<section id="d259690e92" identifier="/us/pl/115/348/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Sanctioning the Use of Civilians as Defenseless Shields Act</shortTitle>”.</content></section>
<section id="d259690e102" identifier="/us/pl/115/348/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>STATEMENT OF POLICY.</heading><content style="-uslm-lc:I658120">  It shall be the policy of the United States to officially and publicly condemn the use of innocent civilians as human shields.</content></section>
<section id="d259690e109" identifier="/us/pl/115/348/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd7e64865-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><heading>IMPOSITION OF SANCTIONS WITH RESPECT TO FOREIGN PERSONS THAT ARE RESPONSIBLE FOR THE USE OF CIVILIANS AS HUMAN SHIELDS.</heading><subsection class="firstIndent0 fontsize10" id="yd7e780e6-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Imposition of Sanctions</inline>.—</heading><paragraph class="fontsize10" id="yd7e780e7-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Mandatory sanctions</inline>.—</heading><content>The President shall impose sanctions described in subsection (d) with respect to each person on the list required under subsection (b).</content></paragraph>
<paragraph class="fontsize10" id="yd7e780e8-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Permissive sanctions</inline>.—</heading><content>The President may impose sanctions described in subsection (d) with respect to each person on the list described in subsection (c).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e780e9-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Mandatory Sanctions List</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd7e780ea-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xd7e780eb-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determinations.</p></sidenote>—</heading><chapeau>Not later than one year after the date of the enactment of this Act, and annually thereafter, the President shall submit to the appropriate congressional committees a list of the following:</chapeau><paragraph class="fontsize10" id="yd7e780ec-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>Each foreign person that the President determines, on or after the date of the enactment of this Act—</chapeau><subparagraph class="fontsize10" id="yd7e780ed-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is a member of Hizballah or is knowingly acting on behalf of Hizballah; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd7e780ee-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd7e780ef-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>Each foreign person that the President determines, on or after the date of the enactment of this Act—</chapeau><subparagraph class="fontsize10" id="yd7e780f0-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is a member of Hamas or is knowingly acting on behalf of Hamas; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd7e780f1-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd7e780f2-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>Each foreign person or agency or instrumentality of a foreign state that the President determines, on or after the <page identifier="/us/stat/132/5056">132 STAT. 5056</page>
date of the enactment of this Act, knowingly and materially supports, orders, controls, directs, or otherwise engages in—</chapeau><subparagraph class="fontsize10" id="yd7e780f3-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any act described in subparagraph (B) of paragraph (1) by a person described in that paragraph; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd7e780f4-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any act described in subparagraph (B) of paragraph (2) by a person described in that paragraph.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e780f5-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Permissive Sanctions List</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd7e780f6-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xd7e780f7-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote>.—</heading><content>Not later than one year after the date of the enactment of this Act, and annually thereafter, the President should submit to the appropriate congressional committees a list of each foreign person that the President determines, on or after the date of the enactment of this Act, knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack, excluding foreign persons included in the most recent list under subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e780f8-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions Described</inline>.—</heading><chapeau>The sanctions to be imposed on a foreign person or an agency or instrumentality of a foreign state under this subsection are the following:</chapeau><paragraph class="fontsize10" id="yd7e780f9-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Blocking of property</inline>.—</heading><content>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>) to the extent necessary to block and prohibit all transactions in property and interests in property of the foreign person or agency or instrumentality of a foreign state if such property or interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</content></paragraph>
<paragraph class="fontsize10" id="yd7e780fa-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Aliens ineligible for visas, admission, or parole</inline>.—</heading><subparagraph class="fontsize10" id="yd7e780fb-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Visas, admission, or parole</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd7e780fc-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote>.—</heading><chapeau>An alien who the Secretary of State or the Secretary of Homeland Security determines is subject to sanctions under subsection (a) is—</chapeau><clause class="fontsize10" id="yd7e780fd-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>inadmissible to the United States;</content></clause>
<clause class="fontsize10" id="yd7e780fe-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>ineligible to receive a visa or other documentation to enter the United States; and</content></clause>
<clause class="fontsize10" id="yd7e780ff-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/etseq">8 U.S.C. 1101 et seq.</ref>).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd7e78100-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Current visas revoked</inline>.—</heading><content>Any visa or other documentation issued to an alien who is subject to sanctions under subsection (a), regardless of when such visa or other documentation was issued, shall be revoked and such alien shall be denied admission to the United States.</content></subparagraph>
<subparagraph class="fontsize10" id="yd7e78101-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/d/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Exception to comply with united nations headquarters agreement and other international obligations</inline>.—</heading><content>The sanctions under this paragraph shall not be imposed on an individual if admitting such individual to the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or with other applicable international obligations.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e78102-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd7e78103-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote>.—</heading><content>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1705">50 U.S.C. 1705</ref>) shall apply to a person that knowingly <page identifier="/us/stat/132/5057">132 STAT. 5057</page>
violates, attempts to violate, conspires to violate, or causes a violation of regulations prescribed to carry out this section to the same extent that such penalties apply to a person that knowingly commits an unlawful act described in section 206(a) of such Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e78104-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Procedures for Judicial Review of Classified Information</inline>.—</heading><paragraph class="fontsize10" id="yd7e78105-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If a finding under this section, or a prohibition, condition, or penalty imposed as a result of any such finding, is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (<ref href="/us/usc/t18/app">18 U.S.C. App.</ref>)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the President may submit such information to the court ex parte and in camera.</content></paragraph>
<paragraph class="fontsize10" id="yd7e78106-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under this section or any prohibition, condition, or penalty imposed as a result of any such finding.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e78107-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Waiver</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd7e78108-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xd7e78109-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Report.</p></sidenote>.—</heading><content>The President may waive the application of sanctions under this section if the President determines and reports to the appropriate congressional committees that such waiver is in the national security interest of the United States.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e7810a-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Regulatory Authority</inline>.—</heading><paragraph class="fontsize10" id="yd7e7810b-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/h/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The President may exercise all authorities under sections 203 and 205 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1702">50 U.S.C. 1702</ref> and 1704) for purposes of carrying out this section.</content></paragraph>
<paragraph class="fontsize10" id="yd7e7810c-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/h/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd7e7810d-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Issuance of regulations</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the President shall prescribe such regulations as may be necessary to implement this section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd7e7810e-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/i" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><chapeau>Nothing in this section may be construed—</chapeau><paragraph class="fontsize10" id="yd7e7810f-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/i/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to limit the authorities of the President pursuant to the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>) or any other relevant provision of law; or</content></paragraph>
<paragraph class="fontsize10" id="yd7e78110-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s3/i/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to apply with respect to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<ref href="/us/usc/t50/s3091/etseq">50 U.S.C. 3091 et seq.</ref>), or to any authorized intelligence activities of the United States.</content></paragraph>

<section id="d259690e425" identifier="/us/pl/115/348/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd7e81d51-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="yd7e81d52-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Admitted; alien</inline>.—</heading><content>The terms “admitted” and “alien” have the meanings given those terms in section 101 of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yd7e81d53-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Agency or instrumentality of a foreign state</inline>.—</heading><content>The term “<term>agency or instrumentality of a foreign state</term>” has the meaning given that term in <ref href="/us/usc/t28/s1603/b">section 1603(b) of title 28, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="yd7e81d54-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>In this section, the term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="yd7e81d55-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the Committee on the Judiciary of the Senate; and<page identifier="/us/stat/132/5058">132 STAT. 5058</page></content></subparagraph>
<subparagraph class="fontsize10" id="yd7e81d56-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Financial Services, the Committee on Foreign Affairs, and the Committee on the Judiciary of the House of Representatives.</content></subparagraph>

<paragraph class="fontsize10" id="yd7e81d57-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Foreign person</inline>.—</heading><chapeau>The term “<term>foreign person</term>” means—</chapeau><subparagraph class="fontsize10" id="yd7e81d58-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any citizen or national of a foreign state, wherever located; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd7e81d59-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any entity not organized solely under the laws of the United States or existing solely in the United States.</content></subparagraph>

<paragraph class="fontsize10" id="yd7e81d5a-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Hamas</inline>.—</heading><chapeau>The term “<term>Hamas</term>” means—</chapeau><subparagraph class="fontsize10" id="yd7e81d5b-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the entity known as Hamas and designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1189">8 U.S.C. 1189</ref>); or</content></subparagraph>
<subparagraph class="fontsize10" id="yd7e81d5c-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any person identified as an agent or instrumentality of Hamas on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Asset Control of the Department of the Treasury, the property or interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>).</content></subparagraph>

<paragraph class="fontsize10" id="yd7e81d5d-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Hizballah</inline>.—</heading><chapeau>The term “<term>Hizballah</term>” means—</chapeau><subparagraph class="fontsize10" id="yd7e81d5e-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the entity known as Hizballah and designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1189">8 U.S.C. 1189</ref>); or</content></subparagraph>

<paragraph class="fontsize10" id="yd7e81d60-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/348/s4/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">United states person</inline>.—</heading><content>The term “<term>United States person</term>” means any United States citizen, permanent resident alien, entity organized under the laws of the United States (including foreign branches), or any person in the United States.</content></paragraph>

<section id="d259690e563" identifier="/us/pl/115/348/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>SUNSET.</heading><content style="-uslm-lc:I658120">  This Act shall cease to be effective on December 31, 2023.</content></section>
