<section id="d159653e102" identifier="/us/pl/115/194/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the Firefighter Cancer Registry Act of 2018.</content></section>
<section id="d159653e109" identifier="/us/pl/115/194/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x800fa76e-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s280e–5">42 USC 280e–5</ref>.</p></sidenote><heading>VOLUNTARY REGISTRY FOR FIREFIGHTER CANCER INCIDENCE.</heading><subsection class="firstIndent0 fontsize10" id="y80112e0f-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x80112e10-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p><p class="leftAlign firstIndent0 fontsize8" id="x80112e11-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Grants.</p><p class="leftAlign firstIndent0 fontsize8" id="x80112e12-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary of Health and Human Services (referred to in this section as the Secretary), acting through the Director of the Centers for Disease Control and Prevention and in coordination with other agencies as the Secretary determines appropriate, shall develop and maintain, directly or through a grant or cooperative agreement, a voluntary registry of firefighters (referred to in this section as the Firefighter Registry) to collect relevant health and occupational information of such firefighters for purposes of determining cancer incidence.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y80112e13-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Use of Firefighter Registry</inline>.—</heading><chapeau>The Firefighter Registry may be used for the following purposes:</chapeau><paragraph class="fontsize10" id="y80112e14-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>To improve data collection and data coordination activities related to the nationwide monitoring of the incidence of cancer among firefighters.</content></paragraph>
<paragraph class="fontsize10" id="y80112e15-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>To collect, consolidate, and maintain, consistent with subsection (g), epidemiological information and analyses related to cancer incidence and trends among firefighters</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y80112e16-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Relevant Data</inline>.—</heading><paragraph class="fontsize10" id="y80112e17-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Data collection</inline>.—</heading><chapeau>In carrying out the voluntary data collection for purposes of inclusion under the Firefighter Registry, the Secretary may collect the following:</chapeau><subparagraph class="fontsize10" id="y80112e18-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x80112e19-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>Information, as determined by the Secretary under subsection (d)(1), of volunteer, paid-on-call, and career firefighters, independent of cancer status or diagnosis.</content></subparagraph>
<subparagraph class="fontsize10" id="y80112e1a-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Individual risk factors and occupational history of firefighters.</content></subparagraph>
<subparagraph class="fontsize10" id="y80112e1b-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>Information, if available, related to—</chapeau><clause class="fontsize10" id="y80112e1c-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>basic demographic information, including—</chapeau><subclause class="fontsize10" id="y80112e1d-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the age of the firefighter involved during the relevant dates of occupation as a firefighter; and</content></subclause>
<subclause class="fontsize10" id="y80112e1e-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the age of cancer diagnosis;<page identifier="/us/stat/132/1507">132 STAT. 1507</page></content></subclause>
</clause>
<clause class="fontsize10" id="y80112e1f-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the status of the firefighter as either volunteer, paid-on-call, or career firefighter;</content></clause>
<clause class="fontsize10" id="y80112e20-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the total number of years of occupation as a firefighter and a detailing of additional employment experience, whether concurrent, before, or anytime thereafter;</content></clause>
<clause class="fontsize10" id="y80112e21-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv)</num><subclause class="inline" id="y80112e22-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/iv/I"><num value="I">(I) </num><content>the approximate number of fire incidents attended, including information related to the type of fire incidents and the role of the firefighter in responding to the incident; or</content></subclause>
<subclause class="indentUp0 fontsize10" id="y80112e23-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/iv/II" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x80112e24-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Estimate.</p></sidenote><content>in the case of a firefighter for whom information on such number and type is unavailable, an estimate of such number and type based on the method developed under subsection (d)(1)(D); and</content></subclause>
</clause>
<clause class="fontsize10" id="y80112e25-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/1/C/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>other medical information and health history, including additional risk factors, as appropriate, and other information relevant to a cancer incidence study of firefighters.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y80112e26-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Information on diagnoses and treatment</inline>.—</heading><chapeau>In carrying out paragraph (1), with respect to diagnoses and treatment of firefighters with cancer, the Secretary shall, as appropriate, enable the Firefighter Registry to electronically connect to State-based cancer registries, for a purpose described by clause (vi) or (vii) of section 399B(c)(2)(D) of the Public Health Service Act (<ref href="/us/usc/t42/s280e/c/2/D">42 U.S.C. 280e(c)(2)(D)</ref>), to obtain—</chapeau><subparagraph class="fontsize10" id="y80112e27-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>date of diagnoses and source of information; and</content></subparagraph>
<subparagraph class="fontsize10" id="y80112e28-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>pathological data characterizing the cancer, including cancer site, state of disease (pursuant to Staging Guide), incidence, and type of treatment.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y80112e29-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8011543a-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Firefighter Registry Coordination Strategy</inline>.—</heading><paragraph class="fontsize10" id="y8011543b-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Required strategy</inline>.—</heading><chapeau>The Secretary shall, in consultation with the relevant stakeholders identified in subsection (e), including epidemiologists and pathologists, develop a strategy to coordinate data collection activities, including within existing State registries, for inclusion in the Firefighter Registry established under this Act. The strategy may include the following:</chapeau><subparagraph class="fontsize10" id="y8011543c-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Increasing awareness of the Firefighter Registry and encouraging participation among volunteer, paid-on-call, and career firefighters.</content></subparagraph>
<subparagraph class="fontsize10" id="y8011543d-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Consideration of unique data collection needs that may arise to generate a statistically reliable representation of minority, female, and volunteer firefighters, including methods, as needed, to encourage participation from such populations.</content></subparagraph>
<subparagraph class="fontsize10" id="y8011543e-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Information on how the Secretary will store data described in subsection (c)(1) and provide electronic access to relevant health information described in subsection (c)(2).</content></subparagraph>
<subparagraph class="fontsize10" id="y8011543f-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Working in consultation with the experts described in subsection (e), a reliable and standardized method for estimating the number of fire incidents attended by a firefighter as well as the type of fire incident so attended in the case such firefighter is unable to provide such information.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y80115440-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report to congress</inline>.—</heading><content>The Secretary shall submit the strategy described in paragraph (1) to the Committee on Energy <page identifier="/us/stat/132/1508">132 STAT. 1508</page>
and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate not later than 30 days after the date of the completion of the strategy.</content></paragraph>
<paragraph class="fontsize10" id="y80115441-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Guidance for inclusion and maintenance of data on firefighters</inline>.—</heading><chapeau>The Secretary shall develop, in consultation with the stakeholders identified in subsection (e), State health agencies, State departments of homeland security, and volunteer, paid-on-call, combination, and career firefighting agencies, a strategy for inclusion of firefighters in the registry that are representative of the general population of firefighters, that outlines the following:</chapeau><subparagraph class="fontsize10" id="y80115442-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>How new information about firefighters will be submitted to the Firefighter Registry for inclusion.</content></subparagraph>
<subparagraph class="fontsize10" id="y80115443-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>How information about firefighters will be maintained and updated in the Firefighter Registry over time.</content></subparagraph>
<subparagraph class="fontsize10" id="y80115444-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>A method for estimating the number of fire incidents attended by a firefighter as well as the type of fire incident so attended in the case such firefighter is unable to provide such information.</content></subparagraph>
<subparagraph class="fontsize10" id="y80115445-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/d/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Further information, as deemed necessary by the Secretary.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y80115446-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Consultation and Report</inline>.—</heading><chapeau>The Secretary shall consult with non-Federal experts on the Firefighter Registry established under this section, and shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes, as appropriate, information on goals achieved and improvements needed to strengthen the Firefighter Registry. Such non-Federal experts shall include the following:</chapeau><paragraph class="fontsize10" id="y80115447-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Public health experts with experience in developing and maintaining cancer registries.</content></paragraph>
<paragraph class="fontsize10" id="y80115448-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Epidemiologists with experience in studying cancer incidence.</content></paragraph>
<paragraph class="fontsize10" id="y80115449-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Clinicians with experience in diagnosing and treating cancer incidence.</content></paragraph>
<paragraph class="fontsize10" id="y8011544a-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Active and retired volunteer, paid-on-call, and career firefighters as well as relevant national fire and emergency response organizations.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8011544b-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8011544c-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Research Availability</inline>.—</heading><content>Subject to subsection (g), the Secretary shall ensure that information and analysis in the Firefighter Registry are available, as appropriate, to the public, including researchers, firefighters, and national fire service organizations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8011544d-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/194/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Privacy</inline>.—</heading><content>In carrying out this Act, the Secretary shall ensure that information in and analysis of the Firefighter Registry are made available in a manner that, at a minimum, protects personal privacy to the extent required by applicable Federal and State privacy law.<page identifier="/us/stat/132/1509">132 STAT. 1509</page></content></subsection>
