<section id="d314546e85" identifier="/us/pl/115/101/s1" role="instruction" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>VEHICULAR ACCESS AND FEES.</heading><content class="firstIndent0 fontsize10" id="xb45506a8-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 4 of the Delaware Water Gap National Recreation Area Improvement Act (<ref href="/us/pl/109/156">Public Law 109–156</ref>)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb45506a9-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/stat/119/2948">119 Stat. 2948</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="yb45554ca-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658141"><num class="fontsize12" value="4">“SEC. 4. </num><heading class="fontsize12">USE OF CERTAIN ROADS WITHIN THE RECREATION AREA.</heading><subsection class="firstIndent0 fontsize10" id="yb45554cb-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Except as otherwise provided in this section, Highway 209, a federally owned road within the boundaries of the Recreation Area, shall be closed to all commercial vehicles.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb45554cc-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Exception for Local Business Use</inline>.—</heading><chapeau>Until September 30, 2021, subsection (a) shall not apply with respect to the use of commercial vehicles that have four or fewer axles and are—</chapeau><paragraph class="fontsize10" id="yb45554cd-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>owned and operated by a business physically located in—</chapeau><subparagraph class="fontsize10" id="yb45554ce-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Recreation Area; or</content></subparagraph>
<subparagraph class="fontsize10" id="yb45554cf-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>one or more adjacent municipalities; or</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb45554d0-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>necessary to provide services to businesses or persons located in—</chapeau><subparagraph class="fontsize10" id="yb45554d1-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Recreation Area; or</content></subparagraph>
<subparagraph class="fontsize10" id="yb45554d2-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>one of more adjacent municipalities.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yb45554d3-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Fee</inline>.—</heading><content>The Secretary shall establish a fee and permit program for the use by commercial vehicles of Highway 209 under subsection (b). The program shall include an annual fee not to exceed $200 per vehicle. All fees received under the program shall be set aside in a special account and be available, without further appropriation, to the Secretary for the administration and enforcement of the program, including registering vehicles, issuing permits and vehicle identification stickers, and personnel costs.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb45554d4-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><chapeau>The following vehicles may use Highway 209 and shall not be subject to a fee or permit requirement under subsection (c):</chapeau><paragraph class="fontsize10" id="yb45554d5-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>Local school buses.</content></paragraph>
<paragraph class="fontsize10" id="yb45554d6-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>Fire, ambulance, and other safety and emergency vehicles.</content></paragraph>
<paragraph class="fontsize10" id="yb45554d7-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>Commercial vehicles using Federal Road Route 209, from—</chapeau><subparagraph class="fontsize10" id="yb45554d8-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Milford to the Delaware River Bridge leading to U.S. Route 206 in New Jersey; and<page identifier="/us/stat/131/2247">131 STAT. 2247</page></content></subparagraph>
<subparagraph class="fontsize10" id="yb4557be9-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>mile 0 of Federal Road Route 209 to Pennsylvania State Route 2001.”</content></subparagraph>

<section id="d314546e207" identifier="/us/pl/115/101/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb4557bea-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 2 of the Delaware Water Gap National Recreation Area Improvement Act (<ref href="/us/pl/109/156">Public Law 109–156</ref>)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb4557beb-e83f-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/stat/119/2946">119 Stat. 2946</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yb4557bec-e83f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/101/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (1) through (5) as paragraphs (2) through (6), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="yb4557bed-e83f-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/115/101/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> before paragraph (2) (as so redesignated by paragraph (1) of this section) the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yb4557bee-e83f-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Adjacent municipalities</inline>.—</heading><content>The term ‘<term>adjacent municipalities</term>’ means Delaware Township, Dingman Township, Lehman Township, Matamoras Borough, Middle Smithfield Township, Milford Borough, Milford Township, Smithfield Township and Westfall Township, in Pennsylvania.”</content></paragraph>
