureau on or before the date that is 1 year before that date relating to exposure due to the September 11th, 2001, terrorism attacks for which a final determination has not been made;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6cf-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>for each claim described in subparagraph (G), a detailed description of the basis for delay;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6d0-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the total number of claims submitted to the Bureau relating to exposure due to the September 11th, 2001, terrorism attacks for which a final determination was made during the 180-day period preceding the report, and the average award amount for any such claims that were approved;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6d1-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">“(J) </num><content>the result of each claim for which a final determination was made during the 180-day period preceding the report, including the number of claims rejected and the basis for any denial of benefits;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6d2-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="K">“(K) </num><content>the number of final determinations which were appealed during the 180-day period preceding the report, regardless of when the final determination was first made;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6d3-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="L">“(L) </num><content>the average number of claims processed per reviewer of the Bureau during the 180-day period preceding the report;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6d4-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="M">“(M) </num><content>for any claim submitted to the Bureau that required the submission of additional information from a public agency, and for which the public agency completed providing all of <page identifier="/us/stat/131/851">131 STAT. 851</page>
the required information during the 180-day period preceding the report, the average length of the period beginning on the date the public agency was contacted by the Bureau and ending on the date on which the public agency submitted all required information to the Bureau;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6d5-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="N">“(N) </num><content>for any claim submitted to the Bureau for which the Bureau issued a subpoena to a public agency during the 180-day period preceding the report in order to obtain information or documentation necessary to determine the claim, the name of the public agency, the date on which the subpoena was issued, and the dates on which the public agency was contacted by the Bureau before the issuance of the subpoena; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6c84f6d6-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="O">“(O) </num><chapeau>information on the compliance of the Bureau with the obligation to offset award amounts under section 1201(f)(3), including—</chapeau><clause class="fontsize10" id="y6c84f6d7-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the number of claims that are eligible for compensation under both this part and the September 11th Victim Compensation Fund of 2001 (<ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref>; <ref href="/us/pl/107/42">Public Law 107–42</ref>) (commonly referred to as the ‘VCF’);</content></clause>
<clause class="fontsize10" id="y6c851de8-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>for each claim described in clause (i) for which compensation has been paid under the VCF, the amount of compensation paid under the VCF;</content></clause>
<clause class="fontsize10" id="y6c851de9-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the number of claims described in clause (i) for which the Bureau has made a final determination; and</content></clause>
<clause class="fontsize10" id="y6c851dea-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>the number of claims described in clause (i) for which the Bureau has not made a final determination.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6c851deb-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c851dec-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><chapeau>Not later than 2 years after the date of enactment of this subsection, and 2 years thereafter, the Comptroller General of the United States shall—</chapeau><subparagraph class="fontsize10" id="y6c851ded-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c851dee-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Study.</p></sidenote><content>conduct a study on the compliance of the Bureau with the obligation to offset award amounts under section 1201(f)(3); and</content></subparagraph>
<subparagraph class="fontsize10" id="y6c851def-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c851df0-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>submit to Congress a report on the study conducted under subparagraph (A) that includes an assessment of whether the Bureau has provided the information required under subparagraph (B)(ix) of paragraph (2) of this subsection in each report required under that paragraph.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6c851df1-e831-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c851df2-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>In this subsection, the term ‘<term>nature of the claim</term>’ means whether the claim is a claim for—</chapeau><subparagraph class="fontsize10" id="y6c851df3-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>benefits under this subpart with respect to the death of a public safety officer;</content></subparagraph>
<subparagraph class="fontsize10" id="y6c851df4-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>benefits under this subpart with respect to the disability of a public safety officer; or</content></subparagraph>
<subparagraph class="fontsize10" id="y6c851df5-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>education assistance under subpart 2.”</content></subparagraph>

<section id="d258915e410" identifier="/us/pl/115/36/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>AGE LIMITATION FOR CHILDREN.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6c856c16-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1212(c) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3796d–1/c">42 U.S.C. 3796d–1(c)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y6c856c17-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>No child</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y6c856c18-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to paragraph (2), no child”</content></paragraph>

<paragraph class="fontsize10" id="y6c856c19-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y6c85ba3a-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c85ba3b-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Delayed approvals</inline>.—</heading><subparagraph class="fontsize10" id="y6c85ba3c-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c85ba3d-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Claims.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Educational assistance application</inline>.—</heading><chapeau>If a claim for assistance under this subpart is approved more than 1 year after the date on which the application for such assistance is filed with the Attorney General, the age <page identifier="/us/stat/131/852">131 STAT. 852</page>
limitation under this subsection shall be extended by the length of the period—</chapeau><clause class="fontsize10" id="y6c85ba3e-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>beginning on the day after the date that is 1 year after the date on which the application is filed; and</content></clause>
<clause class="fontsize10" id="y6c85ba3f-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>ending on the date on which the application is approved.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y6c85ba40-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Claim for benefits for death or permanent and total disability</inline>.—</heading><chapeau>In addition to an extension under subparagraph (A), if any, for an application for assistance under this subpart that relates to a claim for benefits under subpart 1 that was approved more than 1 year after the date on which the claim was filed with the Attorney General, the age limitation under this subsection shall be extended by the length of the period—</chapeau><clause class="fontsize10" id="y6c85ba41-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>beginning on the day after the date that is 1 year after the date on which the claim for benefits is submitted; and</content></clause>

<section id="d258915e514" identifier="/us/pl/115/36/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DUE DILIGENCE IN PAYING BENEFIT CLAIMS.</heading><content class="firstIndent0 fontsize10" id="x6c85e153-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Subpart 1 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3796/etseq">42 U.S.C. 3796 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="indentUp2 firstIndent-2" id="y6c860864-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="1206">“SEC. 1206. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c860865-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s3796c–3">42 USC 3796c–3</ref>.</p></sidenote><heading class="bold">DUE DILIGENCE IN PAYING BENEFIT CLAIMS.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y6c860866-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Bureau, with all due diligence, shall expeditiously attempt to obtain the information and documentation necessary to adjudicate a benefit claim filed under this part, including a claim for financial assistance under subpart 2.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y6c860867-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Sufficient Information Unavailable</inline>.—</heading><content>If a benefit claim filed under this part, including a claim for financial assistance under subpart 2, is unable to be adjudicated by the Bureau because of a lack of information or documentation from a third party, such as a public agency, and such information is not readily available to the claimant, the Bureau may not abandon the benefit claim unless the Bureau has utilized the investigative tools available to the Bureau to obtain the necessary information or documentation, including subpoenas.”</content></subsection>

<paragraph class="fontsize10" id="y6c867d9f-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>shall not determine that a limitation described in subsection (a) applies, absent clear and convincing evidence.”</content></paragraph>

<section id="d258915e631" identifier="/us/pl/115/36/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6c86a4b0-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s3796a">42 USC 3796a note</ref>.</p></sidenote><heading>EFFECTIVE DATE; APPLICABILITY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6c86cbc1-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The amendments made by this Act shall—</chapeau><paragraph class="fontsize10" id="y6c86cbc2-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s6/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>take effect on the date of enactment of this Act; and<page identifier="/us/stat/131/853">131 STAT. 853</page></content></paragraph>
<paragraph class="fontsize10" id="y6c86cbc3-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s6/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>apply to any benefit claim or application under part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3796/etseq">42 U.S.C. 3796 et seq.</ref>) that is—</chapeau><subparagraph class="fontsize10" id="y6c86cbc4-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s6/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>pending before the Bureau of Justice Assistance on the date of enactment; or</content></subparagraph>
<subparagraph class="fontsize10" id="y6c86f2d5-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/36/s6/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>received by the Bureau on or after the date of enactment of this Act.</content></subparagraph>
