<section id="d177569e191" identifier="/us/pl/115/126/tI/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><heading>REQUIRED REPORTING OF CHILD AND SEXUAL ABUSE.</heading><subsection class="firstIndent0 fontsize10" id="ya00a6188-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Reporting Requirement</inline>.—</heading><chapeau>Section 226 of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20341">34 U.S.C. 20341</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya00a6189-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="ya00a618a-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>A person who</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="ya00a618b-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Covered professionals</inline>.—</heading><content>A person who”</content></paragraph>

<subparagraph class="fontsize10" id="ya00a6192-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa00a6193-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definitions.</p></sidenote><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="ya00aafb4-e839-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><content>the term ‘<term>covered individual</term>’ means an adult who is authorized, by a national governing body, a member of a national governing body, or an amateur sports organization that participates in interstate or international amateur athletic competition, to interact with a minor or amateur athlete at an amateur sports organization facility or at any event sanctioned by a national governing body, a member of a national governing body, or such an amateur sports organization;</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="ya00aafb5-e839-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><content>the term ‘<term>event</term>’ includes travel, lodging, practice, competition, and health or medical treatment;</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="ya00aafb6-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><content>the terms ‘amateur athlete’, ‘amateur athletic competition’, ‘amateur sports organization’, ‘international amateur athletic competition’, and ‘national governing body’ have the meanings given the terms in <ref href="/us/usc/t36/s220501/b">section 220501(b) of title 36, United States Code</ref>; and</content></paragraph>
<paragraph class="indentDown1 fontsize10" id="ya00aafb7-e839-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><content>the term ‘<term>as soon as possible</term>’ means within a 24-hour period.”</content></paragraph>

<paragraph class="fontsize10" id="ya00aafb8-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>in subsection (d), in the first sentence, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and for all covered individuals</quotedText>” after “<quotedText>reside</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="ya00aafb9-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>in subsection (f), in the first sentence—</chapeau><subparagraph class="fontsize10" id="ya00aafba-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>and on all</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>on all</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya00aafbb-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and for all covered individuals,</quotedText>” after “<quotedText>lands,</quotedText>”;</content></subparagraph>

<paragraph class="fontsize10" id="ya00aafbc-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>in subsection (h), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and all covered individuals,</quotedText>” after “<quotedText>facilities,</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ya00aafbd-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/a/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><clause class="indentDown1 firstIndent0 fontsize10" id="ya00aafbe-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this section shall be construed to require a victim of child abuse to self-report the abuse.”</content></clause>

<subsection class="firstIndent0 fontsize10" id="ya00aafbf-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s101/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Penalty for Failure To Report</inline>.—</heading><content><ref href="/us/usc/t18/s2258">Section 2258 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or a covered individual as described in subsection (a)(2) of such section 226 who,</quotedText>” after “<quotedText>facility,</quotedText>”.</content></subsection>

<section id="d177569e421" identifier="/us/pl/115/126/tI/s102" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>CIVIL REMEDY FOR PERSONAL INJURIES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa00b24f0-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t18/s2255">Section 2255 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya00b24f1-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s102/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (a) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="ya00b24f2-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Any person who, while a minor, was a victim of a violation of section 1589, 1590, 1591, 2241(c), 2242, 2243, 2251, 2251A, 2252, 2252A, 2260, 2421, 2422, or 2423 of this title and who suffers personal injury as a result of such violation, regardless of whether the injury occurred while such person was a minor, may sue in any appropriate United States District Court and shall recover the actual damages such person sustains or liquidated damages in the amount of $150,000, and the cost of the action, including reasonable attorney’s fees and other litigation costs reasonably incurred. The court may also award punitive damages and such other preliminary and equitable relief as the court determines to be appropriate.”</content></subsection>

<paragraph class="fontsize10" id="ya00b24f3-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s102/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa00b24f4-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><content>in subsection (b), by <amendingAction type="delete">striking</amendingAction> “<quotedText>filed within</quotedText>” and all that follows through the end and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“filed—<paragraph class="indentUp0 fontsize10" id="ya00b4c05-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>not later than 10 years after the date on which the plaintiff reasonably discovers the later of—</chapeau><subparagraph class="fontsize10" id="ya00b4c06-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the violation that forms the basis for the claim; or</content></subparagraph>
<subparagraph class="fontsize10" id="ya00b4c07-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the injury that forms the basis for the claim; or</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="ya00b4c08-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>not later than 10 years after the date on which the victim reaches 18 years of age.”</content></paragraph>
</quotedContent>; and</content></paragraph>
<paragraph class="fontsize10" id="ya00b4c09-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tI/s102/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="ya00b9a2a-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Venue; Service of Process</inline>.—</heading><paragraph class="fontsize10" id="ya00b9a2b-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Venue</inline>.—</heading><content>Any action brought under subsection (a) may be brought in the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28.</content></paragraph>
<paragraph class="fontsize10" id="ya00b9a2c-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Service of process</inline>.—</heading><chapeau>In an action brought under subsection (a), process may be served in any district in which the defendant—</chapeau><subparagraph class="fontsize10" id="ya00b9a2d-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is an inhabitant; or</content></subparagraph>

<paragraph class="fontsize10" id="ya00e595b-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>exercise jurisdiction over the corporation, each national governing body, and each paralympic sports organization with regard to safeguarding amateur athletes against abuse, including emotional, physical, and sexual abuse, in sports;<page identifier="/us/stat/132/321">132 STAT. 321</page></content></paragraph>
<paragraph class="fontsize10" id="ya00e595c-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>maintain an office for education and outreach that shall develop training, oversight practices, policies, and procedures to prevent the abuse, including emotional, physical, and sexual abuse, of amateur athletes participating in amateur athletic activities through national governing bodies and paralympic sports organizations;</content></paragraph>
<paragraph class="fontsize10" id="ya00e595d-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>maintain an office for response and resolution that shall establish mechanisms that allow for the reporting, investigation, and resolution, pursuant to subsection (c), of alleged sexual abuse in violation of the Center’s policies and procedures; and</content></paragraph>
<paragraph class="fontsize10" id="ya00e595e-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>ensure that the mechanisms under paragraph (4) provide fair notice and an opportunity to be heard and protect the privacy and safety of complainants.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya00e595f-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa00e5960-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Policies and Procedures</inline>.—</heading><content>The policies and procedures developed under subsection (a)(3) shall apply as though they were incorporated in and made a part of section 220524 of this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya00e5961-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Binding Arbitration</inline>.—</heading><paragraph class="fontsize10" id="ya00e5962-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Center may, in its discretion, utilize a neutral arbitration body and develop policies and procedures to resolve allegations of sexual abuse within its jurisdiction to determine the opportunity of any amateur athlete, coach, trainer, manager, administrator, or official, who is the subject of such an allegation, to participate in amateur athletic competition.</content></paragraph>
<paragraph class="fontsize10" id="ya00e8073-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Preservation of rights</inline>.—</heading><content>Nothing in this section shall be construed as altering, superseding, or otherwise affecting the right of an individual within the Center’s jurisdiction to pursue civil remedies through the courts for personal injuries arising from abuse in violation of the Center’s policies and procedures, nor shall the Center condition the participation of any such individual in a proceeding described in paragraph (1) upon an agreement not to pursue such civil remedies.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya00e8074-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on Liability</inline>.—</heading><paragraph class="fontsize10" id="ya00e8075-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in paragraph (2), an applicable entity shall not be liable for damages in any civil action for defamation, libel, slander, or damage to reputation arising out of any action or communication, if the action arises from the execution of the responsibilities or functions described in this section, section 220542, or section 220543.</content></paragraph>
<paragraph class="fontsize10" id="ya00e8076-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>Paragraph (1) shall not apply in any action in which an applicable entity acted with actual malice, or provided information or took action not pursuant to this section, section 220542, or section 220543.</content></paragraph>
<paragraph class="fontsize10" id="ya00e8077-e839-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Definition of applicable entity</inline>.—</heading><chapeau>In this subsection, the term ‘<term>applicable entity</term>’ means—</chapeau><subparagraph class="fontsize10" id="ya00e8078-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Center;</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e8079-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a national governing body;</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e807a-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a paralympic sports organization;</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e807b-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>an amateur sports organization or other person sanctioned by a national governing body under section 220525;</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e807c-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>an amateur sports organization reporting under section 220530;</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e807d-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>any officer, employee, agent, or member of an entity described in subparagraph (A), (B), (C), (D), or (E); and<page identifier="/us/stat/132/322">132 STAT. 322</page></content></subparagraph>
<subparagraph class="fontsize10" id="ya00e807e-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>any individual participating in a proceeding pursuant to this section.</content></subparagraph>

<section class="centered fontsize12" id="ya00e807f-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658166"><num class="fontsize12" value="220542">“§ 220542.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa00e8080-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t36/s220542">36 USC 220542</ref>.</p></sidenote> Additional duties.</heading><subsection class="firstIndent0 fontsize10" id="ya00e8081-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Center shall—</chapeau><paragraph class="fontsize10" id="ya00e8082-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>develop training, oversight practices, policies, and procedures for implementation by a national governing body or paralympic sports organization to prevent the abuse, including emotional, physical, and sexual abuse, of any amateur athlete; and</content></paragraph>
<paragraph class="fontsize10" id="ya00e8083-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>include in the policies and procedures developed under section 220541(a)(3)—</chapeau><subparagraph class="fontsize10" id="ya00e8084-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>a requirement that all adult members of a national governing body, a paralympic sports organization, or a facility under the jurisdiction of a national governing body or paralympic sports organization, and all adults authorized by such members to interact with an amateur athlete, report immediately any allegation of child abuse of an amateur athlete who is a minor to—</chapeau><clause class="fontsize10" id="ya00e8085-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the Center, whenever such members or adults learn of facts leading them to suspect reasonably that an amateur athlete who is a minor has suffered an incident of child abuse; and</content></clause>
<clause class="fontsize10" id="ya00e8086-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>law enforcement consistent with section 226 of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20341">34 U.S.C. 20341</ref>);</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya00e8087-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a mechanism, approved by a trained expert on child abuse, that allows a complainant to report easily an incident of child abuse to the Center, a national governing body, law enforcement authorities, or other appropriate authorities;</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e8088-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>reasonable procedures to limit one-on-one interactions between an amateur athlete who is a minor and an adult (who is not the minor’s legal guardian) at a facility under the jurisdiction of a national governing body or paralympic sports organization without being in an observable and interruptible distance from another adult, except under emergency circumstances;</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e8089-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>procedures to prohibit retaliation, by any national governing body or paralympic sports organization, against any individual who makes a report under subparagraph (A) or subparagraph (B);</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e808a-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>oversight procedures, including regular and random audits conducted by subject matter experts unaffiliated with, and independent of, a national governing body or a paralympic sports organization of each national governing body and paralympic sports organization to ensure that policies and procedures developed under that section are followed correctly and that consistent training is offered and given to all adult members who are in regular contact with amateur athletes who are minors, and subject to parental consent, to members who are minors, regarding prevention of child abuse; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya00e808b-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><chapeau>a mechanism by which a national governing body or paralympic sports organization can—</chapeau><clause class="fontsize10" id="ya00e808c-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>share confidentially a report of suspected child abuse of an amateur athlete who is a minor by a <page identifier="/us/stat/132/323">132 STAT. 323</page>
member of a national governing body or paralympic sports organization, or an adult authorized by a national governing body, paralympic sports organization, or an amateur sports organization to interact with an amateur athlete who is a minor, with the Center, which in turn, may share with relevant national governing bodies, paralympic sports organizations, and other entities; and</content></clause>
<clause class="fontsize10" id="ya00e808d-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>withhold providing to an adult who is the subject of an allegation of child abuse authority to interact with an amateur athlete who is a minor until the resolution of such allegation.</content></clause>
</subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya00e808e-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this section shall be construed to limit the ability of a national governing body or paralympic sports organization to impose an interim measure to prevent an individual who is the subject of an allegation of sexual abuse from interacting with an amateur athlete prior to the Center exercising its jurisdiction over a matter.</content></subsection>

<section class="centered fontsize12" id="ya00e808f-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658166"><num class="fontsize12" value="220543">“§ 220543.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa00e8090-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t36/s220543">36 USC 220543</ref>.</p></sidenote> Records, audits, and reports</heading><subsection class="firstIndent0 fontsize10" id="ya00e8091-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Records</inline>.—</heading><content>The Center shall keep correct and complete records of account.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya00e8092-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>The Center shall submit an annual report to Congress, including—</chapeau><paragraph class="fontsize10" id="ya00e8093-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>an audit conducted and submitted in accordance with section 10101; and</content></paragraph>
<paragraph class="fontsize10" id="ya00e8094-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>a description of the activities of the Center.”</content></paragraph>

<section id="d177569e1095" identifier="/us/pl/115/126/tII/s204" style="-uslm-lc:I658143"><num class="fontsize12" value="204">SEC. 204. </num><heading>GENERAL REQUIREMENTS FOR YOUTH-SERVING AMATEUR SPORTS ORGANIZATIONS.</heading><subsection class="firstIndent0 fontsize10" id="ya00f42f2-e839-11f0-a1e4-69761a48a15a" identifier="/us/pl/115/126/tII/s204/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t36/ch2205/schII">Subchapter II of chapter 2205 of title 36, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="ya00f9113-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658166"><num class="fontsize12" value="220530">“§ 220530.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa00f9114-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t36/s220530">36 USC 220530</ref>.</p></sidenote> Other amateur sports organizations</heading><subsection class="firstIndent0 fontsize10" id="ya00f9115-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>An applicable amateur sports organization shall—</chapeau><paragraph class="fontsize10" id="ya00f9116-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>comply with the reporting requirements of section 226 of the Victims of Child Abuse Act of 1990 (<ref href="/us/usc/t34/s20341">34 U.S.C. 20341</ref>);</content></paragraph>
<paragraph class="fontsize10" id="ya00f9117-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>establish reasonable procedures to limit one-on-one interactions between an amateur athlete who is a minor and an adult (who is not the minor’s legal guardian) at a facility under the jurisdiction of the applicable amateur sports organization without being in an observable and interruptible distance from another adult, except under emergency circumstances;</content></paragraph>
<paragraph class="fontsize10" id="ya00f9118-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>offer and provide consistent training to all adult members who are in regular contact with amateur athletes who are minors, and subject to parental consent, to members who are minors, regarding prevention and reporting of child abuse to allow a complainant to report easily an incident of child abuse to appropriate persons; and</content></paragraph>
<paragraph class="fontsize10" id="ya00f9119-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>prohibit retaliation, by the applicable amateur sports organization, against any individual who makes a report under paragraph (1).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ya00f911a-e839-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Definition of Applicable Amateur Sports Organization</inline>.—</heading><chapeau>In this section, the term ‘<term>applicable amateur sports organization</term>’ means an amateur sports organization—</chapeau><paragraph class="fontsize10" id="ya00f911b-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>that is not otherwise subject to the requirements under subchapter III;</content></paragraph>
<paragraph class="fontsize10" id="ya00f911c-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>that participates in an interstate or international amateur athletic competition; and</content></paragraph>
<paragraph class="fontsize10" id="ya00f911d-e839-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>whose membership includes any adult who is in regular contact with an amateur athlete who is a minor.”</content></paragraph>
