<section id="d156703e98" identifier="/us/pl/115/231/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1867341b-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2151">22 USC 2151 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Zimbabwe Democracy and Economic Recovery Amendment Act of 2018</shortTitle>”.</content></section>
<section id="d156703e113" identifier="/us/pl/115/231/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1867341c-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Patrick Nabanyama.</p><p class="leftAlign firstIndent0 fontsize8" id="x1867341d-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Itai Dzamara.</p><p class="leftAlign firstIndent0 fontsize8" id="x1867341e-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Paul Chizuze.</p><p class="leftAlign firstIndent0 fontsize8" id="x1867341f-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2151">22 USC 2151 note</ref>.</p></sidenote><heading>RECONSTRUCTION AND REBUILDING OF ZIMBABWE.</heading><content style="-uslm-lc:I658120">  Section 2 of the Zimbabwe Democracy and Economic Recovery Act of 2001 (<ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref>; <ref href="/us/pl/107/99">Public Law 107–99</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>and restore the rule of law</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>restore the rule of law, reconstruct and rebuild Zimbabwe, and come to terms with the past through a process of genuine reconciliation that acknowledges past human rights abuses and orders inquiries into disappearances, including the disappearance of human rights activists, such as Patrick Nabanyama, Itai Dzamara, and Paul Chizuze</quotedText>”.</content></section>
<section id="d156703e146" identifier="/us/pl/115/231/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x18675b30-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 4(a) of the Zimbabwe Democracy and Economic Recovery Act of 2001<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18675b31-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2151">22 USC 2151 note</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y18678242-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>costly deployment of troops to the Democratic Republic of the Congo</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>private appropriation of public assets</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y18678243-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y18678244-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>In October 2016, the Government of Zimbabwe cleared a small hurdle in its longstanding public sector arrears with the IMF.”</content></paragraph>

<section id="d156703e191" identifier="/us/pl/115/231/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>PROVISIONS RELATED TO MULTILATERAL DEBT RELIEF AND OTHER FINANCIAL ASSISTANCE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1867a955-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 4(b)(2) of the Zimbabwe Democracy and Economic Recovery Act of 2001<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1867a956-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2151">22 USC 2151 note</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y1867a957-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>to propose that the bank should undertake a review of the feasibility of restructuring, rescheduling, or eliminating the sovereign debt of Zimbabwe held by that bank</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>to support efforts to reevaluate plans to restructure, rebuild, reschedule, or eliminate Zimbabwe’s sovereign debt held by that bank and provide an analysis based on reasonable financial options to achieve those goals</quotedText>”; and</content></paragraph>

<section id="d156703e233" identifier="/us/pl/115/231/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>SENSE OF CONGRESS ON THE UNITED STATES-ZIMBABWE BILATERAL RELATIONSHIP.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x18686ca9-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is the sense of Congress that the United States should seek to forge a stronger bilateral relationship with Zimbabwe, including in the areas of trade and investment, if the following conditions are satisfied:</chapeau><paragraph class="fontsize10" id="y18686caa-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Government of Zimbabwe takes the concrete, tangible steps outlined in paragraphs (1) through (4) of section 4(d) of the Zimbabwe Democracy and Economic Recovery Act of 2001, as amended by section 6 of this Act.</content></paragraph>
<paragraph class="fontsize10" id="y18686cab-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>The Government of Zimbabwe takes concrete, tangible steps towards—</chapeau><subparagraph class="fontsize10" id="y18686cac-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>good governance, including respect for the opposition, rule of law, and human rights;</content></subparagraph>
<subparagraph class="fontsize10" id="y18686cad-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>economic reforms that promote growth, address unemployment and underdevelopment, restore livelihoods, ensure respect for contracts and private property rights, and promote significant progress toward monetary policy reforms, particularly with the Reserve Bank of Zimbabwe, and currency exchange reforms; and</content></subparagraph>
<subparagraph class="fontsize10" id="y18686cae-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>identification and recovery of stolen private and public assets within Zimbabwe and in other countries.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y18686caf-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>The Government of Zimbabwe holds an election that is widely accepted as free and fair, based on the following pre- and post-election criteria or conditions:</chapeau><subparagraph class="fontsize10" id="y18686cb0-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Establishment and public release, without cost, of a provisional and a final voter registration roll.</content></subparagraph>
<subparagraph class="fontsize10" id="y18686cb1-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The Zimbabwe Electoral Commission is permitted to entirely carry out the functions assigned to it under section 239 of Zimbabwe’s 2013 Constitution in an independent manner, and the chairperson meets and consults regularly with representatives of political parties represented in the parliament of Zimbabwe and the parties contesting the elections.</content></subparagraph>
<subparagraph class="fontsize10" id="y18686cb2-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>Consistent with Zimbabwe’s 2013 Constitution, the Defence Forces of Zimbabwe—</chapeau><clause class="fontsize10" id="y18686cb3-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>are neither permitted to actively participate in campaigning for any candidate nor to intimidate voters;</content></clause>
<clause class="fontsize10" id="y18686cb4-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>are required to verifiably and credibly uphold their constitutionally-mandated duty to respect the fundamental rights and freedoms of all persons and to be nonpartisan in character; and</content></clause>
<clause class="fontsize10" id="y18686cb5-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>are not permitted to print, transfer, or control ballots or transmit the results of elections.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y18686cb6-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>International observers, including observers from the United States, the African Union, the Southern African Development Community, and the European Union—</chapeau><clause class="fontsize10" id="y18686cb7-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>are permitted to observe the entire electoral process prior to, on, and following voting day, including by monitoring polling stations and tabulation centers; and</content></clause>
<clause class="fontsize10" id="y18686cb8-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>are able to independently access and analyze vote tallying tabulation and the transmission and content of voting results.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y18686cb9-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>Candidates are allowed access to public broadcasting media during the election period, consistent with <page identifier="/us/stat/132/1634">132 STAT. 1634</page>
Zimbabwe’s Electoral Act and are able to campaign in an environment that is free from intimidation and violence.</content></subparagraph>
<subparagraph class="fontsize10" id="y18686cba-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/3/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>Civil society organizations are able to freely and independently carry out voter and civic education and monitor the entire electoral process, including by observing, recording, and transmitting publicly-posted or announced voting results at the ward, constituency, and all higher levels of the vote tallying process.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y18686cbb-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/4" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Laws enacted prior to the passage of Zimbabwe’s March 2013 Constitution that are inconsistent with the new Constitution are amended, <amendingAction type="repeal">repealed</amendingAction>, or subjected to a formal process for review and correction so that such laws are consistent with the new Constitution.</content></paragraph>
<paragraph class="fontsize10" id="y18686cbc-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>The Government of Zimbabwe—</chapeau><subparagraph class="fontsize10" id="y18686cbd-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>has made significant progress on the implementation of all elements of the new Constitution; and</content></subparagraph>
<subparagraph class="fontsize10" id="y18686cbe-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>has demonstrated its commitment to sustain such efforts in achieving full implementation of the new Constitution.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y18686cbf-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s5/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Traditional leaders of Zimbabwe observe section 281 of the 2013 Constitution and are not using humanitarian assistance provided by outside donor organizations or countries in a politicized manner to intimidate or pressure voters during the campaign period.</content></paragraph>

<section id="d156703e360" identifier="/us/pl/115/231/s6" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>CERTIFICATION REQUIREMENTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x186893d0-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 4(d) of the Zimbabwe Democracy and Economic Recovery Act of 2001<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x186893d1-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2151">22 USC 2151 note</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y186893d2-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s6/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>consistent with</quotedText>” and all that follows through “<quotedText>September 1998</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y186893d3-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s6/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (4); and</content></paragraph>
<paragraph class="fontsize10" id="y186893d4-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s6/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (5) as paragraph (4).</content></paragraph>

<section id="d156703e403" identifier="/us/pl/115/231/s7" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>REMOVAL OF AUTHORITY TO PAY LAND ACQUISITION COSTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1868bae5-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 5(a) of the Zimbabwe Democracy and Economic Recovery Act of 2001<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1868bae6-e836-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s2151">22 USC 2151 note</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y1868bae7-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s7/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (2), by <amendingAction type="delete">striking</amendingAction> “<quotedText>, including the payment of costs</quotedText>” and all that follows through “<quotedText>thereto; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></paragraph>
<paragraph class="fontsize10" id="y1868bae8-e836-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/231/s7/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></paragraph>

employment, commercial, and human rights cases surrounding dispossessed Zimbabwean commercial farmers and agricultural companies.</content></section>
