<section id="d160235e92" identifier="/us/pl/115/188/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Department of Veterans Affairs Senior Executive Accountability Act of 2018</shortTitle>” or the “<shortTitle role="act">SEA Act of 2018</shortTitle>”.</content></section>
<section id="d160235e105" identifier="/us/pl/115/188/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SEMIANNUAL REPORTS ON REASSIGNMENT OF DEPARTMENT OF VETERANS AFFAIRS SENIOR EXECUTIVE EMPLOYEES.</heading><subsection class="firstIndent0 fontsize10" id="yb612b5fb-e837-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/188/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t38/ch7/schI">Subchapter I of chapter 7 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="centered fontsize12" id="yb612dd0c-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658163"><num class="fontsize12" value="727">“§ 727.</num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb612dd0d-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s727">38 USC 727</ref>.</p></sidenote><heading class="fontsize12"> Reassignment of senior executives</heading><subsection class="firstIndent0 fontsize10" id="yb612dd0e-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Approval of Reassignments</inline>.—</heading><content>No individual employed in a senior executive position at the Department may be reassigned to another such position at the Department unless such reassignment is approved in writing and signed by the Secretary.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb612dd0f-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Semiannual Reports Required</inline>.—</heading><paragraph class="inline" id="yb612dd10-e837-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>Not later than June 30 and December 31 of each year, the Secretary shall submit to Congress a report on the reassignment of individuals employed in senior executive positions at the Department to other such positions at the Department during the period covered by the report.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yb612dd11-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Each report submitted under paragraph (1) shall describe the purpose of each reassignment and the costs associated with such reassignment.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="yb612dd12-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>For purposes of paragraph (2), costs associated with a reassignment may only include the following:</chapeau><subparagraph class="fontsize10" id="yb612dd13-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>A salary increase.</content></subparagraph>
<subparagraph class="fontsize10" id="yb612dd14-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Temporary travel expenses for the individual or the family of the individual.</content></subparagraph>
<subparagraph class="fontsize10" id="yb612dd15-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Moving expenses.</content></subparagraph>
<subparagraph class="fontsize10" id="yb612dd16-e837-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>A paid incentive.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yb612dd17-e837-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Senior Executive Position Defined</inline>.—</heading><content>In this section, the term ‘<term>senior executive position</term>’ has the meaning given such term in section 713(d) of this title.”</content></subsection>
