<section id="d282985e90" identifier="/us/pl/115/273/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa140fecd-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s1">15 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Study of Underrepresented Classes Chasing Engineering and Science Success Act of 2018</shortTitle>” or the “<shortTitle role="act">SUCCESS Act</shortTitle>”.</content></section>
<section id="d282985e108" identifier="/us/pl/115/273/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS; SENSE OF CONGRESS.</heading><subsection class="firstIndent0 fontsize10" id="ya1414cee-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds the following:</chapeau><paragraph class="fontsize10" id="ya1414cef-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Patents and other forms of intellectual property are important engines of innovation, invention, and economic growth.</content></paragraph>
<paragraph class="fontsize10" id="ya1414cf0-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Many innovative small businesses, which create over 20 percent of the total number of new jobs created in the United States each year, depend on patent protections to commercialize new technologies.</content></paragraph>
<paragraph class="fontsize10" id="ya1414cf1-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Universities and their industry partners also rely on patent protections to transfer innovative new technologies from the laboratory or classroom to commercial use.</content></paragraph>
<paragraph class="fontsize10" id="ya1414cf2-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Recent studies have shown that there is a significant gap in the number of patents applied for and obtained by women and minorities.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya1414cf3-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><content>It is the sense of Congress that the United States has the responsibility to work with the private sector to close the gap in the number of patents applied for and obtained by women and minorities to harness the maximum innovative potential and continue to promote United States leadership in the global economy.</content></subsection>

<section id="d282985e151" identifier="/us/pl/115/273/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REPORT.</heading><subsection class="firstIndent0 fontsize10" id="ya1417404-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Study</inline>.—</heading><chapeau>The Director, in consultation with the Administrator and any other head of an appropriate agency, shall conduct a study that—</chapeau><paragraph class="fontsize10" id="ya1417405-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>identifies publicly available data on the number of patents annually applied for and obtained by, and the benefits of increasing the number of patents applied for and obtained <page identifier="/us/stat/132/4159">132 STAT. 4159</page>
by women, minorities, and veterans and small businesses owned by women, minorities, and veterans; and</content></paragraph>
<paragraph class="fontsize10" id="ya1417406-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>provides legislative recommendations for how to—</chapeau><subparagraph class="fontsize10" id="ya1417407-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>promote the participation of women, minorities, and veterans in entrepreneurship activities; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya1417408-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>increase the number of women, minorities, and veterans who apply for and obtain patents.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ya1417409-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Director shall submit to the Committees on the Judiciary and Small Business of the House of Representatives and the Committees on the Judiciary and Small Business and Entrepreneurship of the Senate a report on the results of the study conducted under subsection (a).</content></subsection>

<section id="d282985e199" identifier="/us/pl/115/273/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>EXTENSION OF FEE-SETTING AUTHORITY.</heading><content style="-uslm-lc:I658120">  Section 10(i)(2) of the Leahy-Smith America Invents Act (<ref href="/us/pl/112/29">Public Law 112–29</ref>; <ref href="/us/stat/125/319">125 Stat. 319</ref>; <ref href="/us/usc/t35/s41">35 U.S.C. 41 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>7-year</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>15-year</quotedText>”.</content></section>
<section id="d282985e225" identifier="/us/pl/115/273/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa1419b1a-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="ya1419b1b-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s5/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrator</inline>.—</heading><content>The term “<term>Administrator</term>” means the Administrator of the Small Business Administration.</content></paragraph>
<paragraph class="fontsize10" id="ya1419b1c-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s5/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term “<term>agency</term>” means a department, agency, or instrumentality of the United States Government.</content></paragraph>
<paragraph class="fontsize10" id="ya1419b1d-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/273/s5/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term “<term>Director</term>” means the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.</content></paragraph>
