<section id="d146947e104" identifier="/us/pl/115/302/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the Action for Dental Health Act of 2018.</content></section>
<section id="d146947e111" identifier="/us/pl/115/302/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ORAL HEALTH EDUCATION.</heading><subsection class="firstIndent0 fontsize10" id="y7f3aa0b0-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 399LL of the Public Health Service Act (<ref href="/us/usc/t42/s280k">42 U.S.C. 280k</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y7f3aa0b1-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y7f3aa0b2-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the subsection heading, by <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">of Oral Health Education Campaign</headingText></quotedText>” after “<quotedText><headingText class="smallCaps">Establishment</headingText></quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7f3aa0b3-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>focused on oral healthcare prevention and education</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>focused on oral health education</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7f3aa0b4-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (b), in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>campaign</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>campaign under subsection (a)</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y7f3aa0b5-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (c) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y7f3aeed6-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Action for Dental Health Program</inline>.—</heading><paragraph class="fontsize10" id="y7f3aeed7-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7f3aeed8-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x7f3aeed9-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Grants.</p><p class="leftAlign firstIndent0 fontsize8" id="x7f3aeeda-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary, in consultation with the Director of the Centers for Disease Control and Prevention and the Administrator of the Health Resources and Services Administration, may award grants, contracts, or cooperative agreements to eligible entities to collaborate with State or local public health officials, tribal health officials, oral health professional organizations, and others, as appropriate, to develop and implement initiatives to improve oral health, including activities to prevent dental disease and reduce barriers to the provision of dental services, including—</chapeau><subparagraph class="fontsize10" id="y7f3aeedb-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>through community-wide dental disease prevention programs; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7f3aeedc-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>by increasing public awareness and education related to oral health and dental disease prevention.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7f3aeedd-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Eligible entities</inline>.—</heading><chapeau>To be eligible to receive a grant, contract, or cooperative agreement under this subsection, an entity shall be—</chapeau><subparagraph class="fontsize10" id="y7f3aeede-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a dental association;<page identifier="/us/stat/132/4397">132 STAT. 4397</page></content></subparagraph>
<subparagraph class="fontsize10" id="y7f3aeedf-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a State or tribal health department or State or tribal oral health program;</content></subparagraph>
<subparagraph class="fontsize10" id="y7f3aeee0-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>an accredited dental education, dental hygiene, or postdoctoral dental education program; or</content></subparagraph>
<subparagraph class="fontsize10" id="y7f3aeee1-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>a non-profit community-based organization that partners with public and private non-profit entities, such as an academic institution, to facilitate the provision of dental services to underserved populations.”</content></subparagraph>

</subsection>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y7f3aeee2-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Technical Amendment</inline>.—</heading><chapeau>Section 399LL–1(d) of the Public Health Service Act (<ref href="/us/usc/t42/s280k–1/d">42 U.S.C. 280k–1(d)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y7f3aeee3-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>shall</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>shall, as practicable and appropriate,</quotedText>” before “<quotedText>utilize</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y7f3aeee4-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>public education campaign</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>oral health education campaign and action for dental health program</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7f3aeee5-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline>.—</heading><content>Not later than 3 years after the date of enactment of this Act, the Secretary of Health and Human Services shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives, a report on the outcomes and effectiveness of programs and activities conducted under sections 399LL and 399LL–1 of the Public Health Service Act (<ref href="/us/usc/t42/s280k">42 U.S.C. 280k</ref> and 280k–1).</content></subsection>

<section id="d146947e309" identifier="/us/pl/115/302/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>GRANTS FOR INNOVATIVE PROGRAMS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7f3b15f6-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 340G of the Public Health Service Act (<ref href="/us/usc/t42/s256g">42 U.S.C. 256g</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y7f3b15f7-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)(5)—</chapeau><subparagraph class="fontsize10" id="y7f3b15f8-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (B), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7f3b15f9-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y7f3b3d0a-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>the establishment or development of models for the provision of dental services to children and adults, such as dental homes, including for the elderly, blind, individuals with disabilities, and individuals living in long-term care facilities; and</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y7f3b3d0b-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>the establishment of initiatives to reduce the use of emergency departments by individuals who seek dental services more appropriately delivered in a dental primary care setting;”</content></subparagraph>

<paragraph class="fontsize10" id="y7f3b3d0c-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/302/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7f3b3d0d-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><content>in subsection (f), by <amendingAction type="delete">striking</amendingAction> “<quotedText>$25,000,000 for the 5-fiscal year period beginning with fiscal year 2008</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>$13,903,000 for each of fiscal years 2019 through 2023</quotedText>”.</content></paragraph>
