<section id="d153065e94" identifier="/us/pl/115/253/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Anti-Terrorism Clarification Act of 2018</shortTitle>”.</content></section>
<section id="d153065e104" identifier="/us/pl/115/253/s2" role="definitions" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CLARIFICATION OF THE TERM “<term>ACT OF WAR</term>”.</heading><subsection class="firstIndent0 fontsize10" id="y4fa63a85-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t18/s2331">Section 2331 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y4fa63a86-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (4), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="y4fa63a87-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (5), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y4fa63a88-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y4fa66199-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><chapeau>the term ‘<term>military force</term>’ does not include any person that—</chapeau><subparagraph class="fontsize10" id="y4fa6619a-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>has been designated as a—</chapeau><clause class="fontsize10" id="y4fa6619b-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>foreign terrorist organization by the Secretary of State under section 219 of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1189">8 U.S.C. 1189</ref>); or</content></clause>
<clause class="fontsize10" id="y4fa6619c-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>specially designated global terrorist (as such term is defined in <ref href="/us/cfr/t31/s594.310">section 594.310 of title 31, Code of Federal Regulations</ref>) by the Secretary of State or the Secretary of the Treasury; or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y4fa6619d-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>has been determined by the court to not be a ‘military force’.”</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y4fa6619e-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4fa6619f-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s2331">18 USC 2331 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>The amendments made by this section shall apply to any civil action pending on or commenced after the date of the enactment of this Act.</content></subsection>

<section id="d153065e203" identifier="/us/pl/115/253/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>SATISFACTION OF JUDGMENTS AGAINST TERRORISTS.</heading><subsection class="firstIndent0 fontsize10" id="y4fa688b0-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t18/s2333">Section 2333 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> at the end following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y4fa688b1-e835-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Use of Blocked Assets to Satisfy Judgments of U.S. Nationals</inline>.—</heading><content>For purposes of section 201 of the Terrorism Risk Insurance Act of 2002 (<ref href="/us/usc/t28/s1610">28 U.S.C. 1610 note</ref>), in any action in which a national of the United States has obtained a judgment against a terrorist party pursuant to this section, the term ‘<term>blocked asset</term>’ shall include any asset of that terrorist party (including the blocked assets of any agency or instrumentality of that party) seized or frozen by the United States under section 805(b) of the Foreign Narcotics Kingpin Designation Act (<ref href="/us/usc/t21/s1904/b">21 U.S.C. 1904(b)</ref>).”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y4fa688b2-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4fa688b3-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s2333">18 USC 2333 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>The amendments made by this section shall apply to any judgment entered before, on, or after the date of enactment of this Act.</content></subsection>

<section id="d153065e261" identifier="/us/pl/115/253/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>CONSENT OF CERTAIN PARTIES TO PERSONAL JURISDICTION.</heading><subsection class="firstIndent0 fontsize10" id="y4fa6afc4-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/253/s4/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t18/s2334">Section 2334 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y4fa6fde5-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Consent of Certain Parties to Personal Jurisdiction</inline>.—</heading><paragraph class="fontsize10" id="y4fa6fde6-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4fa6fde7-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective dates.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (2), for purposes of any civil action under section 2333 of this title, a defendant shall be deemed to have consented to personal jurisdiction in such civil action if, regardless of the date of the occurrence of the act of international terrorism upon which such civil action was filed, the defendant—</chapeau><subparagraph class="fontsize10" id="y4fa6fde8-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>after the date that is 120 days after the date of enactment of this subsection, accepts—</chapeau><clause class="fontsize10" id="y4fa6fde9-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>any form of assistance, however provided, under chapter 4 of part II of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2346/etseq">22 U.S.C. 2346 et seq.</ref>);</content></clause>
<clause class="fontsize10" id="y4fa6fdea-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any form of assistance, however provided, under section 481 of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2291">22 U.S.C. 2291</ref>) for international narcotics control and law enforcement; or</content></clause>
<clause class="fontsize10" id="y4fa6fdeb-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any form of assistance, however provided, under chapter 9 of part II of the Foreign Assistance Act of 1961 (<ref href="/us/usc/t22/s2349bb/etseq">22 U.S.C. 2349bb et seq.</ref>); or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y4fa6fdec-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>in the case of a defendant benefiting from a waiver or suspension of section 1003 of the Anti-Terrorism Act of 1987 (<ref href="/us/usc/t22/s5202">22 U.S.C. 5202</ref>) after the date that is 120 days after the date of enactment of this subsection—</chapeau><clause class="fontsize10" id="y4fa6fded-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>continues to maintain any office, headquarters, premises, or other facilities or establishments within the jurisdiction of the United States; or</content></clause>
<clause class="fontsize10" id="y4fa6fdee-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>establishes or procures any office, headquarters, premises, or other facilities or establishments within the jurisdiction of the United States.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y4fa6fdef-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4fa6fdf0-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>Paragraph (1) shall not apply to any defendant who ceases to engage in the conduct described in paragraphs (1)(A) and (1)(B) for 5 consecutive calendar years.”</content></paragraph>
