<section id="d286067e103" identifier="/us/pl/115/267/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cb5b50-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Missing Children’s Assistance Act of 2018</shortTitle>”.</content></section>
<section id="d286067e118" identifier="/us/pl/115/267/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IMPROVING SUPPORT FOR MISSING AND EXPLOITED CHILDREN.</heading><subsection class="firstIndent0 fontsize10" id="yd6cd0901-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Section 402 of the Missing Children’s Assistance Act (<ref href="/us/usc/t34/s11291">34 U.S.C. 11291</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd6cd0902-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (1) to read as follows:<quotedContent><paragraph class="indentUp0 fontsize10" id="yd6cd3013-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>each year tens of thousands of children run away, or are abducted or removed, from the control of a parent having legal custody without the consent of that parent, under circumstances which immediately place the child in grave danger;”</content></paragraph>

<paragraph class="fontsize10" id="yd6cd3015-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (6), (7), (8), and (10) as paragraphs (4), (5), (6), and (7), respectively;</content></paragraph>
<paragraph class="fontsize10" id="yd6cd3016-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in paragraph (4), as so redesignated, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, including child sex trafficking and sextortion</quotedText>” after “<quotedText>exploitation</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="yd6cd3017-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>in paragraph (6), as so redesignated, by <amendingAction type="add">adding</amendingAction> “<quotedText>and</quotedText>” at the end; and</content></paragraph>
<paragraph class="fontsize10" id="yd6cd3018-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (7), as so redesignated, to read as follows:<quotedContent><paragraph class="indentUp0 fontsize10" id="yd6cd3019-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><chapeau>the Office of Juvenile Justice and Delinquency Prevention administers programs under this title, including programs that prevent and address offenses committed against vulnerable children and support missing children’s organizations, including the National Center for Missing and Exploited Children that—</chapeau><subparagraph class="fontsize10" id="yd6cd301a-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>serves as a nonprofit, national resource center and clearinghouse to provide assistance to victims, families, child-serving professionals, and the general public;</content></subparagraph>
<subparagraph class="fontsize10" id="yd6cd301b-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>works with the Department of Justice, the Federal Bureau of Investigation, the United States Marshals Service, the Department of the Treasury, the Department of State, U.S. Immigration and Customs Enforcement, the United States Secret Service, the United States Postal Inspection Service, other agencies, and nongovernmental organizations in the effort to find missing children and to prevent child victimization; and<page identifier="/us/stat/132/3757">132 STAT. 3757</page></content></subparagraph>
<subparagraph class="fontsize10" id="yd6cd301c-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd6cd301d-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>coordinates with each of the missing children clearinghouses operated by the 50 States, the District of Columbia, Puerto Rico, and international organizations to transmit images and information regarding missing and exploited children to law enforcement agencies, nongovernmental organizations, and corporate partners across the United States and around the world instantly.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yd6cd301e-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>Section 403 of the Missing Children’s Assistance Act (<ref href="/us/usc/t34/s11292">34 U.S.C. 11292</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd6cd301f-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (1) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yd6cd5730-e834-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term ‘<term>missing child</term>’ means any individual less than 18 years of age whose whereabouts are unknown to such individual’s parent;”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yd6cd5735-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Duties and Functions of the Administrator</inline>.—</heading><chapeau>Section 404 of the Missing Children’s Assistance Act (<ref href="/us/usc/t34/s11293">34 U.S.C. 11293</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd6cd5736-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="yd6cd5737-e834-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/267/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>telephone line</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>hotline</quotedText>”; and</content></subparagraph>

<item class="fontsize10" id="yd6cdcb92-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="ee">“(ee) </num><content>extra-familial child sexual molestation;</content></item>
<item class="fontsize10" id="yd6cdcb93-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="ff">“(ff) </num><content>unsolicited obscene material sent to a child;</content></item>
<item class="fontsize10" id="yd6cdcb94-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="gg">“(gg) </num><content>misleading domain names; and</content></item>
<item class="fontsize10" id="yd6cdcb95-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="hh">“(hh) </num><content>misleading words or digital images on the internet; and</content></item>
</subclause>
<subclause class="fontsize10" id="yd6cdcb96-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>make reports received through the tipline available to the appropriate law enforcement agency for its review and potential investigation;</content></subclause>
</clause>
<clause class="fontsize10" id="yd6cdcb97-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>by operating a child victim identification program to assist law enforcement agencies in identifying victims of child pornography and other sexual crimes to support the recovery of children from sexually exploitative situations; and</content></clause>
<clause class="fontsize10" id="yd6cdcb98-e834-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>by utilizing emerging technologies to provide additional outreach and educational materials to parents and families;”</content></clause>
</subparagraph>
