<section id="d286823e85" identifier="/us/pl/115/26/s1" role="instruction" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>MODIFICATION OF TERMINATION DATE FOR VETERANS CHOICE PROGRAM.</heading><content style="-uslm-lc:I658120">  Section 101(p)(2) of the Veterans Access, Choice, and Accountability Act of 2014 (<ref href="/us/pl/113/146">Public Law 113–146</ref>; <ref href="/us/usc/t38/s1701">38 U.S.C. 1701 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>, or the date that is 3 years after the date of the enactment of this Act, whichever occurs first</quotedText>”.</content></section>
<section id="d286823e104" identifier="/us/pl/115/26/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ELIMINATION OF REQUIREMENT TO ACT AS SECONDARY PAYER FOR CARE RELATING TO NON-SERVICE-CONNECTED DISABILITIES AND RECOVERY OF COSTS FOR CERTAIN CARE UNDER CHOICE PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y193268c6-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/26/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 101(e) of the Veterans Access, Choice, and Accountability Act of 2014 (<ref href="/us/pl/113/146">Public Law 113–146</ref>; <ref href="/us/usc/t38/s1701">38 U.S.C. 1701 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y193268c7-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/26/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the subsection heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">Other Health-care Plan</headingText></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Responsibility for Costs of Certain Care</headingText></quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y193268c8-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/26/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (1), in the paragraph heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">to secretary</headingText></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">on health-care plans</headingText></quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y193268c9-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/26/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraphs (2) and (3);</content></paragraph>
<paragraph class="fontsize10" id="y193268ca-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/26/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (4) as paragraph (2); and</content></paragraph>
<paragraph class="fontsize10" id="y193268cb-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/26/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentUp0 fontsize10" id="y193268cc-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Recovery of costs for certain care</inline>.—</heading><subparagraph class="fontsize10" id="y193268cd-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In any case in which an eligible veteran is furnished hospital care or medical services under this section for a non-service-connected disability described in subsection (a)(2) of <ref href="/us/usc/t38/s1729">section 1729 of title 38, United States Code</ref>, or for a condition for which recovery is authorized or with respect to which the United States is deemed to be a third party beneficiary under <ref href="/us/pl/87/693">Public Law 87–693</ref>, commonly known as the ‘Federal Medical Care Recovery Act’ (<ref href="/us/usc/t42/s2651/etseq">42 U.S.C. 2651 et seq.</ref>), the Secretary shall recover or collect from a third party (as defined in subsection (i) of such section 1729) reasonable charges for such care or services to the extent that the veteran (or the provider of the care or services) would be eligible to receive payment for such care or services from such third party if the care or services had not been furnished by a department or agency of the United States.<page identifier="/us/stat/131/130">131 STAT. 130</page></content></subparagraph>
<subparagraph class="fontsize10" id="y193268ce-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Use of amounts</inline>.—</heading><content>Amounts collected by the Secretary under subparagraph (A) shall be deposited in the Medical Community Care account of the Department. Amounts so deposited shall remain available until expended.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y193268cf-e835-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/26/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Paragraph (1) of such section <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>paragraph (4)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>paragraph (2)</quotedText>”.</content></subsection>

<section id="d286823e251" identifier="/us/pl/115/26/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>AUTHORITY TO DISCLOSE CERTAIN MEDICAL RECORDS OF VETERANS WHO RECEIVE NON-DEPARTMENT OF VETERANS AFFAIRS HEALTH CARE.</heading><content class="firstIndent0 fontsize10" id="x19328fe0-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <ref href="/us/usc/t38/s7332/b/2">Section 7332(b)(2) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="fontsize10" id="y19328fe1-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H)</num><clause class="inline" id="y19328fe2-e835-11f0-bc57-ad3ac4b1618c"><num value="i">(i) </num><content>To a non-Department entity (including private entities and other Federal agencies) that provides hospital care or medical services to veterans as authorized by the Secretary.</content></clause>
<clause class="indentUp0 fontsize10" id="y19328fe3-e835-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>An entity to which a record is disclosed under this subparagraph may not redisclose or use such record for a purpose other than that for which the disclosure was made.”</content></clause>
