<section id="d147191e94" identifier="/us/pl/115/3/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">GAO Access and Oversight Act of 2017</shortTitle>”.</content></section>
<section id="d147191e104" identifier="/us/pl/115/3/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ACCESS TO CERTAIN INFORMATION.</heading><subsection class="firstIndent0 fontsize10" id="y97933afc-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/3/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Access to Certain Information</inline>.—</heading><content><ref href="/us/usc/t31/ch7/schII">Subchapter II of chapter 7 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y97933afd-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="721">“§ 721.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x97933afe-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s721">31 USC 721</ref>.</p></sidenote> Access to certain information</heading><subsection class="firstIndent0 fontsize10" id="y97933aff-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><content>No provision of the Social Security Act, including section 453(l) of that Act (<ref href="/us/usc/t42/s653/l">42 U.S.C. 653(l)</ref>), shall be construed to limit, amend, or supersede the authority of the Comptroller General to obtain any information or to inspect any record under section 716 of this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y97933b00-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><content>The specific reference to a statute in subsection (a) shall not be construed to affect access by the Government Accountability Office to information under statutes that are not so referenced.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y97933b01-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/3/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Agency Reports</inline>.—</heading><chapeau><ref href="/us/usc/t31/s720/b">Section 720(b) of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y97933b02-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/3/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the matter preceding paragraph (1), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or planned</quotedText>” after “<quotedText>action taken</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y97933b03-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/3/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (1) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y97936214-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Oversight and Government Reform of the House of Representatives, the congressional committees with jurisdiction over the agency program or activity that is the subject of the recommendation, and the Government Accountability Office before the 61st day after the date of the report; and”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y97936215-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/3/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Authority To Obtain Records</inline>.—</heading><chapeau><ref href="/us/usc/t31/s716">Section 716 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> in subsection (a)—</chapeau><paragraph class="fontsize10" id="y97936216-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/3/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>(a)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(2)</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y97936217-e833-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/3/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after the section heading the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y97936218-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a)</num><paragraph class="inline" id="y97936219-e833-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>The Comptroller General is authorized to obtain such agency records as the Comptroller General requires to discharge the duties of the Comptroller General (including audit, evaluation, and investigative duties), including through the bringing of civil actions under this section.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9793621a-e833-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Courts.</p></sidenote> In reviewing a civil action under this section, the court shall recognize the continuing force and effect <page identifier="/us/stat/131/8">131 STAT. 8</page>
of the authorization in the preceding sentence until such time as the authorization is repealed pursuant to law.”</content></paragraph>
