<section id="d260008e102" identifier="/us/pl/115/342/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Congenital Heart Futures Reauthorization Act of 2017</shortTitle>”.</content></section>
<section id="d260008e112" identifier="/us/pl/115/342/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>NATIONAL CONGENITAL HEART DISEASE RESEARCH, SURVEILLANCE, AND AWARENESS.</heading><content class="firstIndent0 fontsize10" id="x0531bd88-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 399V–2 of the Public Health Service Act (<ref href="/us/usc/t42/s280g–13">42 U.S.C. 280g–13</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="indentUp0 firstIndent0" id="y053232b9-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658146"><num class="bold" value="399V–2">“SEC. 399V–2. </num><heading class="bold">NATIONAL CONGENITAL HEART DISEASE RESEARCH, SURVEILLANCE, AND AWARENESS.</heading><subsection class="firstIndent0 fontsize10" id="y053232ba-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Secretary shall, as appropriate—</chapeau><paragraph class="fontsize10" id="y053232bb-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>enhance and expand research and data collection efforts related to congenital heart disease, including to study and track the epidemiology of congenital heart disease to understand health outcomes for individuals with congenital heart disease across all ages;</content></paragraph>
<paragraph class="fontsize10" id="y053232bc-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>conduct activities to improve public awareness of, and education related to, congenital heart disease, including care of individuals with such disease; and</content></paragraph>
<paragraph class="fontsize10" id="y053232bd-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x053232be-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Grants.</p></sidenote><content>award grants to entities to undertake the activities described in this section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y053232bf-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Activities</inline>.—</heading><paragraph class="fontsize10" id="y053232c0-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall carry out activities, including, as appropriate, through a national cohort study and a nationally-representative, population-based surveillance system, to improve the understanding of the epidemiology of congenital heart disease in all age groups, with particular attention to—</chapeau><subparagraph class="fontsize10" id="y053232c1-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the incidence and prevalence of congenital heart disease in the United States;</content></subparagraph>
<subparagraph class="fontsize10" id="y053232c2-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>causation and risk factors associated with, and natural history of, congenital heart disease;</content></subparagraph>
<subparagraph class="fontsize10" id="y053232c3-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>health care utilization by individuals with congenital heart disease;</content></subparagraph>
<subparagraph class="fontsize10" id="y053232c4-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>demographic factors associated with congenital heart disease, such as age, race, ethnicity, sex, and family <page identifier="/us/stat/132/5041">132 STAT. 5041</page>
history of individuals who are diagnosed with the disease; and</content></subparagraph>
<subparagraph class="fontsize10" id="y053232c5-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>evidence-based practices related to care and treatment for individuals with congenital heart disease.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y053232c6-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Permissible considerations</inline>.—</heading><chapeau>In carrying out the activities under this section, the Secretary may, as appropriate—</chapeau><subparagraph class="fontsize10" id="y053232c7-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>collect data on the health outcomes, including behavioral and mental health outcomes, of a diverse population of individuals of all ages with congenital heart disease, such that analysis of the outcomes will inform evidence-based practices for individuals with congenital heart disease; and</content></subparagraph>
<subparagraph class="fontsize10" id="y053232c8-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>consider health disparities among individuals with congenital heart disease, which may include the consideration of prenatal exposures.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y053232c9-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Awareness Campaign</inline>.—</heading><content>The Secretary may carry out awareness and educational activities related to congenital heart disease in individuals of all ages, which may include information for patients, family members, and health care providers, on topics such as the prevalence of such disease, the effect of such disease on individuals of all ages, and the importance of long-term, specialized care for individuals with such disease.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y053232ca-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Public Access</inline>.—</heading><content>The Secretary shall ensure that, subject to subsection (e), information collected under this section is made available, as appropriate, to the public, including researchers.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y053232cb-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Patient Privacy</inline>.—</heading><content>The Secretary shall ensure that the data and information collected under this section are made available in a manner that, at a minimum, protects personal privacy to the extent required by applicable Federal and State law.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y053232cc-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility for Grants</inline>.—</heading><chapeau>To be eligible to receive a grant under subsection (a)(3), an entity shall—</chapeau><paragraph class="fontsize10" id="y053232cd-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>be a public or private nonprofit entity with specialized experience in congenital heart disease; and</content></paragraph>
<paragraph class="fontsize10" id="y053232ce-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y053232cf-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>To carry out this section, there are authorized to be appropriated $10,000,000 for each of fiscal years 2020 through 2024.”</content></subsection>

<section id="d260008e283" identifier="/us/pl/115/342/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x053232d0-e832-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Summary.</p></sidenote><heading>REPORT.</heading><content style="-uslm-lc:I658120">  Not later than 3 years after the date of enactment of the Congenital Heart Futures Reauthorization Act of 2017, the Secretary of Health and Human Services shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report summarizing any activities carried out pursuant to section 399V–2 of the Public Health Service Act (as amended by section 2), including planned activities, and a summary of any research findings and ongoing research efforts, gaps, and areas <page identifier="/us/stat/132/5042">132 STAT. 5042</page>
of greatest need within the Department of Health and Human Services regarding congenital heart disease in patients of all ages.</content></section>
