<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d154296e85" identifier="/us/pl/115/247/s1" role="instruction" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>CLARIFICATION OF FACILITY MERGER AUTHORIZATION.</heading><content class="firstIndent0 fontsize10" id="x84ec3a6a-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 203(a)(1) of the Federal Power Act (<ref href="/us/usc/t16/s824b/a/1">16 U.S.C. 824b(a)(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> subparagraph (B) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="fontsize10" id="y84ec3a6b-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>merge or consolidate, directly or indirectly, its facilities subject to the jurisdiction of the Commission, or any part thereof, with the facilities of any other person, or any part thereof, that are subject to the jurisdiction of the Commission and have a value in excess of $10,000,000, by any means whatsoever;”</content></subparagraph>

<section id="d154296e112" identifier="/us/pl/115/247/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>NOTIFICATION FOR CERTAIN TRANSACTIONS.</heading><content class="firstIndent0 fontsize10" id="x84ec617c-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 203(a) of the Federal Power Act (<ref href="/us/usc/t16/s824b/a">16 U.S.C. 824b(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="fontsize10" id="y84ec617d-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7)</num><subparagraph class="inline" id="y84ec617e-e835-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84ec617f-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x84ec6180-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Regulations.</p></sidenote><chapeau>Not later than 180 days after the date of enactment of this paragraph, the Commission shall promulgate a rule requiring any public utility that is seeking to merge or consolidate, directly or indirectly, its facilities subject to the jurisdiction of the Commission, or any part thereof, with those of any other person, to notify the Commission of such transaction not later than 30 days after the date on which the transaction is consummated if—</chapeau><clause class="fontsize10" id="y84ec8891-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the facilities, or any part thereof, to be acquired are of a value in excess of $1,000,000; and</content></clause>
<clause class="fontsize10" id="y84ec8892-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>such public utility is not required to secure an order of the Commission under paragraph (1)(B).</content></clause>
</subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y84ec8893-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>In establishing any notification requirement under subparagraph (A), the Commission shall, to the maximum extent practicable, minimize the paperwork burden resulting from the collection of information.”</content></subparagraph>

<section id="d154296e160" identifier="/us/pl/115/247/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84ec8894-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s824b">16 USC 824b note</ref>.</p></sidenote><heading>EFFECTIVE DATE.</heading><content style="-uslm-lc:I658120">  The amendment made by section 1 shall take effect 180 days after the date of enactment of this Act.</content></section>
<section id="d154296e173" identifier="/us/pl/115/247/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>FEDERAL ENERGY REGULATORY COMMISSION REPORT.</heading><subsection class="firstIndent0 fontsize10" id="y84ecafa5-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/247/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Federal Energy Regulatory Commission shall submit to Congress a report that assesses the effects of the amendment made by section 1.<page identifier="/us/stat/132/3153">132 STAT. 3153</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y84ecafa6-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/247/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>In preparing the report under subsection (a), the Federal Energy Regulatory Commission shall—</chapeau><paragraph class="fontsize10" id="y84ecafa7-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/247/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>take into account any information collected under paragraph (7) of section 203(a) of the Federal Power Act (<ref href="/us/usc/t16/s824b/a">16 U.S.C. 824b(a)</ref>) (as added by section 2); and</content></paragraph>
<paragraph class="fontsize10" id="y84ecafa8-e835-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/247/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x84ecafa9-e835-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notice.</p></sidenote><content>provide for public notice and comment with respect to the report.</content></paragraph>
