<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x81a7ec1f-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Endangered Salmon Predation Prevention Act.</p></sidenote>
<section id="d144675e88" identifier="/us/pl/115/329/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x81a7ec20-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1361">16 USC 1361 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Endangered Salmon Predation Prevention Act</shortTitle>”.</content></section>
<section id="d144675e103" identifier="/us/pl/115/329/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SENSE OF CONGRESS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x81a83a41-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is the sense of the Congress that—</chapeau><paragraph class="fontsize10" id="y81a83a42-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/329/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>preventing predation by sea lions, recovery of listed salmonid stocks, and preventing future listings of fish stocks in the Columbia River under the Endangered Species Act of 1973 (<ref href="/us/usc/t16/s1531/etseq">16 U.S.C. 1531 et seq.</ref>) is a vital priority; and</content></paragraph>
<paragraph class="fontsize10" id="y81a83a43-e832-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/329/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Federal Government should continue to fund lethal and nonlethal removal, and deterrence, measures for preventing such predation.</content></paragraph>
</section>
<section id="d144675e124" identifier="/us/pl/115/329/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>TAKING OF SEA LIONS ON THE COLUMBIA RIVER AND ITS TRIBUTARIES TO PROTECT ENDANGERED AND THREATENED SPECIES OF SALMON AND OTHER NONLISTED FISH SPECIES.</heading><content class="firstIndent0 fontsize10" id="x81a8af74-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 120(f) of the Marine Mammal Protection Act of 1972 (<ref href="/us/usc/t16/s1389/f">16 U.S.C. 1389(f)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subsection class="firstIndent0 fontsize10" id="y81a972c5-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Temporary Marine Mammal Removal Authority on the Waters of the Columbia River or Its Tributaries</inline>.—</heading><paragraph class="fontsize10" id="y81a972c6-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Removal authority</inline>.—</heading><chapeau>Notwithstanding any other provision of this Act, the Secretary may issue a permit to an eligible entity to authorize the intentional lethal taking on the waters of the Columbia River and its tributaries of individually identifiable sea lions that are part of a population or stock that is not categorized under this Act as depleted or strategic for the purpose of protecting—</chapeau><subparagraph class="fontsize10" id="y81a972c7-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>species of salmon, steelhead, or eulachon that are listed as endangered species or threatened species under the Endangered Species Act of 1973 (<ref href="/us/usc/t16/s1531/etseq">16 U.S.C. 1531 et seq.</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y81a972c8-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>species of lamprey or sturgeon that are not so listed as endangered or threatened but are listed as a species of concern.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y81a972c9-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Permit process</inline>.—</heading><subparagraph class="fontsize10" id="y81a972ca-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>An eligible entity may apply to the Secretary for a permit under this subsection.<page identifier="/us/stat/132/4476">132 STAT. 4476</page></content></subparagraph>
<subparagraph class="fontsize10" id="y81a972cb-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Timelines and procedures of application</inline>.—</heading><content>The timelines and procedures described in subsection (c) shall apply to applications for permits under this subsection in the same manner such timelines apply to applications under subsection (b).</content></subparagraph>
<subparagraph class="fontsize10" id="y81a972cc-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><content>The Secretary shall establish procedures to coordinate issuance of permits under this subsection, including application procedures and timelines, delegation and revocation of permits to and between eligible entities, monitoring, periodic review, and geographic, seasonal take, and species-specific considerations.</content></subparagraph>
<subparagraph class="fontsize10" id="y81a972cd-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Duration of permit</inline>.—</heading><content>A permit under this subsection shall be effective for a period of not more than 5 years, and may be renewed by the Secretary.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y81a972ce-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Limitations on annual takings</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x81a972cf-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote>—</heading><content>The Secretary shall apply the process for determining limitations on annual take of sea lions under subsection (c) to determinations on limitations under this subsection, and the cumulative number of sea lions authorized to be taken each year under all permits in effect under this subsection shall not exceed 10 percent of the annual potential biological removal level for sea lions.</content></paragraph>
<paragraph class="fontsize10" id="y81a972d0-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Qualified individuals</inline>.—</heading><chapeau>Intentional lethal takings under this subsection shall—</chapeau><subparagraph class="fontsize10" id="y81a972d1-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>be humane within the meaning of such term under section 3(4);</content></subparagraph>
<subparagraph class="fontsize10" id="y81a972d2-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>require that capture, husbandry, transportation, and euthanasia protocols are based on standards propagated by an Institutional Animal Care and Use Committee and that primary euthanasia be limited to humane chemical methods; and</content></subparagraph>
<subparagraph class="fontsize10" id="y81a972d3-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>be implemented by agencies or qualified individuals described in subsection (c)(4), or by individuals employed by the eligible entities described in paragraph (6).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y81a972d4-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Suspension of permitting authority</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x81a972d5-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x81a972d6-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x81a972d7-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>—</heading><content>If, 5 years after the date of the enactment of the Endangered Salmon Predation Prevention Act, the Secretary, after consulting with State and tribal fishery managers, determines that lethal removal authority is no longer necessary to protect salmonid and other fish species from sea lion predation, the Secretary shall suspend the issuance of permits under this subsection.</content></paragraph>
<paragraph class="fontsize10" id="y81a972d8-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Eligible entity defined</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x81a972d9-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Washington.</p><p class="leftAlign firstIndent0 fontsize8" id="x81a972da-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Oregon.</p><p class="leftAlign firstIndent0 fontsize8" id="x81a972db-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Idaho.</p><p class="leftAlign firstIndent0 fontsize8" id="x81a972dc-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Native Americans.</p></sidenote>—</heading><subparagraph class="fontsize10" id="y81a972dd-e832-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this subsection, the term ‘<term>eligible entity</term>’ means—</chapeau><clause class="fontsize10" id="y81a972de-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>with respect to removal in the mainstem of the Columbia River, from river mile 112 to the McNary Dam and its tributaries in the State of Washington, and its tributaries in the State of Oregon above Bonneville Dam, the State of Washington, the State of Oregon, and the State of Idaho;</content></clause>
<clause class="fontsize10" id="y81a972df-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>with respect to removal in the mainstem Columbia River from river mile 112 to the McNary Dam and its tributaries within the State of Washington and in any of its tributaries above Bonneville Dam within the State of Oregon, the Nez Perce Tribe, the Confederated Tribes of the Umatilla Indian Reservation, the Confederated Tribes of the Warm Springs <page identifier="/us/stat/132/4477">132 STAT. 4477</page>
Reservation of Oregon, and the Confederated Tribes and Bands of the Yakama Nation; and</content></clause>
<clause class="fontsize10" id="y81a972e0-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>with respect to removal in the Willamette River and other tributaries of the Columbia River within the State of Oregon below Bonneville Dam, a committee recognized by the Secretary under subparagraph (D).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y81a972e1-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Delegation authority</inline>.—</heading><content>The Secretary may allow eligible entities described in clause (i) or (ii) of subparagraph (A) to delegate their authority under a permit under this subsection to the Columbia River Intertribal Fish Commission for removal in the mainstem of the Columbia River above river mile 112 and below McNary Dam, in the Columbia River tributaries in the State of Washington, or in tributaries within the State of Oregon above Bonneville Dam and below McNary Dam.</content></subparagraph>
<subparagraph class="fontsize10" id="y81a972e2-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Additional delegation authority</inline>.—</heading><content>The Secretary may allow an eligible entity described in subparagraph (A)(i) to delegate its authority under a permit under this subsection to any entity described in subclause (i) or (ii) of subparagraph (A) with respect to removal in the mainstem of the Columbia River above river mile 112 and below McNary Dam, in the Columbia River tributaries in the State of Washington, or in tributaries in the State of Oregon above Bonneville Dam and below McNary Dam.</content></subparagraph>
<subparagraph class="fontsize10" id="y81a999f3-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Committee requirements</inline>.—</heading><clause class="fontsize10" id="y81a999f4-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall recognize a committee established in accordance with this subparagraph as being eligible for a permit under this subsection, for purposes of subparagraph (A)(iii).</content></clause>
<clause class="fontsize10" id="y81a999f5-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>A committee established under this subparagraph shall consist of the State of Oregon and each of the following:</chapeau><subclause class="fontsize10" id="y81a999f6-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>The Confederated Tribes of Siletz Indians or the Confederated Tribes of the Grand Ronde Community, or both.</content></subclause>
<subclause class="fontsize10" id="y81a999f7-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>The Confederated Tribes of the Warm Springs or the Confederated Tribes of the Umatilla Reservation, or both.</content></subclause>
</clause>
<clause class="fontsize10" id="y81a999f8-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Majority agreement required</inline>.—</heading><content>A committee established under this subparagraph may take action with respect to a permit application and removal under this subsection only with majority agreement by the committee members.</content></clause>
<clause class="fontsize10" id="y81a999f9-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplicability of faca</inline>.—</heading><content>The Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) shall not apply to a committee established under this subparagraph.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y81a999fa-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Individual exception</inline>.—</heading><content>For purposes of this subsection, any sea lion located upstream of river mile 112 and downstream of McNary Dam, or in any tributary to the Columbia River that includes spawning habitat of threatened or endangered salmon or steelhead is deemed to be individually identifiable.</content></paragraph>
<paragraph class="fontsize10" id="y81a999fb-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Significant negative impact exception</inline>.—</heading><content>For purposes of this subsection, any sea lion located in the mainstem of the Columbia River upstream of river mile 112 and downstream of McNary Dam, or in any tributary to the Columbia <page identifier="/us/stat/132/4478">132 STAT. 4478</page>
River that includes spawning habitat of threatened or endangered salmon or steelhead is deemed to be having a significant negative impact, within the meaning of subsection (b)(1).</content></paragraph>
<paragraph class="fontsize10" id="y81a999fc-e832-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>In this subsection, the term ‘<term>Indian tribe</term>’ has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>).”</content></paragraph>

<section id="d144675e431" identifier="/us/pl/115/329/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x81a999fd-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1389">16 USC 1389 note</ref>.</p></sidenote><heading>TREATY RIGHTS OF FEDERALLY RECOGNIZED INDIAN TRIBES.</heading><content style="-uslm-lc:I658120">  Nothing in this Act or the amendments made by this Act shall be construed to enlarge, confirm, adjudicate, affect, or modify any treaty or other right of an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>)).</content></section>
<section id="d144675e446" identifier="/us/pl/115/329/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x81a999fe-e832-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Study.</p></sidenote><heading>REPORT.</heading><content style="-uslm-lc:I658120">  Not later than 3 years after the date of the enactment of this Act, the Secretary of Commerce shall study and report to Congress on the effects of deterrence and the lethal taking of sea lions on the recovery of endangered and threatened salmon and steelhead stocks in the waters of the Columbia River and the tributaries of the Columbia River subject to section 120(f) of the Marine Mammal Protection Act of 1972 (<ref href="/us/usc/t16/s1389/f">16 U.S.C. 1389(f)</ref>), as amended by this Act.</content></section>
