<section id="d149322e209" identifier="/us/pl/115/272/tI/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><heading>MANDATORY SANCTIONS WITH RESPECT TO FUNDRAISING AND RECRUITMENT ACTIVITIES FOR HIZBALLAH.</heading><subsection class="firstIndent0 fontsize10" id="ya8f5cdaf-e834-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/272/tI/s101/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 101 of the Hizballah International Financing Prevention Act of 2015 (<ref href="/us/pl/114/102">Public Law 114–102</ref>; <ref href="/us/usc/t50/s1701">50 U.S.C. 1701 note</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<page identifier="/us/stat/132/4145">132 STAT. 4145</page>
<quotedContent><section class="centered fontsize12" id="ya8f669f0-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="101">“SEC. 101. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f669f1-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize12">MANDATORY SANCTIONS WITH RESPECT TO FUNDRAISING AND RECRUITMENT ACTIVITIES FOR HIZBALLAH.</heading><subsection class="firstIndent0 fontsize10" id="ya8f669f2-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f669f3-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8f669f4-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote>The President shall, on or after the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018, impose the sanctions described in subsection (b) with respect to any foreign person that the President determines knowingly provides significant financial, material, or technological support for or to—</chapeau><paragraph class="fontsize10" id="ya8f669f5-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Bayt al-Mal, Jihad al-Bina, the Islamic Resistance Support Association, the Foreign Relations Department of Hizballah, the External Security Organization of Hizballah, or any successor or affiliate thereof as designated by the President;</content></paragraph>
<paragraph class="fontsize10" id="ya8f669f6-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>al-Manar TV, al Nour Radio, or the Lebanese Media Group, or any successor or affiliate thereof as designated by the President;</content></paragraph>
<paragraph class="fontsize10" id="ya8f669f7-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>a foreign person determined by the President to be engaged in fundraising or recruitment activities for Hizballah; or</content></paragraph>
<paragraph class="fontsize10" id="ya8f669f8-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>a foreign person owned or controlled by a person described in paragraph (1), (2), or (3).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8f669f9-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions Described</inline>.—</heading><chapeau>The sanctions described in this subsection are the following:</chapeau><paragraph class="fontsize10" id="ya8f669fa-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Asset blocking</inline>.—</heading><content>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>) (except that the requirements of section 202 of such Act (<ref href="/us/usc/t50/s1701">50 U.S.C. 1701</ref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of a foreign person determined by the President to be subject to subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</content></paragraph>
<paragraph class="fontsize10" id="ya8f669fb-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f669fc-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote><inline class="smallCaps">Aliens ineligible for visas, admission, or parole</inline>.—</heading><subparagraph class="fontsize10" id="ya8f669fd-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Visas, admission, or parole</inline>.—</heading><chapeau>An alien who the Secretary of State or the Secretary of Homeland Security (or designee of one of such Secretaries) determines is subject to subsection (a) is—</chapeau><clause class="fontsize10" id="ya8f669fe-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>inadmissible to the United States;</content></clause>
<clause class="fontsize10" id="ya8f669ff-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>ineligible to receive a visa or other documentation to enter the United States; and</content></clause>
<clause class="fontsize10" id="ya8f66a00-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/etseq">8 U.S.C. 1101 et seq.</ref>).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya8f66a01-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Current visas revoked</inline>.—</heading><clause class="fontsize10" id="ya8f66a02-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of State or the Secretary of Homeland Security (or designee of one of such Secretaries) shall revoke any visa or other entry documentation issued to an alien who the President determines is subject to subsection (a), regardless of when issued.</content></clause>
<clause class="fontsize10" id="ya8f66a03-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Effect of revocation</inline>.—</heading><content>A revocation under clause (i) shall take effect immediately and shall automatically cancel any other valid visa or entry documentation that is in the possession of the alien.</content></clause>
</subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8f66a04-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Waiver</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f66a05-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote>—</heading><page identifier="/us/stat/132/4146">132 STAT. 4146</page>
<paragraph class="fontsize10" id="ya8f66a06-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f66a07-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote>The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section if the President certifies to the appropriate congressional committees that such waiver is in the national security interests of the United States.</content></paragraph>
<paragraph class="fontsize10" id="ya8f66a08-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f66a09-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to a foreign person, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the foreign person in activities described in subsection (a).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8f66a0a-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="ya8f66a0b-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Admitted; alien</inline>.—</heading><content>The terms ‘admitted’ and ‘alien’ have meanings given those terms in section 101 of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101</ref>).</content></paragraph>
<paragraph class="fontsize10" id="ya8f66a0c-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term ‘<term>appropriate congressional committees</term>’ means—</chapeau><subparagraph class="fontsize10" id="ya8f66a0d-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Committee on Foreign Affairs, the Committee on Ways and Means, the Committee on the Judiciary, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8f66a0e-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Committee on Foreign Relations, the Committee on Finance, the Committee on Banking, Housing, and Urban Affairs, the Committee on the Judiciary, and the Select Committee on Intelligence of the Senate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8f66a0f-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Entity</inline>.—</heading><content>The term ‘<term>entity</term>’ means a partnership, association, corporation, or other organization, group, or subgroup.</content></paragraph>
<paragraph class="fontsize10" id="ya8f66a10-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Foreign person</inline>.—</heading><content>The term ‘<term>foreign person</term>’ means any person that is not a United States person.</content></paragraph>
<paragraph class="fontsize10" id="ya8f66a11-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Hizballah</inline>.—</heading><content>The term ‘<term>Hizballah</term>’ has the meaning given such term in section 102(e).</content></paragraph>
<paragraph class="fontsize10" id="ya8f66a12-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Person</inline>.—</heading><content>The term ‘<term>person</term>’ means an individual or entity.</content></paragraph>
<paragraph class="fontsize10" id="ya8f66a13-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">United states person</inline>.—</heading><content>The term ‘<term>United States person</term>’ means a United States citizen, an alien lawfully admitted for permanent residence, an entity organized under the laws of the United States (including foreign branches), or a person in the United States.”</content></paragraph>

<section id="d149322e530" identifier="/us/pl/115/272/tI/s102" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>MODIFICATION OF REPORT WITH RESPECT TO FINANCIAL INSTITUTIONS THAT ENGAGE IN CERTAIN TRANSACTIONS.</heading><content class="firstIndent0 fontsize10" id="xa8f6b835-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 102(d) of the Hizballah International Financing Prevention Act of 2015 (<ref href="/us/pl/114/102">Public Law 114–102</ref>; <ref href="/us/usc/t50/s1701">50 U.S.C. 1701 note</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subsection class="firstIndent0 fontsize10" id="ya8f70656-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Report on Financial Institutions Organized Under the Laws of State Sponsors of Terrorism</inline>.—</heading><paragraph class="fontsize10" id="ya8f70657-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f70658-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8f70659-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>Not later than 180 days after the date of the enactment of the Hizballah International Financing <page identifier="/us/stat/132/4147">132 STAT. 4147</page>
Prevention Amendments Act of 2018, and every 2 years thereafter for a period not to exceed 4 years, the President shall submit to the appropriate congressional committees a report that—</chapeau><subparagraph class="fontsize10" id="ya8f7065a-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>identifies each foreign financial institution described in paragraph (2) that the President determines engages in one or more activities described in subsection (a)(2); and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8f7065b-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provides a detailed description of each such activity.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8f7065c-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Foreign financial institution described</inline>.—</heading><subparagraph class="fontsize10" id="ya8f7065d-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>A foreign financial institution described in this paragraph is a foreign financial institution—</chapeau><clause class="fontsize10" id="ya8f7065e-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>that, wherever located, is—</chapeau><subclause class="fontsize10" id="ya8f7065f-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>organized under the laws of a state sponsor of terrorism or any jurisdiction within a state sponsor of terrorism;</content></subclause>
<subclause class="fontsize10" id="ya8f70660-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>owned or controlled by the government of a state sponsor of terrorism;</content></subclause>
<subclause class="fontsize10" id="ya8f70661-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>located in the territory of a state sponsor of terrorism; or</content></subclause>
<subclause class="fontsize10" id="ya8f70662-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>owned or controlled by a foreign financial institution described in subclause (I), (II), or (III); and</content></subclause>

<subparagraph class="fontsize10" id="ya8f70664-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">State sponsor of terrorism defined</inline>.—</heading><chapeau>In this paragraph, the term ‘<term>state sponsor of terrorism</term>’ means a country the government of which the Secretary of State has determined is a government that has repeatedly provided support for acts of international terrorism for purposes of—</chapeau><clause class="fontsize10" id="ya8f70665-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>section 1754(c) of the Export Control Reform Act of 2018;</content></clause>
<clause class="fontsize10" id="ya8f70666-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>section 620A of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2371">22 U.S.C. 2371</ref>);</content></clause>
<clause class="fontsize10" id="ya8f70667-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>section 40 of the Arms Export Control Act (<ref href="/us/usc/t22/s2780">22 U.S.C. 2780</ref>); or</content></clause>

<section id="d149322e669" identifier="/us/pl/115/272/tI/s103" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><heading>SANCTIONS AGAINST CERTAIN AGENCIES AND INSTRUMENTALITIES OF FOREIGN STATES.</heading><subsection class="firstIndent0 fontsize10" id="ya8f77b99-e834-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/272/tI/s103/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Title I of the Hizballah International Financing Prevention Act of 2015 (<ref href="/us/pl/114/102">Public Law 114–102</ref>; <ref href="/us/usc/t50/s1701">50 U.S.C. 1701 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="ya8f7f0ca-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="103">“SEC. 103. </num><heading class="fontsize12">SANCTIONS AGAINST CERTAIN AGENCIES AND INSTRUMENTALITIES OF FOREIGN STATES.</heading><subsection class="firstIndent0 fontsize10" id="ya8f7f0cb-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0cc-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>—</heading><paragraph class="fontsize10" id="ya8f7f0cd-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0ce-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 180 days after the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018, and as appropriate thereafter, the President shall impose the sanctions described in paragraph (3) with respect to an agency or instrumentality of a foreign state described in paragraph (2).</content></paragraph>
<paragraph class="fontsize10" id="ya8f7f0cf-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Agency or instrumentality of a foreign state described</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0d0-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0d1-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote>An agency or instrumentality of a foreign state <page identifier="/us/stat/132/4148">132 STAT. 4148</page>
is described in this paragraph if the President determines that the agency or instrumentality has, on or after the date of the enactment of the Hizballah International Financing Prevention Amendments Act of 2018, knowingly—</chapeau><subparagraph class="fontsize10" id="ya8f7f0d2-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>conducted significant joint combat operations with, or significantly supported combat operations of, Hizballah; or</content></subparagraph>
<subparagraph class="fontsize10" id="ya8f7f0d3-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provided significant financial support for or to, or significant arms or related materiel to, Hizballah.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8f7f0d4-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Sanctions described</inline>.—</heading><content>The sanctions described in this paragraph are the exercise of all powers granted to the President by the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>) (except that the requirements of section 202 of such Act (<ref href="/us/usc/t50/s1701">50 U.S.C. 1701</ref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of an agency or instrumentality of a foreign state if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8f7f0d5-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0d6-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0d7-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Waiver</inline>.—</heading><paragraph class="fontsize10" id="ya8f7f0d8-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0d9-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote>The President may, for periods not to exceed 180 days, waive the imposition of sanctions under this section with respect to an agency or instrumentality of a foreign state if the President certifies to the appropriate congressional committees that such waiver is vital to the national security interests of the United States.</content></paragraph>
<paragraph class="fontsize10" id="ya8f7f0da-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0db-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 30 days after the issuance of a waiver under paragraph (1) with respect to an agency or instrumentality of a foreign state, and every 180 days thereafter while the waiver remains in effect, the President shall brief the appropriate congressional committees on the status of the involvement of the agency or instrumentality in activities described in subsection (a)(2).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8f7f0dc-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8f7f0dd-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Special Rule</inline>.—</heading><chapeau>The President shall not be required to impose sanctions under this section with respect to an agency or instrumentality of a foreign state if the Secretary certifies in writing to the appropriate congressional committees that—</chapeau><paragraph class="fontsize10" id="ya8f7f0de-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>the agency or instrumentality—</chapeau><subparagraph class="fontsize10" id="ya8f7f0df-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is no longer engaging in activities described in subsection (a)(2); or</content></subparagraph>
<subparagraph class="fontsize10" id="ya8f7f0e0-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>has taken and is continuing to take significant verifiable steps toward terminating such activities; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya8f7f0e1-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the President has received reliable assurances from the government of the foreign state that the agency or instrumentality will not engage in any activity described in subsection (a)(2) in the future.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8f817f2-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="ya8f817f3-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency or instrumentality of a foreign state</inline>.—</heading><content>The term ‘<term>agency or instrumentality of a foreign state</term>’ has the meaning given the term in <ref href="/us/usc/t28/s1603/b">section 1603(b) of title 28, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="ya8f817f4-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term ‘<term>appropriate congressional committees</term>’ means—</chapeau><subparagraph class="fontsize10" id="ya8f817f5-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Committee on Foreign Affairs, the Committee on Financial Services, the Committee on Ways and Means, <page identifier="/us/stat/132/4149">132 STAT. 4149</page>
the Committee on the Judiciary, the Committee on Appropriations, and the Permanent Select Committee on Intelligence of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8f817f6-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, the Committee on the Judiciary, Committee on Finance, Committee on Appropriations, and the Select Committee on Intelligence of the Senate.</content></subparagraph>

<paragraph class="fontsize10" id="ya8f817f7-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Arms or related materiel</inline>.—</heading><chapeau>The term ‘<term>arms or related materiel</term>’ means—</chapeau><subparagraph class="fontsize10" id="ya8f817f8-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>nuclear, biological, chemical, or radiological weapons or materials or components of such weapons;</content></subparagraph>
<subparagraph class="fontsize10" id="ya8f817f9-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>ballistic or cruise missile weapons or materials or components of such weapons; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya8f817fa-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>destabilizing numbers and types of advanced conventional weapons.</content></subparagraph>

<paragraph class="fontsize10" id="ya8f86624-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>efforts to assist willing governments with the development of counter-organized crime legislation, the strengthening of financial investigative capacity, and a fully-vetted counter-organized crime judicial model in jurisdictions plagued with corruption; and</content></paragraph>

<section id="d149322e1909" identifier="/us/pl/115/272/tIII/s301" style="-uslm-lc:I658143"><num class="fontsize12" value="301">SEC. 301. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8fb73d2-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="xa8fb73d3-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading>REGULATORY AUTHORITY.</heading><subsection class="firstIndent0 fontsize10" id="ya8fbc0f4-e834-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/272/tIII/s301/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8fbc0f5-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t50/s1701">50 USC 1701 note</ref>.</p></sidenote>The President shall, not later than 180 days after the date of the enactment of this Act, prescribe regulations as necessary for the implementation of this Act and the amendments made by this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya8fbc0f6-e834-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/272/tIII/s301/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Notification to Congress</inline>.—</heading><content>Not later than 10 days before the prescription of regulations under subsection (a), the President shall notify the appropriate congressional committees regarding the proposed regulations and the provisions of this Act and the amendments made by this Act that the regulations are implementing.</content></subsection>

<section id="d149322e1962" identifier="/us/pl/115/272/tIII/s302" style="-uslm-lc:I658143"><num class="fontsize12" value="302">SEC. 302. </num><heading>IMPLEMENTATION; PENALTIES; JUDICIAL REVIEW; EXEMPTIONS; RULE OF CONSTRUCTION; EXCEPTION RELATING TO IMPORTATION OF GOODS.</heading><subsection class="firstIndent0 fontsize10" id="ya8fc0f1a-e834-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/272/tIII/s302/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Title I of the Hizballah International Financing Prevention Act of 2015 (<ref href="/us/pl/114/102">Public Law 114–102</ref>; <ref href="/us/usc/t50/s1701">50 U.S.C. 1701 note</ref>), as amended by sections 103 and 104 of this Act, is further amended by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="ya8fc5d3b-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="105">“SEC. 105. </num><heading class="fontsize12">IMPLEMENTATION; PENALTIES; JUDICIAL REVIEW; EXEMPTIONS; RULE OF CONSTRUCTION.</heading><subsection class="firstIndent0 fontsize10" id="ya8fc5d3c-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><content>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1702">50 U.S.C. 1702</ref> and 1704) to carry out sections 101, 102, 103, and 201 of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya8fc5d3d-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa8fc5d3e-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1705">50 U.S.C. 1705</ref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of <page identifier="/us/stat/132/4156">132 STAT. 4156</page>
regulations prescribed to carry out section 101, 102, 103, or 201 of this Act to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya8fc5d3f-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Procedures for Judicial Review of Classified Information</inline>.—</heading><paragraph class="fontsize10" id="ya8fc5d40-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If a finding under section 101, 102, 103, or 201 of this Act, or a prohibition, condition, or penalty imposed as a result of any such finding, is based on classified information (as defined in section 1(a) of the Classified Information Procedures Act (<ref href="/us/usc/t18/app">18 U.S.C. App.</ref>)) and a court reviews the finding or the imposition of the prohibition, condition, or penalty, the President may submit such information to the court ex parte and in camera.</content></paragraph>
<paragraph class="fontsize10" id="ya8fc5d41-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in this subsection shall be construed to confer or imply any right to judicial review of any finding under section 101, 102, 103, or 201 of this Act, or any prohibition, condition, or penalty imposed as a result of any such finding.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8fc5d42-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Exemptions</inline>.—</heading><chapeau>The following activities shall be exempt from sections 101, 102, 103, and 201 of this Act:</chapeau><paragraph class="fontsize10" id="ya8fc5d43-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Any authorized intelligence, law enforcement, or national security activities of the United States.</content></paragraph>
<paragraph class="fontsize10" id="ya8fc5d44-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Any transaction necessary to comply with United States obligations under the Agreement between the United Nations and the United States of America regarding the Headquarters of the United States, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, or the Convention on Consular Relations, done at Vienna April 24, 1963, and entered into force March 19, 1967, or any other United States international agreement.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya8fc5d45-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in section 101, 102, 103, or 201 of this Act shall be construed to limit the authority of the President under the International Emergency Economic Powers Act (<ref href="/us/usc/t50/s1701/etseq">50 U.S.C. 1701 et seq.</ref>) or under any other provision of law.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya8fc5d46-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Exception Relating to Importation of Goods</inline>.—</heading><paragraph class="fontsize10" id="ya8fc5d47-e834-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The authorities and requirements to impose sanctions under this Act shall not include the authority or requirement to impose sanctions on the importation of goods.</content></paragraph>
<paragraph class="fontsize10" id="ya8fc5d48-e834-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>In this subsection, the term ‘<term>good</term>’ means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.”</content></paragraph>
