<section id="d159438e88" identifier="/us/pl/115/197/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x629f7d14-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s5101">31 USC 5101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">American Innovation $1 Coin Act</shortTitle>”.</content></section>
<section id="d159438e103" identifier="/us/pl/115/197/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AMERICAN INNOVATION $1 COIN PROGRAM.</heading><content class="firstIndent0 fontsize10" id="x62a01955-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t31/s5112">Section 5112 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after subsection (v) the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y62a12ac6-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="w">“(w) </num><heading class="fontsize10"><inline class="smallCaps">Redesign and Issuance of $1 Coins Honoring Innovation and Innovators From Each State, the District of Columbia, and Each Territory</inline>.—</heading><paragraph class="fontsize10" id="y62a12ac7-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Redesign beginning in 2019</inline>.—</heading><subparagraph class="fontsize10" id="y62a12ac8-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62a12ac9-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote>—</heading><chapeau>Notwithstanding subsection (d)(1) and subsection (d)(2) and in accordance with the provisions of this subsection, during the 14-year period beginning on January 1, 2019 (or such later date as provided under subparagraph (B)(ii)), the Secretary of the Treasury shall mint and issue $1 coins to be known as ‘American Innovation $1 coins’, that—</chapeau><clause class="fontsize10" id="y62a12aca-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>have designs on the obverse selected in accordance with paragraph (2)(A); and</content></clause>
<clause class="fontsize10" id="y62a12acb-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>have a design on the reverse selected in accordance with paragraph (2)(B).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y62a12acc-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Continuity provisions</inline>.—</heading><clause class="fontsize10" id="y62a12acd-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding subparagraph (A), the Secretary shall continue to mint and issue $1 coins honoring Native Americans and their contributions in accordance with subsection (r).</content></clause>
<clause class="fontsize10" id="y62a12ace-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">First coin</inline>.—</heading><chapeau>Notwithstanding subparagraph (A), if the Secretary finds that it is feasible and cost-effective, the Secretary may mint and issue a $1 coin in 2018 to introduce the series of coins described in this subsection, that—</chapeau><subclause class="fontsize10" id="y62a12acf-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>has the obverse described under paragraph (2)(A);</content></subclause>
<subclause class="fontsize10" id="y62a12ad0-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>has a reverse that bears the inscription ‘United States of America’ and ‘American <page identifier="/us/stat/132/1516">132 STAT. 1516</page>
 Innovators’ and a representation of the signature of President George Washington on the first United States patent issued;</content></subclause>
<subclause class="fontsize10" id="y62a12ad1-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>has the edge-incusing described under paragraph (2)(C); and</content></subclause>
<subclause class="fontsize10" id="y62a12ad2-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>the design for which has reviewed by the Citizens Coinage Advisory Committee.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y62a12ad3-e837-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Definition of territory</inline>.—</heading><content>For purposes of this subsection, the term ‘<term>territory</term>’ means the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y62a12ad4-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Design requirements</inline>.—</heading><chapeau>Notwithstanding subsection (d)(1) and subsection (d)(2), the $1 coins issued in accordance with paragraph (1)(A) shall meet the following design requirements:</chapeau><subparagraph class="fontsize10" id="y62a12ad5-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Coin obverse</inline>.—</heading><chapeau>The common design on the obverse of each coin issued under this subsection shall contain—</chapeau><clause class="fontsize10" id="y62a12ad6-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a likeness of the Statue of Liberty extending to the rim of the coin and large enough to provide a dramatic representation of Liberty;</content></clause>
<clause class="fontsize10" id="y62a12ad7-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the inscription ‘$1’; and</content></clause>
<clause class="fontsize10" id="y62a12ad8-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the inscription ‘In God We Trust’.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y62a12ad9-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Coin reverse</inline>.—</heading><chapeau>The design on the reverse of each coin issued under this subsection shall bear the following:</chapeau><clause class="fontsize10" id="y62a12ada-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>An image or images emblematic of one of the following from one of the 50 States, the District of Columbia, or the territories of the United States:</chapeau><subclause class="fontsize10" id="y62a12adb-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>A significant innovation.</content></subclause>
<subclause class="fontsize10" id="y62a12adc-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>An innovator.</content></subclause>
<subclause class="fontsize10" id="y62a12add-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>A group of innovators.</content></subclause>
</clause>
<clause class="fontsize10" id="y62a12ade-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>The name of the State, the District of Columbia, or territory, as applicable.</content></clause>
<clause class="fontsize10" id="y62a12adf-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>The inscription ‘United States of America’.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y62a12ae0-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Edge-incused inscriptions</inline>.—</heading><clause class="fontsize10" id="y62a12ae1-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The inscription of the year of minting or issuance of the coin, the mint mark, and the inscription ‘E Pluribus Unum’ shall be edge-incused into the coin.</content></clause>
<clause class="fontsize10" id="y62a12ae2-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Preservation of distinctive edge</inline>.—</heading><content>The edge-incusing of the inscriptions under clause (i) on coins issued under this subsection shall be done in a manner that preserves the distinctive edge of the coin so that the denomination of the coin is readily discernible, including by individuals who are blind or visually impaired.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y62a12ae3-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Issuance of coins commemorating innovation or innovators</inline>.—</heading><subparagraph class="fontsize10" id="y62a12ae4-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Order of issuance</inline>.—</heading><clause class="fontsize10" id="y62a12ae5-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The coins issued under this subsection commemorating either an innovation, an individual innovator, or a group of innovators, from each State, the District of Columbia, or a territory shall be issued in the following order:</chapeau><subclause class="fontsize10" id="y62a12ae6-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>With respect to each State, the coins shall be issued in the order in which the <page identifier="/us/stat/132/1517">132 STAT. 1517</page>
States ratified the Constitution of the United States or were admitted into the Union, as the case may be.</content></subclause>
<subclause class="fontsize10" id="y62a12ae7-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">District of columbia and territories</inline>.—</heading><content>After all coins are issued under subclause (I), the coins shall be issued for the District of Columbia and the territories in the following order: the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</content></subclause>
</clause>
<clause class="fontsize10" id="y62a12ae8-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Application in event of the admission of additional states</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62a12ae9-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote>.—</heading><content>Notwithstanding clause (i), if any additional State is admitted into the Union before the end of the 14-year period referred to in paragraph (1), the Secretary of the Treasury may issue a $1 coin with respect to the additional State in accordance with clause (i)(I).</content></clause>
<clause class="fontsize10" id="y62a12aea-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Application in the event of independence or adding of a territory</inline>.—</heading><chapeau>Notwithstanding clause (i)—</chapeau><subclause class="fontsize10" id="y62a12aeb-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>if any territory becomes independent or otherwise ceases to be a territory of the United States before $1 coins are minted pursuant to this subsection, the subsection shall cease to apply with respect to such territory; and</content></subclause>
<subclause class="fontsize10" id="y62a12aec-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>if any new territory is added to the United States, $1 coins shall be issued for such territories in the order in which the new the territories are added, beginning after the $1 coin is issued for the Commonwealth of the Northern Mariana Islands.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y62a12aed-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Issuance of coins commemorating four innovations or innovators during each of 14 years</inline>.—</heading><clause class="fontsize10" id="y62a12aee-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Four $1 coin designs as described in this subsection shall be issued during each year of the period referred to in paragraph (1) until 1 coin featuring 1 innovation, an individual innovator, or a group of innovators, from each of the States, the District of Columbia, and territories has been issued.</content></clause>
<clause class="fontsize10" id="y62a151ff-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Number of coins of each design</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62a15200-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>.—</heading><content>The Secretary shall prescribe, on the basis of such factors as the Secretary determines to be appropriate, the number of $1 coins that shall be issued with each of the designs selected for each year of the period referred to in paragraph (1).</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y62a15201-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Selection of concept and design</inline>.—</heading><subparagraph class="fontsize10" id="y62a15202-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Concept</inline><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62a15203-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>.—</heading><content>With respect to each State, the District of Columbia, and each territory to be honored with a coin under this subsection, the selection of the significant innovation, innovator, or group of innovators to be borne on the reverse of such coin shall be made by the Secretary of the Treasury, after consultation with the Governor or other chief executive of the State, the District of Columbia, or territory with respect to which a coin is to be issued under this subsection.<page identifier="/us/stat/132/1518">132 STAT. 1518</page></content></subparagraph>
<subparagraph class="fontsize10" id="y62a15204-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Design</inline>.—</heading><chapeau>Each of the designs required under this subsection shall be selected by the Secretary after—</chapeau><clause class="fontsize10" id="y62a15205-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62a15206-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><chapeau>consultation with—</chapeau><subclause class="fontsize10" id="y62a15207-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the Governor or other chief executive of the State, the District of Columbia, or territory with respect to which a coin is to be issued under this subsection; and</content></subclause>
<subclause class="fontsize10" id="y62a15208-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the Commission of Fine Arts; and</content></subclause>
</clause>
<clause class="fontsize10" id="y62a15209-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x62a1520a-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><content>review by the Citizens Coinage Advisory Committee.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y62a1520b-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Selection and approval process</inline>.—</heading><content>Proposals for designs for $1 coins under this subsection may be submitted in accordance with the design selection and approval process developed by the Secretary in the sole discretion of the Secretary.</content></subparagraph>
<subparagraph class="fontsize10" id="y62a1520c-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Standards</inline>.—</heading><content>Because it is important that the Nation’s coinage and currency bear dignified designs of which the citizens of the United States can be proud, the Secretary shall not select any frivolous or inappropriate design for any $1 coin minted under this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="y62a1520d-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on certain representations</inline>.—</heading><content>No head and shoulders portrait or bust of any person and no portrait of a living person may be included in the design of any coin issued under this subsection.</content></subparagraph>

<paragraph class="fontsize10" id="y62a1520e-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Treatment as numismatic items</inline>.—</heading><content>For purposes of sections 5134 and 5136, all $1 coins minted under this subsection shall be considered to be numismatic items.</content></paragraph>
<paragraph class="fontsize10" id="y62a1520f-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Issuance of numismatic coins</inline>.—</heading><content>The Secretary may mint and issue such number of $1 coins of each design selected under this subsection in uncirculated and proof qualities as the Secretary determines to be appropriate.</content></paragraph>
<paragraph class="fontsize10" id="y62a15210-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Termination of program</inline>.—</heading><content>The issuance of coins under this subsection shall terminate when one innovation, an individual innovator, or a group of innovators, from each State, the District of Columbia, and each territory has been honored and may not be resumed except by an Act of Congress.”</content></paragraph>
