<section id="d313461e94" identifier="/us/pl/115/119/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Recognize, Assist, Include, Support, and Engage Family Caregivers Act of 2017</shortTitle>” or the “<shortTitle role="act">RAISE Family Caregivers Act</shortTitle>”.</content></section>
<section id="d313461e107" identifier="/us/pl/115/119/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xdb4fb8be-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="ydb4fb8bf-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Advisory council</inline>.—</heading><content>The term “<term>Advisory Council</term>” means the Family Caregiving Advisory Council convened under section 4.</content></paragraph>
<paragraph class="fontsize10" id="ydb4fb8c0-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Family caregiver</inline>.—</heading><content>The term “<term>family caregiver</term>” means an adult family member or other individual who has a significant relationship with, and who provides a broad range of assistance to, an individual with a chronic or other health condition, disability, or functional limitation.</content></paragraph>
<paragraph class="fontsize10" id="ydb4fb8c1-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Health and Human Services.</content></paragraph>
<paragraph class="fontsize10" id="ydb4fb8c2-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Strategy</inline>.—</heading><content>The term “<term>Strategy</term>” means the Family Caregiving Strategy set forth under section 3.</content></paragraph>
</section>
<section id="d313461e150" identifier="/us/pl/115/119/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>FAMILY CAREGIVING STRATEGY.</heading><subsection class="firstIndent0 fontsize10" id="ydb50a323-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb50a324-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="xdb50a325-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xdb50a326-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary, in consultation with the heads of other appropriate Federal agencies, shall develop jointly with the Advisory Council and submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, and make publicly available on the internet website of the Department of Health and Human Services, a Family Caregiving Strategy.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb50a327-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The Strategy shall identify recommended actions that Federal (under existing Federal programs), State, and local governments, communities, health care providers, long-term services and supports providers, and others are taking, or may take, to recognize and support family caregivers in a manner that reflects their diverse needs, including with respect to the following:</chapeau><paragraph class="fontsize10" id="ydb50a328-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Promoting greater adoption of person- and family-centered care in all health and long-term services and supports settings, with the person receiving services and supports and <page identifier="/us/stat/132/24">132 STAT. 24</page>
the family caregiver (as appropriate) at the center of care teams.</content></paragraph>
<paragraph class="fontsize10" id="ydb50a329-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Assessment and service planning (including care transitions and coordination) involving family caregivers and care recipients.</content></paragraph>
<paragraph class="fontsize10" id="ydb50a32a-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Information, education and training supports, referral, and care coordination, including with respect to hospice care, palliative care, and advance planning services.</content></paragraph>
<paragraph class="fontsize10" id="ydb50a32b-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Respite options.</content></paragraph>
<paragraph class="fontsize10" id="ydb50a32c-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Financial security and workplace issues.</content></paragraph>
<paragraph class="fontsize10" id="ydb50a32d-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Delivering services based on the performance, mission, and purpose of a program while eliminating redundancies.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb50a32e-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Duties of the Secretary</inline>.—</heading><chapeau>The Secretary, in carrying out subsection (a), shall oversee the following:</chapeau><paragraph class="fontsize10" id="ydb50a32f-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Collecting and making publicly available information submitted by the Advisory Council under section 4(d) to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, including evidence-based or promising practices and innovative models (both domestic and foreign) regarding the provision of care by family caregivers or support for family caregivers.</content></paragraph>
<paragraph class="fontsize10" id="ydb50a330-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Coordinating and assessing existing Federal Government programs and activities to recognize and support family caregivers while ensuring maximum effectiveness and avoiding unnecessary duplication.</content></paragraph>
<paragraph class="fontsize10" id="ydb50a331-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Providing technical assistance, as appropriate, such as disseminating identified best practices and information sharing based on reports provided under section 4(d), to State or local efforts to support family caregivers.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb50a332-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb50a333-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Publications.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Initial Strategy; Updates</inline>.—</heading><chapeau>The Secretary shall—</chapeau><paragraph class="fontsize10" id="ydb50a334-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb50a335-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>not later than 18 months after the date of enactment of this Act, develop, publish, and submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, an initial Strategy incorporating the items addressed in the Advisory Council’s initial report under section 4(d) and other relevant information, including best practices, for recognizing and supporting family caregivers; and</content></paragraph>
<paragraph class="fontsize10" id="ydb50a336-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>biennially update, republish, and submit to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs the Strategy, taking into account the most recent annual report submitted under section 4(d)(1)—</chapeau><subparagraph class="fontsize10" id="ydb50a337-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to reflect new developments, challenges, opportunities, and solutions; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydb50a338-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to review progress based on recommendations for recognizing and supporting family caregivers in the Strategy and, based on the results of such review, recommend priority actions for improving the implementation of such recommendations, as appropriate.<page identifier="/us/stat/132/25">132 STAT. 25</page></content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb50a339-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb50a33a-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xdb50a33b-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Process for Public Input</inline>.—</heading><content>The Secretary shall establish a process for public input to inform the development of, and updates to, the Strategy, including a process for the public to submit recommendations to the Advisory Council and an opportunity for public comment on the proposed Strategy.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb50a33c-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">No Preemption</inline>.—</heading><content>Nothing in this Act preempts any authority of a State or local government to recognize or support family caregivers.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb50a33d-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><chapeau>Nothing in this Act shall be construed to permit the Secretary (through regulation, guidance, grant criteria, or otherwise) to—</chapeau><paragraph class="fontsize10" id="ydb50a33e-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>mandate, direct, or control the allocation of State or local resources;</content></paragraph>
<paragraph class="fontsize10" id="ydb50a33f-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>mandate the use of any of the best practices identified in the reports required under this Act; or</content></paragraph>
<paragraph class="fontsize10" id="ydb50a340-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s3/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>otherwise expand the authority of the Secretary beyond that expressly provided to the Secretary in this Act.</content></paragraph>

<section id="d313461e326" identifier="/us/pl/115/119/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>FAMILY CAREGIVING ADVISORY COUNCIL.</heading><subsection class="firstIndent0 fontsize10" id="ydb51dac1-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb51dac2-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xdb51dac3-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Convening</inline>.—</heading><content>The Secretary shall convene a Family Caregiving Advisory Council to advise and provide recommendations, including identified best practices, to the Secretary on recognizing and supporting family caregivers.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb51dac4-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><paragraph class="fontsize10" id="ydb51dac5-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The members of the Advisory Council shall consist of—</chapeau><subparagraph class="fontsize10" id="ydb51dac6-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the appointed members under paragraph (2); and</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dac7-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Federal members under paragraph (3).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydb51dac8-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Appointed members</inline>.—</heading><chapeau>In addition to the Federal members under paragraph (3), the Secretary shall appoint not more than 15 voting members of the Advisory Council who are not representatives of Federal departments or agencies and who shall include at least 1 representative of each of the following:</chapeau><subparagraph class="fontsize10" id="ydb51dac9-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Family caregivers.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51daca-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Older adults with long-term services and supports needs.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dacb-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Individuals with disabilities.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dacc-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Health care and social service providers.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dacd-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>Long-term services and supports providers.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dace-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>Employers.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dacf-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>Paraprofessional workers.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dad0-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>State and local officials.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dad1-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>Accreditation bodies.</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dad2-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/2/J" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">(J) </num><content>Veterans.</content></subparagraph>

<paragraph class="fontsize10" id="ydb51dad4-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Federal members</inline>.—</heading><chapeau>The Federal members of the Advisory Council, who shall be nonvoting members, shall consist of the following:</chapeau><subparagraph class="fontsize10" id="ydb51dad5-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The Administrator of the Centers for Medicare &amp; Medicaid Services (or the Administrator’s designee).</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dad6-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The Administrator of the Administration for Community Living (or the Administrator’s designee who has experience in both aging and disability).</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dad7-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>The Secretary of Veterans Affairs (or the Secretary’s designee).<page identifier="/us/stat/132/26">132 STAT. 26</page></content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dad8-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The heads of other Federal departments or agencies (or their designees), including relevant departments or agencies that oversee labor and workforce, economic, government financial policies, community service, and other impacted populations, as appointed by the Secretary or the Chair of the Advisory Council.</content></subparagraph>

<paragraph class="fontsize10" id="ydb51dad9-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Diverse representation</inline>.—</heading><content>The Secretary shall ensure that the membership of the Advisory Council reflects the diversity of family caregivers and individuals receiving services and supports.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb51dada-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb51dadb-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xdb51dadc-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><content>The Advisory Council shall meet quarterly during the 1-year period beginning on the date of enactment of this Act and at least three times during each year thereafter. Meetings of the Advisory Council shall be open to the public.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ydb51dadd-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Advisory Council Annual Reports</inline>.—</heading><paragraph class="fontsize10" id="ydb51dade-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb51dadf-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xdb51dae0-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 12 months after the date of enactment of this Act, and annually thereafter, the Advisory Council shall submit to the Secretary, the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, the Committee on Education and the Workforce of the House of Representatives, and the State agencies responsible for carrying out family caregiver programs, and make publicly available on the internet website of the Department of Health and Human Services, a report concerning the development, maintenance, and updating of the Strategy, including a description of the outcomes of the recommendations and any priorities included in the initial report pursuant to paragraph (2), as appropriate.</content></paragraph>
<paragraph class="fontsize10" id="ydb51dae1-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Initial report</inline>.—</heading><chapeau>The Advisory Council’s initial report under paragraph (1) shall include—</chapeau><subparagraph class="fontsize10" id="ydb51dae2-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb51dae3-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Records.</p><p class="leftAlign firstIndent0 fontsize8" id="xdb51dae4-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>an inventory and assessment of all federally funded efforts to recognize and support family caregivers and the outcomes of such efforts, including analyses of the extent to which federally funded efforts are reaching family caregivers and gaps in such efforts;</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51dae5-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb51dae6-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xdb51dae7-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><chapeau>recommendations—</chapeau><clause class="fontsize10" id="ydb51dae8-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>to improve and better coordinate Federal programs and activities to recognize and support family caregivers, as well as opportunities to improve the coordination of such Federal programs and activities with State programs; and</content></clause>
<clause class="fontsize10" id="ydb51dae9-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>to effectively deliver services based on the performance, mission, and purpose of a program while eliminating redundancies, avoiding unnecessary duplication and overlap, and ensuring the needs of family caregivers are met;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydb51daea-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the identification of challenges faced by family caregivers, including financial, health, and other challenges, and existing approaches to address such challenges; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydb51daeb-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/d/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdb51daec-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>an evaluation of how family caregiving impacts the Medicare program, the Medicaid program, and other Federal programs.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydb51daed-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/119/s4/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplicability of FACA</inline>.—</heading><content>The Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) shall not apply to the Advisory Council.<page identifier="/us/stat/132/27">132 STAT. 27</page></content></subsection>
</section>
<section id="d313461e582" identifier="/us/pl/115/119/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>FUNDING.</heading><content style="-uslm-lc:I658120">  No additional funds are authorized to be appropriated to carry out this Act. This Act shall be carried out using funds otherwise authorized.</content></section>
<section id="d313461e589" identifier="/us/pl/115/119/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>SUNSET PROVISION.</heading><content style="-uslm-lc:I658120">  The authority and obligations established by this Act shall terminate on the date that is 3 years after the date of enactment of this Act.</content></section>
