<section id="d306218e92" identifier="/us/pl/115/229/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">East Rosebud Wild and Scenic Rivers Act</shortTitle>”.</content></section>
<section id="d306218e102" identifier="/us/pl/115/229/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS; PURPOSE.</heading><subsection class="firstIndent0 fontsize10" id="y35abe0e1-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds that—</chapeau><paragraph class="fontsize10" id="y35abe0e2-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>East Rosebud Creek is cherished by the people of Montana and visitors from across the United States for its clean water, spectacular natural setting, and outstanding recreational opportunities;</content></paragraph>
<paragraph class="fontsize10" id="y35abe0e3-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>recreational activities, including fishing, hunting, camping, paddling, hiking, rock climbing, and wildlife watching, on East Rosebud Creek and the surrounding land generate millions of dollars annually for the local economy;</content></paragraph>
<paragraph class="fontsize10" id="y35abe0e4-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>East Rosebud Creek—</chapeau><subparagraph class="fontsize10" id="y35abe0e5-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is a national treasure;</content></subparagraph>
<subparagraph class="fontsize10" id="y35abe0e6-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>possesses outstandingly remarkable values; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35abe0e7-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>merits the high level of protection afforded by the Wild and Scenic Rivers Act (<ref href="/us/usc/t16/s1271/etseq">16 U.S.C. 1271 et seq.</ref>) in order to maintain the benefits provided by the Creek, as described in paragraphs (1) and (2), for future generations to enjoy; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y35abe0e8-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>designation of select public land segments of East Rosebud Creek under the Wild and Scenic Rivers Act (<ref href="/us/usc/t16/s1271/etseq">16 U.S.C. 1271 et seq.</ref>) would recognize the importance of maintaining the values of the Creek while preserving public access, respecting private property rights, allowing appropriate maintenance of existing infrastructure, and allowing historical uses of the Creek to continue.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y35abe0e9-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><content>The purpose of this Act is to designate East Rosebud Creek in the State of Montana as a component of the National Wild and Scenic Rivers System to preserve and protect for present and future generations the outstandingly remarkable scenic, recreational, and geologic values of the Creek.<page identifier="/us/stat/132/1630">132 STAT. 1630</page></content></subsection>

<section id="d306218e171" identifier="/us/pl/115/229/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DESIGNATION OF WILD AND SCENIC RIVER SEGMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y35ac2f0a-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Designation</inline>.—</heading><content>Section 3(a) of the Wild and Scenic Rivers Act (<ref href="/us/usc/t16/s1274/a">16 U.S.C. 1274(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="y35ac2f0b-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="213">“(213) </num><heading class="fontsize10"><inline class="smallCaps">East rosebud creek, montana</inline>.—</heading><chapeau>The portions of East Rosebud Creek in the State of Montana, consisting of—</chapeau><subparagraph class="fontsize10" id="y35ac2f0c-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the 13-mile segment exclusively on public land within the Custer National Forest from the source in the Absaroka-Beartooth Wilderness downstream to the point at which the Creek enters East Rosebud Lake, including the stream reach between Twin Outlets Lake and Fossil Lake, to be administered by the Secretary of Agriculture as a wild river; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35ac2f0d-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the 7-mile segment exclusively on public land within the Custer National Forest from immediately below, but not including, the outlet of East Rosebud Lake downstream to the point at which the Creek enters private property for the first time, to be administered by the Secretary of Agriculture as a recreational river.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y35ac2f0e-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35ac2f0f-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1274">16 USC 1274 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Adjacent Management</inline>.—</heading><paragraph class="fontsize10" id="y35ac2f10-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Nothing in paragraph (213) of section 3(a) of the Wild and Scenic Rivers Act (<ref href="/us/usc/t16/s1274/a">16 U.S.C. 1274(a)</ref>) (as added by subsection (a)) creates a protective perimeter or buffer zone outside the designated boundary of the river segment designated by that paragraph.</content></paragraph>
<paragraph class="fontsize10" id="y35ac2f11-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/229/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Outside activities</inline>.—</heading><content>The fact that an otherwise authorized activity or use can be seen or heard within the boundary of the river segment designated by paragraph (213) of section 3(a) of the Wild and Scenic Rivers Act (<ref href="/us/usc/t16/s1274/a">16 U.S.C. 1274(a)</ref>) (as added by subsection (a)) shall not preclude the activity or use outside the boundary of the river segment.</content></paragraph>
