<section id="d313742e92" identifier="/us/pl/115/115/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">EPS Improvement Act of 2017</shortTitle>”.</content></section>
<section id="d313742e102" identifier="/us/pl/115/115/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>APPLICATION OF ENERGY CONSERVATION STANDARDS TO CERTAIN EXTERNAL POWER SUPPLIES.</heading><subsection class="firstIndent0 fontsize10" id="yffbc3678-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition of External Power Supply</inline>.—</heading><chapeau>Section 321(36)(A) of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6291/36/A">42 U.S.C. 6291(36)(A)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yffbc3679-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> the subparagraph designation and all that follows through “<quotedText>The term</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="fontsize10" id="yffbc367a-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">External power supply</inline>.—</heading><clause class="fontsize10" id="yffbc367b-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term”</content></clause>

<paragraph class="fontsize10" id="yffbc367c-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><clause class="indentUp2 fontsize10" id="yffbc367d-e839-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Exclusion</inline>.—</heading><chapeau>The term ‘<term>external power supply</term>’ does not include a power supply circuit, driver, or device that is designed exclusively to be connected to, and power—</chapeau><subclause class="fontsize10" id="yffbc367e-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>light-emitting diodes providing illumination;</content></subclause>
<subclause class="fontsize10" id="yffbc367f-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>organic light-emitting diodes providing illumination; or</content></subclause>
<subclause class="fontsize10" id="yffbc3680-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>ceiling fans using direct current motors.”</content></subclause>

<subsection class="firstIndent0 fontsize10" id="yffbc3681-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Standards for Lighting Power Supply Circuits</inline>.—</heading><paragraph class="fontsize10" id="yffbc3682-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>Section 340(2)(B) of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6311/2/B">42 U.S.C. 6311(2)(B)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> clause (v) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentUp2 fontsize10" id="yffbc5d93-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>electric lights and lighting power supply circuits;”</content></subsection>

<paragraph class="fontsize10" id="yffbc5d94-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/b/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Energy conservation standard for certain equipment</inline>.—</heading><content>Section 342 of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6313">42 U.S.C. 6313</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yffbc5d95-e839-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Lighting Power Supply Circuits</inline>.—</heading><content>If the Secretary, acting pursuant to section 341(b), includes as covered equipment solid state lighting power supply circuits, drivers, or devices described in section 321(36)(A)(ii), the Secretary may prescribe under this part, not earlier than 1 year after the date on which <page identifier="/us/stat/131/2281">131 STAT. 2281</page>
a test procedure has been prescribed, an energy conservation standard for such equipment.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="yffbc5d96-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Technical Corrections</inline>.—</heading><paragraph class="fontsize10" id="yffbc5d97-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/c/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Section 321(6)(B) of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6291/6/B">42 U.S.C. 6291(6)(B)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>(19)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(20)</quotedText>”.</content></paragraph>
<paragraph class="fontsize10" id="yffbc5d98-e839-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/115/s2/c/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Section 324 of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6294">42 U.S.C. 6294</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>(19)</quotedText>” each place it appears in each of subsections (a)(3), (b)(1)(B), (b)(3), and (b)(5) and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(20)</quotedText>”.</content></paragraph>
