<section id="d144182e181" identifier="/us/pl/115/335/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SENSE OF CONGRESS ON ADVANCING A NEGOTIATED SOLUTION TO NICARAGUA’S CRISIS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x41f947d4-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y41f947d5-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>credible negotiations between the Government of Nicaragua and representatives of Nicaragua’s civil society, student movement, private sector, and political opposition, mediated by the Catholic Church in Nicaragua, represent the best opportunity to reach a peaceful solution to the current political crisis that includes—</chapeau><subparagraph class="fontsize10" id="y41f947d6-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a commitment to hold early elections that meet democratic standards and permit credible international electoral observation;</content></subparagraph>
<subparagraph class="fontsize10" id="y41f947d7-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the cessation of the violence perpetrated against civilians by the National Police of Nicaragua and by armed groups supported by the Government of Nicaragua; and</content></subparagraph>
<subparagraph class="fontsize10" id="y41f947d8-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s2/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>independent investigations into the killings of protesters; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y41f947d9-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>negotiations between the Government of Nicaragua and representatives of Nicaragua’s civil society, student movement, private sector, and political opposition, mediated by the Catholic Church in Nicaragua, have not resulted in an agreement as of the date of the enactment of this Act because the Government of Nicaragua has failed to credibly participate in the process.<page identifier="/us/stat/132/5020">132 STAT. 5020</page></content></paragraph>
</section>
<section id="d144182e216" identifier="/us/pl/115/335/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>STATEMENT OF POLICY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x41f96eea-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is the policy of the United States to support—</chapeau><paragraph class="fontsize10" id="y41f96eeb-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the rule of law and an independent judiciary and electoral council in Nicaragua;</content></paragraph>
<paragraph class="fontsize10" id="y41f96eec-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>democratic governance in Nicaragua;</content></paragraph>
<paragraph class="fontsize10" id="y41f96eed-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>free and fair elections overseen by credible domestic and international observers in Nicaragua; and</content></paragraph>
<paragraph class="fontsize10" id="y41f96eee-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s3/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>anti-corruption and transparency efforts in Nicaragua.</content></paragraph>

<section id="d144182e244" identifier="/us/pl/115/335/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>RESTRICTIONS ON INTERNATIONAL FINANCIAL INSTITUTIONS RELATING TO NICARAGUA.</heading><subsection class="firstIndent0 fontsize10" id="y41f9bd0f-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Restrictions</inline>.—</heading><chapeau>The Secretary of the Treasury shall—</chapeau><paragraph class="fontsize10" id="y41f9bd10-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>instruct the United States Executive Director at each international financial institution of the World Bank Group to use the voice, vote, and influence of the United States to oppose the extension by the International Finance Corporation of any loan or financial or technical assistance to the Government of Nicaragua for a project in Nicaragua;</content></paragraph>
<paragraph class="fontsize10" id="y41f9bd11-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>instruct the United States Executive Director of the Inter-American Development Bank to use the voice, vote, and influence of the United States to oppose the extension by the Bank of any loan or financial or technical assistance to the Government of Nicaragua for a project in Nicaragua; and</content></paragraph>
<paragraph class="fontsize10" id="y41f9bd12-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>instruct the United States Executive Director of each other international financial institution, including the International Monetary Fund, to work with other key donor countries to develop a coherent policy approach to future engagements with and lending to the Government of Nicaragua, in a manner that will advance human rights, including the full restoration of the rights guaranteed to the people of Nicaragua through the commitments made by the Government of Nicaragua as a signatory of the International Covenant on Civil and Political Rights.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y41f9bd13-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions for Basic Human Needs and Democracy Promotion</inline>.—</heading><content>The restrictions under paragraphs (1) and (2) of subsection (a) shall not apply with respect to any loan or financial or technical assistance provided to address basic human needs or to promote democracy in Nicaragua.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y41f9bd14-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41f9bd15-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Briefing by the Secretary of the Treasury</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of the Treasury shall brief the appropriate congressional committees on the effectiveness of international financial institutions in enforcing applicable program safeguards in Nicaragua.</content></subsection>
</section>
<section id="d144182e294" identifier="/us/pl/115/335/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>IMPOSITION OF TARGETED SANCTIONS WITH RESPECT TO NICARAGUA.</heading><subsection class="firstIndent0 fontsize10" id="y41faa776-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41faa777-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="x41faa778-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>.—</heading><chapeau>The President shall impose the sanctions described in subsection (c) with respect to any foreign person, including any current or former official of the Government of Nicaragua or any person acting on behalf of that Government, that the President determines—</chapeau><paragraph class="fontsize10" id="y41faa779-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to be responsible for or complicit in, or responsible for ordering, controlling, or otherwise directing, or to have knowingly participated in, directly or indirectly, any activity described in subsection (b);</content></paragraph>
<paragraph class="fontsize10" id="y41faa77a-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>to be a leader of—</chapeau><page identifier="/us/stat/132/5021">132 STAT. 5021</page>
<subparagraph class="fontsize10" id="y41faa77b-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an entity that has, or whose members have, engaged in any activity described in subsection (b); or</content></subparagraph>
<subparagraph class="fontsize10" id="y41faa77c-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an entity whose property and interests in property are blocked under subsection (c)(1)(A) as a result of activities related to the tenure of the leader;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y41faa77d-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>to have knowingly materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services in support of—</chapeau><subparagraph class="fontsize10" id="y41faa77e-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an activity described in subsection (b); or</content></subparagraph>
<subparagraph class="fontsize10" id="y41faa77f-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a person whose property and interests in property are blocked under subsection (c)(1)(A); or</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y41faa780-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to be owned or controlled by, or to have knowingly acted or purported to act for or on behalf of, directly or indirectly, any person whose property and interests in property are blocked under subsection (c)(1)(A).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y41faa781-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Activities Described</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41faa782-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote>.—</heading><chapeau>An activity described in this subsection is any of the following in or in relation to Nicaragua on or after April 18, 2018:</chapeau><paragraph class="fontsize10" id="y41faa783-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Significant acts of violence or conduct that constitutes a serious abuse or violation of human rights against persons associated with the protests in Nicaragua that began on April 18, 2018.</content></paragraph>
<paragraph class="fontsize10" id="y41faa784-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Significant actions or policies that undermine democratic processes or institutions.</content></paragraph>
<paragraph class="fontsize10" id="y41faa785-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>Acts of significant corruption by or on behalf of the Government of Nicaragua or a current or former official of the Government of Nicaragua, including—</chapeau><subparagraph class="fontsize10" id="y41faa786-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the expropriation of private or public assets for personal gain or political purposes;</content></subparagraph>
<subparagraph class="fontsize10" id="y41faa787-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>corruption related to government contracts;</content></subparagraph>
<subparagraph class="fontsize10" id="y41faa788-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>bribery; or</content></subparagraph>
<subparagraph class="fontsize10" id="y41faa789-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the facilitation or transfer of the proceeds of corruption.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y41faa78a-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The arrest or prosecution of a person, including an individual or media outlet disseminating information to the public, primarily because of the legitimate exercise by such person of the freedom of speech, assembly, or the press.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y41face9b-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions Described</inline>.—</heading><paragraph class="fontsize10" id="y41face9c-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The sanctions described in this subsection are the following:</chapeau><subparagraph class="fontsize10" id="y41face9d-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Asset blocking</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41face9e-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x41face9f-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>.—</heading><content>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of a person determined by the President to be subject to subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</content></subparagraph>
<subparagraph class="fontsize10" id="y41facea0-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusion from the united states and revocation of visa or other documentation</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41facea1-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x41facea2-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>—</heading><content>In the case of an alien determined by the President to be subject to subsection (a), denial of a visa to, and exclusion from the United States of, the alien, and revocation in accordance with section 221(i) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1201/i">8 U.S.C. 1201(i)</ref>), of any visa or other documentation of the alien.<page identifier="/us/stat/132/5022">132 STAT. 5022</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y41facea3-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><content>A person that violates, attempts to violate, conspires to violate, or causes a violation of a measure imposed pursuant to paragraph (1)(A) or any regulation, license, or order issued to carry out paragraph (1)(A) shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1705">50 U.S.C. 1705</ref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</content></paragraph>
<paragraph class="fontsize10" id="y41facea4-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Exception relating to importation of goods</inline>.—</heading><content>The requirement to block and prohibit all transactions in all property and interests in property under paragraph (1)(A) shall not include the authority to impose sanctions on the importation of goods.</content></paragraph>
<paragraph class="fontsize10" id="y41facea5-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Exception to comply with united nations headquarters agreement</inline>.—</heading><content>Sanctions under paragraph (1)(B) shall not apply to an alien if admitting the alien into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y41facea6-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41facea7-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation; Regulatory Authority</inline>.—</heading><paragraph class="fontsize10" id="y41facea8-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><content>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1702">50 U.S.C. 1702</ref> and 1704) to carry out this section.</content></paragraph>
<paragraph class="fontsize10" id="y41facea9-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s5/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Regulatory authority</inline>.—</heading><content>The President shall issue such regulations, licenses, and orders as are necessary to carry out this section.</content></paragraph>

<section id="d144182e528" identifier="/us/pl/115/335/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>ANNUAL CERTIFICATION AND WAIVER.</heading><subsection class="firstIndent0 fontsize10" id="y41fb43da-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41fb43db-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x41fb43dc-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Certification</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State shall submit to the appropriate congressional committees a report certifying whether the Government of Nicaragua is taking effective steps—</chapeau><paragraph class="fontsize10" id="y41fb43dd-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to strengthen the rule of law and democratic governance, including the independence of the judicial system and electoral council;</content></paragraph>
<paragraph class="fontsize10" id="y41fb43de-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to combat corruption, including by investigating and prosecuting cases of public corruption;</content></paragraph>
<paragraph class="fontsize10" id="y41fb43df-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to protect civil and political rights, including the rights of freedom of the press, speech, and association, for all people of Nicaragua, including political opposition parties, journalists, trade unionists, human rights defenders, indigenous peoples, and other civil society activists;</content></paragraph>
<paragraph class="fontsize10" id="y41fb43e0-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to investigate and hold accountable officials of the Government of Nicaragua and other persons responsible for the killings of individuals associated with the protests in Nicaragua that began on April 18, 2018; and</content></paragraph>
<paragraph class="fontsize10" id="y41fb43e1-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to hold free and fair elections overseen by credible domestic and international observers</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y41fb43e2-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Waiver</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41fb43e3-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>.—</heading><paragraph class="fontsize10" id="y41fb43e4-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Temporary general waiver</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41fb43e5-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote>.—</heading><content>If the Secretary certifies to the appropriate congressional committees under subsection (a) that the Government of Nicaragua is taking effective steps <page identifier="/us/stat/132/5023">132 STAT. 5023</page>
as described in that subsection, the President may waive the application of the restrictions under section 4 and sanctions under section 5 for a period of not more than one year beginning on the date of the certification.</content></paragraph>
<paragraph class="fontsize10" id="y41fb43e6-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">National interest waiver</inline>.—</heading><chapeau>The President may waive the application of the restrictions under section 4 and sanctions under section 5 if the President—</chapeau><subparagraph class="fontsize10" id="y41fb43e7-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41fb43e8-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determines that such a waiver is in the national interest of the United States; and</content></subparagraph>
<subparagraph class="fontsize10" id="y41fb43e9-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41fb43ea-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notice.</p></sidenote><content>submits to the appropriate congressional committees a notice of and justification for the waiver.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y41fb43eb-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Sense of congress</inline>.—</heading><content>It is the sense of Congress that the President should exercise the waiver authority provided under paragraph (1) if the Secretary of State certifies under subsection (a) that the Government of Nicaragua is taking effective steps as described in that subsection.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y41fb43ec-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>In preparing a certification required by subsection (a), the Secretary shall consult with the appropriate congressional committees.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y41fb43ed-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s6/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Annual Briefing</inline>.—</heading><content>The Secretary shall annually brief the appropriate congressional committees on whether the Government of Nicaragua is taking effective steps as described in subsection (a).</content></subsection>

<section id="d144182e652" identifier="/us/pl/115/335/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>REPORT ON HUMAN RIGHTS VIOLATIONS AND CORRUPTION IN NICARAGUA.</heading><subsection class="firstIndent0 fontsize10" id="y41fb920e-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41fb920f-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, the Secretary of State, acting through the Assistant Secretary of State for Intelligence and Research, and in coordination with the Secretary of the Treasury and the Director of National Intelligence, shall submit to the appropriate congressional committees a report on—</chapeau><paragraph class="fontsize10" id="y41fb9210-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s7/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the involvement of senior officials of the Government of Nicaragua, including members of the Supreme Electoral Council, the National Assembly, and the judicial system, in human rights violations, acts of significant corruption, and money laundering; and</content></paragraph>
<paragraph class="fontsize10" id="y41fb9211-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s7/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>persons that transfer, or facilitate the transfer of, goods or technologies for use in or with respect to Nicaragua, that are used by the Government of Nicaragua to commit serious human rights violations against the people of Nicaragua.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y41fb9212-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The report required by subsection (a) may be classified.</content></subsection>

<section id="d144182e688" identifier="/us/pl/115/335/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>CIVIL SOCIETY ENGAGEMENT STRATEGY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x41fb9213-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x41fb9214-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x41fbb925-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Briefing.</p></sidenote>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall brief the appropriate congressional committees on a strategy—</chapeau><paragraph class="fontsize10" id="y41fbb926-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s8/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>for engaging relevant elements of civil society in Nicaragua, including independent media, human rights, and anti-corruption organizations, to strengthen rule of law and increase accountability for human rights abuses and corruption in Nicaragua; and</content></paragraph>
<paragraph class="fontsize10" id="y41fbb927-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s8/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>setting forth measures to support the protection of human rights and anti-corruption advocates in Nicaragua.<page identifier="/us/stat/132/5024">132 STAT. 5024</page></content></paragraph>
</section>
<section id="d144182e714" identifier="/us/pl/115/335/s9" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>REFORM OF WESTERN HEMISPHERE DRUG POLICY COMMISSION.</heading><content style="-uslm-lc:I658120">  Section 603(f)(1) of the Department of State Authorities Act, Fiscal Year 2017 (<ref href="/us/pl/114/323">Public Law 114–323</ref>; <ref href="/us/stat/130/1938">130 Stat. 1938</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>Not later than 60 days after the date of the enactment of this Act, the Commission shall hold an initial meeting to develop and implement</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>At the initial meeting of the Commission, the Commission shall develop and implement</quotedText>”.</content></section>
<section id="d144182e737" identifier="/us/pl/115/335/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><heading>TERMINATION.</heading><content style="-uslm-lc:I658120">  The provisions of this Act (other than section 9) shall terminate on December 31, 2023.</content></section>
<section id="d144182e744" identifier="/us/pl/115/335/s11" style="-uslm-lc:I658142"><num class="fontsize12" value="11">SEC. 11. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x41fc0748-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y41fc0749-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s11/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y41fc074a-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s11/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Committee on Appropriations of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="y41fc074b-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s11/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Foreign Affairs, the Committee on Financial Services, and the Committee on Appropriations of the House of Representatives.</content></subparagraph>

<paragraph class="fontsize10" id="y41fc074c-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s11/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Good</inline>.—</heading><content>The term “<term>good</term>” means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</content></paragraph>
<paragraph class="fontsize10" id="y41fc074d-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s11/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Person</inline>.—</heading><content>The term “<term>person</term>” means an individual or entity.</content></paragraph>
<paragraph class="fontsize10" id="y41fc074e-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/335/s11/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">United states person</inline>.—</heading><content>The term “<term>United States person</term>” means any United States citizen, permanent resident alien, entity organized under the laws of the United States or any jurisdiction within the United States (including a foreign branch of such an entity), or any person in the United States.</content></paragraph>
