<section id="d311244e104" identifier="/us/pl/115/160/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Secret Service Recruitment and Retention Act of 2018</shortTitle>”.</content></section>
<section id="d311244e114" identifier="/us/pl/115/160/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>EXTENSION OF OVERTIME PAY EXCEPTION THROUGH 2018 FOR PROTECTIVE SERVICES.</heading><subsection class="firstIndent0 fontsize10" id="y91bb01d2-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendments</inline>.—</heading><paragraph class="fontsize10" id="y91bb01d3-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Section 2 of the Overtime Pay for Protective Services Act of 2016 (<ref href="/us/usc/t5/s5547">5 U.S.C. 5547 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="y91bb01d4-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the section heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText>in 2016</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>during 2016 through 2018</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y91bb01d5-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>2016</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2016, 2017, or 2018</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y91bb01d6-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in subsection (b), by <amendingAction type="delete">striking</amendingAction> paragraph (1) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="y91bb01d7-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, including <ref href="/us/usc/t5/s5547/a">section 5547(a) of title 5, United States Code</ref>, and only to the extent that an appropriation is provided specifically in an appropriations Act for premium pay in excess of the annual equivalent of the limitation on the rate of pay contained in section 5547(a), any covered employee may receive premium pay during 2016, 2017, and 2018, to the extent provided under section 118 of the Treasury and General Government Appropriations Act, 2001 (<ref href="/us/usc/t5/s5547">5 U.S.C. 5547 note</ref>).”</content></paragraph>

<paragraph class="fontsize10" id="y91bb01d8-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/a/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Clarifying provision</inline>.—</heading><content>Section 118 of the Treasury and General Government Appropriations Act, 2001 (<ref href="/us/usc/t5/s5547">5 U.S.C. 5547 note</ref>) <amendingAction type="amend">is amended</amendingAction>, in the first sentence, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or 3056A</quotedText>” after “<quotedText>section 3056(a)</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y91bb01d9-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x91bb01da-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s5547">5 USC 5547 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by subsection (a) shall take effect as if enacted on December 31, 2016.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y91bb01db-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report on Extensions</inline>.—</heading><chapeau>Not later than January 30, 2018, and January 30, 2019, the Director of the Secret Service shall submit to the Committee on Homeland Security and the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the effects of the amendment made by subsection (a)(2). The report shall include, with respect to the previous calendar year—<page identifier="/us/stat/132/1247">132 STAT. 1247</page></chapeau><paragraph class="fontsize10" id="y91bb01dc-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the total number of United States Secret Service personnel receiving premium pay above the premium pay limitation in subsection (a) of <ref href="/us/usc/t5/s5547">section 5547 of title 5, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="y91bb01dd-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the total amount of premium pay for that calendar year paid to United States Secret Service personnel above the premium pay limitation in such subsection;</content></paragraph>
<paragraph class="fontsize10" id="y91bb01de-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the mean and median amount of premium pay paid to United States Secret Service personnel above the premium pay limitation in such subsection;</content></paragraph>
<paragraph class="fontsize10" id="y91bb01df-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the greatest amount paid to United States Secret Service personnel above the premium pay limitation in such subsection and the number of employees who received that amount;</content></paragraph>
<paragraph class="fontsize10" id="y91bb01e0-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>notwithstanding the amendments made by subsection (a), the total number of United States Secret Service personnel who were not fully compensated for service because of the premium pay earnings limitation in section 118 of the Treasury and General Government Appropriations Act, 2001 (<ref href="/us/usc/t5/s5547">5 U.S.C. 5547 note</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y91bb01e1-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>the total amount of premium pay United States Secret Service personnel would have been paid but for the premium pay earnings limitation in such section; and</content></paragraph>
<paragraph class="fontsize10" id="y91bb01e2-e838-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/160/s2/c/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x91bb01e3-e838-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p></sidenote><content>a list of United States Secret Service personnel who, within the calendar year, received premium pay above the premium pay limitation in subsection (a) of <ref href="/us/usc/t5/s5547">section 5547 of title 5, United States Code</ref>, and separated from the agency, including the type of separation in each case.</content></paragraph>

<section id="d311244e293" identifier="/us/pl/115/160/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REPORT OF THE COMPTROLLER GENERAL OF THE UNITED STATES.</heading><content style="-uslm-lc:I658120">  Not later than 1 year after the effective date of this section, the Comptroller General of the United States shall complete a study and submit to the Committee on the Judiciary of the House of Representatives, the Committee on the Judiciary of the Senate, the Committee on Oversight and Government Reform of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the extent of the progress made by the United States Secret Service in implementing the recommendations of the United States Secret Service Protective Mission Panel, including in particular those items pertaining to training and personnel enumerated in the Executive Summary to Report from the United States Secret Service Protective Mission <page identifier="/us/stat/132/1248">132 STAT. 1248</page>
