<section id="d162418e94" identifier="/us/pl/115/173/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Securely Expediting Clearances Through Reporting Transparency Act of 2018</shortTitle>” or the “<shortTitle role="act">SECRET Act of 2018</shortTitle>”.</content></section>
<section id="d162418e107" identifier="/us/pl/115/173/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x322f79f6-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act—</chapeau><paragraph class="fontsize10" id="y322f79f7-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>Bureau</term>” means the National Background Investigations Bureau of the Office;</content></paragraph>
<paragraph class="fontsize10" id="y322f79f8-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the term “<term>Director</term>” means the Director of National Intelligence acting as the Security Executive Agent; and</content></paragraph>
<paragraph class="fontsize10" id="y322f79f9-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the term “<term>Office</term>” means the Office of Personnel Management acting as the Suitability and Credentialing Executive Agent.</content></paragraph>

<section id="d162418e129" identifier="/us/pl/115/173/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REPORT ON BACKLOG OF PERSONNEL SECURITY CLEARANCE INVESTIGATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x3230163a-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not later<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3230163b-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x3230163c-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote> than 90 days after the date of enactment of this Act, and quarterly thereafter for 5 years, the Director of the Bureau, in coordination with the Director, shall submit to Congress a report on the backlog of personnel security clearance investigations at the Bureau for the most recent full calendar quarter, which shall include—</chapeau><paragraph class="fontsize10" id="y3230163d-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the size of the backlog of personnel security clearance investigations of the Bureau, including, for each sensitivity level—</chapeau><subparagraph class="fontsize10" id="y3230163e-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of interim clearances granted;</content></subparagraph>
<subparagraph class="fontsize10" id="y3230163f-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the number of initial investigations for Federal employees;</content></subparagraph>
<subparagraph class="fontsize10" id="y32301640-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the number of periodic reinvestigations for Federal employees;</content></subparagraph>
<subparagraph class="fontsize10" id="y32301641-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the number of initial investigations for employees of Federal contractors;</content></subparagraph>
<subparagraph class="fontsize10" id="y32301642-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the number of periodic reinvestigations for employees of Federal contractors;</content></subparagraph>
<subparagraph class="fontsize10" id="y32301643-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>the number of initial investigations for employees of, and employees of contractors of, the Department of Defense;<page identifier="/us/stat/132/1292">132 STAT. 1292</page></content></subparagraph>
<subparagraph class="fontsize10" id="y32301644-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>the number of periodic reinvestigations for employees of and employees of contractors of the Department of Defense;</content></subparagraph>
<subparagraph class="fontsize10" id="y32301645-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>the number of employees of the Bureau conducting background investigations for the Bureau; and</content></subparagraph>
<subparagraph class="fontsize10" id="y32301646-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/1/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the number of employees of contractors of the Bureau conducting background investigations for the Bureau;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y32301647-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the average length of time, for each sensitivity level, for the Bureau to carry out an initial investigation and a periodic reinvestigation;</content></paragraph>
<paragraph class="fontsize10" id="y32301648-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a discussion of the factors contributing to the average length of time to carry out an initial investigation and a periodic reinvestigation;</content></paragraph>
<paragraph class="fontsize10" id="y32301649-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3230164a-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Plan.</p></sidenote><chapeau>a backlog mitigation plan, which shall include—</chapeau><subparagraph class="fontsize10" id="y3230164b-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3230164c-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x3230164d-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>the identification of the cause of, and recommendations to remedy, the backlog at the Bureau;</content></subparagraph>
<subparagraph class="fontsize10" id="y3230164e-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the steps the Director of the Bureau shall take to reduce the backlog;</content></subparagraph>
<subparagraph class="fontsize10" id="y3230164f-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>process reforms to improve efficiencies in, and the quality of, background investigations by the Bureau; and</content></subparagraph>
<subparagraph class="fontsize10" id="y32301650-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/4/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>a projection of when the backlog at the Bureau will be sufficiently reduced to meet required timeliness standards; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y32301651-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s3/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>a description of improvements in the information and data security of the Bureau.</content></paragraph>

<section id="d162418e246" identifier="/us/pl/115/173/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x32301652-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading>REPORT ON SECURITY CLEARANCE INVESTIGATIONS OF PERSONNEL OF THE EXECUTIVE OFFICE OF THE PRESIDENT.</heading><content style="-uslm-lc:I658120">  Not later than 90 days after the date of enactment of this Act, the Director of the Office of Administration of the Executive Office of the President, in coordination with the Director and the Director of the Office, shall submit to Congress a report that explains the process for conducting and adjudicating security clearance investigations for personnel of the Executive Office of the President, including personnel of the White House Office.</content></section>
<section id="d162418e256" identifier="/us/pl/115/173/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x32301653-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading>REPORT ON COSTS ASSOCIATED WITH BIFURCATED BACKGROUND INVESTIGATION SYSTEMS.</heading><content style="-uslm-lc:I658120">  Not later than 120 days after the date of enactment of this Act, the Director of the Office, in consultation with the other members of the Suitability and Security Clearance Performance Accountability Council established under Executive Order 13467 (<ref href="/us/fr/73/38103">73 Fed. Reg. 38103</ref>) and the Under Secretary of Defense for Intelligence, shall submit to Congress a report on the cost of maintaining comprehensive background investigations capability within the Office under the control or direction of the Bureau and a background investigations capability for Department of Defense personnel under the control or direction of the Department of Defense for implementation of the plan referenced in section 925 of the National Defense Authorization Act for Fiscal Year 2018 (<ref href="/us/pl/115/91">Public Law 115–91</ref>), as compared to the cost of sustaining a single Government-wide background investigations enterprise.</content></section>
<section id="d162418e272" identifier="/us/pl/115/173/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>REPORTS ON CONTINUOUS EVALUATION, RECIPROCITY, AND TIMELINESS MEASURES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x32308b84-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not later than 120 days after the date of enactment of this Act, the Director shall submit to Congress reports that provide—<page identifier="/us/stat/132/1293">132 STAT. 1293</page></chapeau><paragraph class="fontsize10" id="y32308b85-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the status of implementing continuous evaluation Government-wide, including—</chapeau><subparagraph class="fontsize10" id="y32308b86-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of agencies with continuous evaluation programs and how many of those programs are currently conducting automated records checks of the required data sources as identified by the Director; and</content></subparagraph>
<subparagraph class="fontsize10" id="y32308b87-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a discussion of the barriers for agencies to implement continuous evaluation programs, including any requirement under a statute, regulation, Executive Order, or other administrative requirement;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y32308b88-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>a detailed explanation of efforts by agencies to meet requirements for reciprocal recognition to access classified information, including—</chapeau><subparagraph class="fontsize10" id="y32308b89-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the range of the length of time for agencies to grant reciprocal recognition to access classified information;</content></subparagraph>
<subparagraph class="fontsize10" id="y32308b8a-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>additional requirements for reinvestigations or readjudications, by agency; and</content></subparagraph>
<subparagraph class="fontsize10" id="y32308b8b-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>any other barriers to the timely granting of reciprocity, by agency, including any requirement under a statute, regulation, Executive Order, or other administrative requirement; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y32308b8c-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s6/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x32308b8d-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><content>a review of whether the schedule for processing security clearances under section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<ref href="/us/usc/t50/s3341">50 U.S.C. 3341</ref>) should be modified.</content></paragraph>
</section>
<section id="d162418e328" identifier="/us/pl/115/173/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>REVIEW AND UPDATE OF POSITION DESIGNATION GUIDANCE.</heading><subsection class="firstIndent0 fontsize10" id="y323175ee-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="y323175ef-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>agency</term>” has the meaning given the term in Executive Order 13467 (<ref href="/us/fr/73/38103">73 Fed. Reg. 38103</ref>), or any successor thereto;</content></paragraph>
<paragraph class="fontsize10" id="y323175f0-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>the term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y323175f1-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Homeland Security and Governmental Affairs and the Select Committee on Intelligence of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="y323175f2-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Oversight and Government Reform and the Permanent Select Committee on Intelligence of the House of Representatives;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y323175f3-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>the term “<term>background investigation</term>” means any investigation required for the purpose of determining the—</chapeau><subparagraph class="fontsize10" id="y323175f4-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>eligibility of a covered individual for logical and physical access to Federally controlled facilities or information systems;</content></subparagraph>
<subparagraph class="fontsize10" id="y323175f5-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>suitability or fitness of a covered individual for Federal employment;</content></subparagraph>
<subparagraph class="fontsize10" id="y323175f6-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>eligibility of a covered individual for access to classified information or to hold a national security sensitive position; or</content></subparagraph>
<subparagraph class="fontsize10" id="y323175f7-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>fitness of a covered individual to perform work for or on behalf of the United States Government as a contractor employee; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y323175f8-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>the term “<term>covered individual</term>”—</chapeau><subparagraph class="fontsize10" id="y323175f9-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>means a person who performs work for or on behalf of the executive branch or seeks to perform work for or on behalf of the executive branch;</content></subparagraph>
<subparagraph class="fontsize10" id="y323175fa-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is not limited to Federal employees;<page identifier="/us/stat/132/1294">132 STAT. 1294</page></content></subparagraph>
<subparagraph class="fontsize10" id="y323175fb-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>includes all persons, not excluded under subparagraph (D), who require eligibility for access to classified information or eligibility to hold a sensitive position, including, but not limited to, contractors, subcontractors, licensees, certificate holders, grantees, experts, consultants, and government employees; and</content></subparagraph>
<subparagraph class="fontsize10" id="y323175fc-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>does not include—</chapeau><clause class="fontsize10" id="y323175fd-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the President;</content></clause>
<clause class="fontsize10" id="y323175fe-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>employees of the President under section 105 or 107 of <ref href="/us/usc/t3">title 3, United States Code</ref> (except to the extent otherwise directed by the President);</content></clause>
<clause class="fontsize10" id="y323175ff-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/D/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the Vice President; or</content></clause>
<clause class="fontsize10" id="y32317600-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/a/4/D/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>employees of the Vice President under <ref href="/us/usc/t3/s106">section 106 of title 3, United States Code</ref>, or an annual legislative branch appropriations Act (except to the extent otherwise directed by the Vice President).</content></clause>

<subsection class="firstIndent0 fontsize10" id="y32317601-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Review and Updating</inline>.—</heading><paragraph class="fontsize10" id="y32317602-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x32317603-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x32317604-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x32317605-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p><p class="leftAlign firstIndent0 fontsize8" id="x32317606-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Initial review and update of guidance</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Director and the Director of the Office shall review and make recommendations to Congress and the President as appropriate to issue guidance to assist agencies in determining—</chapeau><subparagraph class="fontsize10" id="y32317607-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>position sensitivity designation; and</content></subparagraph>
<subparagraph class="fontsize10" id="y32317608-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the appropriate background investigation to initiate for each position designation.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y32317609-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3231760a-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x3231760b-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="x3231760c-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reviews and revisions of position designations</inline>.—</heading><content>Not less frequently than every 4 years, the President, acting through relevant agencies (as determined by the President) and in accordance with the guidance described in paragraph (1), shall review and, if necessary, revise the position designation of positions within agencies.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3231760d-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3231760e-e838-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reports to Congress</inline>.—</heading><chapeau>Not later than 30 days after completing a review under subsection (b)(2), the President shall submit to the appropriate congressional committees a report on—</chapeau><paragraph class="fontsize10" id="y3231760f-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>any issues identified in the review; and</content></paragraph>
<paragraph class="fontsize10" id="y32317610-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the number of position designations revised as a result of the review.<page identifier="/us/stat/132/1295">132 STAT. 1295</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y32317611-e838-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/173/s7/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">No Change in Authority</inline>.—</heading><content>Nothing in this section limits or expands the authority of any agency to designate a position as sensitive or as requiring its occupant to have access to classified information.</content></subsection>
