<section id="d306865e92" identifier="/us/pl/115/218/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Northern Mariana Islands U.S. Workforce Act of 2018</shortTitle>”.</content></section>
<section id="d306865e102" identifier="/us/pl/115/218/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x91fed3ff-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t48/s1806">48 USC 1806 note</ref>.</p></sidenote><heading>PURPOSES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x91fefb10-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The purposes of this Act are—</chapeau><paragraph class="fontsize10" id="y91fefb11-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to increase the percentage of United States workers (as defined in section 6(i) of the Joint Resolution entitled “A Joint Resolution to approve the ‘Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America’, and for other purposes” (<ref href="/us/usc/t48/s1806">48 U.S.C. 1806</ref>)) in the total workforce of the Commonwealth of the Northern Mariana Islands, while maintaining the minimum number of workers who are not United States workers to meet the changing demands of the Northern Mariana Islands’ economy;</content></paragraph>
<paragraph class="fontsize10" id="y91fefb12-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to encourage the hiring of United States workers into such workforce; and</content></paragraph>
<paragraph class="fontsize10" id="y91fefb13-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>to ensure that no United States worker—</chapeau><subparagraph class="fontsize10" id="y91fefb14-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is at a competitive disadvantage for employment compared to a worker who is not a United States worker; or</content></subparagraph>
<subparagraph class="fontsize10" id="y91fefb15-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is displaced by a worker who is not a United States worker.</content></subparagraph>
</paragraph>
</section>
<section id="d306865e143" identifier="/us/pl/115/218/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>TRANSITIONAL PROVISIONS.</heading><subsection class="firstIndent0 fontsize10" id="y9200cfd6-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 6 of the Joint Resolution entitled “A Joint Resolution to approve the ‘Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America’, and for other purposes” (<ref href="/us/usc/t48/s1806">48 U.S.C. 1806</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y9200cfd7-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y9200cfd8-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (2), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2019</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2029</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9200cfd9-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (6) to read as follows:<quotedContent><paragraph class="indentDown1 fontsize10" id="y9201450a-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Fees for training united states workers</inline>.—</heading><subparagraph class="fontsize10" id="y9201450b-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Supplemental fee</inline>.—</heading><clause class="fontsize10" id="y9201450c-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In addition to fees imposed pursuant to section 286(m) of the Immigration and <page identifier="/us/stat/132/1548">132 STAT. 1548</page>
Nationality Act (<ref href="/us/usc/t8/s1356/m">8 U.S.C. 1356(m)</ref>) to recover the full costs of adjudication services, the Secretary shall impose an annual supplemental fee of $200 per nonimmigrant worker on each prospective employer who is issued a permit under subsection (d)(3) during the transition program.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9201450d-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote> A prospective employer that is issued a permit with a validity period of longer than 1 year shall pay the fee for each year of requested validity at the time the permit is requested.</content></clause>
<clause class="fontsize10" id="y9201450e-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9201450f-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="x92014510-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notice.</p><p class="leftAlign firstIndent0 fontsize8" id="x92014511-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Federal Register,</p><p class="leftAlign firstIndent0 fontsize8" id="x92014512-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">publication.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Inflation adjustment</inline>.—</heading><content>Beginning in fiscal year 2020, the Secretary, through notice in the Federal Register, may annually adjust the supplemental fee imposed under clause (i) by a percentage equal to the annual change in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics.</content></clause>
<clause class="fontsize10" id="y92014513-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Use of funds</inline>.—</heading><content>Amounts collected pursuant to clause (i) shall be deposited into the Treasury of the Commonwealth Government for the sole and exclusive purpose of funding vocational education, apprenticeships, or other training programs for United States workers.</content></clause>
<clause class="fontsize10" id="y92014514-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Fraud prevention and detection fee</inline>.—</heading><chapeau>In addition to the fees described in clause (i), the Secretary—</chapeau><subclause class="fontsize10" id="y92014515-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>shall impose, on each prospective employer filing a petition under this subsection for one or more nonimmigrant workers, a $50 fraud prevention and detection fee; and</content></subclause>
<subclause class="fontsize10" id="y92014516-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>shall deposit and use the fees collected under subclause (I) for the sole purpose of preventing and detecting immigration benefit fraud in the Northern Mariana Islands, in accordance with section 286(v)(2)(B) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1356/v/2/B">8 U.S.C. 1356(v)(2)(B)</ref>).</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92014517-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92014518-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x92014519-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Plan for the expenditure of funds</inline>.—</heading><chapeau>Not later than 120 days before the first day of fiscal year 2020, and annually thereafter, the Governor of the Commonwealth Government shall submit to the Secretary of Labor—</chapeau><clause class="fontsize10" id="y9201451a-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a plan for the expenditures of amounts deposited under subparagraph (A)(iii);</content></clause>
<clause class="fontsize10" id="y9201451b-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a projection of the effectiveness of such expenditures in the placement of United States workers into jobs held by non-United States workers; and</content></clause>
<clause class="fontsize10" id="y9201451c-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9201451d-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><content>a report on the changes in employment of United States workers attributable to expenditures of such amounts during the previous year.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9201451e-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Determination and report</inline>.—</heading><chapeau>Not later than 120 days after receiving each expenditure plan under subparagraph (B)(i), the Secretary of Labor shall—</chapeau><clause class="fontsize10" id="y9201451f-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>issue a determination on the plan; and</content></clause>
<clause class="fontsize10" id="y92014520-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>submit a report to Congress that describes the effectiveness of the Commonwealth Government at meeting the goals set forth in such plan.<page identifier="/us/stat/132/1549">132 STAT. 1549</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92014521-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Payment restriction</inline>.—</heading><content>Payments may not be made in a fiscal year from amounts deposited under subparagraph (A)(iii) before the Secretary of Labor has approved the expenditure plan submitted under subparagraph (B)(i) for that fiscal year.”</content></subparagraph>
</paragraph>

</paragraph>
<paragraph class="fontsize10" id="y92014522-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (b), by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y92014523-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than December 1, 2027, the Secretary shall submit a report to the Committee on Energy and Natural Resources of the Senate, the Committee on the Judiciary of the Senate, the Committee on Natural Resources of the House of Representatives, and the Committee on the Judiciary of the House of Representatives that—</chapeau><subparagraph class="fontsize10" id="y92014524-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>projects the number of asylum claims the Secretary anticipates following the termination of the transition period; and</content></subparagraph>
<subparagraph class="fontsize10" id="y92014525-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>describes the efforts of the Secretary to ensure appropriate interdiction efforts, provide for appropriate treatment of asylum seekers, and prepare to accept and adjudicate asylum claims in the Commonwealth.”</content></subparagraph>
</paragraph>
</quotedContent>;</content></paragraph>
<paragraph class="fontsize10" id="y92014526-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>in subsection (d)—</chapeau><subparagraph class="fontsize10" id="y92014527-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (2) through (5) as paragraphs (3) through (6), respectively;</content></subparagraph>
<subparagraph class="fontsize10" id="y92014528-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (1) the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="y92019349-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Protection for united states workers</inline>.—</heading><subparagraph class="fontsize10" id="y9201934a-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Temporary labor certification</inline>.—</heading><clause class="fontsize10" id="y9201934b-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9201934c-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Beginning with petitions filed with employment start dates in fiscal year 2020, a petition to import a nonimmigrant worker under this subsection may not be approved by the Secretary unless the petitioner has applied to the Secretary of Labor for a temporary labor certification confirming that—</chapeau><subclause class="fontsize10" id="y9201934d-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>there are not sufficient United States workers in the Commonwealth who are able, willing, qualified, and available at the time and place needed to perform the services or labor involved in the petition; and</content></subclause>
<subclause class="fontsize10" id="y9201934e-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>employment of the nonimmigrant worker will not adversely affect the wages and working conditions of similarly employed United States workers.</content></subclause>
</clause>
<clause class="fontsize10" id="y9201934f-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Petition</inline>.—</heading><content>After receiving a temporary labor certification under clause (i), a prospective employer may submit a petition to the Secretary for a Commonwealth Only Transitional Worker permit on behalf of the nonimmigrant worker.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92019350-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Prevailing wage survey</inline>.—</heading><clause class="fontsize10" id="y92019351-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92019352-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In order to effectuate the requirement for a temporary labor certification under subparagraph (A)(i), the Secretary of Labor shall use, or make available to employers, an occupational wage survey conducted by the Governor that the Secretary of Labor has determined meets the statistical standards for determining prevailing wages in the Commonwealth on an annual basis.</content></clause>
<clause class="fontsize10" id="y92019353-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Alternative method for determining the prevailing wage</inline>.—</heading><content>In the absence of an occupational <page identifier="/us/stat/132/1550">132 STAT. 1550</page>
wage survey approved by the Secretary of Labor under clause (i), the prevailing wage for an occupation in the Commonwealth shall be the arithmetic mean of the wages of workers similarly employed in the territory of Guam according to the wage component of the Occupational Employment Statistics Survey conducted by the Bureau of Labor Statistics.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92019354-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Minimum wage</inline>.—</heading><chapeau>An employer shall pay each Commonwealth Only Transitional Worker a wage that is not less than the greater of—</chapeau><clause class="fontsize10" id="y9201ba65-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the statutory minimum wage in the Commonwealth;</content></clause>
<clause class="fontsize10" id="y9201ba66-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the Federal minimum wage; or</content></clause>
<clause class="fontsize10" id="y9201ba67-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the prevailing wage in the Commonwealth for the occupation in which the worker is employed.”</content></clause>

<subparagraph class="fontsize10" id="y9201ba68-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="amend">amending</amendingAction> paragraph (3), as redesignated, to read as follows:<quotedContent><paragraph class="indentDown1 fontsize10" id="y92027db9-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Permits</inline>.—</heading><subparagraph class="fontsize10" id="y92027dba-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall establish, administer, and enforce a system for allocating and determining terms and conditions of permits to be issued to prospective employers for each nonimmigrant worker described in this subsection who would not otherwise be eligible for admission under the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/etseq">8 U.S.C. 1101 et seq.</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y92027dbb-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Numerical cap</inline>.—</heading><chapeau>The number of permits issued under subparagraph (A) may not exceed—</chapeau><clause class="fontsize10" id="y92027dbc-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>13,000 for fiscal year 2019;</content></clause>
<clause class="fontsize10" id="y92027dbd-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>12,500 for fiscal year 2020;</content></clause>
<clause class="fontsize10" id="y92027dbe-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>12,000 for fiscal year 2021;</content></clause>

<clause class="fontsize10" id="y92027dc1-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>10,000 for fiscal year 2024;</content></clause>
<clause class="fontsize10" id="y92027dc2-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>9,000 for fiscal year 2025;</content></clause>
<clause class="fontsize10" id="y92027dc3-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">“(viii) </num><content>8,000 for fiscal year 2026;</content></clause>

<subparagraph class="fontsize10" id="y92027dc8-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Reports regarding the percentage of united states workers</inline>.—</heading><clause class="fontsize10" id="y92027dc9-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">By governor</inline>.—</heading><content>Not later than 60 days before the end of each calendar year, the Governor shall submit a report to the Secretary that identifies the ratio between United States workers and other workers in the Commonwealth’s workforce based on income tax filings with the Commonwealth for the tax year.</content></clause>
<clause class="fontsize10" id="y92027dca-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92027dcb-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">By gao</inline>.—</heading><content>Not later than December 31, 2019, and biennially thereafter, the Comptroller General of the United States shall submit a report to the Chair and Ranking Member of the Committee on Energy and Natural Resources of the Senate, the Chair and Ranking Member of the Committee on Natural Resources of the House of Representatives, the Chair and Ranking Member of the Committee on Health, Education, Labor, and Pensions of the Senate and the <page identifier="/us/stat/132/1551">132 STAT. 1551</page>
Chair and Ranking Member of the Committee on Education and the Workforce of the House of Representatives that identifies the ratio between United States workers and other workers in the Commonwealth’s workforce during each of the previous 5 calendar years.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92027dcc-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Petition; issuance of permits</inline>.—</heading><clause class="fontsize10" id="y92027dcd-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92027dce-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Submission</inline>.—</heading><chapeau>A prospective employer may submit a petition for a permit under this paragraph not earlier than—</chapeau><subclause class="fontsize10" id="y92027dcf-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>120 days before the date on which the prospective employer needs the beneficiary’s services; or</content></subclause>
<subclause class="fontsize10" id="y92027dd0-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>if the petition is for the renewal of an existing permit, not earlier than 180 days before the expiration of such permit.</content></subclause>
</clause>
<clause class="fontsize10" id="y92027dd1-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92027dd2-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Employment verification</inline>.—</heading><content>The Secretary shall establish a system for each employer of a Commonwealth Only Transitional Worker to submit a semiannual report to the Secretary and the Secretary of Labor that provides evidence to verify the continuing employment and payment of such worker under the terms and conditions set forth in the permit petition that the employer filed on behalf of such worker.</content></clause>
<clause class="fontsize10" id="y92027dd3-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Revocation</inline>.—</heading><subclause class="fontsize10" id="y92027dd4-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92027dd5-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary, in the Secretary’s discretion, may revoke a permit approved under this paragraph for good cause, including if—</chapeau><item class="fontsize10" id="y92027dd6-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>the employer fails to maintain the continuous employment of the subject worker, fails to pay the subject worker, fails to timely file a semiannual report required under this paragraph, commits any other violation of the terms and conditions of employment, or otherwise ceases to operate as a legitimate business (as defined in clause (iv)(II));</content></item>
<item class="fontsize10" id="y92027dd7-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>the beneficiary of such petition does not apply for admission to the Commonwealth by the date that is 10 days after the period of petition validity begins, if the employer has requested consular processing; or</content></item>
<item class="fontsize10" id="y9202a4e8-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>the employer fails to provide a former, current, or prospective Commonwealth Only Transitional Worker, not later than 21 business days after receiving a written request from such worker, with the original (or a certified copy of the original) of all petitions, notices, and other written communication related to the worker (other than sensitive financial or proprietary information of the employer, which may be redacted) that has been exchanged between the employer and the Department of Labor, the Department of Homeland Security, or any other Federal agency or department.</content></item>
</subclause>
<subclause class="fontsize10" id="y9202a4e9-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Reallocation of revoked petition</inline>.—</heading><content>Notwithstanding subparagraph (C), for each <page identifier="/us/stat/132/1552">132 STAT. 1552</page>
permit revoked under subclause (I) in a fiscal year, an additional permit shall be made available for use in the subsequent fiscal year.</content></subclause>
</clause>
<clause class="fontsize10" id="y9202a4ea-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Legitimate business</inline>.—</heading><subclause class="fontsize10" id="y9202a4eb-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A permit may not be approved for a prospective employer that is not a legitimate business.</content></subclause>
<subclause class="fontsize10" id="y9202a4ec-e836-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Defined term</inline>.—</heading><chapeau>In this clause, the term ‘<term>legitimate business</term>’ means a real, active, and operating commercial or entrepreneurial undertaking that the Secretary, in the Secretary’s sole discretion, determines—</chapeau><item class="fontsize10" id="y9202a4ed-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>produces services or goods for profit, or is a governmental, charitable, or other validly recognized nonprofit entity;</content></item>
<item class="fontsize10" id="y9202a4ee-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>meets applicable legal requirements for doing business in the Commonwealth;</content></item>
<item class="fontsize10" id="y9202a4ef-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>has substantially complied with wage and hour laws, occupational safety and health requirements, and all other Federal, Commonwealth, and local requirements related to employment during the preceding 5 years;</content></item>
<item class="fontsize10" id="y9202a4f0-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="dd">“(dd) </num><content>does not directly or indirectly engage in, or knowingly benefit from, prostitution, human trafficking, or any other activity that is illegal under Federal, Commonwealth, or local law;</content></item>
<item class="fontsize10" id="y9202a4f1-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="ee">“(ee) </num><content>is a participant in good standing in the E-Verify program;</content></item>
<item class="fontsize10" id="y9202a4f2-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="ff">“(ff) </num><content>does not have, as an owner, investor, manager, operator, or person meaningfully involved with the undertaking, any individual who has been the owner, investor, manager, operator, or otherwise meaningfully involved with an undertaking that does not comply with item (cc) or (dd), or is the agent of such an individual; and</content></item>
<item class="fontsize10" id="y9202a4f3-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="gg">“(gg) </num><content>is not a successor in interest to an undertaking that does not comply with item (cc) or (dd).</content></item>
</subclause>
</clause>
<clause class="fontsize10" id="y9202a4f4-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><heading class="fontsize10"><inline class="smallCaps">Construction occupations</inline>.—</heading><content>A permit for Construction and Extraction Occupations (as defined by the Department of Labor as Standard Occupational Classification Group 47–0000) may not be issued for any worker other than a worker described in paragraph (7)(B).”</content></clause>
</subparagraph>
</paragraph>

<subparagraph class="fontsize10" id="y9202a4f5-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>in paragraph (4), as redesignated, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or to Guam for the purpose of transit only</quotedText>” after “<quotedText>except admission to the Commonwealth</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y9202a4f6-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>in paragraph (5), as redesignated, by <amendingAction type="add">adding</amendingAction> at the end the following: “<quotedText>Approval of a petition filed by the new employer with a start date within the same fiscal year as the current permit shall not count against the numerical limitation for that period.</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9202a4f7-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/3/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="y9202cc08-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9202cc09-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Requirement to remain outside of the united states</inline>.—</heading><page identifier="/us/stat/132/1553">132 STAT. 1553</page>
<subparagraph class="fontsize10" id="y9202cc0a-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in subparagraph (B)—</chapeau><clause class="fontsize10" id="y9202cc0b-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>a permit for a Commonwealth Only Transitional Worker—</chapeau><subclause class="fontsize10" id="y9202cc0c-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>shall remain valid for a period that may not exceed 1 year; and</content></subclause>
<subclause class="fontsize10" id="y9202cc0d-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>may be renewed for not more than two consecutive, 1-year periods; and</content></subclause>
</clause>
<clause class="fontsize10" id="y9202cc0e-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>at the expiration of the second renewal period, an alien may not again be eligible for such a permit until after the alien has remained outside of the United States for a continuous period of at least 30 days prior to the submission of a renewal petition on their behalf.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9202cc0f-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Long-term workers</inline>.—</heading><content>An alien who was admitted to the Commonwealth as a Commonwealth Only Transitional Worker during fiscal year 2015, and during every subsequent fiscal year beginning before the date of the enactment of the Northern Mariana Islands U.S. Workforce Act of 2018, may receive a permit for a Commonwealth Only Transitional Worker that is valid for a period that may not exceed 3 years and may be renewed for additional 3-year periods during the transition period. A permit issued under this subparagraph shall be counted toward the numerical cap for each fiscal year within the period of petition validity.”</content></subparagraph>

<paragraph class="fontsize10" id="y9202cc10-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y92031a31-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y92031a32-e836-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Commonwealth</inline>.—</heading><content>The term ‘<term>Commonwealth</term>’ means the Commonwealth of the Northern Mariana Islands.</content></paragraph>
<paragraph class="fontsize10" id="y92031a33-e836-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Commonwealth only transition worker</inline>.—</heading><content>The term ‘<term>Commonwealth Only Transition Worker</term>’ means an alien who has been admitted into the Commonwealth under the transition program and is eligible for a permit under subsection (d)(3).</content></paragraph>
<paragraph class="fontsize10" id="y92031a34-e836-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Governor</inline>.—</heading><content>The term ‘<term>Governor</term>’ means the Governor of the Commonwealth of the Northern Mariana Islands.</content></paragraph>
<paragraph class="fontsize10" id="y92031a35-e836-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term ‘<term>Secretary</term>’ means the Secretary of Homeland Security.</content></paragraph>
<paragraph class="fontsize10" id="y92031a36-e836-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Tax year</inline>.—</heading><content>The term ‘<term>tax year</term>’ means the fiscal year immediately preceding the current fiscal year.</content></paragraph>
<paragraph class="fontsize10" id="y92031a37-e836-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">United states worker</inline>.—</heading><chapeau>The term ‘<term>United States worker</term>’ means any worker who is—</chapeau><subparagraph class="fontsize10" id="y92031a38-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a citizen or national of the United States;</content></subparagraph>
<subparagraph class="fontsize10" id="y92031a39-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>an alien who has been lawfully admitted for permanent residence; or</content></subparagraph>

<paragraph class="fontsize10" id="y92031a43-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Secretary of labor</inline>.—</heading><content>Notwithstanding the requirements under <ref href="/us/usc/t5/s553/b">section 553(b) of title 5, United States Code</ref>, the Secretary of Labor shall publish in the Federal Register, not later than 180 days after the date of the enactment of this Act, an interim final rule that specifies how the Secretary intends to implement the amendments made by subsection (a) that relate to the responsibilities of the Secretary.</content></paragraph>
<paragraph class="fontsize10" id="y92031a44-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Recommendations of the governor</inline>.—</heading><chapeau>In developing the interim final rules under paragraphs (1) and (2), the Secretary of Homeland Security and the Secretary of Labor—</chapeau><subparagraph class="fontsize10" id="y92031a45-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>shall each consider, in good faith, any written public recommendations regarding the implementation of this Act that are submitted by the Governor of the Commonwealth not later than 60 days after the date of the enactment of this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y92031a46-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>may include provisions in such rule that are responsive to any recommendation of the Governor that is not inconsistent with this Act, including a recommendation to reserve a number of permits each year for occupational categories necessary to maintain public health or safety in the Commonwealth.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92031a47-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92031a48-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x92031a49-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p><p class="leftAlign firstIndent0 fontsize8" id="x92031a4a-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t48/s1807">48 USC 1807 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Department of the Interior Technical Assistance</inline>.—</heading><chapeau>Not later than October 1, 2019, and biennially thereafter, the Secretary of the Interior shall submit a report to Congress that describes the fulfillment of the Department of the Interior’s responsibilities to the Commonwealth of the Northern Mariana Islands—</chapeau><paragraph class="fontsize10" id="y92031a4b-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to identify opportunities for economic growth and diversification;</content></paragraph>
<paragraph class="fontsize10" id="y92031a4c-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to provide assistance in recruiting, training, and hiring United States workers; and</content></paragraph>
<paragraph class="fontsize10" id="y92031a4d-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to provide such other technical assistance and consultation as outlined in section 702(e) of the Consolidated Natural Resources Act of 2008 (<ref href="/us/usc/t48/s1807">48 U.S.C. 1807</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92031a4e-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92031a4f-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x92031a50-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t48/s1806">48 USC 1806 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Outreach and Training</inline>.—</heading><content>Not later than 120 days after the date on which the Secretary of Labor publishes an interim final rule in the Federal Register in accordance with subsection (b)(2), the Secretary shall conduct outreach and training in the Commonwealth of the Northern Mariana Islands for employers and workers on the foreign labor certification process set forth in section 6 of the Joint Resolution entitled “A Joint Resolution to approve the ‘Covenant To Establish a Commonwealth of the Northern Mariana Islands in Political Union with the United States of America’, and for other purposes”, as amended by subsection (b), including the minimum wage requirement set forth in subsection (d)(2)(C) of such section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92031a51-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92031a52-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t48/s1806">48 USC 1806 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><paragraph class="fontsize10" id="y92031a53-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as specifically otherwise provided, this Act and the amendments made by this Act—<page identifier="/us/stat/132/1555">132 STAT. 1555</page></chapeau><subparagraph class="fontsize10" id="y92031a54-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/e/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>shall take effect on the date of the enactment of this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y92031a55-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/e/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92031a56-e836-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>shall apply to petitions for Commonwealth Only Transitional Workers filed on or after such date.</content></subparagraph>

<paragraph class="fontsize10" id="y92031a57-e836-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/218/s3/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Authority of secretary of homeland security</inline>.—</heading><content>The Secretary of Homeland Security, in the Secretary’s discretion, may delay the effective date of any provision of this Act relating to Commonwealth Only Transition Workers until the effective date of the interim final rule described in subsection (b), except for provisions providing annual numerical caps for such workers.</content></paragraph>
