<section id="d259863e92" identifier="/us/pl/115/344/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Preventing Maternal Deaths Act of 2018</shortTitle>”.</content></section>
<section id="d259863e102" identifier="/us/pl/115/344/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SAFE MOTHERHOOD.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xf5b3adaf-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 317K of the Public Health Service Act (<ref href="/us/usc/t42/s247b–12">42 U.S.C. 247b–12</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yf5b3adb0-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="yf5b3adb1-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in paragraph (1)—</chapeau><clause class="fontsize10" id="yf5b3adb2-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>purpose of this subsection is to develop</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>purposes of this subsection are to establish or continue a Federal initiative to support State and tribal maternal mortality review committees, to improve data collection and reporting around maternal mortality, and to develop or support</quotedText>”;</content></clause>
<clause class="fontsize10" id="yf5b3adb3-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>population at risk of death and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>populations at risk of death and severe</quotedText>”; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf5b3adb4-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in paragraph (2)—</chapeau><clause class="fontsize10" id="yf5b3adb5-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by <amendingAction type="amend">amending</amendingAction> subparagraph (A) to read as follows:<quotedContent><subparagraph class="indentDown1 fontsize10" id="yf5b3adb6-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5b3adb7-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>The Secretary may continue and improve activities related to a national maternal mortality data collection and surveillance program to identify and support the review of pregnancy-associated deaths and pregnancy-related deaths that occur during, or within 1 year following, pregnancy.”</content></subparagraph>

<clause class="fontsize10" id="yf5b3adb8-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subparagraph (C) the following:<quotedContent><subparagraph class="indentDown1 fontsize10" id="yf5b3d4c9-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5b3d4ca-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Cooperation.</p></sidenote><content>The Secretary may, in cooperation with States, Indian tribes, and tribal organizations, develop a program to support States, Indian tribes, and tribal organizations in establishing or operating maternal mortality review committees, in accordance with subsection (d).”</content></subparagraph>

<clause class="fontsize10" id="yf5b3d4d1-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and other groups of women with disproportionately high rates of maternal mortality</quotedText>” before the semicolon;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4d2-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in subparagraph (I), by <amendingAction type="delete">striking</amendingAction> “<quotedText>domestic</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>interpersonal</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4d3-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subparagraphs (I) through (L) as subparagraphs (J) through (M), respectively;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4d4-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subparagraph (H) the following:<quotedContent><subclause class="indentUp0 fontsize10" id="yf5b3d4d5-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>activities to reduce disparities in maternity services and outcomes;”</content></subclause>
</quotedContent>; and</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4d6-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>in subparagraph (K), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>, alcohol and illegal drug use</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>and substance abuse and misuse</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf5b3d4d7-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>in subsection (c)—</chapeau><subparagraph class="fontsize10" id="yf5b3d4d8-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>(1) <headingText class="smallCaps">In general</headingText>—The Secretary</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>The Secretary</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4d9-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subparagraphs (A) through (C) as paragraphs (1) through (3), respectively, and adjusting the margins accordingly;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4da-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in paragraph (1), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>and the building of partnerships with outside organizations concerned about safe motherhood</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4db-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>in paragraph (2), as so redesignated, by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b3d4dc-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>in paragraph (3), as so redesignated, by <amendingAction type="delete">striking</amendingAction> the period and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></subparagraph>

<paragraph class="fontsize10" id="yf5b3d4e0-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (d) as subsection (f);</content></paragraph>
<paragraph class="fontsize10" id="yf5b3d4e1-e831-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/344/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (c) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yf5b4be42-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Maternal Mortality Review Committees</inline>.—</heading><paragraph class="fontsize10" id="yf5b4be43-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In order to participate in the program under subsection (a)(2)(D), the applicable maternal mortality review committee of the State, Indian tribe, or tribal organization shall—</chapeau><subparagraph class="fontsize10" id="yf5b4be44-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>include multidisciplinary and diverse membership that represents a variety of clinical specialties, State, tribal, or local public health officials, epidemiologists, statisticians, community organizations, geographic regions within the area covered by such committee, and individuals or organizations that represent the populations in the area covered by such committee that are most affected by pregnancy-related deaths or pregnancy-associated deaths and lack of access to maternal health care services; and<page identifier="/us/stat/132/5049">132 STAT. 5049</page></content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4be45-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>demonstrate to the Centers for Disease Control and Prevention that such maternal mortality review committee’s methods and processes for data collection and review, as required under paragraph (3), use best practices to reliably determine and include all pregnancy-associated deaths and pregnancy-related deaths, regardless of the outcome of the pregnancy.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf5b4be46-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Process for confidential reporting</inline>.—</heading><chapeau>States, Indian tribes, and tribal organizations that participate in the program described in this subsection shall, through the State maternal mortality review committee, develop a process that—</chapeau><subparagraph class="fontsize10" id="yf5b4be47-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>provides for confidential case reporting of pregnancy-associated and pregnancy-related deaths to the appropriate State or tribal health agency, including such reporting by—</chapeau><clause class="fontsize10" id="yf5b4be48-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>health care professionals;</content></clause>
<clause class="fontsize10" id="yf5b4be49-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>health care facilities;</content></clause>
<clause class="fontsize10" id="yf5b4be4a-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any individual responsible for completing death records, including medical examiners and medical coroners; and</content></clause>
<clause class="fontsize10" id="yf5b4be4b-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>other appropriate individuals or entities; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf5b4be4c-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provides for voluntary and confidential case reporting of pregnancy-associated deaths and pregnancy-related deaths to the appropriate State or tribal health agency by family members of the deceased, and other appropriate individuals, for purposes of review by the applicable maternal mortality review committee; and</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4be4d-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>shall include—</chapeau><clause class="fontsize10" id="yf5b4be4e-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5b4be4f-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><content>making publicly available contact information of the committee for use in such reporting; and</content></clause>
<clause class="fontsize10" id="yf5b4be50-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>conducting outreach to local professional organizations, community organizations, and social services agencies regarding the availability of the review committee.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf5b4be51-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Data collection and review</inline>.—</heading><chapeau>States, Indian tribes, and tribal organizations that participate in the program described in this subsection shall—</chapeau><subparagraph class="fontsize10" id="yf5b4be52-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>annually identify pregnancy-associated deaths and pregnancy-related deaths—</chapeau><clause class="fontsize10" id="yf5b4be53-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>through the appropriate vital statistics unit by—</chapeau><subclause class="fontsize10" id="yf5b4be54-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>matching each death record related to a pregnancy-associated death or pregnancy-related death in the State or tribal area in the applicable year to a birth certificate of an infant or fetal death record, as applicable;</content></subclause>
<subclause class="fontsize10" id="yf5b4be55-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>to the extent practicable, identifying an underlying or contributing cause of each pregnancy-associated death and each pregnancy-related death in the State or tribal area in the applicable year; and</content></subclause>
<subclause class="fontsize10" id="yf5b4be56-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>collecting data from medical examiner and coroner reports, as appropriate;</content></subclause>
</clause>
<clause class="fontsize10" id="yf5b4be57-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>using other appropriate methods or information to identify pregnancy-associated deaths and pregnancy-related deaths, including deaths from pregnancy outcomes not identified through clause (i)(I);<page identifier="/us/stat/132/5050">132 STAT. 5050</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf5b4be58-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5b4be59-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xf5b4be5a-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>through the maternal mortality review committee, review data and information to identify adverse outcomes that may contribute to pregnancy-associated death and pregnancy-related death, and to identify trends, patterns, and disparities in such adverse outcomes to allow the State, Indian tribe, or tribal organization to make recommendations to individuals and entities described in paragraph (2)(A), as appropriate, to improve maternal care and reduce pregnancy-associated death and pregnancy-related death;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4be5b-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>identify training available to the individuals and entities described in paragraph (2)(A) for accurate identification and reporting of pregnancy-associated and pregnancy-related deaths;</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4be5c-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>ensure that, to the extent practicable, the data collected and reported under this paragraph is in a format that allows for analysis by the Centers for Disease Control and Prevention; and</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4be5d-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5b4be5e-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><content>publicly identify the methods used to identify pregnancy-associated deaths and pregnancy-related deaths in accordance with this section.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf5b4be5f-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Confidentiality</inline>.—</heading><chapeau>States, Indian tribes, and tribal organizations participating in the program described in this subsection shall establish confidentiality protections to ensure, at a minimum, that—</chapeau><subparagraph class="fontsize10" id="yf5b4be60-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>there is no disclosure by the maternal mortality review committee, including any individual members of the committee, to any person, including any government official, of any identifying information about any specific maternal mortality case; and</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4be61-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>no information from committee proceedings, including deliberation or records, is made public unless specifically authorized under State and Federal law.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf5b4be62-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Reports to cdc</inline>.—</heading><chapeau>For fiscal year 2019, and each subsequent fiscal year, each maternal mortality review committee participating in the program described in this subsection shall submit to the Director of the Centers for Disease Control and Prevention a report that includes—</chapeau><subparagraph class="fontsize10" id="yf5b4be63-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5b4be64-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xf5b4be65-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>data, findings, and any recommendations of such committee; and</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4be66-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>as applicable, information on the implementation during such year of any recommendations submitted by the committee in a previous year.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf5b4be67-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">State partnerships</inline>.—</heading><content>States may partner with one or more neighboring States to carry out the activities under this subparagraph. With respect to the States in such a partnership, any requirement under this subparagraph relating to the reporting of information related to such activities shall be deemed to be fulfilled by each such State if a single such report is submitted for the partnership.</content></paragraph>
<paragraph class="fontsize10" id="yf5b4be68-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate mechanisms for indian tribes and tribal organizations</inline>.—</heading><content>The Secretary,<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5b4be69-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote> in consultation with Indian tribes, shall identify and establish appropriate mechanisms for Indian tribes and tribal organizations to demonstrate, report data, and conduct the activities as required for participation in the program described in this subsection. Such mechanisms may include technical assistance with respect to grant <page identifier="/us/stat/132/5051">132 STAT. 5051</page>
application and submission procedures, and award management activities.</content></paragraph>
<paragraph class="fontsize10" id="yf5b4be6a-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Research availability</inline>.—</heading><content>The Secretary shall develop a process to ensure that data collected under paragraph (5) is made available, as appropriate and practicable, for research purposes, in a manner that protects individually identifiable or potentially identifiable information and that is consistent with State and Federal privacy law.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yf5b4be6b-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="yf5b4e57c-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the terms ‘Indian tribe’ and ‘tribal organization’ have the meanings given such terms in section 4 of the Indian Self-Determination and Education Assistance Act;</content></paragraph>
<paragraph class="fontsize10" id="yf5b4e57d-e831-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the term ‘<term>pregnancy-associated death</term>’ means a death of a woman, by any cause, that occurs during, or within 1 year following, her pregnancy, regardless of the outcome, duration, or site of the pregnancy; and</content></paragraph>
<paragraph class="fontsize10" id="yf5b4e57e-e831-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>the term ‘<term>pregnancy-related death</term>’ means a death of a woman that occurs during, or within 1 year following, her pregnancy, regardless of the outcome, duration, or site of the pregnancy—</chapeau><subparagraph class="fontsize10" id="yf5b4e57f-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>from any cause related to, or aggravated by, the pregnancy or its management; and</content></subparagraph>
<subparagraph class="fontsize10" id="yf5b4e580-e831-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>not from accidental or incidental causes.”</content></subparagraph>
