<section id="d314392e92" identifier="/us/pl/115/105/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Jobs for Our Heroes Act</shortTitle>”.</content></section>
<section id="d314392e102" identifier="/us/pl/115/105/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>MEDICAL CERTIFICATE FOR VETERANS OPERATING COMMERCIAL MOTOR VEHICLES.</heading><subsection class="firstIndent0 fontsize10" id="y46de34a6-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Qualified Examiners</inline>.—</heading><content>Section 5403(d)(2) of the FAST Act (<ref href="/us/usc/t49/s31149">49 U.S.C. 31149 note</ref>; <ref href="/us/stat/129/1548">129 Stat. 1548</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><paragraph class="fontsize10" id="y46de5bb7-e83a-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x46de5bb8-e83a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definition.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Qualified examiner</inline>.—</heading><chapeau>The term ‘<term>qualified examiner</term>’ means an individual who—</chapeau><subparagraph class="fontsize10" id="y46de5bb9-e83a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is employed by the Department of Veterans Affairs as an advanced practice nurse, doctor of chiropractic, doctor of medicine, doctor of osteopathy, physician assistant, or other medical professional;</content></subparagraph>
<subparagraph class="fontsize10" id="y46de5bba-e83a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is licensed, certified, or registered in a State to perform physical examinations;</content></subparagraph>
<subparagraph class="fontsize10" id="y46de5bbb-e83a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>is familiar with the standards for, and physical requirements of, an operator required to be medically certified under <ref href="/us/usc/t49/s31149">section 31149 of title 49, United States Code</ref>; and</content></subparagraph>
<subparagraph class="fontsize10" id="y46de5bbc-e83a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>has never, with respect to such section, been found to have acted fraudulently, including by fraudulently awarding a medical certificate.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y46de5bbd-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendments</inline>.—</heading><chapeau>Section 5403 of the FAST Act (<ref href="/us/usc/t49/s31149">49 U.S.C. 31149 note</ref>; <ref href="/us/stat/129/1548">129 Stat. 1548</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y46de5bbe-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>physician-approved veteran operator, the qualified physician</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>veteran operator approved by a qualified examiner, the qualified examiner</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y46de5bbf-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)(1)—</chapeau><subparagraph class="fontsize10" id="y46de5bc0-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>the physician</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>the examiner</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y46de5bc1-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>qualified physician</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>qualified examiner</quotedText>”;</content></subparagraph>

<paragraph class="fontsize10" id="y46de5bc5-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>in subsection (d)—</chapeau><subparagraph class="fontsize10" id="y46de5bc6-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/b/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (1), (2), and (3) as paragraphs (3), (1), and (2), respectively, and by moving the text of paragraph (3), as redesignated, to appear after paragraph (2), as redesignated; and</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y46de5bca-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x46de5bcb-e83a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s31149">49 USC 31149 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rulemaking</inline>.—</heading><content>The amendments made by this section shall be incorporated into any rulemaking proceeding related to section 5403 of the FAST Act (<ref href="/us/usc/t49/s31149">49 U.S.C. 31149 note</ref>; <ref href="/us/stat/129/1548">129 Stat. 1548</ref>) that is being conducted as of the date of the enactment of this Act.</content></subsection>

<section id="d314392e325" identifier="/us/pl/115/105/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>COMMERCIAL DRIVER’S LICENSE STANDARDS FOR CURRENT AND FORMER MEMBERS OF THE ARMED FORCES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x46de82dc-e83a-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <ref href="/us/usc/t49/s31305/d">Section 31305(d) of title 49, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y46de82dd-e83a-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/105/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the subsection heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">Veteran Operators</headingText></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Operators Who Are Members of the Armed Forces, Reservists, or Veterans</headingText></quotedText>”;</content></paragraph>
